REPORT OUT OF ACTION TAKEN IN CLOSED SESSION. CITY ATTORNEY, PLEASE. THANK YOU MAYOR. IN A CLOSED SESSION THIS AFTERNOON, THE CITY COUNCIL CONSIDERED WHETHER TO INITIATE LITIGATION AGAINST OR ACCEPT A SETTLEMENT FROM SURETEC INSURANCE COMPANY FOR $42,562.33. THE CITY COUNCIL VOTED UNANIMOUSLY TO ACCEPT THE SETTLEMENT. THE SETTLEMENT, TOGETHER WITH DEVELOPER CASH DEPOSITS FORFEITED TO THE CITY, FULLY REIMBURSES THE CITY FOR THE DIRECT COST OF CONSTRUCTING PUBLIC IMPROVEMENTS IN THE HIGHLAND VIEW HOMES DEVELOPMENT. AFTER THE DEVELOPER, CARLSBAD COASTAL VIEWS LLC, DEFAULTED ON ITS OBLIGATIONS TO CONSTRUCT THE PUBLIC IMPROVEMENTS, THERE WERE NO OTHER REPORTABLE ACTIONS. THANK YOU. NEXT IS PUBLIC COMMENT. [PUBLIC COMMENT] I HAVE TO READ THE FOLLOWING. THE BROWN ACT AND THE CITY MEETING RULES ALLOW MEMBERS OF THE PUBLIC TO COMMENT ON ITEMS, NOT ON THE AGENDA, AS LONG AS THE COMMENTS ARE REGARDING MATTERS WITHIN THE CITY COUNCIL'S SUBJECT MATTER JURISDICTION. MEMBERS OF THE PUBLIC MAY ALSO COMMENT ON AGENDA ITEMS, AS LONG AS THE COMMENTS RELATE TO THE QUESTION OR MATTER UNDER CONSIDERATION. INFORMATION ON HOW TO PARTICIPATE IN THE MEETING IS ALSO ON THE FRONT PAGE OF THIS AGENDA. THE CITY COUNCIL RECEIVED NON-AGENDA PUBLIC COMMENTS FOR A TOTAL OF 15 MINUTES AT THE BEGINNING OF THE MEETING, CITY COUNCIL WILL RECEIVE ANY ADDITIONAL NON-AGENDA PUBLIC COMMENTS AT THE END OF THE MEETING. IN CONFORMANCE WITH THE BROWN ACT NO ACTION MAY OCCUR ON ANY NON-AGENDA ITEMS. WHEN MAKING YOUR COMMENTS, PLEASE TREAT OTHERS WITH COURTESY, CIVILITY AND RESPECT. [00:10:02] WE WELCOME CLAPPING DURING THE CEREMONIAL PRESENTATIONS AT THE BEGINNING OF THE CITY COUNCIL MEETING. HOWEVER, WE ASK THAT YOU REFRAIN FROM CLAPPING DURING THE BUSINESS SECTION OF THE MEETING, STARTING WITH THE NON-AGENDA PUBLIC COMMENT. THIS WILL MAKE SURE THAT THE PEOPLE'S BUSINESS CAN BE CONDUCTED EFFICIENTLY AND THAT THE CHAMBER IS A PLACE WHERE ALL POINTS OF VIEW ARE WELCOMED AND RESPECTED. THE CLERK WILL CALL YOUR NAME. PLEASE COME UP TO THE PODIUM. YOU'LL HAVE THREE MINUTES AT THE 2.5 MINUTE MARK. THE PODIUM WILL TURN YELLOW, TELLING YOU THAT YOU ONLY HAVE 30S LEFT. I'VE ASKED THE CLERK TO TURN OFF THE MICROPHONE AT THE CONCLUSION OF THE THREE MINUTES. THAT WAY, EVERY SPEAKER GETS EXACTLY THE SAME AMOUNT OF TIME. PLEASE CALL THE FIRST SPEAKER. LINDA DANIELS, FOLLOWED BY THOMAS KRAUSS. CAN I GET MY SCREEN UP HERE? WHAT HAPPENED? OKAY. HI. MAYOR KEITH BLACKBURN AND CITY COUNCIL MEMBERS. MY NAME IS LINDA DANIELS. I'VE BEEN UP HERE MANY TIMES OVER THE LAST FEW YEARS. I'M A RESIDENT OF CARLSBAD FOR 11.5 YEARS, AND I MOVED HERE IN 2013, AND WHEN I DID, I JOINED THE SIERRA CLUB AND I WANTED TO BRING COMMUNITY CHOICE ENERGY TO CARLSBAD AND DEL MAR AND SOLANA BEACH. WE NOW HAVE OCEANSIDE, VISTA AND SAN MARCOS AND ESCONDIDO. SO WE HAD SUCCESS. WE'RE SAVING MONEY AND HAVE A HEALTHIER ENVIRONMENT BECAUSE WE USE CLEANER ENERGY. SDG [INAUDIBLE] CAN PROVIDE THIS CLEANER ENERGY. THE CEA CAN. OKAY, WE HAVE THAT. IT TOOK SIX YEARS, BUT WE DID IT. CARLSBAD ALSO PASSED A WONDERFUL CLIMATE EMERGENCY DECLARATION. IT IS NOW TIME TO UPDATE OUR CAP. IT'S TIME FOR CARLSBAD TO BE A LEADER IN SUSTAINABILITY AGAIN, LIKE IN 2019 WHEN WE REQUIRED ALL NEW CONSTRUCTION TO HAVE HEAT PUMP WATER HEATERS MORE EFFICIENT AND WITH REBATES, IT COST ME NOTHING TO ELECTRIFY MY HOME. AND IT'S NOW REQUIRED BY THE STATE ON ALL NEW CONSTRUCTION. SO WE LED THE FIELD. THEN I ATTENDED TWO PLANNING COMMISSION MEETINGS LAST THIS MONTH. I WAS AMAZED HOW BLIND THEY ARE TO THE ENVIRONMENTAL NEEDS THAT WE HAVE HERE IN CARLSBAD. THERE WERE FOUR PEOPLE THAT GOT UP AND TALKED AGAINST THE CAP AFTER NINE OF US HAD ALREADY GOTTEN UP AND TALKED ABOUT THE CAP, OKAY, AND EXPLAINED THAT IN ORDER TO BE APPROVED, ANY ORDINANCE BY THE CDC, IT HAS TO BE COST EFFECTIVE. AND THEY KEPT TALKING ABOUT COST STUDIES AND HOW MUCH IT WOULD ON AND ON AND ON. AND THEY WERE BELIEVED BY THE COMMISSIONERS, WHICH ABSOLUTELY UPSET ME. SO WHAT I DID IS I SENT TO ALL OF YOU AN EMAIL THAT GAVE YOU A WEBSITE THAT TELLS YOU THAT AFFORDABLE HOMES ARE MORE AFFORDABLE WHEN THEY'RE ALL ELECTRIC. IN FACT, THERE'S 248 NEW ELECTRIC HOMES AT MARJA ACRES. AND I SPOKE WITH KB HOMES AND THEY SAY BETWEEN 5 AND $10,000 PER HOME, DEPENDING UPON THE PLAN. OKAY, THEY'RE ALL ELECTRIC. AND OF COURSE THEY HAVE SOLAR BECAUSE THAT'S MANDATED BY THE STATE TOO. AND THEY SAVED $1 MILLION. AND THE SAME THING HAPPENED OVER HERE AT LAGUNA ROAD THAT IS ALL ELECTRIC. THEY ONLY HAVE 13 UNITS, BUT THEY SAVED LIKE 100 TO $200,000 BY DOING THAT. SO WHEN I LEFT THE MEETING, I WANT YOU TO KNOW, I WENT UP TO THOSE FOUR PEOPLE AND I SAID, GOOGLE IT. JUST GOOGLE IT. IS ELECTRIC LESS EXPENSIVE THAN MIXED FUEL HOMES. I JUST COULDN'T BELIEVE IT. ANYWAY. THERE IS NO COST PROBLEM. ALL RIGHT, SOUTHERN CALIFORNIA EDISON, A UTILITY. EVEN STATES ALL ELECTRIC HOMES ARE CLEAN, AFFORDABLE AND GOOD FOR THE EARTH. SO NOT ONLY ARE ALL ELECTRIC HOMES MORE EFFICIENT. IF YOU WANT TO TURN THOSE INTO THE CLERK, YOU COULD DO THAT OVER HERE. LINDA, IF YOU WANT TO GIVE THAT TO THE CLERK, YOU MAY. PETITION THAT TO. PEOPLE SAY THEY WANT CARLSBAD RESIDENTS ONLY. HI, IT'S THOMAS KRAUS AGAIN. FULL DISCLOSURE, I AM A CANDIDATE FOR CITY TREASURER, BUT I'M HERE TO TALK ABOUT TRANSPARENCY ISSUES WITH RESPECT TO BOTH FINANCIAL AND INFORMATION REPORTING HERE IN THE CITY. AND JUST AS AN EXAMPLE, WHILE I'LL FOCUS MOST OF MY TIME ON THE TREASURER'S REPORTS, EVEN TODAY'S AGENDA PACKET WAS 101 PAGES. AND THE SECTION THAT I'M INTERESTED IN TALKING ABOUT LATER IS WAY BURIED DOWN IN THERE. AND IT'S 26 PAGES ABOUT WINDSOR POINTE. [00:15:01] I'D PERHAPS ASK YOU GUYS TO INCLUDE A TABLE OF CONTENTS OR SOMETHING. IF YOU DON'T WANT TO INCLUDE SEPARATORS BETWEEN EACH OF THE SECTIONS, LIKE YOU WOULD IN A LEGAL BRIEF. AND THAT'S JUST AN ENDEMIC OF WHAT I THINK IS THE WAY INFORMATION IS COMMUNICATED, OR LACK THEREOF, FOR OUR RESIDENTS. AND THIS ISSUE IN PARTICULAR THAT CONCERNS ME IS ABOUT THE ANNUAL REPORT OF INVESTMENTS FOR EACH FISCAL YEAR AND THE MONTHLY REPORTS OF THE TREASURER'S INVESTMENT PERFORMANCE. AND IF YOU LOOK AT, FOR INSTANCE, THE MOST RECENT ANNUAL REPORT DATED SEPTEMBER 10TH, AND I WOULD LIKE TO COMMEND THE STAFF. I MENTIONED IT LAST TIME IT WAS RELEASED IN SEPTEMBER AFTER A JUNE FISCAL YEAR. THE FOUR PREVIOUS ANNUAL REPORTS, I BELIEVE, FROM MEMORY, WERE ISSUED IN NOVEMBER, FEBRUARY, MARCH AND MAY. SO ON AVERAGE MORE THAN SIX MONTHS AFTER THE END OF THE FISCAL YEAR. SO CLEARLY, WITH THE ACTING TREASURER ABLE TO GET THIS THING OUT WITHIN 90 DAYS, I THINK THERE SHOULD BE A STATUTORY REQUIREMENT THAT THE ANNUAL REPORT BE DELIVERED BY THE END OF SEPTEMBER OF EVERY CALENDAR YEAR, WHICH WOULD BE PRIOR TO ANY ELECTION, AND CERTAINLY GIVE PEOPLE THE ABILITY TO HAVE MORE TIMELY INPUT. THE OTHER THING THAT YOU CAN SEE FROM THIS REPORT IS IN THE FIRST TWO PAGES, WHICH LEAD UP TO THE NEXT STEP. SO IN ESSENCE, THE ENTIRE TWO PAGE EXECUTIVE SUMMARY, THERE IS NOT ONE NUMBER HERE THAT TELLS YOU HOW THE TREASURER'S INVESTMENT PERFORMANCE ACTUALLY WHAT ACTUALLY WAS. AND I CAN GIVE YOU THE SPECIFIC WAY THAT IT'S HIDDEN, IS THAT THE FIRST NUMBER DESCRIBES SAYS THE CITY'S INVESTMENT PORTFOLIO INCREASED BY $28.5 MILLION IN PAR VALUE. WELL, THAT DOESN'T DO YOU ANY GOOD IF YOU DON'T KNOW THAT THE FUND MAY HAVE LOST, LET'S SAY, $10 MILLION. BUT DURING THE YEAR THERE WAS A $12 MILLION SURPLUS, WHICH WAS LEFT IN THE SWEEP ACCOUNTS, WHICH END UP IN THIS REPORT. SO IT'S LIKE TRYING TO FIGURE OUT YOUR INVESTMENT PERFORMANCE IF YOU'RE LOOKING AT YOUR CHECKING ACCOUNT BALANCE, WHEN ALL OF YOUR STOCKS AND YOUR PAYCHECKS AND YOUR RENT CHECKS AND EXPENSES ARE COMING OUT OF THE SAME ACCOUNT, JUST BECAUSE IT WENT UP DOESN'T MEAN YOU MADE MONEY IN YOUR INVESTMENT PERFORMANCE. JUST LIKE IF IT WENT DOWN, IT DOESN'T MEAN YOU LOST MONEY. BUT THIS IS HOW THE BIGGEST LOSSES IN BASICALLY IN THE HISTORY OF CARLSBAD FISCAL YEAR 2022, OVER $30 MILLION OF MARKET LOSSES OCCURRED. AND IT WAS NEVER POINTED OUT EXPLICITLY. AND I JUST FIND THAT JUST A COMPLETE FAILURE. SO I'D ENCOURAGE YOU, BEFORE THE NEW TREASURER GETS INAUGURATED, TO START WORKING ON THE REPORTING CHANGES THAT ANY TREASURER OUGHT TO MEET. KELLY MCCORMICK, FOLLOWED BY GENE WALKER. HELLO. THIS IS KELLY MCCORMICK. I'M A PUBLIC HEALTH EDUCATOR WITH SAN DIEGUITO ALLIANCE FOR DRUG-FREE YOUTH. I WOULD LIKE TO THANK THE CARLSBAD CITY COUNCIL FOR JUST A FEW MINUTES AGO, RECOGNIZING THE IMPORTANCE OF RED RIBBON WEEK, AND ALSO FOR YOUR YEAR ROUND SUPPORT OF PROGRAMS AND POLICIES THAT SUPPORT THE HEALTH AND WELL-BEING OF YOUTH. AS A LONG TIME RESIDENT OF CARLSBAD AND THE PARENT OF TWO CHILDREN WHO ARE NOW YOUNG ADULTS, IT'S ALWAYS BEEN ENCOURAGING TO SEE THE CITY'S COMMITMENT TO YOUTH ACTIVITIES LIKE PARKS, LIBRARIES AND SCHOOLS. AND FOR TEENS WHO MAY BE HEADED DOWN A DESTRUCTIVE PATH. THE CARLSBAD POLICE DEPARTMENT PROVIDES AN EXCELLENT YOUTH DIVERSION PROGRAM. ON TOP OF THAT, THE CITY COUNCIL RECENTLY VOTED TO IMPROVE THE HEALTH OF CHILDREN AND ADULTS LIVING IN MULTI-UNIT HOUSING BY BANNING SMOKING AND VAPING IN AND AROUND THE PROPERTIES. EXPOSURE TO SECONDHAND SMOKE FROM EITHER TOBACCO OR MARIJUANA CAN CAUSE OR EXACERBATE SERIOUS HEALTH CONDITIONS, ESPECIALLY IN CHILDREN. IT'S ALWAYS A GOOD TIME TO GIVE CHILDREN AND TEENS TOOLS AND INFORMATION THAT CAN HELP THEM MAKE HEALTHY CHOICES THROUGHOUT THEIR LIVES, AND TO UNDERSTAND THAT CHOICES HAVE CONSEQUENCES. STUDENTS FROM CARLSBAD'S LA COSTA CANYON HIGH SCHOOL PARTICIPATE IN SAN DIEGUITO ALLIANCE PROGRAMS SUCH AS STUDY BUDDIES, WHICH IS A HOMEWORK AND MENTORING PROGRAM THAT PAIRS TEENS WITH ELEMENTARY SCHOOL STUDENTS AND TEEN PRESENTERS, WHERE STUDENTS FROM LCPS AND OTHER HIGH SCHOOLS WHO HAVE ALWAYS MADE THE CHOICE TO STAY ALCOHOL AND DRUG FREE, TALK TO ELEMENTARY AND MIDDLE SCHOOL STUDENTS ABOUT THE BENEFITS OF BEING SUBSTANCE FREE. TO HIGHLIGHT OUR APPRECIATION, I HAVE SOME HIGHLIGHTER PENS TO SHARE WITH YOU AND I WILL LEAVE THOSE WITH THE CLERK. THANK YOU. HI. I'VE SPOKEN IN THE LAST SEVERAL WEEKS ABOUT THE LEAGUE OF CITIES AND THE FACT THAT THE CITY PAYS DUES TO THE LEAGUE OF CITIES $30,000 A YEAR TO BELONG TO THE LEAGUE OF CITIES. [00:20:03] PLUS, WE PAY FOR COUNCIL MEMBERS TO TRAVEL TO THOSE EVENTS. WE PAY FOR THE TRAVEL COSTS AND THE OVERNIGHT COSTS AND THE MEALS. I RECENTLY FOUND THAT LEAGUE OF CITIES, THEY HAVE A POLITICAL ACTION COMMITTEE CALLED CITY PAC. THEY RIGHTLY HAVE CAMPAIGN FINANCE DISCLOSURES AS ARE REQUIRED FOR EVERY PAC. I WAS ASTONISHED TO FIND, THOUGH, THAT THE LEAGUE OF CITIES STAFF ARE PROVIDING STAFF TIME FROM LEAGUE OF CITIES TO THE PAC, MEANING OUR TAX DOLLARS PAID IN LEAGUE OF CITIES DUES ARE IN TURN USED FOR STAFF AT A POLITICAL ACTION COMMITTEE. IT IS ESSENTIAL THAT OUR TAX DOLLARS ARE USED TRANSPARENTLY. COUNCIL MEMBERS ACOSTA AND BHAT-PATEL ARE BOTH ON THE BOARD OF DIRECTORS FOR THE LEAGUE OF CITIES, WITH COUNCIL MEMBER ACOSTA RECENTLY BEING NAMED THE SECOND VICE PRESIDENT OF THAT ORGANIZATION. OUR TAX DOLLARS, DUES AND COUNCIL MEMBER TRAVEL EXPENSES TO THE LEAGUE OF CITIES EVENTS ARE AN INAPPROPRIATE WAY TO FUND A PAC. THE STAFFING FOR A PAC TO NOW FIND THAT OUR TAX DOLLARS ARE PAYING FOR PAC STAFF AND COUNCIL MEMBERS CONTINUING TO DECLINE TO DISCLOSE THEIR VOTES AT LEAGUE OF CITIES OR SPONSORS FOR THE EVENTS ATTENDED, AT THOSE AT THOSE FUNCTIONS IS JUST ADDING INSULT TO INJURY. MAYOR, YOU HAVE TO DO SOMETHING. BRING A MOTION TO REQUIRE DISCLOSURE FOR ANYONE WHO IS THE APPOINTED PERSON FOR THIS ORGANIZATION. THANK YOU. THERE ARE NO MORE SPEAKERS. THANK YOU. NEXT IS THE CONSENT CALENDAR. [CONSENT CALENDAR] ITEMS NUMBER ONE AND TWO. DO WE HAVE ANY SPEAKERS? NO, WE DO NOT. ANY COUNCIL MEMBERS WANT TO PULL ANY OF THESE ITEMS. MOTION, PLEASE. MOVE APPROVAL OF CONSENT ITEMS. SECOND. PLEASE VOTE. PASSES UNANIMOUSLY. ITEM NUMBER THREE IS THE MAYORAL APPOINTMENT TO ONE MEMBER OF THE SENIOR COMMISSION. [3. MAYORAL APPOINTMENT OF ONE MEMBER TO THE SENIOR COMMISSION – Adoption of a resolution appointing one member to the Senior Commission. (Staff