Public Works Superintendent Kyle Lancaster presented the staff report and reviewed a PowerPoint Presentation (on file in the Office of the City Clerk).
Gave an overview of the process of naming amenities.
Packard - can you give us an indication of circumstances of naming Brierly Field . .. Lancaster - named before adoption of current criteria.
Mayor Lewis - James Brierly was a student and CHS - three year letterman - was straight A student and received appointment to West Point. November 12th killed by vietnamese sniper in 1968.
Beth and Brad Thorp came forward to address Council. Spoke about sons love for sport of baseball. Brad - was ex-minor leaguer of Los Angeles Dodger. Passed in 7 months. Honored if it would be approved. Andrew Ryan - asked that field be named after Cousin Mitchell.
Tom Watson, President of Carlsbad Youth Baseball - final time as President. Tim Silverman taking over. Baseball tournament coming up in a couple of weeks - championship of Southern California. In support of Thorp Field and members of the community support. Mitchell part of baseball community for a long time.
Eugene Adan, Celinda Drive, came forward to address Council. Spoke in support of naming field Thorp Field.
Dave Walker, former President of Booster Club of Carlsbad High School. Children played with Mitchell throughout the years. Never gave up the five years he was sick. Spoke of worthy cause. Encouraged Council to name Field One at Poinsettia Park to Thorp Field.
Terie Healey, son was best friend of Mitchell's. Played ball with Mitchell. Son is going on to play college ball. Encourage Council to name the field "Thorp Field".
Blackburn - started looking around at fields - what a perfect way to recognize someone who has contributed to our community. Would like to have strict guidelines - so we are prepared for it.
Hall - spoke in support also.
Kulchin - spoke about being at Stagecoach Park and saw signatures. Spoke in support.
Lewis - asked for slide for what is involved in naming process. Did not like the way this went about - Commission did not go through the guidelines. Spoke about Tony Mata. Also spoke about TJ Frazee. Concerned that the City has a way to evaluate that. Got to be fair about requests. Dismayed by the Commission. Commission needs to give more feedback.

Senior Planner Christer Westman presented the staff report and reviewed a PowerPoint Presentation (on file in the Office of the City Clerk).
Gave an overview of the proposed resort including location, and hotel details. 215 rooms, conference space, day spa, restaurant, grill and outdoor swimming pool.
Parking Structure (provided on site) 81 parking stalls at grade and 268 within structure. Planning Commission that a section of code be implemented that a 15% reduction in parking.
15% request for reduction in parking - total of 395 parking stalls on site.
Craftsman Style Architecture.
Project would be required to do street improvements along Carlsbad Boulevard and Ponto Drive.
Planning Commission conditioned project for enhanced slope and landscape and garden walls at the lobby to reduce noise and screen light sources. Also enchances landscaping betwinn parking and hanover beach colony.
Hall - more detail of hotel conditions. Westman - showed picture of access and exit also lobby area - across street from Hanover - increased height for burm and higher barrier and additional landscaping. Additional heigh with grading,k walls and landscaping.
Packard - what is planned for connections of Ponto to Avenida Encinas. Eventually Ponto to be improved to Beach Way with connection to Carlsbad Boulevard. Link of Ponto Drive that exists today. Future improvements for Beach.
Lewis - would you go over the zoning of this location and just to east of property? Westman - the area east and Hanover Beach Properties - Residential Medium designation - small lot condominium. 8/9 units breaker???? density??? Not sure.
Mr. Westman gave an overview of the surrounding area zoning designations.
And zoning of Ponto Area.
Lewis - in reference to Hanover Development - zoning has remained consistent all the way through???? Yes, said Westman.
Bill HOfman of Hofman Planning, CArlsbad, came forward to address Council representing Wavecrest. Gave an overview of project (working on project for five years). Glad to be here finally. Terrific project. Built by high quality developer.
Requested approval to move forward with construction.
Bill Canepa, Carlsbad, thanked Commission for consideration. Project meets existing zoning. Meets Ponto Vision Plan and Local Coastal Plan.
Packard - ground breaking date?? Canepa - think from construction stand point - could be ready next Spring.
Came down to area in early 70's.