contact: Tammy McMinn, City Clerk Services)] MY RECOMMENDATION IS, AS ALWAYS, WHEN WE HAVE A. I'M SORRY. WE HAVE SPEAKERS, PLEASE. CECILIA SCHOUWE. GOOD EVENING. MAYOR, CITY COUNCIL MEMBERS AND STAFF. MY NAME IS CECILIA SCHOUWE AND I'M SPEAKING ON BEHALF OF MY APPLICATION TO SERVE AS A COMMISSIONER ON THE SENIOR COMMISSION. I BEGAN MY SERVICE ON THE COMMISSION IN MARCH 2023, HAVING SERVED IN AN UNPLANNED VACANCY I TOOK OVER AT OR WAS APPOINTED AT THAT TIME. MY APPOINTMENT HAS BEEN A NICE ADDITION TO MY SERVICE IN TAX PREPARATION AT THE SENIOR CENTER DURING TAX SEASON FILING. I'VE LEARNED A LOT SERVING AS A COMMISSIONER, AND I'VE DEVELOPED A DEEP APPRECIATION FOR THE SERVICES AND ACTIVITIES PROVIDED TO THE SENIOR COMMUNITY IN OUR CITY. AND I DO HAVE TO COMPLIMENT THE STAFF AT THE SENIOR CENTER, WHO DO AN OUTSTANDING JOB OF PROVIDING THOSE SERVICES. THEY DO A LOT OF OUTREACH AND IT'S BEEN VERY REWARDING. I RESPECTFULLY ASK FOR YOUR CONSIDERATION, AND I LOOK FORWARD TO YOUR DECISION. THANK YOU VERY MUCH. MA'AM, PLEASE PRONOUNCE YOUR LAST NAME. IS IT SCHOUWE OR SCHOUWE? WELL, WE SAY SCHOUWE. IT'S. IT'S A DUTCH NAME. IT'S ACTUALLY SHUI. I THINK IT IS, BUT SCHOUWE IS FINE. OKAY, YOU'RE MY RECOMMENDATION. SO I WANTED TO MAKE SURE I SAID YOUR NAME PROPERLY. OH, OKAY. THANK YOU VERY MUCH. THANK YOU FOR YOUR TIME. AS ALWAYS, WHEN A WHEN A MEMBER OF A. DO WE HAVE ANY OTHER SPEAKERS? I'M SORRY. NO, WE DO NOT. THANK YOU. WHENEVER ANYTIME WE HAVE A MEMBER OF ONE OF OUR COMMITTEES WHO'S DOING A GOOD JOB AND ASK FOR REAPPOINTMENT, THEY TAKE PRIORITY. AND IN THIS PARTICULAR CASE, I'M NOMINATING CECILIA SCHOUWE. PLEASE VOTE. THAT PASSES UNANIMOUSLY. ITEM NUMBER FOUR IS THE MAYORAL APPOINTMENT OF TWO MEMBERS TO THE CARLSBAD TOURISM BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD. [4. MAYORAL APPOINTMENT OF TWO MEMBERS TO THE CARLSBAD TOURISM BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD – 1) Adoption of a resolution appointing Michael Bryan to the Carlsbad Tourism Business Improvement District Advisory Board; and 2) Adoption of a resolution appointing Valerie Castillon to the Carlsbad Tourism Business Improvement District Advisory Board. (Staff contact: Tammy McMinn, City Clerk Services)] DO WE HAVE ANY SPEAKERS? NO, WE DO NOT. OKAY. THIS IS AGAIN, THIS IS ONE WHERE IT'S RECOMMENDED. THE REPRESENTATIVES FROM THE LARGER HOTELS FILL THESE TWO POSITIONS. SO MY RECOMMENDATION IS TO APPOINT MICHAEL BRIAN AND VALERIE CASTILIAN. I HOPE I SAID THAT CORRECTLY. ANY COMMENTS? DISCUSSION. PLEASE VOTE. THAT PASSES UNANIMOUSLY. THANK YOU. NEXT IS ITEM NUMBER FIVE, DEPARTMENTAL AND CITY MANAGER'S REPORT. [5. TRI-CITY MEDICAL CENTER UPDATE – Receive a presentation from Tri-City Medical Center President and CEO Gene Ma regarding Tri-City Medical Center and regional affiliations. (Staff contact: Sheila Cobian, City Manager] [00:25:01] CITY MANAGER, PLEASE. GREAT. THANK YOU SO MUCH. ITEM NUMBER FIVE IS THE TRI-CITY MEDICAL CENTER UPDATE AND GIVING THE PRESENTATION TODAY IS TRI-CITY CENTER'S PRESIDENT AND CEO, DOCTOR GENE MA. SIR. GOOD EVENING. MAYOR BLACKBURN CITY STAFF AND DISTINGUISHED COUNCIL MEMBERS, THANK YOU VERY MUCH FOR ALLOWING ME TO COME AND SPEAK TO YOU AND ADDRESS SOME ISSUES THAT I THINK THAT HAVE ARISEN SINCE YOU LIKELY HEARD OF THE DISENGAGEMENT OF OUR PARTNERSHIP. WE HAD HOPED WOULD BE A PARTNERSHIP FOR TRI-CITY WITH UC SAN DIEGO HEALTH. AND I KNOW THAT THERE ARE A LOT OF QUESTIONS THAT HAVE ARISEN. SO JUST BRIEFLY, MY NAME AGAIN IS DR. GENE MA. I'M A 25 YEAR RESIDENT OF CARLSBAD, PROUDLY A RESIDENT OF CARLSBAD, HAVE RAISED OUR CHILDREN HERE AND VERY THANKFUL FOR TO HAVE BEEN ABLE TO RAISE THEM HERE. AND THANKS TO THE GREAT WORK OF ALL OF YOU. AND, AND HAVE BEEN AN EMERGENCY PHYSICIAN IN THIS COMMUNITY FOR THAT PERIOD OF TIME. I NOW SERVE AS THE CEO, BUT TOOK OVER AT A TIME WHEN TRI-CITY WAS, AS YOU MAY VERY WELL KNOW, PUBLICLY AWARE OF THE FINANCIAL DISTRESS OF THE ORGANIZATION COMING OUT OF COVID. WITH THAT SAID, THERE WAS A LOT OF, I THINK, RUMORS THAT CIRCULATE WENT OUT OF A SITUATION LIKE THAT. AND AT A TIME WHEN WE HAD AN OPPORTUNITY WITH A REALLY THOUGHTFUL BOARD WE'RE VERY FORTUNATE RIGHT NOW TO HAVE THAT BOARD WHO RECOGNIZES THAT THE FINANCIAL PRESSURES, THE MARGINS IN HEALTH CARE REALLY DRIVE TOWARDS GREATER AFFILIATION AND LEVERAGING ECONOMIES OF SCALE AND IN RECOGNIZING THAT AND PUTTING ASIDE THEIR OWN PERSONAL INTEREST WHICH I HAVEN'T ALWAYS SEEN FROM OUR BOARD MEMBERS IN THE PAST, TO BE HONEST. THIS IS A BOARD THAT TRULY HAS THE INTEREST OF THE COMMUNITY AT HEART. IT'S ABOUT THIS DISTRICT. THIS DISTRICT IS COMPRISED OF CARLSBAD, OCEANSIDE AND VISTA, FORMED IN 1961 TO PROVIDE THAT LEVEL OF COMMUNITY SERVICE TO THIS ENTIRE REGION. AND THERE ARE A LOT OF FIRSTS THAT HAVE OCCURRED OUT OF TRI-CITY. MANY OF YOU MAY NOT KNOW MANY OF THE STROKE PROTOCOLS THAT OCCUR TODAY. THOSE FIRST STROKE TREATMENTS CAME OUT OF TRI-CITY. THE FIRST PATIENT TREATED IN THIS REGION WAS A 20 SOMETHING YEAR OLD WOMAN WHO WAS SHOPPING FOR HER BRIDAL DRESS AND SUFFERED A DEVASTATING STROKE AND WAS TREATED WITH WHAT NOW HAS BECOME THE STANDARD OF CARE. MANY OF THE ROBOTIC INNOVATIONS HAVE LED TRI-CITY TO BE THAT ROBOTIC INNOVATOR AND MINIMALLY INVASIVE. SO A LOT OF THE CONTRACTS IN NORTH COUNTY FOR SOME OF THE BIG HOSPITAL SYSTEMS WILL OFTEN GO TO TRI-CITY BECAUSE OF THE EXPERTISE OF THE PHYSICIANS THAT ARE THERE. BUT WE'VE CERTAINLY HAD OUR CHALLENGES. AND TODAY, I'M PROUD TO SHARE WITH YOU THAT AFTER GOING THROUGH ONE OF THE MOST DIFFICULT TIMES FOR THIS ORGANIZATION, WE ARE NOW NINE CONSECUTIVE MONTHS OF CASH FLOWING. SO WE HAVE FOUND SOLID FINANCIAL GROUND FOR THIS ORGANIZATION. AT A POINT WHEN A YEAR AND A HALF AGO WE WERE, FOR LACK OF A BETTER TERM, HEMORRHAGING $5 MILLION A MONTH. SO AT THIS POINT, EVERY CONSECUTIVE MONTH THIS YEAR, WE ARE IN THE BLACK, SO TO SPEAK. BUT THAT ISN'T GOING TO BE THE ENTIRE STORY. AT THE END OF THE DAY WHAT I WANTED TO SHARE WITH YOU IS YES, THAT IS TRUE. WE HAD ENTERED INTO A DUE DILIGENCE PROCESS TO FIND A PARTNER TO BE ABLE TO BRING SERVICES TO NORTH COUNTY, BECAUSE OUR FEELING WAS NORTH COUNTY IS LACKING CERTAIN SERVICES. THERE ARE SERVICES THAT RESIDENTS LIKE MYSELF AND ALL OF US HAVE TO GO CURRENTLY TO LA JOLLA OR EVEN SOUTH TO ACQUIRE. THAT'S UNACCEPTABLE FOR A GROWING POPULATION AND THE KIND OF COMMUNITY AND INVESTMENTS THAT ARE NECESSARY TO SUPPORT A FACILITY LIKE TRI-CITY. IT'S GOING TO NEED A PARTNER. AND SO WHEN WE DID THAT DUE DILIGENCE PROCESS, WE ENTERTAINED OFFERS FROM MULTIPLE HEALTH ENTITIES. IN THE END, THE PROPOSAL FROM UC SAN DIEGO WAS TREMENDOUS. OVERWHELMINGLY TREMENDOUS. EVEN THE CEO OF SHARP INDICATED, YOU KNOW, THAT WAS THE RIGHT DECISION BY THE BOARD BASED ON WHAT WAS PUT FORWARD. FAST FORWARD NINE MONTHS LATER UNFORTUNATELY, THE PROPOSAL HAD CHANGED DRAMATICALLY. AND WHILE IT'S, YOU KNOW, IT'S WATER UNDER THE BRIDGE NOW, IT'S UNFORTUNATE. AND AS A PRODUCT, SO TO SPEAK, OF UC, UC UNDERGRAD, UC MEDICAL SCHOOL, UC RESIDENCY HERE AT UC SAN DIEGO WAS VERY, VERY MUCH IN FAVOR OF FINDING A WAY FORWARD WITH UC SAN DIEGO. UNFORTUNATELY, IT WAS JUST NOT MEANT TO BE. AND THE TERMS WERE SIGNIFICANTLY DIFFERENT FROM WHAT HAD BEEN PROPOSED. AND AT THAT POINT IN TIME, THE ADVICE OF OUR TRANSACTIONAL ADVISORS WAS THAT IT WAS JUST NOT A RISK THAT THIS DISTRICT AND THE RESIDENTS OF THE COMMUNITY COULD TAKE. [00:30:08] AND SO AT THIS POINT, WE HAVE MOVED ON. BUT WHAT I DO WANT TO SHARE WITH YOU IS THAT THE BOARD HAS NOT CHANGED ITS VIEW THAT WE ARE LOOKING WITH WITH HAVING CONVERSATIONS WITH MULTIPLE PARTNERS. AND WE DO FULLY ANTICIPATE THAT AT SOME POINT WE WILL BE ABLE TO DISCLOSE WHAT THAT LOOKS LIKE. BUT THE GOAL IS TO BE ABLE TO BRING TO MAKE, TO ENSURE THAT NORTH COUNTY RESIDENTS HAVE ACCESS TO EXCEPTIONAL HEALTH CARE HERE IN NORTH COUNTY, AND TO BRING SERVICES THAT WE SHOULD NOT HAVE TO GO SOUTH IN TRAFFIC TO ACHIEVE, TO ACQUIRE. SO IN THE MEANTIME, I JUST WILL CLOSE THERE'S PLENTY I COULD SHARE, BUT TODAY I JUST WANT TO KEEP IT BRIEF AND THAT IN THE MEANTIME, TRI-CITY DOES STAND ON ITS OWN. WE ARE FINANCIALLY ON SOLID GROUND AGAIN. BUT WE WILL CONTINUE TO LOOK FOR A PARTNERSHIP. THREE OF THE THINGS THAT I DO WANT TO BRIEFLY SHARE THAT ARE COMING. WE ARE BRINGING A PARTNERSHIP WITH ONE OF THE PREEMINENT MINIMALLY INVASIVE SPINE SURGICAL PARTNERSHIPS IN CALIFORNIA AND NOW ESTABLISHING THEMSELVES NATIONALLY. THEY ARE THEY CHOSE TRI-CITY BECAUSE OF OUR WELLNESS CENTER AND BECAUSE OF ITS PROXIMITY TO THE AIRPORT AND THEIR CLIENTELE FLYING IN NATIONAL SPORTS TEAMS, FLYING IN THROUGHOUT THE COUNTRY. AND THAT WAS CRITICAL TO THEM. SO THEY WILL BE BRINGING THEIR IN THE MIDST OF FINISHING THEIR SURGICAL CENTER AND DOING MINIMALLY INVASIVE SPINE SURGERY. THOSE OF YOU THAT HAVE EVER HAD TO CONSIDER SPINE OR BACK INJURIES, NECK INJURIES, IT'S OFTEN SCARY BECAUSE THOSE ARE BIG, BIG SURGERIES. THEY ARE REALLY REDEFINING HOW THAT OCCURS AND DOING THAT ON A MINIMALLY INVASIVE SCALE IN A WAY THAT MANY. THAT'S REALLY A SERVICE NOT AVAILABLE HERE IN SAN DIEGO AT THIS POINT IN TIME. SO WE'RE EXCITED THAT IT'S GOING TO FINISH UP HERE THAT SURGICAL FINISHES CENTER IS COMPLETED EARLY THIS COMING YEAR. SECONDLY, WE WILL OPEN OUR PHF, WHICH IS A PSYCHIATRIC HEALTH FACILITY. IT'S FIRST OF ITS KIND IN SAN DIEGO COUNTY. WE'RE VERY PROUD TO OFFER THAT SERVICE AND TO ENSURE THAT WE ARE ABLE TO MEET THE NEEDS OF OUR BEHAVIORAL HEALTH COMMUNITY AND THE GREAT DEMANDS THAT ARE THERE. AND IT'S ABSOLUTELY A SERVICE THAT SHOULD BE ON PAR WITH OUR OTHER MEDICAL NEEDS, BUT OFTEN GETS NEGLECTED. SO WE'RE VERY PROUD TO BE ABLE TO OFFER THAT. AND THAT WILL OPEN UP HERE. WE HOPE AGAIN IN THE FIRST QUARTER OF THE COMING YEAR. FINALLY, OUR EMERGENCY DEPARTMENT, THIS IS A TOPIC THAT'S NEAR AND DEAR, I THINK TO MANY COMMUNITY MEMBERS HEARTS AND BUT PARTICULARLY MAYOR BLACKBURN HAS EXPRESSED TO ME AS A POLICE OFFICER HIS CHALLENGES IN THE PAST THROUGHOUT THE HOSPITALS, BUT PARTICULARLY AT TRI-CITY, WE ARE DEDICATED TO CHANGING THAT PARADIGM. SO WE HAVE A REMODEL OF OUR EMERGENCY DEPARTMENT THAT'S REALLY BUILT ON OPERATIONAL EFFICIENCIES AND STRUCTURAL RE-ENGINEERING. SOME LEAN PROCESSES HAVE REDESIGNED THAT AREA. WE EXPECT THAT TO ALSO COME OPEN IN THE FIRST QUARTER OF THIS COMING YEAR. AND ALONG WITH THAT, WE'VE REALLY CHANGED THE WAY THAT WE'RE GOING TO DELIVER THE CARE AND THE WAY OUR STAFFING MODELS ARE, BECAUSE OUR COMMUNITY SHOULD NOT HAVE TO WAIT HOURS FOR CRITICAL SERVICES, AND ALSO ENSURING THAT OUR PARAMEDICS AND OUR POLICE OFFICERS AREN'T SPENDING UNNECESSARY TIME WAITING IN EMERGENCY ROOMS, BUT RATHER PROVIDING THE COMMUNITY SERVICE THAT THEY REALLY DESERVE AND OUR COMMUNITY NEEDS TO HAVE. SO I'LL STOP THERE UNLESS YOU HAVE ANY QUESTIONS. AND AGAIN, THANK YOU FOR TAKING THE TIME AND GIVING ME THE OPPORTUNITY TO SPEAK TODAY. PLEASE STAY THERE BECAUSE I KNOW THE COUNCIL WILL HAVE QUESTIONS. BUT FIRST WE HAVE ANY COMMENTS FROM THE PUBLIC. THERE ARE NO SPEAKERS. OKAY. ANYBODY HAVE ANY QUESTIONS? MS. ACOSTA? OKAY. THANK YOU. THANK YOU SO MUCH FOR BEING HERE AND FOR THE PRESENTATION. I THINK IT'S REALLY IMPORTANT NOT JUST THAT WE HEAR THIS, BUT THAT THE PUBLIC HEAR WHAT IS HAPPENING. THE CURRENT STATUS AT TRI-CITY, BECAUSE THERE HAVE BEEN A LOT OF QUESTIONS. SO I JUST WANTED TO SHARE WITH YOU TWO OF THOSE, AND MAYBE WE CAN GET SOME CLARITY ON THEM. SURE. ACTUALLY, ONE AND ONE WAS A FOLLOW UP TO SOMETHING THAT YOU SAID, WHICH IS THE PHF, THE PSYCHIATRIC HEALTH FACILITY. YOU SAID IT WAS THE FIRST OF ITS KIND IN SOME WAY. AND I'M CURIOUS ABOUT WHAT IS THAT WAY. AND THEN THE SECOND QUESTION IS, WHAT IS THE FUTURE OF OUR OB GYN FACILITIES THERE? BECAUSE I KNEW THAT THAT WAS AN ISSUE I'VE HEARD A LOT ABOUT. NO, THOSE ARE FANTASTIC QUESTIONS. AND THANK YOU FOR THOSE QUESTIONS. FIRST AT PHF SO THERE ACTUALLY IS NOT A LICENSED PSYCHIATRIC HEALTH FACILITY IN SAN DIEGO COUNTY. THERE ARE INPATIENT BEHAVIORAL HEALTH UNITS AND THERE ARE CRISIS STABILIZATION UNITS. BUT WHAT THE BEHAVIORAL HEALTH SERVICES FOR THE COUNTY OF SAN DIEGO HAS REALIZED IS YOU NEED A CONTINUUM OF CARE. AS AN EMERGENCY PHYSICIAN, I SAW THE TURNSTILE THAT WAS THE EMERGENCY ROOM. [00:35:03] WE WOULD GET WHAT WE CALL 51 50S. INVOLUNTARY HOLDS. BUT THERE'S REALLY NO RESOURCES FOR THESE PATIENTS, AND THEY DON'T QUITE FIT IN THESE CATEGORIES. AND SO YOU MEDICATE THEM, THEY GO BACK OUT. BUT YOU KNOW THEY'RE COMING BACK. AND THAT'S NOT GOOD CARE. WHAT THIS COUNTY'S BEHAVIORAL HEALTH SERVICES RECOGNIZE IS WE NEED TO FILL THAT CONTINUUM OF CARE, EXPAND ON OUR AMBULATORY SERVICES, OUTPATIENT SERVICES, THERAPY PROGRAMS, BUT ALSO FILL IN THE GAPS. AND A PHF SITS RIGHT BELOW AN INPATIENT UNIT, BUT HIGHER THAN A CRISIS STABILIZATION UNIT FROM FROM A LEVEL OF ACUITY AND LENGTH OF STAY. NOW, THAT SAID, LA COUNTY HAS A TRUE PHF. LICENSED BY THE STATE OF CALIFORNIA AND THIS WILL BE THE FIRST PHF LICENSED IN SAN DIEGO. BUT THE REALITY OF IT IS, IS PHFS HAS STARTED TO ESSENTIALLY TAKE ON THE SAME LEVEL OF CARE AS INPATIENT UNITS. BUT THE COST IS IT'S A LOWER LEVEL OF IT'S A LOWER COST STRUCTURE. SO THAT'S WHY IT IS CONSIDERED THE FIRST OF ITS KIND. WE DO HAVE INPATIENT BEHAVIORAL HEALTH UNITS, BUT THEY SERVE A LITTLE BIT OF A DIFFERENT PURPOSE. THE SECOND QUESTION IS A GREAT QUESTION. THAT WAS REALLY ONE OF THE KEY DISTINGUISHING FACTORS THAT LED OUR BOARD TO CHOOSE UC SAN DIEGO HEALTH BECAUSE THEY WERE COMMITTED TO REOPENING BEHAVIORAL HEALTH. I'M SORRY. MATERNAL FETAL MATERNAL HEALTH SERVICES AT TRI-CITY. WE ARE STILL COMMITTED TO THAT. UNFORTUNATELY, THAT WAS ONE OF THE KEY THINGS THAT HAD CHANGED THAT NO LONGER WAS DEFINITIVELY IN THE MODEL. THE FINANCIAL FORECASTS DID NOT SPECIFICALLY SPEAK TO REOPENING LABOR AND DELIVERY. AND AS YOU KNOW, LABOR AND DELIVERY UNITS ARE CLOSING THROUGHOUT THE STATE. AND THIS COUNTY HAS SEEN MULTIPLE CLOSURES. AND IN FACT, SINCE TRI-CITY CLOSED ITS THERE WERE TWO MORE CLOSURES IN SAN DIEGO COUNTY, INCLUDING ANOTHER ONE IN NORTH COUNTY. AND SO AT THIS POINT IN TIME, IT IS A CRITICAL DECISION FACTOR FOR OUR BOARD TO FIND A PARTNER THAT HAS THE RESOURCES, THE EXPERTISE TO BE ABLE TO COMMIT TO BRINGING BACK MATERNAL HEALTH HERE IN NORTH COUNTY, BUT IN A FASHION THAT WE REALLY ALWAYS ENVISIONED, WHICH WAS TO EXPAND THAT BECAUSE MATERNAL FETAL MEDICINE, WHICH IS HIGH RISK MATERNAL CARE IS ACTUALLY NOT AVAILABLE IN NORTH COUNTY. IF YOU HAVE SIGNIFICANT HIGH RISK, YOU HAVE TO GO TO LA JOLLA OR SOUTH. GREAT. THANK YOU VERY MUCH. MISS BURKHOLDER. THANK YOU, MAYOR, AND THANK YOU, DOCTOR MA. I APPRECIATE THAT. JUST A FEW QUESTIONS ON THE PHF. HOW MANY BEDS ARE YOU GUYS ANTICIPATING FOR THAT? IT IS A 16 BED FACILITY. OKAY. YES. AND THEN I THINK, IN MY UNDERSTANDING, THEY'RE TYPICALLY A LITTLE BIT LONGER STAY THAN A NORMAL 51 50. DO YOU HAVE THE AVERAGE OR ANY SORT OF INFORMATION ON WHAT YOU ANTICIPATE THE HOSPITAL PROVIDING FOR THAT? YEAH, MOST AVERAGES AND THOSE ARE GOING TO BE ABOUT 11 DAYS. OKAY. AND THEN FINANCIALLY, IS THIS AN ONGOING PROJECT FOR THE HOSPITAL OR IS THIS A PILOT PROJECT, OR IS THIS ANTICIPATED TO BE KIND OF REPLACING YOUR PREVIOUS BEHAVIORAL HEALTH AT A HIGHER LEVEL? YOU KNOW, IT IS REPLACING AND IT'S PERMANENT. OUR AGREEMENT IS IN PERPETUITY. AND WE HAVE IT'S A PARTNERSHIP WITH THE COUNTY OF SAN DIEGO. AND IT WILL BE IT IS BEING CONSTRUCTED AS A LONG TERM DEAL. THERE IS. AND THE BEST PART OF IT IS, IS THE WAY IT'S CONSTRUCTED BY AND THE SUPPORT OF THE COUNTY IS TO ENSURE THAT THE FINANCIAL PRESSURES DON'T JEOPARDIZE THAT, SUCH THAT WE'RE HAVING A CONVERSATION THREE YEARS FROM NOW, BECAUSE, AS YOU KNOW, THERE ARE TWO AREAS THAT ARE CRITICALLY UNDERFUNDED IN HEALTH CARE, AND THAT INCLUDES MATERNAL FETAL MEDICINE, WHICH IS WHY LABOR AND DELIVERY UNITS ARE CLOSING THROUGHOUT THE STATE AND IN MENTAL HEALTH. AND BECAUSE OF THAT, THE COUNTY RECOGNIZED THAT AND IS SUPPORTING US IN A COST PLUS MODEL TO ENSURE THAT WHILE TRI-CITY WILL NEVER MAKE A PROFIT AND THAT'S OKAY WITH US BECAUSE IT'S ALL ABOUT DELIVERING THAT SERVICE, BUT IT WILL BE SUSTAINABLE AND WE WON'T HAVE THIS CONVERSATION ABOUT TRI-CITY OR ANY FACILITY THAT'S ABLE TO CONSTRUCT A SIMILAR MODEL. CLOSING SUCH UNITS AGAIN AND TAKING AWAY THOSE CRITICAL RESOURCES. SO GREAT QUESTION. MY QUESTION IS REFERRAL SOURCES. YEAH. SO THE REFERRAL SOURCES ARE ANY HOSPITAL EMERGENCY DEPARTMENT CRISIS STABILIZATION UNITS AND ANY OUTPATIENT MENTAL HEALTH FACILITIES. SO IT CAN COME FROM A LOCAL PSYCHOLOGIST, PSYCHIATRIST SEEING A PATIENT IN THEIR OFFICE WHO SAYS, REALLY? I THINK YOU NEED TO BE HOSPITALIZED. SO THERE'S NO ACUTENESS TO A DIAGNOSIS. WE'RE TALKING ABOUT THREAT TO HARM OR SOMEONE ELSE HIMSELF OR SOMEONE ELSE. RIGHT. LIKE ARE ARE IS THERE. NO. THEY DON'T HAVE TO MEET 51 50 CRITERIA EXACTLY AS YOU'RE SPEAKING TO. [00:40:01] SO REALLY INSIGHTFUL QUESTIONS. BUT THEY WOULD HAVE TO MEET INPATIENT CRITERIA. OKAY. SO THEY DO HAVE TO BE OF HIGH ENOUGH SEVERITY TO MEET THAT AGAIN TO MEET THAT CONTINUUM OF CARE. OTHERWISE THEY MIGHT BE ABLE TO GO TO A CRISIS STABILIZATION UNIT OR HOPEFULLY BE MANAGED OUTPATIENT. BUT IF THEY NEED INPATIENT CARE, THIS UNIT WILL BE THE FIRST UNIT TO BE REACHED THAT PEOPLE WILL REACH FOR. AND WE ARE PARTNERING NOW WITH OH, I'M BLANKING RIGHT NOW. WE HAVE ENTERED INTO AN AGREEMENT TO PARTNER WITH A BEHAVIORAL HEALTH EXPERT THAT WE WILL BE CONTRACTING TO MANAGE THAT BECAUSE THEY ACTUALLY IT'S EXODUS. IT'S JUST YEAH, THAT'S WHAT'S HAPPENING THESE DAYS. SO THEY ACTUALLY RUN OUR CRISIS STABILIZATION UNITS IN NORTH COUNTY. AND THAT ACTUALLY FACILITATES THE CONVERSATION, ENSURES THAT WE HAVE THAT COMMUNICATION AND SEAMLESS TRANSFER OF CARE WHEN IT'S NECESSARY. AND THE DATA IS ALL, IS ALL HOUSED WITHIN THEIR ELECTRONIC MEDICAL RECORDS ALSO, SO THAT WE KNOW THAT THEY'LL BE ABLE TO DELIVER THAT LEVEL OF CARE BECAUSE THEY DO IT ALL THE TIME, AND THEY'RE THE ONES THAT RUN THE ONE THAT WE ACTUALLY WENT TO VISIT IN LA. AND THAT'S WHAT PROMPTED US TO SAY, YOU KNOW WHAT? I THINK THEY CAN DELIVER THIS CARE AT A LOWER COST WITH THE HIGHER LEVEL OF EXPERTISE. LET'S BRING THEM INTO THE MIX. AND IT BEGAN A THREE WAY CONVERSATION WITH THE COUNTY. AND IT SEEMS TO BE WORKING OUT REALLY WELL. WE HOPE TO FINALIZE THAT AGREEMENT SHORTLY. I LOVE IT, I THINK THAT 11 DAYS IS PLENTY OF TIME TO CREATE THAT STABILIZATION, BUT ALSO REINCORPORATE THEM BACK INTO THEIR ORIGINAL SETTING, IF THAT'S POSSIBLE, AND ALSO PROVIDE THEM WITH THAT CONTINUUM OF CARE THAT YOU MENTIONED. AND JUST A SELFLESS PLUG. I HAD MY BACK SURGERY AT TRI-CITY AND IT WENT FABULOUSLY. SO. WONDERFUL. THANK YOU. THANK YOU. MISS BHAT-PATEL. YES, THANK YOU AND THANKS FOR BEING HERE. I VOLUNTEERED LIKE 20 PLUS YEARS AGO IN THE EMERGENCY DEPARTMENT AT TRI-CITY. SO I JUST HEARING THAT THAT'S YOUR BACKGROUND. THANK YOU FOR YOUR SERVICE ON THAT, BECAUSE I KNOW THERE'S A LOT GOING ON OVER THERE, SO REALLY APPRECIATE THAT. SO A COUPLE OF THE BEHAVIORAL HEALTH AND OB GYN QUESTION WAS ASKED. THAT WAS SOMETHING THAT I DEFINITELY HAD ON MY LIST OF QUESTIONS. I WAS JUST CURIOUS WITH REGARDS TO THE PARTNERS AND THE DIFFERENT FOLKS THAT YOU'RE LOOKING AT AS YOU MOVE FORWARD WITH PARTNERSHIPS FOR THE ENTITY, WHAT THE TIMELINE IS LOOKING LIKE FOR THAT? I KNOW YOU SAID, YOU KNOW, YOU'VE BEEN MOVING FORWARD. SO I'M JUST CURIOUS ON, YOU KNOW, IS IT A YEAR OUT? A COUPLE YEARS OUT? WHAT IS WHAT IS THAT LOOKING LIKE? I TO BE PERFECTLY FRANK, I THINK THAT MY HOPE IS THAT WE'LL HAVE AN ENTER INTO A LETTER OF INTENT WITH A POTENTIAL PARTNER WITHIN 4 TO 6 MONTHS. AND SUBSEQUENT TO THAT, I THINK A PARTNERSHIP WOULD LIKELY COME. THE DEFINITIVE AGREEMENT WOULD PROBABLY TAKE ANOTHER EIGHT MONTHS TO ARRIVE AT. SO IT'S WE'RE LOOKING AT ABOUT A YEAR. IT'S A LOT LONGER THAN I HAD HOPED. I THINK ONE OF THE THINGS THAT CAUGHT PEOPLE'S ATTENTION IS THE REASON WHY WE DID TAKE A STEP BACK ALSO IS THAT YOU KNOW, SOME OF THESE ENTITIES HAD HEARD WHAT TRI-CITY WAS WILLING TO PUT ON THE TABLE FOR UCSD, AND THERE WAS A LOT OF, HEY, IF THAT'S ON THE TABLE, WE WOULD, YOU KNOW, UNLESS THAT'S YOUR CONVERSATIONS ARE GOING WELL, WE WOULD LIKE FOR YOU TO TAKE A STEP BACK BECAUSE WE WOULD LIKE TO HAVE A CONVERSATION WITH YOU AGAIN. TRI-CITY IS NOT LOOKING TO SELL THIS DISTRICT. IT'S NOT LOOKING FOR A 500 MILLION ASSET PURCHASE AGREEMENT. IT'S LITERALLY THE DISTRICT'S BOARD IS SAYING WE NEED A HEALTH SYSTEM PARTNER THAT IS GOING TO ENSURE THAT THEY'RE GOING TO BE GOOD STEWARDS OF THIS DISTRICT AND PROVIDE THE CARE FOR THIS COMMUNITY AND ENHANCE THE LEVEL OF CARE. AND WE'RE WILLING TO TURN IT OVER TO YOU AND LET YOU MANAGE IT. AND SO YOU KNOW, THE DISTRICT WAS WILLING TO MAKE A LOT OF CONCESSIONS TO MAKE THIS WORK. AND I THINK THAT THAT'S RAISED THE INTEREST OF A LOT OF PARTIES. NOW, THAT SAID, NOT A LOT OF PARTIES ARE COMING IN TO CALIFORNIA TO OPERATE HOSPITALS TODAY. MORE ARE LEAVING. SO, YOU KNOW, IT'S A CHALLENGING LANDSCAPE, BUT HERE'S WHAT'S VERY CLEAR. NORTH COUNTY IS VERY DESIRABLE, AND IT IS AN AREA WHERE IF YOU'RE GOING TO GO INTO A HOSPITAL AND PARTNER, THIS IS A HIGHLY COVETED REGION. AND CARLSBAD IS NO DOUBT, YOU KNOW, A CROWN JEWEL. THANK YOU. AND THEN I'D BE CURIOUS TO HEAR, YOU KNOW, I HEARD SOME SNIPPETS OF IT AS YOU WERE TALKING WITH REGARDS TO SOME OF THE GOALS FOR THE DISTRICT. I WAS JUST CURIOUS, AS YOU'RE LOOKING AT PARTNERS, WHAT IN PARTICULAR YOU'RE LOOKING FOR IN THAT PARTICULAR PARTNER, TO BE ABLE TO TAKE ON FOR THE DISTRICT AND TAKE ON ALONGSIDE THE DISTRICT, I GUESS WOULD BE A BETTER WAY TO PUT IT. [00:45:02] YEAH. YOU KNOW, THE GOAL WE WERE REALLY LOOKING FOR IS TO REALLY, FOR LACK OF A BETTER TERM, IS TO TRANSFER THE BALANCE SHEET. REALLY? YOU TAKE ALL OF IT. TAKE ALL OF IT. THE BOARD WILL STEP ASIDE, MAINTAIN A DIFFERENT FUNCTION. BUT WE WOULD CREATE A NEW OPERATING BOARD THAT IS FOCUSED ON HEALTH CARE, BUT ALLOW AN ENTITY THAT HAS THE RESOURCES AND THE SCALE. IT'S BECOMING HEALTH CARE IS BECOMING A IT'S LANDSCAPE OF THE HAVES AND HAVE NOTS. AND AS AI THE INVESTMENTS INTO AI ARE COMING THROUGH, IT'S GOING TO BE THAT THE ENTITIES THAT HAVE THE MARGINS AND THE ABILITY TO MAKE THOSE SIGNIFICANT INVESTMENTS THAT WILL CREATE THAT SIGNIFICANTLY GROWING DICHOTOMY OF THOSE THAT HAVE AND THOSE THAT HAVE NOT. OUR GOAL IS TO ENSURE THAT TRI-CITY AND THE RESIDENTS OF THE COMMUNITY HAVE ACCESS TO THE HAVE. THAT'S EXACTLY WHY I WENT INTO PUBLIC HEALTH IS THE ACCESS TO CARE. SO IT'S I APPRECIATE YOU SAYING THAT IN THE WAY THAT YOU SAID THAT. AND I THINK I HOPE THAT THAT COMMITMENT STAYS. IT SOUNDS LIKE WITH YOU IT WILL. AND ONE OF THE OTHER PIECES THAT I WAS CURIOUS ABOUT IS AROUND THE PRIVATE VERSUS PUBLIC. I MEAN, SHARP IS A PRIVATE ENTITY, RIGHT? AND OBVIOUSLY UCSD IS A PUBLIC ENTITY. HOW WILL THAT LANDSCAPE BE NAVIGATED IF A PARTNER THAT IS PRIVATE COMES IN AND THEY'RE WANTING TO PARTNER WITH YOU ALL? I THINK THAT I KNOW THOSE WERE SOME QUESTIONS THAT CAME FROM THE PUBLIC FOR US. AND SO IF YOU DON'T MIND SHARING A LITTLE BIT ON THAT, THAT WOULD BE HELPFUL. YEAH, THERE ARE LIMITED PUBLIC ENTITIES. AND WITH UC, YOU KNOW, OUR AGREEMENT LOOKING LIKE THAT'S COMPLETELY DISENGAGED. IT'S GOING TO BE VERY LIMITED FOR ANY PUBLIC OPPORTUNITIES. BUT WITH THAT SAID, I DON'T SEE OUR BOARD CHOOSING A FOR PROFIT. OUR BOARD IS VERY MUCH ALIGNED WITH THE COMMUNITY NEEDS OF A NOT FOR PROFIT. AND I THINK THAT PHILOSOPHICALLY, WHEN YOU HAVE A MERGER OR ACQUISITION AFFILIATION, I THINK, YOU KNOW, PHILOSOPHICAL ALIGNMENT IS CRITICAL. AND SO THAT IS SO BOTH THE OTHER HEALTH SYSTEMS HERE IN THIS COUNTY ARE THE BIG ONES ARE ALSO NOT FOR PROFIT, ALTHOUGH THEY ARE PRIVATE. SO YEAH. GREAT. THANK YOU. I JUST HAVE COMMENTS NEXT. THANKS. OKAY. IS THIS FACILITY GOING TO BE ABLE TO ACCEPT 51 50S FROM POLICE OFFICERS DIRECTLY FROM THE STREET TO YOUR FACILITY? SO IT'S DESIGNED NOT TO BE IT'S DESIGNED TO BE ALLOW THE 51 50S TO GO CURRENTLY. TO WHERE TO OFFLOAD EMERGENCY DEPARTMENTS THAT ARE OVERWHELMED AND HAVE 51 50S SITTING THERE FOR DAYS AND THEN ALLOW MORE CAPACITY IN THAT SETTING. SO THAT IS THE INTENT. HOWEVER, THERE IS CONVERSATION ABOUT DIRECT TO PHFS SPECIFICALLY IN THE STATE. AND SO THAT IS A CONVERSATION THAT IS