Dale Schreiber, Carlsbad, questions for Commission. Dedicating a 60 feet easement for access out of project? Temporary blacktop road to beach - will this conflict with driveway into Ponto storage? Considered with adequate parking on road and drainage into property? Are we going to compel developer to contribute their fair share for improvements. Make sure that we get this traffic impact.
Packard - did you present these questions and concerns at Planning Commission? Yes said Schreiber. Kulchin - did you speak at Planning Commission meeting.
Ron Ashman, Brew Engineering and Surveying, did not speak at Planning Commission either. Spoke about Tentative Parcel Map Application.
Mr. Schreiber is concerned - described the improvements along Ponto Drive. Have control to dedicate public right of way. Asking to make sure that as staff goes forward that the necessary public right of ways are acquired.
Fully dedicated public right of way is of interest to Mr. Schreiber. The public street dedication is of concern. Have you talked to staff about concerns. Just wawnt to get concerns in public record. POinting out the 24 foot temporary ponto drive road. Spoke about right of way configuration near Schreiber's driveway.

David Hauser - dedication of 60 foot right of way . . . Schreiber was not correct. Proposed right of way is along portion of lot that connects in with this property. This panhandle property is owned by developer (wavecrest). If built out now, would lose access to properties further down because will be at higher elevation, therefore conditioning for temporary - also conditioned to make a dedication (condition 22 of Planning Commission Resoltuion (what resolution). All shall be reflected on final map including the 60 foot right of way.
Per hauser in response to lewis - no way Schreiber could be burned. The developer is also conditioned to design and install improvements along Ponto Drive to intersection with Beach Way. Not only will he have to build temporary improvements must also bond and commit for permanent improvements. (Listen to this).
Lewis - Fair share of Carlsbad Boulevard?
Hauser - we looked at different ways to establish fair share - we have conditioned project to construct all improvements to support the development - not conditioned for any additional improvements on Carlsbad Boulevard. Ponto improvements born by the developer and Beach Way.

Hauser commented staff will work on impacts to driveway. Make sure that an temporary intersection design will meet needs of property owners.

Hall - difficulties for business right now - commericial world to obtain credit.
Kulchin - when do you see the banks ready to lend money? When do you think that the state will be able to bring up their ratings? Per Cox, towards the end of year credit standing will be doing better. Credit score - ability to get the money will be higher than before. About the State, balanced budget with 1/2 smoke and mirrors.

Kulchin - noticed on list - trash, parties and noise a problem? Johnson - were photographs and complaints of trash - beer bottles lined up along the curb . . . individuals maybe standing near a vehicle. A vandalized vehicle.
Packard - slide of residences please. Do you know the distance from Carrillo Way from home opposing? frontages about 80 feet so maybe about 300 to 350 feet from Carrillo Way.
Lewis - what other areas do we have no parking restrictions on public streets. Johnson - Carlsbad Boulever, Celinda Drive - a number of streets because of street sweeping - restrictions on early mornings for that. Can't recall any other locations.

Linda Very, Carlsbad (Mar Viera), Carlsbad, 6332 Paseo Serra. Oppose Parking Restrictions. Love Carlsbad - live on Cul De Sac last house on the right - trail behind house goes down to where they are saying. Sympathetic to present conditions. I don't belive problem was fine for five years. They used to park on Carrillo Way. There is designated visitor parking. When called over there. Would have to petition for other spaces. Individuals will now park on cul de sac and hike up the trail.
It will push the problem up farther - like it just the way it is now. Wants parking back on Carrillo Way.
Steven Helming, right across from mailboxes. Would like parking situation to stay the same. Maybe talk to Cascada about taking away red curbs.
Road is deemed safe by City Engineer. Is it a safety hazard. If you take any portion and make them no parking it will impact other homeowners on the streets.
Elderly visitors will not be able to stay over night. City Street, we expect to be able to use streets we pay taxes for.