ACTIVELY OCCURRING AND MAY OCCUR. BUT IN ITS CURRENT FORM, IT WAS DESIGNED AS A PROVIDER TO PHF PHYSICIAN CONVERSATION, TO ACCEPT. THANK YOU. AND FOR THE BENEFIT OF THE AUDIENCE. ONE OF THE THINGS THAT WE KEEP TALKING ABOUT IS THIS 5150 JUST A VERY BRIEF EXPLANATION. IF OUR POLICE OFFICERS AND THE STREETS ENCOUNTER SOMEBODY WHO HAS EMOTIONAL PROBLEMS OR HAS OTHER ISSUES IN THEIR LIVES THAT THEY CAN'T CARE SAFELY FOR THEMSELVES, THE LAW ALLOWS US TO TAKE THEM INTO CUSTODY AND DELIVER THEM TO A PSYCH UNIT TO SO THEY'LL BE SAFE AND POSSIBLY GET SOME MORE TREATMENT. ALSO IT'S VERY COMMON FOR OUR POLICE OFFICERS TO ARREST SOMEBODY AND BOOK THEM INTO THE JAIL. AND BECAUSE OF A INJURY OR AN ILLNESS THERE, THE OFFICER HAS TO THEN TAKE THE PRISONER TO THE HOSPITAL TO GET TREATED AND THEN BACK TO THE JAIL AND DOCTOR MA, THANK YOU SO MUCH FOR LISTENING TO ME. WHEN I'VE MET WITH YOU AND TOLD YOU, MY BIGGEST CONCERN WAS THE AMOUNT OF TIME OUR OFFICERS AND OUR FIREMEN ARE OFF THE STREETS, SITTING IN AN EMERGENCY ROOM FOR HOURS AND HOURS AND HOURS, AND THEY'RE NOT ABLE TO BE OUT ON THE STREETS DOING WHAT THEY'RE SUPPOSED TO BE DOING. SO THANK YOU FOR LISTENING. I LOOK FORWARD TO SEEING THE CHANGES WITHIN THE ER DEPARTMENT. I'D LIKE TO SEE OUR FIREMEN OFFLOAD THEIR, PATIENTS QUICKER SO THEY CAN GET BACK AND BE READY FOR THE NEXT ONE. AND TO SEE OUR OFFICERS BE ABLE TO GET THE THE THEIR NEEDS FULFILLED SO THEY CAN GET BACK ONTO THE STREET. SO THANK YOU AS A PARTNERSHIP, OUR RESIDENTS. THANK YOU FOR THAT. ANY OTHER COMMENTS FROM COUNCIL? MISS BHAT-PATEL? SURE. THANK YOU. THANK YOU AGAIN FOR BEING HERE, AND I'M LOOKING FORWARD TO HEARING AND SEEING UPDATES AS THEY MOVE ALONG. I THINK ONE OF THE THINGS THAT I'M HOPING FOR IS MORE DIALOG AS THIS CONTINUES TO MOVE FORWARD. [00:50:07] I KNOW THAT OUR RESIDENTS, AT LEAST ESPECIALLY WITH MY PUBLIC HEALTH BACKGROUND, THEY'RE ALWAYS ASKING WHAT'S GOING ON WITH TRI-CITY. AND SO I THINK IT WOULD BE REALLY GREAT TO BE ABLE TO CONTINUE TO HAVE THIS GREAT PARTNERSHIP THAT WE HAVE. AND IF THERE'S A WAY TO GET UPDATES REGULARLY, I THINK THAT WOULD BE REALLY GREAT AGAIN, FOR OUR COMMUNITY TO HEAR AS THINGS ARE GOING FORWARD, ESPECIALLY IN THE BEHAVIORAL HEALTH ASPECT. WE I KNOW WE'RE ALL, YOU KNOW, SEEING A LOT MORE DIALOG AROUND THAT THROUGHOUT THE STATE AND ESPECIALLY HERE IN OUR COUNTY AS WELL. AND I THINK IT'S SO IMPORTANT FOR US TO MAKE SURE THAT WE'RE HAVING THOSE CONVERSATIONS AROUND WHAT SOLUTIONS WE'RE OFFERING FOR OUR COMMUNITY. AND THEN I THINK THE OTHER PIECE IS, I THINK IT WOULD BE GREAT FOR ALL OF US TO SEE. I KNOW I'VE BEEN TO THE FACILITY, OF COURSE, BUT I'M SURE IT WOULD BE GREAT FOR ALL OF US TO AT SOME POINT SEE, YOU KNOW, TRI-CITY MEDICAL CENTER IF WE HAVEN'T ALREADY. BUT I THINK JUST AS AS THINGS MOVE ALONG AGAIN, IF THERE'S AN OPPORTUNITY FOR US TO COME VISIT, I THINK THAT WOULD BE SOMETHING THAT I JUST WANT TO PUT A PLUG OUT THERE FOR. BUT OTHER THAN THAT, THANK YOU SO MUCH AND LOOKING FORWARD TO HEARING BACK. ANY OTHER COMMENTS FROM COUNCIL? THANK YOU SO MUCH, MR. MA. THANK YOU FOR TAKING THE TIME TO COME HERE AND SHARE THE INFORMATION. THANK YOU SO MUCH FOR YOUR THOUGHTFUL QUESTIONS AND INTEREST, AND I WOULD LOVE TO INVITE YOU ALL TO A TOUR OF THE FACILITY. IT'S SLATED TO OPEN AGAIN PROBABLY JANUARY, SO PROBABLY BEFORE WOULD BE WONDERFUL IF YOU WOULD SO DESIRE WE'D BE GLAD TO DO SO. THANK YOU AGAIN. THANK YOU. APPRECIATE YOUR TIME. NEXT IS ITEM NUMBER SIX. [6. PROGRESS REPORT ON ACTIONS TO ADDRESS CONCERNS RELATED TO THE WINDSOR POINTE AFFORDABLE HOUSING PROJECT – Receive a progress report on City Council-directed actions related to the Windsor Pointe Affordable Housing Project. (Staff contact: Mandy Mills, Community Services)] CITY MANAGER, PLEASE. YES. ITEM NUMBER SIX IS A PROGRESS REPORT ON ACTIONS TO ADDRESS CONCERNS RELATED TO THE WINDSOR POINTE AFFORDABLE HOUSING PROJECT MAKING OUR PRESENTATION TODAY IS OUR HOUSING AND HOMELESS SERVICES DIRECTOR, MANDY MILLS. MANDY. GOOD EVENING, MAYOR AND CITY COUNCIL MEMBERS. MY NAME IS MANDY MILLS. I'M THE DIRECTOR OF HOUSING AND HOMELESS SERVICES. AND AS THE CITY MANAGER MENTIONED, I WILL BE GIVING THE CITY COUNCIL AN UPDATE ON THE ACTIONS THAT THE CITY COUNCIL DIRECTED CITY STAFF TO TAKE ON AUGUST 20TH TO ADDRESS CONCERNS ABOUT WINDSOR POINTE APARTMENTS. SO THERE IS THIS IS INFORMATIONAL UPDATE. SO THERE IS THE RECOMMENDED ACTION IS TO RECEIVE THE REPORT. A LITTLE BIT OF BACKGROUND REGARDING WINDSOR POINTE. IT IS AN AFFORDABLE HOUSING PROJECT THAT OFFERS SUPPORTIVE SERVICES. FROM THE VERY BEGINNING STAGES OF THIS PROJECT, THE CITY HAS HEARD SAFETY CONCERNS FROM THE NEIGHBORS. STAFF HAS WORKED WITH AFFIRMED HOUSING TO ADDRESS MANY CONCERNS AND WE'VE MADE PROGRESS IN SOME AREAS. IT IS IMPORTANT TO NOTE THAT THIS IS NOT A FACILITY. I KNOW FOLKS OFTEN REFER TO IT AS A FACILITY. IT IS AN APARTMENT BUILDING, SO THERE ARE FAIR HOUSING LAWS AND OTHER REGULATIONS REGARDING THE FUNDING THAT WAS USED TO BUILD THIS PROJECT THAT COME INTO THE EQUATION WHEN IT COMES TO TRYING TO ADDRESS SOME OF THE CONCERNS. CITY STAFF ALSO FOLLOWED THE PROCEDURES IN OUR GOVERNING DOCUMENTS, SO THE GROUND LEASE AND OTHER LOAN DOCUMENTS TO REMEDY SOME OF THE ISSUES. SOME CONCERNS ALSO ARE ADDRESSED BY OTHER ENTITIES OUTSIDE THE CITY. SO, FOR EXAMPLE, THE COUNTY OF SAN DIEGO, WHICH PROVIDES SERVICES TO RESIDENTS THERE, HAS INCREASED THE LEVEL OF SUPPORT PROVIDED BECAUSE THE COUNTY IS THE SERVICE PROVIDER FOR THAT PROJECT. SO A LITTLE MORE BACKGROUND. SO IN MARCH OF THIS YEAR, THE CITY COUNCIL REVIEWED THE STATUS OF STAFF'S EFFORTS TO RESOLVE SOME CONCERNS HERE DIRECTLY FROM THE COMMUNITY AND TO DISCUSS SOME OPTIONS FOR MOVING FORWARD. THE CITY COUNCIL GAVE STAFF DIRECTION TO PURSUE SOME VERY SPECIFIC ACTIONS AND RETURN WITH REGULAR UPDATES TO CHECK PROGRESS. AND BASED ON PROGRESS MADE AND NEW INFORMATION SHARED CITY COUNCIL THEN PROVIDED FURTHER DIRECTION TO STAFF AT EACH OF THESE SUBSEQUENT MEETINGS. SO SINCE MARCH WE HAVE BEEN BACK. BETWEEN MARCH AND NOW, THIS WILL BE OUR FIFTH TIME WITH AN UPDATE. AND AT THE AUGUST 20TH MEETING, THE COUNCIL DIRECTION AT THAT MEETING WAS TO SEE WHAT GROUNDS EXIST WITHIN OUR CONTRACTS RELATED TO THIS PROJECT TO REPLACE THE PROPERTY PROJECT MANAGEMENT COMPANY AND THEN TO PURSUE MAKING THAT CHANGE IF POSSIBLE. ADDITIONALLY, CITY COUNCIL ALSO DIRECTED STAFF TO REVIEW THE MANAGEMENT AGREEMENT TO SEE IF CHANGE OR THE MANAGEMENT PLAN TO SEE IF CHANGES COULD BE MADE TO ADDRESS 24 HOUR SECURITY. BEYOND WHAT IS REQUIRED BY LAW. [00:55:01] OPERATIONS AT WINDSOR POINTE MUST ALSO CONFORM TO VARIOUS CONTRACTUAL AGREEMENTS BETWEEN THE CITY AND AFFIRMED HOUSING. THESE AGREEMENTS WERE PUT INTO PLACE AS PART OF THE PROJECT'S FINANCING AND GROUND LEASE. THE CITY OWNS THE PROPERTY AND LEASES IT TO AFFIRMED HOUSING. SO SHORTLY AFTER THE CITY COUNCIL DIRECTION IN AUGUST, THE CITY ATTORNEY AND CITY MANAGER FOLLOWED THE PROCEDURES OUTLINED IN THOSE GOVERNING DOCUMENTS TO NOTIFY AFFIRMED HOUSING OF THE CITY'S MANAGEMENT AND OPERATIONAL EXPECTATIONS. CITY STAFF AND AFFIRMED HOUSING ARE STILL WORKING ON SOME OF THE ITEMS OUTLINED BY THE CITY IN THOSE LETTERS. THE OTHER SIGNIFICANT PART OF THE CITY COUNCIL DIRECTION FROM AUGUST RELATED TO THE REQUEST TO CHANGE THE MANAGEMENT AGENT. THE PROCESS TO CHANGE THE MANAGEMENT AGENT IS OUTLINED IN OUR CONTRACTUAL AGREEMENTS SINCE AUGUST 20TH. THE FIRST TWO STEPS MENTIONED NOTICED HERE HAVE BEEN COMPLETED AND THE THIRD STEP IS UNDERWAY. IF ALL OTHER FUNDING ENTITIES APPROVE OF THE NEW PROVIDER, WE ANTICIPATE THE NEW COMPANY WOULD BE IN PLACE AS SOON AS NOVEMBER. ONCE THE NEW MANAGEMENT AGENT IS ON BOARD, A NEW MANAGEMENT PLAN WILL BE DRAFTED BETWEEN THAT NEW AGENT AND AFFIRMED HOUSING. WE WILL ALSO BE REVIEWING THAT MANAGEMENT PLAN AND REVIEWING FOR COMMENT AND POSSIBLY AN EVENTUAL CONSENT. WE MUST OBTAIN. WE MUST PROVIDE APPROVAL FOR THAT WITHIN 120 DAYS FROM THE SUBMISSION. WE HOPE IT TO BE MUCH SOONER THAN THAT. BUT THAT IS KIND OF THE OUTER END OUTLINED IN OUR DOCUMENT. AND I JUST WANT TO POINT OUT AT ALL THESE MEETINGS THAT WE HAVE BEEN, PROVIDING THE UPDATES, THE CITY COUNCIL ALONG THESE PAST FEW MONTHS HAVE BEEN GIVING, YOU KNOW, A NUMBER OF DIRECTION SINCE THEN AND A NUMBER HAVE ACTIONS HAVE TAKEN PLACE. I KNOW FOR SOME FOLKS IT FEELS LIKE IT HAS BEEN A LONG TIME, AND THESE ARE JUST SOME OF THE CHANGES THAT HAVE BEEN MADE. AND SOME THINGS, AS I MENTIONED, JUST REQUIRE REQUIRE CERTAIN NUMBER OF DAYS FOR CONSENT OR APPROVAL OR OTHER FUNDING AGENCIES TO REVIEW. THERE ARE CERTAIN PROCUREMENT PROCEDURES THAT TAKE SOME TIME. FOR EXAMPLE, EVEN JUST UPDATING THE NEW TO A NEW MANAGEMENT AGENT. IT HAS ONLY BEEN 60 DAYS REALLY SINCE THAT DATE IN AUGUST, AND APPROVAL OF THE NEW MANAGEMENT COMPANY IS ALMOST COMPLETE. SO ACTUALLY THAT IS IT MAY NOT SOUND QUICK TO SOME PEOPLE, BUT THAT ACTUALLY TO BE ABLE TO PROVIDE NOTICE TO THE PRIOR AGENT AND THEN TO FIND A NEW ENTITY AND THEN TO SEND OUT ALL THE DOCUMENTS FOR REVIEW, HAS BEEN QUITE A QUICK PROCESS. IN ADDITION TO THOSE ACTIONS, IN AUGUST AT THE CITY COUNCIL REQUESTED, WE ALSO JUST WANTED TO PROVIDE SOME UPDATES ON TWO OTHER ITEMS. ONE IS REGARDING THE COUNTY OF SAN DIEGO ACTIONS, AND THEY THE COUNTY OF SAN DIEGO DID SUBMIT A LETTER TO THE CITY RECENTLY. AND SO OVER THE PAST FEW MONTHS, THE COUNTY OF SAN DIEGO HAS INCREASED ON SITE SUPPORTIVE SERVICES AND THE BOARD OF SUPE RVISORS IN APRIL REQUESTED THAT THE COUNTY ENHANCE CLINICAL SUPPORT SERVICES TO THE PROJECT SEVEN DAYS A WEEK. SO FAR, COUNTY STAFF HAVE NOT IDENTIFIED FUNDING TO COVER THE COSTS, BUT WILL CONTINUE TO SEEK FUNDING TO SUPPORT THAT REQUEST. THE OTHER MAIN ISSUE HAS BEEN LOOKING INTO LONG TERM SOLUTIONS THAT WILL HELP INCREASE THE NUMBER OF VETERANS AT WINDSOR POINTE. SO AT THE FEDERAL LEVEL, HUD ANNOUNCED A CHANGE IN AUGUST THAT THE VA DISABILITY BENEFITS WILL NOT BE COUNTED TOWARDS THAT MAXIMUM INCOME, SO THAT JUST DOES HELP MORE RESIDENTS QUALIFY FOR AFFORDABLE HOUSING. ADDITIONALLY, ON SEPTEMBER 9TH, GOVERNOR NEWSOM SIGNED INTO LAW A SIMILAR PROVISION AT THE STATE LEVEL, WHICH WILL APPLY TO STATE FUNDED PROJECTS LIKE, WINDSOR POINTE. SO THAT WAS ONE THING IN THE PAST THAT WAS PREVENTING SOME PEOPLE FROM QUALIFYING BECAUSE WITH THEIR DISABILITY BENEFITS, IT ACTUALLY DID PUT THEM SLIGHTLY OVER THE MAXIMUM. SO THIS WOULD ACTUALLY HELP MORE PEOPLE QUALIFY. IN ADDITION TO THAT, AFFIRMED HOUSING IS PLANNING ON APPLYING FOR PROJECT BASED HOUSING VOUCHERS THROUGH A PROGRAM KNOWN AS VASH, WHICH IS THE VETERANS AFFAIRS SUPPORTIVE HOUSING PROGRAM. SO THIS IS ADMINISTERED BY THE COUNTY OF SAN DIEGO AND SERVICES ARE PROVIDED BY THE VETERANS ADMINISTRATION. SO IF AWARDED, WE WOULD FIND OUT IN JANUARY IF THE COUNTY OF SAN DIEGO DID AWARD VOUCHERS TO WINDSOR POINTE, AND THEN [01:00:08] REFERRALS WOULD BE THESE WOULD BE REQUIRED TO BE VETERANS, NOT AS RIGHT NOW IT IS A PREFERENCE THAT WOULD BE A REQUIREMENT. SO OBVIOUSLY MORE VETERANS WOULD BE AT THE PROPERTY, ESPECIALLY ON THAT NO PLACE LIKE HOME SIDE RIGHT NOW WE ONLY HAVE VETERANS ON THE TAX CREDIT SIDE, THE GENERAL AFFORDABLE SIDE, BECAUSE THE INCOME QUALIFICATION IS A LITTLE BIT HIGHER ON THAT SIDE AT THIS POINT IN TIME. THE OTHER BENEFIT IS THAT VETERANS IN THESE UNITS ARE REQUIRED TO BE CASE MANAGED. SO THEY ACTUALLY WOULD BE HAVING A MONTHLY CASE MANAGEMENT, AT LEAST ONE MONTHLY CASE MANAGEMENT MEETING. SO IF THOSE ARE APPROVED, THE CITY IS REQUIRED TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE COUNTY OF SAN DIEGO TO BE ADMINISTER THOSE VOUCHERS IN THE CITY. SO WE WOULD BE COMING BACK TO THE HOUSING COMMISSION AND THEN TO THE CITY COUNCIL FOR APPROVAL OF THAT. SO OBVIOUSLY OUR WORK HERE IS NOT DONE. WE STILL HAVE MORE TO DO, BUT WE WILL CONTINUE TO IMPLEMENT THE IDENTIFIED ACTIONS THAT HAS BEEN REQUESTED BY THE CITY COUNCIL. WE'LL CONTINUE TO MONITOR OUR STATISTICS AND TRENDS AND CONTINUE TO WORK CLOSELY WITH WINDSOR POINTE. THE NEW PROPERTY MANAGEMENT COMPANY AND THE COUNTY OF SAN DIEGO TO ADDRESS ANY ISSUES. WE LOOK FORWARD TO RETURNING BACK WITH AN