Lila, new to Paseo Descanso, live in house number 6. Did note that there are cars parked on lower half of road. Have no children and only have two cars and park in garage. If my family or extended members - I wan this to be a win - win - do not want a restriction. Would like name off of list. ONly for parked cars on the other side is what lady thought initially.
Packard - new resident - yes said lady. Did you read CC&R's - did you notice that there are restrictions for parking in the garage.
Carrie Lonyen, Carlsbad, a Cascada resident, came forward to address Council. Only half of Fennell's presentation true. Security company inspects garage. They also give tickets to people parked in wrong places. I feel sorry for people who have visitors and more cars . . .no where to park. Everything painted red. If you have visitors, where are they supposed to park.
Not a safety concern.
Kulchin - you have private security in there - they give warnings and tow cars. Like living in Nazi concentration camp.
Lewis - in the requirements of the home - your CC&R's agreed to paint the curbs red - went to the city and presented it as a fire hazard.
Other cars are over night guests. Are there limitations on how many can live in the home asked Lewis - no just the number of cars.
Hall - confirmed individual didn't like seeing cars in street so petitioned to paint curbs red.
Lewis - those are private streets in the neighborhood. And HOA requested curb red.
David Lyon, renter in Cascada condos. Origin of problem was the painting of curbs red. Initially able to park on Rancho Carrillo, then that right was taken away. Who required who to paint what red??? Parking limited in Cascada now.
Robert Wolfer, Paseo Monona, President of HOA - been working with Descanso homeowners and Cascada homeowners. Have done everything they can. Our CC&R's require - two cars in two car garage and garage cannot be used for other purposes. Difficult to enforce that requirement. If garage is full of storage, cannot park in garage. Been told, that there is plenty of parking in Cascada - 34 visitor spaces that are rarely used in Cascada. I was here when there was an issue on Cassia.
We have tried everything we can to get cars into Cascada. The red curbs in Cascada - the Fire Department came through and said road is too narrow when cars parked on both sides of road.
Lewis - if the Fire Department said one red side not both sides. Some spaces are variance parking. Can request a variance for additional spaces.

KirstinFirella, 6334 Paseo Descanso, am opposed to parking restriction. Conflicted opposition - don't think this is a long term solution. Question - is it an option to have the parking on one side of Carrillo Way open again for the Cascada residents.

41 of 44 homeowners that were home signed petition for parking restrictions on Paseo Descanso.
Dean Nathans, 6351 Paseo Descanso, sympathetic to neighbors at end of street; however, we suggest that we do not want to penalize everyone on the street to solve the problem. Maybe allow permit parking for Paseo Descanso residents through the permit process.

Johnson gave details of length of Carrillo Way - three lanes - the Center line has been moved to the south. Because of turn lane is not enough space for parking. There is a taper of the road - there may be the middle segment where it is 20 feet wide to make it wide enough for parking. Also sight cooridor must be taken into consideration. If Parking on Carrillo Way, space for three or four cars only. Could be concern because this only ingress degress to the communities.
Hall - can you walk us through what has changed in past five years.
Johnson - when roads were built - about 80 % of roads have no parking. On improvement plans that constructed road - there were no parking signs on Carrillo Way - only last couple of years.
Red curb in Cascadao condo units - that is typical in multi-family dwelling units. Fire Marshall will determine that red curb is necessary.
If Fire Marshal said paint the curbs road HOA would have been ordered to contract for painting curb.
Hall - one of the speakers tonight - After this was built and sold, something could have changed. And based on Fire Department inspection - could have been delay in inspection for compliance of conditions of approval.
Packard - if Via Cascada designed and built to allow fire trucks to travel - did the streets not get built to requirement or did trucks get wider. Johnson - when project was built per plans - when the roads are built to allow the one sided parking. Originally engineered for one side parking. packard confirmed that for several years the curbs were not painted in violation of plan. Johnson - do not know if there was a lag.
Chief Crawford - my understanding that this was always intended to be a red curb.
Why not red curb the inside and leave outisde un red asked Johnson? Chief - driveway curbs must be red.
Kulchin - if you did red curb red side and can park on the otehr. Per Crawford - it's an issue relating to the ingress degress width.
Lewis - do we still have a Planner inside right now. No.
Lewis - when projects are approved they were approved with idea that both autos were parked in the garage. And units are designed for 4 people.
Hildabrand - do not know if the units are 1 and 2 bedroom. Should be designed to meet the city's parking regulations.
Lewis commented that had similar situation on Poinsettia.
Blackburn - Did go out there on Paseo Descanso at 8:45 last night. Came here leaning towards denying the appeal and upholding the Traffic Safety Commission decision.
Will support the appeal of the Traffic Safety Commission and support parking restrictions on Paseo Descanso.

Cari Dale Public Works Manager and Don Wasko Public Works Superintendent presented the staff report and reviewed a PowerPoint Presentation (on file in the Office of the City Clerk).
Lewis, cant we say "if Possible" for Required plan? State Water Board Requires SSMP and how you do it is up to you said Wasko.
Hall - the STate Board - the Regional Board do not give us a blueprint - what we have developed is specific to Carlsbad Program and System.
HIldabrand - what are the penalties - we have set forth what we are going to do? Or is it a best efforts to comply with what's put out in the plan.
Stone - the Order requires that the Plan to the maximum extent practicable.
To implement with plan.
Hall - say we are going to clean lines every two years but do it every year instead. Order requires that we continuously improve our program to get to 0 spills. Hall concerned that we are out of compliance due to the fact where we set the benchmark.
Lewis - concerned about the fines. Hildabrand - from what I understand - the rates that are set is sufficient to fund the Plan as it is.
When we get NOV's the Board looks at how much we have tried. Fines are based on how well you have tried to eliminate spills. Per Stone, the Board looks at Notices of Violations in the past.
Packard - what level we can be content with?
Stone - we are not asking for additional resources or staff - what we have in our rates can take care of the plan. Just asking that plan be reviewed.
Packard - have had to make changes because of agency forcing the standards.
Hildabrand - is there a possiblity to add wording that will allow us to add verbiage. Stone nothing that prohibits that we can do whatever is possible.
Ball - I think adding words may be fine . .. I don't think it will actually reduce any liability. We will get fined because we have a spill and a number of factors will be considered. What is your level of effort and history. If possible can be added. Would rather diabuse Council that will protect us.
Wasko now reviewing due dates.

Final elements due August 1, 2009.

Hall - my understanding that we need to clean every pipe at least once a year 12" and under? How often do we scope- every other year.
Alan Wanamaker, Carlsbad, came forward to address Council. My original concern is that we don't try to go after a fly with a hawotizer. In the original order from Sacramento no direction given on how to combat FOG program. Would urge Council to give direction to Council, if something less than an interceptor can be used, then use something smaller.
Wasko - currently Mr. Wanamaker does not have a grease device at all. Is not contributing to the grease - we will continue to monitor that and wil allow him to use a grease trap.
Hall - there isn't any grandfathering? If a violation you will require an interceptor? Wasko - other measures can be taken to limit the FOG going down the drain to lower the FOG - if you aren't contributing FOG, will not force the installation of the device. Hall - will newer owners be able to self-certify. Wasko - our staff will be inspecting.
Dale - in restaurant business - usually a high turnover in kitchen staff - part is educating the folks working in the kitchen.
Hall - concerning item - cost of doing business - would like to see us bring in a private sector to help us. Would like to take the easiest part (25% of the city and outsource it for three years).
Lewis - maybe a workshop.
Hall - would like to review on how to outsource some of the work.
Hildabrand - we could go out to bid for the crew and vactor truck that is not used right now. Prefer to use least cost alternative.
Hall - am recommending three years so that scope of work can be understood.