UPDATE TO THE CITY COUNCIL ONCE THE NEW MANAGEMENT COMPANY HAS COME ON BOARD AND HAS OPPORTUNITY TO ASSESS OPERATIONS AND MAKE ANY CHANGES. AND WITH THAT, I AM AVAILABLE FOR ANY QUESTIONS YOU MIGHT HAVE. CALL SPEAKERS PLEASE. LORI ROBBINS, FOLLOWED BY SETH HOLLER. GOOD EVENING. LORI ROBBINS, RESIDENT OF CARLSBAD. I URGE THE MAYOR AND COUNCIL TO DIRECT STAFF TO DEVELOP CLEAR AND IMMEDIATE ACTIONS TO RESOLVE THE SITUATION AT WINDSOR POINTE. THIS REPORT FAILS TO DO THIS. THE REPORT SAYS AFFIRMED HAS AGREED TO REPLACE KHAN AM, BUT ONLY ONCE ALL THE FUNDERS AGREE. THE REPORT DOES NOT SPECIFY WHO THESE FUNDERS ARE. IT DOES NOT SAY WHO WILL GET THAT AGREEMENT. IT DOES NOT AGREE TO ANY TIMELINE THAT THIS WILL HAPPEN IN. IT IS INCREDIBLY VAGUE. ACTIONS REQUIRE PRECISE LANGUAGE. STAFF NEEDS TO SHARPEN THEIR PENCILS AND GET INTO THE DETAILS OF THIS IMPORTANT ISSUE. AFFIRMED IS PUSHING BACK AGAINST THE CITY'S REQUEST FOR MORE SECURITY AND SERVICES BY SAYING THE SPENDING REQUIRED IS BEYOND INDUSTRY STANDARDS. BUT NEVER PROVIDES THE STANDARD FOR THE SEVERELY MENTALLY ILL. THE REPORT STATES THAT THEY WILL CONTINUE TO NEGOTIATE TO GET BETTER LANGUAGE. BETTER LANGUAGE, BETTER LANGUAGE IS NOT THE RIGHT GOAL. STAFF NEEDS TO HOLD A FIRM'S FEET TO THE FIRE AND GET THEM TO MEET THEIR CONTRACTUAL OBLIGATIONS. A FIRM TOOK MONEY FROM THE CITY AND THE COUNTY TO PROVIDE SAFE AND DECENT HOUSING FOR SEVERELY MENTALLY ILL PEOPLE. AFFIRMED IS FAILING BADLY ON THIS COMMITMENT. THE METRICS ARE ONE AND A HALF POLICE CALLS PER DAY. CLEARLY, THE RESIDENTS ARE NOT HAPPY. FURTHER, RESIDENTS IN THE SURROUNDING COMMUNITY ARE ALSO UNHAPPY AND FREQUENTLY SHARE THEIR HORRIFIC STORIES. WINDSOR POINTE RESIDENTS AND THE SURROUNDING COMMUNITY ARE BEING UNDERSERVED BY A FIRM'S LACK OF SPENDING. COUNCIL, PLEASE DIRECT CITY STAFF TO DEMAND A FIRM SPEND THE MONEY REQUIRED TO MEET THE TERMS OF THE CONTRACT, AND PROVIDE SAFE HOUSING FOR THE LOW INCOME AND SEVERELY MENTALLY ILL RESIDENTS WHO LIVE THERE. FURTHER COUNCIL PLEASE KEEP FOCUS ON THIS ISSUE AND REJECT STAFF'S PROPOSAL TO PROPOSE TO POSTPONE ANY FURTHER UPDATES UNTIL A NEW MANAGEMENT COMPANY HAS BEEN SELECTED AND HAS TIME TO OPERATE. DIRECT STAFF TO REPORT BACK WITHIN THE NEXT 30 DAYS, INCLUDE METRICS AND NOT KICK THE CAN DOWN THE ROAD. [01:05:05] THANK YOU. SETH HOLLER. THANK YOU. SETH HOLLER. I LIVE NEXT TO WINDSOR POINTE, ALMOST DIRECTLY ACROSS THE STREET. THE LEVEL OF CONTEMPT THAT AFFIRMED HOUSING HAS SHOWN TO CARLSBAD COUNCIL AND ITS RESIDENTS IS EXTREMELY CONCERNING, AS STATED BY A FIRM HOUSING IN THEIR LETTER TO THE CITY COUNCIL, THE GROUND LEASE DOES NOT REQUIRE THE TENANT AFFIRMED HOUSING TO IMPLEMENT ALL CITY RECOMMENDATIONS, NOR DOES THE TENANT BELIEVE IT WOULD BE PRUDENT TO DO SO. AFFIRMED HOUSING COMPLETELY DUPED THE CITY COUNCIL INTO FUNDING WINDSOR POINTE BY UTTERLY DOWNPLAYING THE NUMEROUS COMMUNITY CONCERNS ABOUT IT, WHICH HAVE UNFORTUNATELY BEEN MUCH WORSE THAN WE COULD HAVE EVER IMAGINED. SUBSEQUENTLY, THE CITY BLINDLY SIGNED AWAY A PIECE OF OUR GREAT CITY TO AFFIRMED HOUSING TO DO AS THEY WILL WITH THROUGH WHAT THEY FEEL IS AN UNBREAKABLE GROUND LEASE. AFFIRMED HOUSING IS NOW IN A POSITION WHERE THEY BELIEVE THEY CAN DISREGARD THE WANTS AND NEEDS OF THE CITY COUNCIL AND CARLSBAD RESIDENTS WITH NO REPERCUSSION. AS A FOR PROFIT COMPANY, AFFIRMED HAS SHOWN IT ONLY CARED AND CONTINUES TO CARE ABOUT ONE THING. PROFITING OFF THIS ENDEAVOR AT THE COST OF ALL OTHERS. THEY CLEARLY DO NOT CARE ABOUT THE SAFETY AND WELL-BEING OF THE RESIDENTS OF WINDSOR POINTE OR THE SURROUNDING COMMUNITY. THE FACILITY IS NOT BEING MAINTAINED. PEOPLE ARE ODYING, DEALING DRUGS AND BEING PHYSICALLY AND SEXUALLY ASSAULTED INSIDE THE WALLS. AFFIRMED IS GETTING APPROXIMATELY $500,000 A YEAR TO MANAGE THIS PROPERTY. WHY IS THERE NOT A FULL TIME PROPERTY MANAGER AT EACH SITE, AS STIPULATED IN THE PROJECT'S FUNDING DOCUMENTS? WHERE IS THE ONGOING UPKEEP STIPULATED IN THE PROJECT FUNDING DOCUMENTS? WHY IS NOTHING BEING ADDRESSED UNTIL IT IS BROUGHT TO THE ATTENTION TO AFFIRMED HOUSING ATTENTION. WHERE EXACTLY IS ALL THE MONEY GOING? I MUST INSIST THAT THE CITY COUNCIL VOTE TO DO AN INDEPENDENT FINANCIAL AUDIT OF WINDSOR POINTE TO ASCERTAIN IF AFFIRMED HOUSING IS SIPHONING FUNDS FROM THIS PROJECT. THANK YOU VERY MUCH. ANGIE. ANGIE FRICK, FOLLOWED BY TYLER COLLINS. TYLER COLLINS. GOOD EVENING COUNCIL. SO MY NAME IS TYLER COLLINS, AND I COME HERE TONIGHT TO DISCUSS WINDSOR POINTE. SO WE'VE HEARD FROM OTHER PEOPLE SPEAKING TODAY AND AFFIRMED HOUSING CONTINUES TO GIVE US THE RUNAROUND. I REALLY YOU KNOW, WE SAW THIS PROGRESS REPORT, BUT I DON'T SEE VERY MUCH PROGRESS OCCURRING. YOU KNOW, THERE ARE REPORTS OF THE HARDING STREET PROPERTIES, FRONT GATE BEING OPEN ALL DAY ON OCTOBER 5TH AND SIXTH, AND THIS HAS BEEN DOCUMENTED WITH PHOTOGRAPHIC EVIDENCE. WHERE ARE THE SECURITY GUARDS THAT WERE SUPPOSEDLY SUPPOSED TO BE THERE DURING THE DAY? WERE THEY OUT IN THEIR CARS OFF THE JOB? I DON'T KNOW, BUT NOW AFFIRMED IS REPLACING CONAM WITH ANOTHER MANAGEMENT COMPANY, SOLARI. BUT THAT REALLY BEGS THE QUESTION DOES THIS COMPANY HAVE EXPERIENCE SERVING SMI SEVERELY MENTALLY ILL INDIVIDUALS? UNLESS SOLARI HAS ADEQUATE EXPERIENCE WITH THESE INDIVIDUALS, I DON'T THINK WE'RE GOING TO GET A DIFFERENT OUTCOME. AND FOR THAT REASON, I'M NOT SURE WE CAN REALLY WAIT TO GO ANOTHER SIX MONTHS AND EVALUATE HOW THIS MANAGEMENT COMPANY IS DOING. WE NEED ONGOING REPORTS. WE OWE IT TO THE COMMUNITY. WE OWE IT TO THE NEIGHBORS AND THE RESIDENTS WHO ARE SUFFERING THERE. SO I IMPLORE COUNCIL TO CONTINUE TO MONITOR THIS. AND I KNOW A LOT OF YOU GUYS ARE DOING YOUR BEST. SO LET'S JUST KEEP IN MIND OUT FOR THESE PEOPLE, REAL INDIVIDUALS WHO ARE SUFFERING EVERY DAY. THANK YOU. THOMAS KRAUS FOLLOWED BY JEAN WALKER. HI AGAIN. I JUST WANTED TO COMMENT PRIMARILY ON THE THEME OF TRANSPARENCY. AND SO WITH RESPECT TO THE WINDSOR POINTE. AGAIN, AS I MENTIONED EARLIER, IT WAS DIFFICULT JUST TO FIND THE MATERIALS ON A PROJECT LIKE THIS AND A LONG AGENDA PACKET. SO I'D RECOMMEND TO MAKE IT EASIER FOR THE GENERAL PUBLIC TO HAVE A TABLE OF CONTENTS WITH THE AGENDA PACKET. BUT AS WELL ON THE FINANCIAL DIMENSIONS, AS I UNDERSTAND THAT THE CITY HAS AN INVESTMENT IN WINDSOR POINTE OR PROVIDED SOME SORT OF LOAN FACILITY TO [01:10:05] THE PROJECT, AND AT LEAST AS OF THE LAST REPORT THAT I LOOKED AT, THERE WERE A NUMBER OF THESE SORTS OF LOCAL INFRASTRUCTURE PROJECTS THAT THE CITY ACTUALLY HAS AN INVESTMENT IN. NOT ALL OF WHICH ARE MAKING REGULAR PAYMENTS. SO JUST ON THE DIMENSION OF ADDING ADDITIONAL CONTROL AND FLEXIBILITY ON BEHALF OF THE COUNCIL TO ACT ON BEHALF OF THE CITY. AGAIN, I'M NOT PRIVY TO THE CONTRACTUAL TERMS OF THESE FINANCIAL ARRANGEMENTS, BUT IF YOU'RE LENDING PEOPLE MONEY, TYPICALLY, YOU KNOW, YOU CAN INCLUDE IN YOUR COVENANTS, YOU KNOW, WHATEVER SORT OF TRIGGERS THAT YOU NEED RECOGNIZING THAT FUNDING MAY BE COMING FROM MULTIPLE SOURCES, AND MAYBE THESE COVENANTS NEED TO BE COORDINATED. AGAIN, THAT'S A LITTLE BIT OUTSIDE OF MY LANE. BUT CERTAINLY IF WE'RE GOING TO BE PUTTING THE CITY'S RESERVE FUNDS, IN ESSENCE, INTO THESE PROJECTS AND THEY'RE BEING TRACKED AND REPORTED ON ON THE INVESTMENT REPORTS, SO I ASSUME THAT THE COUNCIL SEES THESE AS INVESTMENTS. WE SHOULD CERTAINLY OUGHT TO BE LEVERAGING OUR DOLLARS WITH OUR POLICY DESIRES AND ACCOUNTABILITY. THANK YOU. HI. IN AFFIRMS RESPONSE TO THE CITY OF CARLSBAD, AFFIRMED ARGUES THAT BROKEN GATES, ENTRY DOORS, AND STAIRWELL DEBRIS DO NOT CONSTITUTE VIOLATIONS OF THE GROUND LEASE. THIS IS AN ISSUE OF SEMANTICS THAT SHOULD HAVE BEEN ADDRESSED AT THE TIME OF THE GROUND LEASE SIGNING. IT'S PART OF THE NEGOTIATION THAT YOU GO THROUGH WITH ANY LEASE. THE CITY ATTORNEY SHOULD HAVE RECOGNIZED THIS ISSUE AS ANY COMPETENT ATTORNEY WOULD HAVE. AND SHE IN FACT, IF SHE IN FACT READ THE GROUND LEASE PRIOR TO SIGNING IT, AFFIRMED STATES THAT THEY DO NOT PROVIDE 24 HOUR SCREENING BY ON SITE MANAGEMENT AND SECURITY STAFF BECAUSE OF ISSUES RELATED TO RESIDENT PRIVACY. FIRST, AFFIRMED PROVIDES THIS KIND OF SECURITY AND ANOTHER FACILITY IN SAN DIEGO. IT'S CALLED STUDIO 15. YOU CAN GO READ THE REVIEWS FOR THE PEOPLE THAT LIVE THERE ONLINE, AND THEY'LL TELL YOU WHAT THE PROTOCOLS ARE. SECOND, THEY HAD AFFIRMED IN RECENT YEARS HAS GIVEN $600,000 IN POLITICAL DONATIONS ALL OVER CALIFORNIA FOR THEM TO SAY THEY DON'T HAVE THE MONEY FOR ONSITE SECURITY THEY HAVE TO PRIORITIZE WHERE THEY SPEND THEIR MONEY. I AGREE WITH THAT. FINALLY, I RECENTLY DROPPED MY SON OFF AT COLLEGE AT HIS DORM. THE DORM HAS AN ALARMED ACCESS WITH KEY FOBS ONLY. THERE IS 24 HOUR SECURITY IN THE DORM. WHEN YOU ENTER THE DORM, THERE IS SOMEONE WORKING AT THE SERVICE DESK 24 OVER SEVEN. HOW A FACILITY FOR PEOPLE WITH SERIOUS MENTAL ILLNESS IS LESS SECURE THAN MY KID'S DORM IS INCREDIBLE TO ME. AFFIRMED ARGUES THAT THE CITY ENTERED THE GROUND LEASE WITH FULL KNOWLEDGE OF THE INTENDED POPULATION. THAT IS NOT TRUE. EACH OF THE COUNCIL MEMBERS, INCLUDING THE ONES ON THE DAIS TODAY WHO VOTED FOR THIS PROJECT, HAVE STATED THAT THEY WERE NEVER FULLY INFORMED REGARDING THE NO PLACE LIKE HOME FUNDING OR HOW IT WOULD OPERATE. EMAILS UNCOVERED FROM THE PUBLIC RECORDS ACT REQUESTS DEMONSTRATE THAT AFFIRMED PLACE MORE AND MORE PRESSURE ON CITY STAFF TO ALLOW A WORKSHOP FOR WP UPDATES IN EARLY 2020, RATHER THAN DOING AN UPDATE DURING A CITY COUNCIL MEETING TO THE POINT WHERE JIMMY SILVERWOOD, THE SON, EMAILED CITY STAFF STATING THAT THE ISSUE HAD NOW ESCALATED TO HIS FATHER'S LEVEL, APPARENTLY MEANING THAT IF DADDY IS INVOLVED, IT'S A REALLY BIG DEAL. THE ONLY ENTITY WHO ENTERED INTO THIS AGREEMENT WITH FULL KNOWLEDGE OF HOW NO PLACE LIKE HOME FUNDING WOULD WORK WAS AFFIRMED WITHIN FOUR MONTHS OF OPENING AFFIRMED SENT THE CITY A LETTER STATING THEY COULD NOT DEAL WITH THIS POPULATION. AT THAT POINT AFFIRMED GAVE UP AND HOISTED RESPONSIBILITY ONTO THE CITY. A COUPLE OF YEARS AGO, JAMES SILVERWOOD SUED HIS NEXT DOOR NEIGHBOR OVER HIS NEIGHBOR'S CONSTRUCTION OF A WORKOUT ROOM, STATING THAT HE COULDN'T HAVE QUIET ENJOYMENT OF A SUNSET THE ENTIRE CITY IS NOW NOT ENJOYING THERE. THERE ARE NO MORE SPEAKERS. QUESTIONS OF COUNCIL. MISS BURKHOLDER. THANK YOU. THANK YOU MANDY. THANK YOU COUNCIL. THIS IS NUMBER FIVE OR WHATEVER WE'RE ON HERE. I WILL MAKE IT QUICK TONIGHT. I WON'T HAVE 5000 QUESTIONS, BUT SOME OF THE COMMENTS FROM THE PUBLIC DID MAKE ME THINK OF A FEW THINGS, AND I HAVE A FEW THINGS WRITTEN DOWN, AND THESE ARE IN NO PARTICULAR [01:15:07] ORDER RELATIVE TO YOUR REPORT. MISS MILLS, I JUST HAVE A RANDOM ON EACH PAGE. SORRY. ON THE SECOND PAGE OF THE STAFF REPORT, IT SAYS THAT THE PROJECT MET AN IMPORTANT NEED FOR PERMANENT SUPPORTIVE HOUSING IN CARLSBAD FOR PEOPLE WITH VERY LOW INCOMES. THERE HAVE BEEN QUESTIONS ABOUT THE PEOPLE THAT LIVE IN CARLSBAD. AND THE QUESTION I OFTEN GET IS PROBABLY THE MOST IS HOW MANY CARLSBAD PEOPLE ARE ACTUALLY RESIDING IN WINDSOR POINTE. BECAUSE AS THE STAFF HAS LAID OUT IN THIS REPORT, IT MET AN IMPORTANT NEED FOR PERMANENT SUPPORTIVE HOUSING IN CARLSBAD. DOES NOT SAY FOR CARLSBAD RESIDENTS, BUT CURIOUS. RIGHT? AT THE LAST TIME REPORTED WE HAD FIVE INDIVIDUALS, FIVE RESIDENTS WITH A CARLSBAD RELATED PREFERENCE THAT COULD BE LIVING OR WORKING IN CARLSBAD AND AGAIN, KEEP IN MIND WE ARE ONLY ALLOWED THAT LOCAL PREFERENCE ON HALF OF THE UNITS. SO FOR THE NO PLACE LIKE HOME REGULATED UNITS, WE ARE NOT ALLOWED TO HAVE THAT REQUIREMENT. CORRECT. AND THEN WHEN YOU TALK ABOUT THE VETERANS, THE VASH WILL THOSE HAVE THAT PREFERENCE FOR CARLSBAD AS WELL? I COULDN'T REMEMBER WHAT THE REPORT SAYS ON THAT. NO, THAT'S A COUNTY WIDE. IT'S A REGIONAL VOUCHER. AND SO IT'S ANYBODY ON THE WAITING LIST. BUT IT IS A VETERAN REQUIREMENT AS OPPOSED TO A PREFERENCE VETERAN AND SEVERELY MENTALLY ILL. YES. CORRECT. YES. AND THEN IN THE STAFF REPORT, IT DOES SAY THAT THERE WAS AN INSPECTION. I THINK IT'S CALLED AN INSPECTION. YEAH. RECENT CITY STAFF AND POLICE DEPARTMENT RECENTLY INSPECTED THE PROPERTY. IT JUST DOESN'T SAY WHAT LOCATION? IT JUST SAYS THAT THE ALARM ON THE GATE AT [INAUDIBLE] WAS WORKING, BUT IT DOESN'T SAY WHEN THAT HAPPENED OR IF THE HARDING LOCATION WAS INSPECTED AS WELL. JUST FOR CLARIFICATION, YES. SO WE DID CONDUCT INSPECTION OF BOTH LOCATIONS. AND JUST TO CLARIFY, THE THERE REALLY ONLY IS AN ALARM ON THE OAK GATE BECAUSE THE GATE AT HARDING IS ACTUALLY THE ENTRY POINT. SO THERE WOULD BE NO ALARM ON THAT GATE. SO THE OAK LOCATION HAS A SECURE FRONT DOOR. RIGHT. AND THEN THE GATE IS SUPPOSED TO BE EMERGENCY ACCESS IN TERMS OF GETTING IN AND THEN ALSO FOR EXITING. SO THAT HAS AN ALARM IF IT IS OPEN FOR A CERTAIN NUMBER OF SECONDS. CORRECT. YEAH. I REMEMBER GOING OUT TO THE OAK STREET OR THE HARDING STREET LOCATION AND BEING ABLE TO BASICALLY REACH MY HAND OVER, BECAUSE THERE WAS REALLY NO SECURITY ON THAT GATE THERE THAT YOU'RE TALKING ABOUT TO GET INTO. UNFORTUNATELY, WE, THE VILLAGE MASTER PLAN, LIMITS THE HEIGHT OF FENCES AND GATES AND FRONT WALLS, AND SO THERE IS A HEIGHT LIMITATION. GOING BACK ALL THE WAY TO WELL, THIS WASN'T REALLY BUILT FOR THESE TYPE OF PEOPLE WE THOUGHT IT WAS GOING TO BE FOR VETERANS. I HEAR YOU, I HEAR WHAT YOU'RE SAYING. ON PAGE FOUR OF THE STAFF REPORT, WE TALKED ABOUT THIS VISITOR SCREENINGS DUE TO RESIDENT PRIVACY. AND THAT AFFIRMED HAS NOT COMMITTED TO PROVIDING 24 HOUR ONSITE SECURITY AT BOTH LOCATIONS BECAUSE OF, QUOTE, INDUSTRY STANDARDS. IT'S MY UNDERSTANDING THAT THIS IS A BIT OF A PILOT PROJECT. SO WHAT INDUSTRY STANDARDS ARE THEY REFERRING TO? OTHER PERMANENT SUPPORTIVE HOUSING PROJECTS THROUGHOUT THE COUNTY. AND THEY DON'T HAVE 24 HOUR SECURITY 24 HOUR SECURITY. GENERALLY FOR A UNIT OF THIS SIZE WOULD NOT BE WOULD NOT BE IN PLACE. GENERALLY I WOULD AGREE WITH GENERALLY FOR A UNIT THIS SIZE, BUT I DON'T THINK I WOULD AGREE FOR 24 SMI NO PLACE LIKE HOME INDIVIDUALS FOR A UNIT OF THIS SIZE. YEAH. SO FOR EXAMPLE, LIKE IN DOWNTOWN SAN DIEGO WHEN YOU HAVE HUNDREDS OF UNITS AND IN A MORE URBAN DOWNTOWN ENVIRONMENT THEY MIGHT HAVE 24 HOUR SECURITY IN A LOCATION LIKE THAT BECAUSE YOU HAVE FOLKS ENTERING FROM THE STREET. AND I THINK THEY DO. AND AS WE HAVE SEEN, WE HAVE FOLKS ENTERING FROM THE STREET AS WELL. I SAW IT WHEN I WAS THERE, PEOPLE THAT DON'T EVEN LIVE THERE. OKAY. SO THEY DON'T HAVE ANY INDUSTRY STANDARDS REALLY TO SPEAK OF. ONE OF THE THINGS THAT ONE OF THE SPEAKERS BROUGHT UP THAT I THOUGHT WAS VERY INTERESTING WAS THAT IN THE STAFF REPORT, IT DOES STATE THAT WE ARE, YOU KNOW, MOVING FORWARD WITH REPLACING CONAM WITH A DIFFERENT MANAGEMENT COMPANY, SO TO SPEAK. AND SO ONE OF THE THINGS THAT IT SAYS IN THE REPORT THAT ALL FUNDING ENTITIES HAVE TO AGREE. CAN YOU JUST DELINEATE THOSE FUNDING ENTITIES. OF COURSE. SO THERE'S THE TAX CREDIT ALLOCATION COMMITTEE WHICH ARE THE TAX CREDITS. AND THAT'S AN ENTITY AT THE STATE LEVEL. AND THEN THERE'S THE COUNTY OF SAN DIEGO AND THERE'S THE CITY OF CARLSBAD. PERFECT. AND SO IN MY MIND, I THINK WE HAVE 55 YEAR COVENANTS ON THIS GROUND LEASE. AND IN ORDER TO PROPERLY CHANGE THOSE, WE'D HAVE TO HAVE ALL THREE OF THOSE SAME ENTITIES AGREE. IF WE CAN MAKE THIS CHANGE TO REPLACE CONAM, WHO HAS REPEATEDLY NOT DONE WHAT WE ASKED THEM TO DO, WHAT THEY AGREED TO DO, THEN [01:20:09] PERHAPS THERE IS HOPE FOR THE GROUND LEASE. I'M AN ETERNAL OPTIMIST, MISS MILLS. ETERNALLY OPTIMISTIC. THERE HAVE BEEN SOME QUESTIONS AROUND A FIRM BEING EQUIPPED TO HANDLE THIS TYPE OF POPULATION. AS WE KNOW, WE DID RECEIVE A LETTER FROM THEM ABOUT HOW THEY REALLY WEREN'T EQUIPPED TO HANDLE THIS TYPE OF POPULATION. SO I GUESS MY QUESTION WOULD BE HOW WILL WE KNOW IF THE REPLACEMENT AGENCY IS ACTUALLY EQUIPPED TO HANDLE THE POPULATION? SO I THINK THE LETTER THAT SOMEBODY FROM THE PUBLIC WAS REFERRING TO WAS THE LETTER FROM AFFIRMED HOUSING DISCUSSING PERMANENT SUPPORTIVE HOUSING IN GENERAL, JUST OF WHICH MOST AFFORDABLE HOUSING DEVELOPERS WOULD CLARIFY THAT THEY'RE JUST SEVERELY UNDERFUNDED. AND SO THE AMOUNT OF OPERATING RESERVE FUNDS THAT COME FOR PROJECTS LIKE THAT ARE JUST USUALLY NOT ENOUGH TO PROVIDE THE ADEQUATE AMOUNT OF SERVICES. SO IN THIS CASE, WE'RE TALKING ABOUT THE PROPERTY MANAGER. SO YOU KNOW, AT FIRST CONAM WAS YOU KNOW, REVIEWED THEIR EXPERIENCE AND THEIR BACKGROUND AND HAS TREMENDOUS AMOUNT OF EXPERIENCE WITH AFFORDABLE HOUSING, RESTRICTED HOUSING, AFFORDABLE HOUSING COMPLIANCE, AS WELL AS A NUMBER OF PROJECTS THAT OPERATE PERMANENT SUPPORTIVE HOUSING. SO WE ARE GOING THROUGH THAT PROCESS ON THIS REQUEST AS WELL. OKAY. I THINK I HAVE MORE ABOUT THAT A LITTLE BIT LATER, BUT ONE OF THE THINGS THAT I THOUGHT WAS INTERESTING IS ONE OF THE THINGS THAT I THINK WE NEED TO REALLY NOTE IS THAT IN A LETTER FROM THE COUNTY OF SAN DIEGO, APRIL 5, 2024, IT DID INCLUDE TWO MANAGER UNITS, MEANING THAT THERE WOULD BE A MANAGER AT EACH LOCATION. AND WE KNOW THERE'S ONLY ONE MANAGER, THERE'S NOT ONE AT EACH LOCATION, ONE AT HARDING AND ONE AT THE OAK STREET LOCATION. SO IN THEIR OWN LETTER, THEY SAID THAT WOULD BE HAPPENING AS WELL AS ON CAMERA AT A CITY COUNCIL MEETING WHERE THEY AGREED TO THIS UNIQUE OPPORTUNITY TO HAVE A PROPERTY MANAGER AT EACH LOCATION. I DO REMEMBER THAT I THINK IT WAS SEPTEMBER OF 2021. YOU HAD MENTIONED IN YOUR REPORT TO YOU THAT THE GROUND LEASE WE LEASED TO A FIRM. CAN YOU TELL US HOW MUCH WE CHARGE FOR THAT? THE GROUND LEASE IS A DOLLAR A YEAR. YEAH. OKAY. THAT IS A HECK OF A DEAL. IF YOU'RE AFFIRMED HOUSING, I GUESS I SHOULD. I MEAN, I GUESS I'M IN THE WRONG BUSINESS. OKAY. AND THEN WHEN WE TALKED ABOUT THE VASH, I GOT TO GO BACK TO THAT FOR A SECOND BECAUSE IT SAYS THAT IN THE STAFF REPORT, THE PROJECT BASED VOUCHERS UNITS WOULD BE REFERRED OR, SORRY, RESERVED FOR HUD-VASH VETERANS HOUSING REFERRED BY THE SAN DIEGO COUNTY VETERANS AFFAIRS OFFICE. AND MY QUESTION IT DOESN'T ANSWER IN HERE REFERRED TO WHOM IS IT REFERRED TO THE COUNTY FROM VETERANS AFFAIRS OR REFERRED TO YOU AND YOUR DEPARTMENT? THANK YOU FOR THE QUESTION. SO KEEP IN MIND THIS IS A LAYERED ON TOP OF THE NO PLACE LIKE HOME REQUIREMENT. SO THE REFERRAL FROM THE VETERANS ADMINISTRATION IS ON THE VETERANS STATUS. AND THEN THE COORDINATED ENTRY PROCESS ALSO HAS TO AFFIRM THAT THOSE FOLKS HAVE ARE NEXT ON THE LIST FOR PERMANENT SUPPORTIVE HOUSING. SO IT'S ALMOST LIKE A CROSS-REFERENCE TO MAKE SURE THAT THEY ARE ON THE LIST AND MAKE THAT SERIOUS MENTAL ILLNESS REQUIREMENT AS WELL. AND SO IT'S KIND OF A MULTIPLE CHECKS. YEAH. AND SO CARLSBAD'S REALLY NOT HAVING ANY SORT OF INPUT IN THAT PROCESS. THAT'S CORRECT. NO, WE'RE NOT INVOLVED IN THE REFERRAL PROCESS. AND THEN IF WHO IS GOING TO BE THE ULTIMATE DECISION MAKER THAT WILL DECIDE IF IT'S SOLARI OR ANOTHER ENTITY THAT IS THE NEW MANAGEMENT COMPANY, BECAUSE I FEEL LIKE WE SHOULD HAVE A SEAT AT THAT TABLE FOR SURE. SO THAT'S THE ENTITY THAT AFFIRMED HAS PUT FORWARD. AND ALL THE FUNDING AGENCIES AT THIS POINT IN TIME ARE IN THAT REVIEW PROCESS, REVIEW AND CONSENT PROCESS. COULD WE MAKE SURE THAT SOLARI DOESN'T WORK FOR AFFIRMED AND OTHER CAPACITIES THAT ARE OUTSIDE OF THE SCOPE OF CARING FOR SEVERELY MENTALLY ILL PEOPLE IN PERMANENT SUPPORTIVE HOUSING, SO THAT THEY ARE WELL EQUIPPED AND EXPERTS IN PROVIDING WHAT WE NEED TO SEE AT WINDSOR POINTE. WOULD THAT BE OKAY TO WRITE? THAT'S PART OF THE REVIEW PROCESS, IS TO SEE THEIR EXPERIENCE WITH OTHER SIMILAR PROJECTS. GREAT. THANK YOU. AND THEN IT SAYS IN THE STAFF REPORT THAT THIS WILL BE BROUGHT BACK IN SIX MONTHS. HOWEVER, THERE HAS BEEN GREAT CONCERN IN THE COMMUNITY. AS YOU CAN IMAGINE, WE'RE TWO YEARS PLUS INTO THIS PROJECT. AND NOTICE I DID NOT CALL IT A FACILITY AND WE STILL HAVEN'T SEEN WHAT NEEDS TO COME TO FRUITION TO RENDER THE COMMUNITY SAFE. SO IF IN FACT, STAFF DOES NOT FEEL LIKE THIS IS ROLLING OUT TO THE BEST OF THE ABILITY THAT WE THE EXPECTATIONS THAT WE SET FORWARD, WILL IT BE BROUGHT BACK TO [01:25:01] COUNCIL AND THEN WHAT KIND OF TIME THING OR TIMELINE WOULD YOU BE LOOKING AT THERE? YEAH, I THINK REALLY WE'RE WE ANTICIPATE THAT A NEW ENTITY WOULD BE ON BOARD, HOPEFULLY MANAGING THE PROJECT IN NOVEMBER. AND OF COURSE, WE STILL HAVE TO REVIEW AND CONSENT TO THE NEW MANAGEMENT PLAN. SO THAT COULD TAKE A LITTLE WHILE AS WELL. AND WE WANT TO SEE OBVIOUSLY HOW THE NEW ENTITY, YOU KNOW, IS UP AND RUNNING. IF THERE ARE CONCERNS, WE ABSOLUTELY WOULD BE COMING FORWARD WITH ANY UPDATES NECESSARY. SO IF THERE IS SOMETHING THAT NEEDS TO BE REPORTED, WE CERTAINLY WOULD BE REPORTING THAT ONE OF THE THINGS THAT I TOYED WITH IN MY MIND WAS REQUESTING THAT STAFF DO A MEMO EVERY MONTH ON AN UPDATE FOR WINDSOR POINTE, BECAUSE WE DO SEND OUT MEMOS EVERY THURSDAY THROUGH THE CITY, AND THEY GENERALLY UPDATES ON THINGS LIKE NEW LAWS THAT HAVE COME INTO, YOU KNOW, SINCE JANUARY OR SOMETHING WHERE WE NEED TO I THINK I GOT ONE TODAY ON HANDBILL DELIVERIES, YOU KNOW, IN THE COMMUNITY. SO I JUST AM AND MAYBE MY OTHER COUNCIL MEMBERS WOULD LIKE TO WEIGH IN ON THAT, BUT I AM JUST A LITTLE BIT RESERVED IN THINKING THAT WE COULD WAIT SIX MORE MONTHS FOR AN UPDATE. WHILE I APPRECIATE I KNOW YOU'VE WORKED REALLY HARD TO MAKE THIS HAPPEN AND MOVE IN A REALLY FAST WAY, I DO APPRECIATE THAT, MISS MILLS, AND THAT IS NOT EASY TO DO, ESPECIALLY WHEN YOU HAVE DIFFERENT PEOPLE THAT ARE HAVING INPUT THERE. SO I WILL RESERVE ANY SORT OF MOTION BASED ON WHAT MY COLLEAGUES SAY ON THAT ONE. BUT HAVING SAID ALL OF THAT, I DO HAVE A MOTION TO MAKE. WOULD YOU LIKE FOR ME TO MAKE IT AT THE END OF COMMENTS? OR? IF YOU DON'T MIND. I WILL BE HAPPY TO. REMIND ME IN CASE I FORGET. I THINK THAT THOSE ARE ALL OF THE QUESTIONS. IF I DIDN'T HIT EVERYTHING, I APOLOGIZE. BUT I DO HAVE SORT OF AN ONGOING QUESTIONS ABOUT THIS PROJECT. THANK YOU. THANK YOU. OTHER QUESTIONS? OTHER QUESTIONS FROM COUNCIL. MAYOR. PARDON ME. MAY I SUPPLEMENT A COUPLE OF MISS MILLS RESPONSES, PLEASE? SO FIRST OFF, COUNCIL MEMBER BURKHOLDER INDICATED THAT IT WAS HER UNDERSTANDING THAT WINDSOR POINTE IS A PILOT PROJECT. I DON'T BELIEVE WINDSOR POINTE IS A PILOT PROJECT. NO, IT WAS THE SECOND PROJECT IN SAN DIEGO COUNTY TO BE FUNDED WITH NO PLACE LIKE HOME. SO THE FUNDING WAS A NEW FUNDING SOURCE. SO I THINK THAT'S PROBABLY THE NEWNESS OF THE FUNDING SOURCE. I DIDN'T. EXCUSE ME, CITY ATTORNEY. I DIDN'T SAY IT WAS A PILOT PROJECT. IT IS MY UNDERSTANDING THAT IT IS PART OF A PILOT. I DON'T BELIEVE IT'S PART OF A PILOT PROJECT EITHER. SO THERE ARE OTHER WINDSOR POINTES, I JUST. OKAY, WELL, THAT'S GOOD TO KNOW. I WISH I HAD KNOWN THAT TWO YEARS AGO, TOO, BECAUSE IT WOULD HAVE BEEN GOOD TO COMPARE AND CONTRAST. SO WITH REGARD TO THE GROUND LEASE, THE GROUND LEASE IS A DOLLAR A YEAR, BUT IT HAS BEEN FULLY PREPAID FOR THE ENTIRE 99 YEAR LEASE PERIOD. AND THEN WITH REGARD TO THE RESTRICTIONS, THE 55 YEAR RESTRICTIONS THAT APPLY TO WINDSOR POINTE ARE REQUIRED BY THE FEDERAL AND STATE LAW THAT ARE AUTHORIZING THE FUNDING PROGRAMS THAT WERE USED TO FINANCE THE PROJECT, AND THEY APPLY EVEN IF THE UNDERLYING FINANCING PROGRAMS ARE REPAID. REMOVING RESTRICTIONS WOULD REQUIRE NOT ONLY AGREEMENT BY THE PARTY, BUT IT WOULD REQUIRE CHANGING THE APPLICABLE FEDERAL AND STATE LAW. THE STATE WOULD LIKELY REQUIRE WOULD LIKELY CONSIDER ANY ACTION TO REMOVE THE 55 YEAR RESTRICTIONS TO BE INCOMPATIBLE WITH THE CITY'S HOUSING ELEMENT AND ITS RELATED OBLIGATION TO AFFIRMATIVELY FURTHER FAIR HOUSING BASED ON THE STATE'S RECENT ACTIONS AGAINST THE CITIES OF OAK GROVE AND NORWALK. POSSIBLE DIRECT CONSEQUENCES OF VIOLATING THE HOUSING ELEMENT. AND THE OBLIGATION TO AFFIRMATIVELY FURTHER FAIR HOUSING MAY INCLUDE DECERTIFICATION OF THE CITY'S HOUSING ELEMENT, SUBJECTING THE CITY TO THE BUILDER'S REMEDY, FORFEITURE OF ENCAMPMENT RESOLUTION FUNDING, A REQUIREMENT TO SITE AND PROVIDE FUNDING FOR AN ADDITIONAL PERMANENT SUPPORTIVE HOUSING PROJECT AND PAYMENT OF THE STATE'S LEGAL FEES. POSSIBLE INDIRECT CONSEQUENCES INCLUDE THE LOSS OF FEDERAL AND STATE GRANT FUNDS THAT WERE CONDITIONED UPON COMPLIANCE WITH ANTI-DISCRIMINATION LAWS, SUCH AS THE GRANT FUNDING RECEIVED FOR POLICE AND FIRE DEPARTMENT TRAINING AND EQUIPMENT, THE VILLAGE AND BARRIO LIGHTING PROGRAM, AND VETERANS MEMORIAL PARK. QUESTIONS FROM MISS LUNA. MANDY, COULD YOU PUT UP HOW MANY