Packard - can you give us an indication of circumstances of naming Brierly Field . .. Lancaster - named before adoption of current criteria.
Mayor Lewis - James Brierly was a student and CHS - three year letterman - was straight A student and received appointment to West Point. November 12th killed by vietnamese sniper in 1968.
Beth and Brad Thorp came forward to address Council. Spoke about sons love for sport of baseball. Brad - was ex-minor leaguer of Los Angeles Dodger. Passed in 7 months. Honored if it would be approved. Andrew Ryan - asked that field be named after Cousin Mitchell.
Tom Watson, President of Carlsbad Youth Baseball - final time as President. Tim Silverman taking over. Baseball tournament coming up in a couple of weeks - championship of Southern California. In support of Thorp Field and members of the community support. Mitchell part of baseball community for a long time.
Eugene Adan, Celinda Drive, came forward to address Council. Spoke in support of naming field Thorp Field.
Dave Walker, former President of Booster Club of Carlsbad High School. Children played with Mitchell throughout the years. Never gave up the five years he was sick. Spoke of worthy cause. Encouraged Council to name Field One at Poinsettia Park to Thorp Field.
Terie Healey, son was best friend of Mitchell's. Played ball with Mitchell. Son is going on to play college ball. Encourage Council to name the field "Thorp Field".
Blackburn - started looking around at fields - what a perfect way to recognize someone who has contributed to our community. Would like to have strict guidelines - so we are prepared for it.
Hall - spoke in support also.
Kulchin - spoke about being at Stagecoach Park and saw signatures. Spoke in support.
Lewis - asked for slide for what is involved in naming process. Did not like the way this went about - Commission did not go through the guidelines. Spoke about Tony Mata. Also spoke about TJ Frazee. Concerned that the City has a way to evaluate that. Got to be fair about requests. Dismayed by the Commission. Commission needs to give more feedback.

Senior Planner Christer Westman presented the staff report and reviewed a PowerPoint Presentation (on file in the Office of the City Clerk).
Gave an overview of the proposed resort including location, and hotel details. 215 rooms, conference space, day spa, restaurant, grill and outdoor swimming pool.
Parking Structure (provided on site) 81 parking stalls at grade and 268 within structure. Planning Commission that a section of code be implemented that a 15% reduction in parking.
15% request for reduction in parking - total of 395 parking stalls on site.
Craftsman Style Architecture.
Project would be required to do street improvements along Carlsbad Boulevard and Ponto Drive.
Planning Commission conditioned project for enhanced slope and landscape and garden walls at the lobby to reduce noise and screen light sources. Also enchances landscaping betwinn parking and hanover beach colony.
Hall - more detail of hotel conditions. Westman - showed picture of access and exit also lobby area - across street from Hanover - increased height for burm and higher barrier and additional landscaping. Additional heigh with grading,k walls and landscaping.
Packard - what is planned for connections of Ponto to Avenida Encinas. Eventually Ponto to be improved to Beach Way with connection to Carlsbad Boulevard. Link of Ponto Drive that exists today. Future improvements for Beach.
Lewis - would you go over the zoning of this location and just to east of property? Westman - the area east and Hanover Beach Properties - Residential Medium designation - small lot condominium. 8/9 units breaker???? density??? Not sure.
Mr. Westman gave an overview of the surrounding area zoning designations.

Lewis - in reference to Hanover Development - zoning has remained consistent all the way through???? Yes, said Westman.
Bill HOfman of Hofman Planning, CArlsbad, came forward to address Council representing Wavecrest. Gave an overview of project (working on project for five years). Glad to be here finally. Terrific project. Built by high quality developer.
Requested approval to move forward with construction.
Bill Canepa, Carlsbad, thanked Commission for consideration. Project meets existing zoning. Meets Ponto Vision Plan and Local Coastal Plan.
Packard - ground breaking date?? Canepa - think from construction stand point - could be ready next Spring.
Came down to area in early 70's.

Dale Schreiber, Carlsbad, questions for Commission. Dedicating a 60 feet easement for access out of project? Temporary blacktop road to beach - will this conflict with driveway into Ponto storage? Considered with adequate parking on road and drainage into property? Are we going to compel developer to contribute their fair share for improvements. Make sure that we get this traffic impact.
Packard - did you present these questions and concerns at Planning Commission? Yes said Schreiber. Kulchin - did you speak at Planning Commission meeting.
Ron Ashman, Brew Engineering and Surveying, did not speak at Planning Commission either. Spoke about Tentative Parcel Map Application.
Mr. Schreiber is concerned - described the improvements along Ponto Drive. Have control to dedicate public right of way. Asking to make sure that as staff goes forward that the necessary public right of ways are acquired.
Fully dedicated public right of way is of interest to Mr. Schreiber. The public street dedication is of concern. Have you talked to staff about concerns. Just wawnt to get concerns in public record. POinting out the 24 foot temporary ponto drive road. Spoke about right of way configuration near Schreiber's driveway.

David Hauser - dedication of 60 foot right of way . . . Schreiber was not correct. Proposed right of way is along portion of lot that connects in with this property. This panhandle property is owned by developer (wavecrest). If built out now, would lose access to properties further down because will be at higher elevation, therefore conditioning for temporary - also conditioned to make a dedication (condition 22 of Planning Commission Resoltuion (what resolution). All shall be reflected on final map including the 60 foot right of way.
Per hauser in response to lewis - no way Schreiber could be burned. The developer is also conditioned to design and install improvements along Ponto Drive to intersection with Beach Way. Not only will he have to build temporary improvements must also bond and commit for permanent improvements. (Listen to this).
Lewis - Fair share of Carlsbad Boulevard?
Hauser - we looked at different ways to establish fair share - we have conditioned project to construct all improvements to support the development - not conditioned for any additional improvements on Carlsbad Boulevard. Ponto improvements born by the developer and Beach Way.

Kulchin - noticed on list - trash, parties and noise a problem? Johnson - were photographs and complaints of trash - beer bottles lined up along the curb . . . individuals maybe standing near a vehicle. A vandalized vehicle.
Packard - slide of residences please. Do you know the distance from Carrillo Way from home opposing? frontages about 80 feet so maybe about 300 to 350 feet from Carrillo Way.
Lewis - what other areas do we have no parking restrictions on public streets. Johnson - Carlsbad Boulever, Celinda Drive - a number of streets because of street sweeping - restrictions on early mornings for that. Can't recall any other locations.

Hall - spoke about how the problem started - any history on the red curbs in the Cascada development? For five years fine said Mr. Fenneell - maybe a change in management came in and did red curbs around the permiter.
Linda Very, Carlsbad (Mar Viera), Carlsbad, 6332 Paseo Serra. Oppose Parking Restrictions. Love Carlsbad - live on Cul De Sac last house on the right - trail behind house goes down to where they are saying. Sympathetic to present conditions. I don't belive problem was fine for five years. They used to park on Carrillo Way. There is designated visitor parking. When called over there. Would have to petition for other spaces. Individuals will now park on cul de sac and hike up the trail.
It will push the problem up farther - like it just the way it is now. Wants parking back on Carrillo Way.
Steven Helming, right across from mailboxes. Would like parking situation to stay the same. Maybe talk to Cascada about taking away red curbs.
Road is deemed safe by City Engineer. Is it a safety hazard. If you take any portion and make them no parking it will impact other homeowners on the streets.
Elderly visitors will not be able to stay over night. City Street, we expect to be able to use streets we pay taxes for.
There is algae in storm drain.