TIMES YOU'VE BEEN TO THE COUNCIL THAT SLIDE THAT YOU REPORTED BACK? I KNOW IT SEEMS LIKE QUITE A BIT, BUT. THIS IS JUST UNTIL TONIGHT. [01:30:02] SO OBVIOUSLY THIS IS THE FIFTH ITEM, BUT WE ALSO HAVE THE TIMELINE ONE IN CASE THAT'S HELPFUL. JUST TO SHOW IN SINCE MARCH. SO WHAT DELIVERABLES. I MEAN TO ME WAITING FOR THE NEW FIRM TO COME ON, I JUST, CAN'T SEE THAT TO WAIT FOR A REPORT BACK TO US. I APPRECIATE COUNCIL MEMBER BURKHOLDER'S ON THE MEMOS AND THAT, BUT THAT DOESN'T HELP THE PUBLIC. REALLY THEY DON'T REALLY LOOK AT THOSE. SO WHAT WOULD BE A REASONABLE TIME FRAME THAT YOU THINK BECAUSE YOU'RE WORKING ON SOME DELIVERABLES, YOU'RE WORKING ON SOME OTHER STUFF? I MEAN, I'M NOT LOOKING AT SOMETHING THAT'S GOING TO TAKE A LOT OF STAFF TIME, BUT MAYBE JANUARY COME BACK WITH HERE'S SORT OF A STATUS REPORT ON WHERE WE ARE WITH THIS OR THAT SO THAT WE'RE NOT LOSING WE'RE NOT LOSING TRACK ON THAT. AND IT GIVES THE PUBLIC AN OPPORTUNITY TO MAYBE ASK QUESTIONS TO WHERE THAT IS OR MAYBE FEBRUARY. BUT ARE THERE ANY DELIVERABLES YOU MIGHT HAVE IN MIND OR THINGS THAT ARE IN PROCESS THAT WOULD BE RELEVANT FOR THE COUNCIL? AS FAR AS INFORMATIONAL AND THEN AS FAR AS THE PUBLIC. SO I THINK REALISTICALLY, IF A NEW ENTITY WERE TO COME ON BOARD IN NOVEMBER GIVING A FULL 90 DAYS REALLY GIVES THEM TILL JANUARY. AND THEN OF COURSE, WE PREPARE THEIR REPORT AND COME BACK. SO THAT POTENTIALLY COULD BE FEBRUARY. I MEAN, I THINK 90 DAYS IS A DECENT AMOUNT TO SEE WHAT CAN BE DONE IN THE 90 DAYS. ALSO, WE NEED THE TIME TO REVIEW AND, YOU KNOW, NEGOTIATE AND CONSENT TO THE NEW MANAGEMENT PLAN AS WELL. SO I'M A LITTLE AFRAID THAT, YOU KNOW, 60 DAYS IS A LITTLE TOO SOON. AND THEN, OF COURSE, WE HAVE TO PREPARE THE REPORT TO COME BACK. SO EVEN JANUARY MIGHT BE A LITTLE. SO MAYBE FEBRUARY, VALENTINE'S DAY GIFT. OKAY, WELL, THAT'S SOMETHING THAT MAYBE MY COLLEAGUES WE CAN THINK ABOUT AND BRING BACK. AND I, WHILE YOU WERE TALKING, I PASSED A NOTE TO CITY MANAGER JUST IN CASE PEOPLE SEE ME PASSING NOTES. I ASKED CITY MANAGER IF FEBRUARY WAS REASONABLE, AND HE SAID IT WAS. MRS. ACOSTA. THANK YOU. I'D JUST LIKE TO CLARIFY A COUPLE OF POINTS. THANK YOU FOR THE PRESENTATION AND ALL THE INFORMATION. ONE OF THE TOPICS THAT WE'VE KIND OF BEEN TALKING ABOUT IS CHANGING OVER THE MANAGEMENT COMPANY. AND I KNOW THAT WE NEED TO UPDATE THE MANAGEMENT PLAN BECAUSE IN THE MANAGEMENT PLAN THE CURRENT MANAGEMENT COMPANY IS IDENTIFIED. HOW WILL THAT BE SYNCED UP WITH THE CHANGEOVER? BECAUSE THE NEW MANAGEMENT COMPANY WILL START IN NOVEMBER. RIGHT. SO WHEN WILL THAT MANAGEMENT PLAN BE CHANGED? YEAH, EXACTLY. SO ONCE ALL THE CONSENTS ARE PROVIDED BY THE FUNDING AGENCIES TO ALLOW THE NEW PROPERTY MANAGER, THEN THE NEW PROPERTY MANAGER AND AFFIRMED HOUSING WILL BE DRAFTING A NEW MANAGEMENT PLAN. AND OBVIOUSLY, LIKE YOU'RE SAYING, THE EXISTING ONE IS SPECIFIC TO CONAM. SO IT WOULD BE SPECIFIC TO THAT NEW ENTITY. AND THEN WE WOULD BE GIVEN NOTICE AND OPPORTUNITY TO REVIEW THAT AND TO MAKE, YOU KNOW, POTENTIAL SUGGESTIONS FOR REVISIONS. SO THERE IS A PERIOD OF TIME WHERE, YOU KNOW, WE HAVE CERTAIN NUMBER OF DAYS TO REVIEW THAT. AND THEN WHEN WE SEND OUR COMMENTS BACK, YOU KNOW, THEY HAVE CERTAIN NUMBER OF DAYS TO REVIEW THAT. SO REALISTICALLY THAT WOULD NEED TO BE COMPLETED WITHIN 120 DAYS. I DON'T THINK IT WILL TAKE THAT LONG. I MEAN, WE ARE WORKING VERY DILIGENTLY. WE MEET REGULARLY, WE TALK REGULARLY, SO I THINK WE CAN ACCOMPLISH IT BEFORE 120 DAYS, WHICH IS ANOTHER REASON WHY PERHAPS FEBRUARY MIGHT MAKE MORE SENSE TO HAVE SOME INFORMATION TO SHARE. GREAT. THANK YOU. I DID WANT TO KIND OF GO BACKWARDS A LITTLE BIT AND TALK ABOUT THE FUNDING AGENCIES WHO ARE ALL PARTICIPATING IN APPROVING THIS, AND THEN THE MANAGEMENT PLAN. SO THE FUNDING AGENCIES, COULD YOU IDENTIFY THEM, AND THEN CAN YOU IDENTIFY WHO'S AT THE TABLE IN PUTTING TOGETHER THE MANAGEMENT PLAN? SURE. SO THE TAX CREDIT ALLOCATION COMMITTEE IS A STATEWIDE ENTITY. THEY PROVIDE THE TAX CREDIT EQUITY TAX CREDITS. AND THEN YOU SELL THOSE TAX CREDITS TO GET THE EQUITY TO THE PROJECT. SO THERE'S A REGULATORY AGREEMENT AGAINST THE ON THE PROPERTY REGARDING THAT. AND THEN IN ADDITION TO THAT, THE STATE FUNDING, WHICH IS NO PLACE LIKE HOME, FLOWS THROUGH THE COUNTY OF SAN DIEGO. SO IT'S STATE FUNDING. SO ALL THOSE REGULATIONS ARE STATE REGULATIONS, AND THOSE ARE OVERSEEN AND ADMINISTERED BY THE COUNTY OF SAN DIEGO. SO THEY WOULD ALSO BE REVIEWING AND APPROVING THE MANAGEMENT PLAN. AND THEN OF COURSE, THERE'S THE CITY OF CARLSBAD. NOW, WE DON'T NECESSARILY WE ARE NOT NECESSARILY SITTING AROUND THE TABLE TOGETHER REVIEWING THESE AT THE SAME TIME AND DISCUSSING CHANGES. SO IT IS A LITTLE BIT AWKWARD, LIKE WHERE WE MIGHT HAVE AN INTEREST IN CHANGING A CERTAIN SECTION. [01:35:02] YOU KNOW, THE OTHER FUNDING AGENCIES MAY NOT SHARE THE SAME SENTIMENT. AND SO WE MIGHT BE MAKING RECOMMENDED CHANGES ON DIFFERENT SECTIONS. SO WITH SO MANY PARTIES AT THE TABLE, HOW DO WE DO THAT ASYNCHRONOUSLY. LIKE DO WE SEND RED LINE DOCUMENTS OR DO WE MEET ON ZOOM. LIKE HOW DO WE MAKE SURE THAT WE ARE ALL ON THE SAME PAGE AND GETTING ALL THE RIGHT WORDS ARTICULATED IN THIS TOO? RIGHT. SO ALL OF THE CHANGES GO TO AFFIRMED AND THEN AFFIRMED WOULD BE MAKING A COMBINED REDLINE DOCUMENT. OKAY. SO THAT EVERYBODY COULD SEE THE OTHER ENTITIES REQUESTED CHANGES. AND WE EXPECT ALL OF THIS TO BE DONE AND READY TO BE REPORTED BY FEBRUARY. THAT'S THE GOAL. OKAY, GREAT. THANK YOU VERY MUCH. MISS BHAT-PATEL. YES. THANK YOU. I HAVE A FEW QUESTIONS FOR YOU, MISS MILLS. AND THEN I'D LOVE TO ASK AFFIRMED A FEW QUESTIONS, IF I MAY. SO ONE OF MY QUESTIONS IS AROUND SPECIFICALLY, I KNOW WE TALKED ABOUT SOLARI AND THAT'S THE NEW MANAGEMENT COMPANY. ONE OF THE THINGS THAT OUR COLLEAGUES HAVE BROUGHT UP HERE IS AROUND HAVING THAT UPDATE. AND I WOULD LIKE TO PUT A PLUG AND POTENTIAL QUESTION AS TO WHEN WE DO HAVE THAT UPDATE, IT WOULD BE REALLY HELPFUL TO HAVE THEM AT THE TABLE AS WELL, SO WE CAN ASK THOSE QUESTIONS OF THEM IN TERMS OF WHAT THEY'RE GOING TO DO DIFFERENTLY, HOW THEY PLAN TO DO IT DIFFERENTLY, BECAUSE I'M SURE WE'LL BE RECEIVING THOSE QUESTIONS FROM THE COMMUNITY. SO I JUST WANTED TO THROW. I KNOW THAT'S NOT NECESSARILY A QUESTION, BUT OR MAYBE IT IS. IS THAT POSSIBLE TO BRING THEM IN FOR FEBRUARY? I THINK THAT'S A REASONABLE SUGGESTION. OKAY. GREAT. THANK YOU. AND THEN I THINK THE REST OF MY QUESTIONS ARE ACTUALLY FOR AFFIRMED. SO IF I COULD PLEASE HAVE AFFIRMED, COME TO THE MIC, I WOULD REALLY APPRECIATE THAT. GOOD EVENING. THANK YOU. AND IF YOU WOULDN'T MIND IDENTIFYING YOURSELF, YOU BET. JONATHAN TAYLOR WITH AFFIRMED HOUSING GROUP. GREAT. THANK YOU. ALL RIGHT, SO JUST A FEW QUESTIONS AND I'M SURE YOU'VE YOU'VE HEARD IT TIME AND TIME AGAIN FROM US WITH REGARDS TO THE SECURITY, I KNOW WE NOTICED IN THE STAFF REPORT THAT THERE WAS MENTION OF. AND I KNOW MY COLLEAGUE MENTIONED IT TO THE INDUSTRY STANDARD AND THEN THE COST, YOU KNOW. AND HOW THAT'S PROHIBITING US FROM HAVING THAT FOR OUR COMMUNITY. AS YOU KNOW, THAT'S SOMETHING THAT MANY FOLKS IN THE COMMUNITY HAVE ASKED FOR. AND SOMETHING THAT WE WERE WE HAVE BEEN ASKING FOR QUITE SOME TIME. SO I'M JUST CURIOUS IF, YOU KNOW, IF YOU ALL ARE CONTINUING TO LOOK AT OPTIONS FOR THAT OR IF THIS INDICATION WAS LIKE THAT THE DOOR IS CLOSED ON THE SECURITY ASPECT OF THINGS. WE ARE CONTINUING TO LOOK INTO OPTIONS TO MAKE IMPROVEMENTS TO THE SECURITY, TRYING TO GET CREATIVE. AND WITH ALL OF THE STAKEHOLDERS. WE HAVE OBVIOUSLY ONGOING CONVERSATIONS WITH CITY STAFF, WITH THE POLICE, WITH THE COUNTY, AND THERE'S SO MANY PEOPLE COMING TO THE TABLE COLLABORATING REALLY CREATIVE IDEAS COMING FORWARD SO THAT WE CAN LOOK AT WAYS TO CONSTANTLY MAKE IMPROVEMENTS AND DO SO IN AN EFFICIENT MANNER THAT REALLY SERVES THE NEEDS OF THE WHOLE COMMUNITY WELL OUR RESIDENTS, THE NEIGHBORS, AND DO SO IN A COST EFFECTIVE MANNER. OKAY. AND CAN CAN WE HOPE TO HEAR MORE FROM YOU ALL WHEN THAT FEBRUARY UPDATE COMES UP. I'D LIKE TO SEE MOVEMENT ON THAT. I DON'T THINK WE HAVE SEEN MOVEMENT ON THAT. IT SEEMS LIKE IT'S BEEN STAGNANT. SO WHEN IN FEBRUARY I AT LEAST MYSELF I'D LOVE TO HEAR WHAT MY COLLEAGUES HAVE TO SAY. BUT FROM A SECURITY PERSPECTIVE, JUST BEING ABLE TO SEE SOME MOVEMENT AND TAKING A BITE AT THE APPLE AT THAT SPECIFICALLY WOULD BE REALLY IMPORTANT. SO I JUST WANT TO THROW THAT OUT THERE. AND THEN IN TERMS OF THE MANAGEMENT COMPANY, I KNOW THAT YOU ALL ARE, YOU KNOW, AND IT'S OBVIOUSLY NOT JUST YOU ALL, BUT THE REST OF THE FUNDING AGENCIES THAT SOLARI IS GOING TO HOPEFULLY BE THE ONE THAT WILL BE MOVING FORWARD WITH. FROM YOUR PERSPECTIVE, THE TIMELINE OF NOVEMBER IS SOMETHING THAT IS GOING TO BE MET. I THINK THAT'S SOMETHING THAT YOU'RE HEARING FROM ALL OF US. IS THAT HAPPENING? IS IT FOR SURE HAPPENING? WHAT'S THE TIMELINE LOOKING LIKE? SO WE'D LOVE TO HEAR IS THAT GOING TO BE MET? YES. THAT'S THE SAME DIRECTION THAT WE'RE MOVING IN. WE WANT TO RECEIVE CONSENT FROM ALL OF THE STAKEHOLDERS. WE'RE IN THE PROCESS OF MAKING THAT HAPPEN. AT THE TIME THAT WE RECEIVED THE NOTICE TO DISCONTINUE SERVICES FROM CONAM, THAT WAS JUST A ONE MONTH NOTICE. IT'S A TOUGH TIMEFRAME TO OBTAIN CONSENTS FROM ALL OF THE STAKEHOLDERS FOR A NEW PROPERTY MANAGEMENT COMPANY IN THAT AMOUNT OF TIME, SO I DO BELIEVE THAT IT'S ABSOLUTELY REASONABLE THAT BY THE END OF NOVEMBER, WE WILL HAVE A CONTRACT IN PLACE WITH THE NEW MANAGEMENT AGENT. AND THEN, AS YOU'VE ALREADY HEARD, OUTLINED, THE WORK ON THE PROPERTY MANAGEMENT PLAN WOULD CONTINUE AFTER THAT. OKAY. AND THEN I KNOW THE OTHER QUESTION, AND THIS MIGHT GO BACK TO THE SECURITY PIECE WAS AROUND THE DOORS BEING PROPPED OPEN. [01:40:07] AND ONE OF THE QUESTIONS I KNOW I HAD DURING BRIEFING THAT CAME UP WAS, I THINK, IF I'M NOT MISTAKEN, IN THIS REPORT, IT TALKS ABOUT THAT WE'RE LOOKING AT, YOU KNOW, OR YOU ALL ARE LOOKING AT, OKAY, WHO PROPPED IT OPEN. WHAT HAPPENED. WHAT DO WE NEED TO GET IN CONTACT WITH THOSE FOLKS? I'M JUST CURIOUS IF YOU COULD DETAIL AND TO THE EXTENT THAT YOU CAN, WHAT IS BEING DONE TO ADDRESS THAT? BECAUSE THAT IS CLEARLY AN ISSUE THAT HAS BEEN BROUGHT UP. AND SO I'M JUST CURIOUS IF YOU CAN TALK THROUGH SOME OF THE THINGS TO MAKE SURE THAT THOSE DOORS ARE GOING TO STAY SECURE. JUST TO CLARIFY, YOU'RE TALKING ABOUT THE PROPPING OPEN OF THE FRONT GATES. CORRECT. YEAH, I THAT IS SOMETHING THAT NORMALLY WOULD HAVE BEEN CAUGHT BY PROPERTY MANAGEMENT STAFF, WHETHER IT'S THE MANAGER OR THE MAINTENANCE PERSON, AND WOULD HAVE, YOU KNOW, INVESTIGATED. WHY IS THIS BEING PROPPED OPEN? IS IT SOMEBODY MOVING FURNITURE IN AND OUT? AND THEN AFTER MAKING THAT ASSESSMENT, DETERMINED THEY NEEDED TO REMOVE WHATEVER WAS BLOCKING THE GATE FROM CLOSING? SO I DON'T KNOW THE SPECIFICS OF THE OCCASIONS WHERE THIS DID OCCUR. SO I CAN'T REALLY SPEAK TO THAT, BUT I CAN JUST SPEAK TO THE NORMAL STANDARD OPERATING PROCEDURES OF HOW THAT WOULD NORMALLY BE HANDLED. OKAY. AND I'M HOPING SINCE THERE IS VIDEO SURVEILLANCE, THAT WE'D BE ABLE TO SEE WHO'S COMING IN AND OUT AND WHO IS PROPPING THOSE DOORS. YEAH. I'M SORRY. ME PERSONALLY, I HAVE NOT. MEMBERS OF MY TEAM DEFINITELY HAVE. AND CONAM PROPERTY MANAGEMENT AS WELL. OKAY. AND THEN THE OTHER QUESTION THAT WAS BROUGHT UP WAS AROUND THE FULL TIME PROGRAM MANAGERS ON BOTH PROPERTIES. DO YOU CAN YOU TELL US A PLAN AS TO HOW THAT'S GOING TO COME TO FRUITION IN THE NEAR TERM? WHEN YOU SAY LIKE A RESIDENT MANAGER? TERMS OF HAVING SO SINCE THERE'S ONE RIGHT NOW SHARED WITH BOTH SITES. AND I KNOW THAT'S SOMETHING THAT WE WERE TALKING ABOUT FOR BOTH HOUSING SITES. I'M JUST CURIOUS WHAT THE PLAN IS TO MAKE SURE THAT THERE'S GOING TO BE PRESENCE AT BOTH HOUSING SITES. I DON'T HAVE AN ANSWER TO THAT AT THIS POINT. IT'S SOMETHING THAT WE'RE CONTINUING TO LOOK AT. I CAN SPEAK A LITTLE BIT TO WHAT WE TYPICALLY SEE AND WHAT I WOULD CALL AN INDUSTRY STANDARD, AND THAT TYPICALLY WHEN WE HAVE APARTMENT COMMUNITIES THAT HAVE TWO STAFF UNITS, TYPICALLY IT WOULD BE AN ON SITE RESIDENT MANAGER TAKES ONE OF THE UNITS AND THEN AN ON SITE MAINTENANCE PERSON WOULD RESIDE IN THE OTHER UNIT. SO THAT'S