Rights have been taken away by this parking.

Car alarms have gone off on two occassions.
Lack of a good night sleep is an effect on Quality of Life.
There is adequate parking in the Cascada for all residents in condominium community.

Lila, new to Paseo Descanso, live in house number 6. Did note that there are cars parked on lower half of road. Have no children and only have two cars and park in garage. If my family or extended members - I wan this to be a win - win - do not want a restriction. Would like name off of list. ONly for parked cars on the other side is what lady thought initially.
Packard - new resident - yes said lady. Did you read CC&R's - did you notice that there are restrictions for parking in the garage.
Carrie Lonyen, Carlsbad, a Cascada resident, came forward to address Council. Only half of Fennell's presentation true. Security company inspects garage. They also give tickets to people parked in wrong places. I feel sorry for people who have visitors and more cars . . .no where to park. Everything painted red. If you have visitors, where are they supposed to park.
Not a safety concern.
Kulchin - you have private security in there - they give warnings and tow cars. Like living in Nazi concentration camp.
Lewis - in the requirements of the home - your CC&R's agreed to paint the curbs red - went to the city and presented it as a fire hazard.
Other cars are over night guests. Are there limitations on how many can live in the home asked Lewis - no just the number of cars.
Hall - confirmed individual didn't like seeing cars in street so petitioned to paint curbs red.
Lewis - those are private streets in the neighborhood. And HOA requested curb red.
David Lyon, renter in Cascada condos. Origin of problem was the painting of curbs red. Initially able to park on Rancho Carrillo, then that right was taken away. Who required who to paint what red??? Parking limited in Cascada now.
Robert Wolfer, Paseo Monona, President of HOA - been working with Descanso homeowners and Cascada homeowners. Have done everything they can. Our CC&R's require - two cars in two car garage and garage cannot be used for other purposes. Difficult to enforce that requirement. If garage is full of storage, cannot park in garage. Been told, that there is plenty of parking in Cascada - 34 visitor spaces that are rarely used in Cascada. I was here when there was an issue on Cassia.
We have tried everything we can to get cars into Cascada. The red curbs in Cascada - the Fire Department came through and said road is too narrow when cars parked on both sides of road.
Lewis - if the Fire Department said one red side not both sides. Some spaces are variance parking. Can request a variance for additional spaces.

KirstinFirella, 6334 Paseo Descanso, am opposed to parking restriction. Conflicted opposition - don't think this is a long term solution. Question - is it an option to have the parking on one side of Carrillo Way open again for the Cascada residents.

41 of 44 homeowners that were home signed petition for parking restrictions on Paseo Descanso.
Dean Nathans, 6351 Paseo Descanso, sympathetic to neighbors at end of street; however, we suggest that we do not want to penalize everyone on the street to solve the problem. Maybe allow permit parking for Paseo Descanso residents through the permit process.

Johnson gave details of length of Carrillo Way - three lanes - the Center line has been moved to the south. Because of turn lane is not enough space for parking. There is a taper of the road - there may be the middle segment where it is 20 feet wide to make it wide enough for parking. Also sight cooridor must be taken into consideration. If Parking on Carrillo Way, space for three or four cars only. Could be concern because this only ingress degress to the communities.
Hall - can you walk us through what has changed in past five years.
Johnson - when roads were built - about 80 % of roads have no parking. On improvement plans that constructed road - there were no parking signs on Carrillo Way - only last couple of years.
Red curb in Cascadao condo units - that is typical in multi-family dwelling units. Fire Marshall will determine that red curb is necessary.
If Fire Marshal said paint the curbs road HOA would have been ordered to contract for painting curb.
Hall - one of the speakers tonight - After this was built and sold, something could have changed. And based on Fire Department inspection - could have been delay in inspection for compliance of conditions of approval.
Packard - if Via Cascada designed and built to allow fire trucks to travel - did the streets not get built to requirement or did trucks get wider. Johnson - when project was built per plans - when the roads are built to allow the one sided parking. Originally engineered for one side parking. packard confirmed that for several years the curbs were not painted in violation of plan. Johnson - do not know if there was a lag.
Chief Crawford - my understanding that this was always intended to be a red curb.
Why not red curb the inside and leave outisde un red asked Johnson? Chief - driveway curbs must be red.
Kulchin - if you did red curb red side and can park on the otehr. Per Crawford - it's an issue relating to the ingress degress width.
Lewis - do we still have a Planner inside right now. No.
Lewis - when projects are approved they were approved with idea that both autos were parked in the garage. And units are designed for 4 people.
Hildabrand - do not know if the units are 1 and 2 bedroom. Should be designed to meet the city's parking regulations.

Cari Dale Public Works Manager and Don Wasko Public Works Superintendent presented the staff report and reviewed a PowerPoint Presentation (on file in the Office of the City Clerk).
Lewis, cant we say "if Possible" for Required plan? State Water Board Requires SSMP and how you do it is up to you said Wasko.
Hall - the STate Board - the Regional Board do not give us a blueprint - what we have developed is specific to Carlsbad Program and System.
HIldabrand - what are the penalties - we have set forth what we are going to do? Or is it a best efforts to comply with what's put out in the plan.
Stone - the Order requires that the Plan to the maximum extent practicable.
To implement with plan.
Hall - say we are going to clean lines every two years but do it every year instead. Order requires that we continuously improve our program to get to 0 spills. Hall concerned that we are out of compliance due to the fact where we set the benchmark.
Lewis - concerned about the fines. Hildabrand - from what I understand - the rates that are set is sufficient to fund the Plan as it is.
When we get NOV's the Board looks at how much we have tried. Fines are based on how well you have tried to eliminate spills. Per Stone, the Board looks at Notices of Violations in the past.
Packard - what level we can be content with?
Stone - we are not asking for additional resources or staff - what we have in our rates can take care of the plan. Just asking that plan be reviewed.
Packard - have had to make changes because of agency forcing the standards.
Hildabrand - is there a possiblity to add wording that will allow us to add verbiage. Stone nothing that prohibits that we can do whatever is possible.
Ball - I think adding words may be fine . .. I don't think it will actually reduce any liability. We will get fined because we have a spill and a number of factors will be considered. What is your level of effort and history. If possible can be added. Would rather diabuse Council that will protect us.
Wasko now reviewing due dates.

Hall - my understanding that we need to clean every pipe at least once a year 12" and under? How often do we scope- every other year.
Alan Wanamaker, Carlsbad, came forward to address Council. My original concern is that we don't try to go after a fly with a hawotizer. In the original order from Sacramento no direction given on how to combat FOG program. Would urge Council to give direction to Council, if something less than an interceptor can be used, then use something smaller.
Wasko - currently Mr. Wanamaker does not have a grease device at all. Is not contributing to the grease - we will continue to monitor that and wil allow him to use a grease trap.
Hall - there isn't any grandfathering? If a violation you will require an interceptor? Wasko - other measures can be taken to limit the FOG going down the drain to lower the FOG - if you aren't contributing FOG, will not force the installation of the device. Hall - will newer owners be able to self-certify. Wasko - our staff will be inspecting.
Dale - in restaurant business - usually a high turnover in kitchen staff - part is educating the folks working in the kitchen.
Hall - concerning item - cost of doing business - would like to see us bring in a private sector to help us. Would like to take the easiest part (25% of the city and outsource it for three years).
Lewis - maybe a workshop.
Hall - would like to review on how to outsource some of the work.
Hildabrand - we could go out to bid for the crew and vactor truck that is not used right now. Prefer to use least cost alternative.
Hall - am recommending three years so that scope of work can be understood.