WHAT IS NORMAL. AND SO THE SPECIFICS OF WHAT WAS SAID IN TERMS OF HAVING TWO MANAGERS, ONE AT ONE LOCATION AND ONE AT THE OTHER, I CAN'T SPEAK TO THAT BECAUSE. EXCUSE ME JUST A MOMENT. SURE. THIS IS NOT A PARTICIPATION EXPLANATION. IF YOU YOU HAVE ANOTHER OUTBURST, I'M GOING TO ASK YOU TO WAIT OUTSIDE. AND WE DO HAVE IT TELEVISED OUTSIDE. PLEASE CONTINUE. SIR. YEAH. SO IT IS NORMAL TO HAVE TWO UNITS. ONE WOULD BE FOR THE MANAGER. ONE WOULD BE FOR A MAINTENANCE PERSON. NORMALLY YOU WOULD NOT FOR A PROJECT OF THIS SIZE YOU WOULD HAVE ONE MANAGER AND YOU MIGHT HAVE A LEASING AGENT AS WELL THAT IS PART TIME, BUT IT WOULD NOT BE TYPICAL FOR A PROPERTY OF THIS SIZE TO HAVE TWO MANAGERS. TWO RESIDENT MANAGERS. OKAY. I JUST HAVE COMMENTS. THANK YOU. ANY OTHER QUESTIONS? OKAY. COMMENTS. MISS BHAT-PATEL. I'M SORRY, I DID HAVE ONE QUICK QUESTION. MANDY, ON SLIDE NUMBER TEN, YOU TALKED ABOUT CASE MANAGEMENT WOULD BE REQUIRED. WAS THAT JUST FOR THE VETERANS OR WOULD THAT BE FOR ALL RESIDENTS? NO, THAT'S FOR THE THE VASH FUNDING DOES REQUIRE THE VA DOES REQUIRE THAT RESIDENTS WHO ARE IN THOSE PROJECT BASED UNITS THAT THEY ACCEPT MONTHLY CASE MANAGEMENT MEETINGS. SO THAT WOULD JUST BE THAT LIMITED RESIDENTS, THE OTHER RESIDENTS ARE NOT REQUIRED TO TAKE IT. THAT'S CORRECT. OKAY. THANK YOU. THAT WAS MY ONLY QUESTION. CLOSING STATEMENTS, MISS BHAT-PATEL. YES. ALL RIGHT. GREAT. WELL. THANK YOU. THANKS FOR THE UPDATE, MISS MILLS. I KNOW THAT THIS HAS BEEN A LOT OF WORK FROM YOUR DEPARTMENT AND YOUR END. AND SO I JUST WANT TO SAY THANK YOU FOR ALL THE WORK THAT YOU'RE PUTTING INTO THIS. I AM SURE FROM MY LINE OF QUESTIONING, YOU HEARD, YOU KNOW, I'D LIKE TO SEE MORE FROM AFFIRMED. AND THEN, OF COURSE, WHENEVER OUR NEW PROPERTY MANAGEMENT DOES COME ON BOARD WOULD LOVE TO HEAR UPDATES FROM THEIR END IN TERMS OF HOW THEY'RE GOING TO END UP MANAGING DIFFERENTLY THAN WHAT WE HAD CURRENTLY. AND SO OTHER THAN THAT, JUST THANKFUL AND LOOKING FORWARD TO HEARING WHAT MY COLLEAGUES HAVE TO SAY AND WHAT COUNCIL MEMBER BURKHOLDER HAS TO SAY WITH REGARDS TO A MOTION. [01:45:05] THANKS. MISS ACOSTA. THANK YOU. THANK YOU, MISS MILLS. AND TO ALL THE PEOPLE WHO AREN'T SITTING THERE WITH YOU THAT HAVE ALSO WORKED ON THIS FROM THE CITY, THERE HAS OBVIOUSLY BEEN A GREAT DEAL OF PUBLIC ATTENTION AND COMMUNITY OUTREACH TO THE COUNCIL ON THESE ISSUES AROUND WINDSOR POINTE, AND THERE ARE MANY CONCERNS THAT THE COMMUNITY HAS AROUND SAFETY AND AROUND THE SECURITY OF THE FACILITY AND FOR THE TENANTS ON BEHALF OF THE TENANTS AND THE NEIGHBORS. I SHARE THOSE CONCERNS IN A LOT OF WAYS, AND I AM PLEASED THAT THERE IS GOING TO BE A CHANGE IN THE PROPERTY MANAGER, BECAUSE I DO THINK THAT THAT THAT WILL BE A FRESH START AND WE WILL BE REVISITING THE MANAGEMENT PLAN. I LOOK FORWARD TO THAT NEXT UPDATE. AND I DO THINK THAT WE NEED TO CONTINUE TO BUILD A STRONGER RELATIONSHIP WITH AFFIRMED AND THE PROPERTY MANAGEMENT COMPANY. SO THEY SEE THAT WE ARE SERIOUS. AND EVEN IN JUST LOOKING AT THE LETTERS THAT WERE INCLUDED IN THE STAFF REPORT, THERE'S A DEFENSIVENESS AND A COMBATIVE BEHAVIOR FROM AFFIRMED AND THE PROPERTY MANAGER WITH THE CITY THAT I DIDN'T LIKE AT ALL, I FELT LIKE WE NEED TO BE PARTNERS IN THIS TO PROTECT THE COMMUNITY AND TO PROTECT THE RESIDENTS. SO HOPEFULLY WE CAN OVERCOME THAT FROM THESE MEETINGS AND WITH THE CHANGE, I HOPE IT'S A FRESH START. THANK YOU. MISS BURKHOLDER. OKAY, MISS LUNA, THEN WE'LL COME BACK. WE CAN HAVE MISS BURKHOLDER DO CLEANUP. THE ONLY THING IS, EVERY TIME WE GET A STAFF REPORT, MANDY, YOU KNOW, LIKE THE COUNTY OF SAN DIEGO IS DOING THIS, AND SO-AND-SO IS DOING THIS, AND SO-AND-SO IS DOING THIS. AND SO I KNOW IN THE PAST YOU'VE DONE GREAT LITTLE CHARTS SO THAT WE CAN SEE WHO'S DOING WHAT, WHERE AND MAYBE IN YOUR FEBRUARY REPORT, BECAUSE IT'S LIKE, YOU KNOW, THE MAYOR ASKED ABOUT THE VOUCHER PROGRAM AND THAT, WELL, YOU KNOW, WHAT'S THE COUNTY OF SAN DIEGO GOING TO DO WITH THAT VETERANS VOUCHER PROGRAM? ONE ONE. YOU KNOW, WHAT'S THE PROGRESS OF THAT? THE HSA FROM THE COUNTY OF SAN DIEGO HAS, YOU KNOW, SAID, OH, IN 90 DAYS IT WILL BE A REPORT BACK ON THIS AND ON THAT COMPONENT FIRST SERVICING WINDSOR POINTE. AND I HAVE TO DIG THROUGH ALL OF THIS MATERIAL TO PULL IT OUT AND TO SEE WHAT IT IS. SO I WAS HOPING MAYBE IN FEBRUARY WE COULD DO SOMETHING LIKE THAT. MISS BURKHOLDER. THANK YOU, MAYOR. I'M SITTING HERE HEARING THIS, THINKING TO MYSELF, JONATHAN, DO YOU HEAR YOURSELF? THAT'S THE QUESTION GOING THROUGH MY MIND. THERE IS ABSOLUTELY NOTHING NORMAL ABOUT THIS PROJECT. THE UTOPIA THAT YOU DESCRIBED ISN'T SOME HOUSING PROJECT SOMEWHERE. I'M 100% SURE OF THAT. THERE IS NO MONITORED SURVEILLANCE. IT IS A VIDEO SURVEILLANCE, BUT THERE IS NO ONE MONITORING IT. THERE'S A BODY THERE. WHO OUR OWN POLICE CHIEF TALKED ABOUT THAT WASN'T MONITORING IT, BUT HE WAS THERE. AND OF COURSE, THE GATE HEIGHT IS RESTRICTED, MISS MILLS, BECAUSE IT'S A RESIDENTIAL AREA. NOBODY EVER THOUGHT THIS TYPE OF PROJECT WOULD BE THERE, SO WHY WOULD WE NEED TO WORRY ABOUT THAT? THE DESIGN OF THE BUILDING IS NOT ADEQUATE TO SUPPORT WHAT WE'RE DOING AT WINDSOR POINTE AND IT DOESN'T REQUIRE CREATIVITY. AS JONATHAN SAID, WE AREN'T MAKING MACRAME. WE'RE ASKING FOR SECURITY. IT REQUIRES MONEY AND INTEGRITY AND THE WILL TO DO WHAT YOU SAID YOU WOULD DO. NONE OF WHICH I'VE SEEN TWO PLUS YEARS NOW. AND SO I DO HAVE A MOTION, AS YOU ALL PROBABLY HAVE KNOWN, THAT I'VE MET WITH EVERY ELECTED LEADER OUR COUNTY SUPERVISOR, OUR SENATOR. OUR CONGRESSMAN. OUR ASSEMBLY MEMBER. AND I'M GOING TO ASK THAT THE LEGISLATIVE SUBCOMMITTEE TAKE IT UP UPON OURSELVES TO SOLICIT LETTERS OF SUPPORT IN WHAT WE ARE DOING AS A CITY TO DO THE THINGS THAT WE TALKED ABOUT TONIGHT AND IN HOLDING ACCOUNTABLE NOT ONLY WHAT WE HAVE GOING ON TODAY, BUT ALSO IN THE FUTURE FOR THE MANAGEMENT PLAN. AND THEN I CAN ADD INTO THAT IF YOU IF IT'S OKAY WITH YOU, MISS MILLS, JUST TO SAY THAT WE'LL BRING THIS BACK FOR AN UPDATE IN FEBRUARY TO EVALUATE THE NEW MANAGEMENT COMPANY. AND SO THAT WOULD BE A MOTION. PLEASE BE SPECIFIC ON THE MOTION. I DON'T COMPLETELY UNDERSTAND WHAT IT IS. SO I'VE MET WITH ALL OF THE AS AN INDIVIDUAL AS A CITY COUNCIL MEMBER, REPRESENTATIVE DISTRICT ONE MET WITH ALL OF THE ELECTED'S, TALKED ABOUT WHAT THE CHALLENGES ARE THAT WE FACE AT WINDSOR POINTE. REVIEWED ALL OF THESE MATERIALS FROM THE LETTERS FROM THE, YOU KNOW, TO THE CITY ATTORNEYS AND COUNTY OF SAN DIEGO AND ALL THIS STUFF, BASICALLY EXPLAINING, HERE'S WHAT WE [01:50:08] WERE TOLD WE WOULD GET. WE'RE NOT GETTING THAT. OF ALL THOSE THINGS I JUST SAID IN MY CLOSING REMARKS RIGHT NOW, AND I THINK IT IS, IS AN IMPRESSION TO SAY WE HAVE ALL OF THE ELECTED'S IN NORTH COUNTY TO SAY THAT, OF COURSE, WE WANT TO SUPPORT CARLSBAD. WE WANT THIS TO BE SUCCESSFUL IS ESSENTIALLY WHAT WE'RE SAYING. AND IT'S NOT. SO I DON'T SEE ANY HARM IN HAVING THE LEGISLATIVE SUBCOMMITTEE TAKE IT UP TO SAY THE CITY WOULD LIKE TO PUT LETTERS OF SUPPORT AND SOLICIT THOSE FROM, YOU KNOW, WE WRITE THE LETTER THEY SIGN OFF TO SAY, OF COURSE, WE SUPPORT THE CITY OF CARLSBAD AND WHAT THEY'RE DOING. THAT'S A LONG MOTION. SOMEBODY SHOULD BE OKAY. I'LL SECOND FOR AND I HAVE QUESTIONS. I TOTALLY UNDERSTAND AND THINK IT WOULD BE HELPFUL. IS THERE SOMETHING SPECIFIC THAT YOU'RE LOOKING FOR, OR IS IT GENERAL SUPPORT FOR US TO MOVE FORWARD WITH? YOU KNOW, WHATEVER WE'RE DOING IN TERMS OF PROTECTING OUR COMMUNITY? I THINK THAT'S A GREAT QUESTION. AND YES, THAT BUT ALSO IN THE EVENT THAT THIS DOES FALL INTO SOME SORT OF, THEY'RE LEGISLATORS JUST LIKE US, RIGHT. SO IN THE EVENT THIS DOES FALL INTO SOME SORT OF A POSITION WHERE WE HAVE TO GO INTO GREATER ADVOCACY, I THINK IT WOULD BE GREAT TO BE ABLE TO GO BACK AND REVISIT WITH THEM AND SAY, REMEMBER, THESE WERE THE THINGS THAT WE TALKED ABOUT. YOU ALL SUPPORTED WHAT WE WANTED TO DO AS A CITY. HOW CAN WE PARTNER TO MAKE THIS SUCCESSFUL IN CARLSBAD SO THAT IT CAN BE SUCCESSFUL EVERYWHERE ELSE? OKAY. I WOULD I'M SUPPORTIVE OF OF THIS. I THINK IT WOULD BE GREAT TO HAVE SOME SPECIFICITY COME OUT OF THE SUBCOMMITTEE WITH REGARDS TO WHAT WOULD BE IN THOSE LETTERS OF SUPPORT THAT WE'D BE ASKING FOR. SO BUT OTHER THAN THAT, YES, OF COURSE, SUPPORTIVE. MS. ACOSTA YOU'RE 50% OF OUR LEGISLATIVE SUBCOMMITTEE. SO YOUR QUESTION IS GOING TO BE VERY IMPORTANT. THANK YOU. WOULD THE MAKER OF THE MOTION BE WILLING TO AMEND IT TO HAVE IT COME BACK HERE BEFORE WE SEND IT OUT? FOR SURE. OKAY. IT MAKES SENSE TO ME. SO EVERYBODY CAN HAVE INPUT. YEAH. IF YOU AND IF THE SECOND AGREES WITH THAT, I WOULD. FRIENDLY AMENDMENT OR WHAT DO YOU WANT TO DO? I'M FINE WITH ME. I THINK WE'RE OKAY IF THE MAKER AMENDS THE MOTION AND THE SECOND AGREES. CITY ATTORNEY. IS THAT RECORDED? DO YOU HAVE THAT? OKAY, GREAT. THANK YOU. COUNCIL, CAN I JUST ASK BECAUSE OF HOW IMPORTANT THIS SUBJECT IS? AND WE WANT TO MAKE SURE THAT WE ACCURATELY CAPTURE THIS. CAN WE TAKE ABOUT A THREE MINUTE RECESS SO THAT WE CAN GIVE THE CITY CLERK TIME TO BASICALLY PUT THE MOTION UP FOR THE PUBLIC TO VIEW, AND THEN WE CAN KIND OF WORDSMITH IT FROM HERE? THAT WOULD AND WOULD THAT THEN WOULD YOU WANT IT BROUGHT BACK AGAIN BEFORE IT GOES TO LEDGE, OR CAN WE FIGURE THAT OUT TONIGHT, IS THAT WHAT YOU'RE SUGGESTING, CITY MANAGER? NO. I WANT TO INITIALLY CAPTURE THE ACCURATE INITIAL MOTION. I'M WITH YOU. YEAH. THAT'S FINE, THANK YOU. OKAY, SO HOW ABOUT FIVE MINUTES? OKAY. THANK YOU. THANK YOU FOR YOUR PATIENCE, COUNCIL. SO WE'LL RECONVENE TO ORDER. GREAT. THANK YOU SO MUCH. AND WE'VE ASKED THE CLERK'S OFFICE TO GO AHEAD AND PREPARE THE MOTION. AND OUR APOLOGIES IF WE DIDN'T ACCURATELY CAPTURE THIS, BUT WE WERE TRYING TO GET IT ALL. SO IF COUNCIL COULD QUICKLY KIND OF REVIEW THE LANGUAGE AND LET US KNOW. MISS BURKHOLDER, THIS IS YOUR MOTION. PLEASE SPEAK UP. I'M SORRY. JUST A COUPLE OF QUESTIONS. SO THERE'S NO DATE FINITE HERE, BUT WE'RE TALKING ABOUT BRINGING BACK SOMETHING TO COUNCIL BEFORE IT GOES TO LEGISLATIVE SUBCOMMITTEE. WHEN WOULD THAT BE? OUR NEXT LEDGE IS IN NOVEMBER. AND THAT WASN'T CLEAR FOR US. I'M TRYING TO FIGURE THAT OUT. YEAH. SO THE ASK WOULD BE, WE WOULD DRAFT A LETTER, BRING IT BACK BEFORE THE FULL BOARD TO THEN GO BACK TO THE LEGISLATIVE SUBCOMMITTEE. IS THAT THE COUNCIL'S DESIRE OR ARE WE GOOD WITH THIS AND GOING WITH THIS LEGISLATIVE SUBCOMMITTEE SUBSEQUENT TO JUST PASSING THIS? MORE IMPORTANTLY, DOES IT MEET YOUR WHAT YOU WERE HOPING I WOULD GO WITH THIS AND TAKE IT TO THE LEGISLATIVE SUBCOMMITTEE FROM HERE. IF WE ARE ALL IN AGREEMENT THAT THIS IS WHAT WE WANT TO DO, IF THERE'S THEN THE LEGISLATIVE SUBCOMMITTEE WOULD PUT TOGETHER THE LETTER. I THINK THAT'S HOW IT GOES. YEAH. THE WAY WE'VE DRAFTED THE LEGISLATIVE SUBCOMMITTEE, WE WOULD WORK WITH THE LEGISLATIVE SUBCOMMITTEE TO BASICALLY COME UP WITH THE LANGUAGE. STAFF WOULD PREPARE IT. THEN ULTIMATELY, WE WOULD BRING IT BACK BEFORE THE FULL CITY COUNCIL, FULL CITY COUNCIL WOULD BLESS THE LETTER, THEN WE WOULD SEND IT. SO I'M JUST SAYING WE OMIT ANOTHER MEETING OF THE FULL COUNCIL. WE TAKE THIS TO LEDGE SO WE HAVE DIRECTION. WE COME UP WITH THE WORDING THAT COMES BACK TO THE FULL COUNCIL. [01:55:04] CORRECT. AND THEN WE PUSH. OKAY. I'M IN AGREEMENT WITH THAT. WHAT LEDGE SUBCOMMITTEE. WHICH LEGISLATIVE COMMITTEE DID YOU WANT IT TO COME TO NOVEMBER, THE NOVEMBER LEDGE? WE'LL DEFER TO COUNCIL LEDGE SUBCOMMITTEE MEMBERS. WHEN DO YOU WANT THIS TO COME TO YOU NOVEMBER, WHATEVER YOUR NEXT MEETING IS? COULDN'T THAT BE ADDRESSED IN THE NEXT MEETING? I DON'T THINK WE HAVE TO PUT THAT IN THE WORDING OF THIS MOTION, BUT I THINK THAT WOULD BE IDEAL. OKAY. WE HAVE A MOTION. WE HAVE A SECOND READY FOR A MOTION, A VOTE. YES. OKAY. PLEASE VOTE. IF IT'S NOT LOCKING. CAN WE JUST TRY AGAIN? PASSES UNANIMOUSLY. AND COUNCIL MEMBERS. IN ADDITION TO THAT, WE WILL. WE ARE COMMITTED TO BRINGING BACK THE UPDATE, AND THAT WILL OCCUR AT THE FEBRUARY 1ST OF THE FEBRUARY CITY COUNCIL MEETINGS. THANK YOU VERY MUCH, CITY MANAGER. THAT BRINGS US TO THE CONCLUSION OF OUR MEETING. [COUNCIL COMMENTARY AND REQUESTS FOR CONSIDERATION OF MATTERS:] FINAL THOUGHTS, MISS LUNA.
