To consider amending the Carlsbad Municipal Code to add Chapter 8.45 regulating the consumption of alcoholic beverages or controlled substances by minors at parties, gatherings and events and to establish criminal liability for those hosting the events. Police Chief Tom Zoll came forward to address Council and explain the repurcussions of this ordinance. Linda Ledesma Juvenile Justice Program, more experimentation with alcohol, more truancy, what is the % of first time offenders 1/3 are alcohol or drug related offenses. They get alcohol at parties from adults. This ordinance affixes some responsibility to parents, or adult supervisors to stop serving alcohol to minors. Introduce Aaron Byzack North County Coalition.
President of North Coastal Prevention Coalition. Came forward to address Council to talk about why this is a problem and why we need to take action. The key club at CHS surveyd peers and huge amount have friends who drink underage. Youth coalition to advertise that oside and cbad have social host ordinances. Underage drinking is a major problem especially when adults supply the alcohol.
Some think the fine is too high but it has proven not to be. Long term outcomes-trending downward, % of 11th graders using alcohol is going down for the most part. Continue public awareness.
Not enough police offers in the street. this ordinance helps combat that.
Packard pointed out on slide 3 76% said alcohol was obtained by parents at parties.
Comments: Nicole Pappas spoke in support of the social host ordinance. 16% of 7th graders and 70% of 11 graders had had alcohol. Before the age of 12, 22% had tried alcohol.

City Attorney Ron Ball, 2 items before council for consideration, to raise the limits of liability for taxi cabs and introduce ordinance that would add codification to the principal that taxi cab drivers must have mandotory drug/alcohol testing to get a city license to drive taxi cab. Blackburn-taxi cab insurance limits are too low 100/300. Help from staff and they surveyed other cities and they have 1million limits. PAckard asked-did staff get info about difference in ins rates for those increases on taxi cab drivers. Erin Letsch same forward and did not lookin to it. Blackburn said he called an John Burnham insurance and asked this qeustion. Asked the average of rates for cabbies. Current cost at 100/300 2500 peryear, increase to about 3100 per year to increase to 1milion limit. Packard wants to know if smaller cab companies would go under because of the increase. He thinks its ok.

Returning the documents regarding the public hearing and they have been corrected. docs memorialized the density reduction and single family homes and prohibited big box stores by controlling the size and number of items and food items that could be sold. Those are part of the ordinance and approving resolution. Typo in one section of the ordinance- CS-051 the word and in the line 5, should be and and not or. To make clear the amount of sku's is 30000 or such other less amounts. Council is to determine if less sku's is ok per Ball recommendations.
Blackburn said these were discussed at the last meeting. This prevents a Walmart or something like it from moving into the location. This is allowed by law to prevent stores that are undesired for the area won't be allowed.

She is concerned that nothing air polution traffic rules from encina 4 and 5 new energy center and 12 traffic lanes from i-5 expansion.
Walt Meier, Carlsbad, came forward to address Coucnil. Mr. Meier spoke regarding overnight parking restriction. He thinks street parking in front of your home is your space. He wants overnight parking stickers for Carillo ranch restrictions. subsidizes some water meters for agricultural growing. Concerns about unscyncrenized traffic lights throughout the city. and wants traffic engineers to review traffic lights.
Josephina DiSalvo, Carlsbad, artist and resident, arts on the coast, please put painted crosswalks. During art walks and thursday walks on the coast need more crosswalks inthe areas around grand and state and jefferson. all village intersections with flourescent paint.
Thursdays on the Coast starting sept 24th. 5:30-8:30 free invited council and mayor to attend.

Errata sheet changes the resolution. No questions. Applicant is present. Jim Kennedy representing ATT. San Diego, has been operation in compliance and would like to ask for continuance. Open public hearing at 7:06. Jason Haines neighborhood, give proper color, when the wireless facility was built there was no policy in place. 2nd time this came up, packard said when att offered to move, packard said it would be like putting lipstick on a pig. The city got sued and had to allow the site tocontinue. This is the 3rd extension and he doesn't want it.
He also said this isn't right for the neighborhood. It's an eyesore because it doesn't fit cosmetically. Should be moved elsewhere in the city. doesn't belong in residential neighborhood. Mayor explain the lawsuit. Ball said there is a long history involved it was denied and the court said not sufficient evidence to deny. So nothing is different today so they have no evidence to chance the court decision. if it is denied and they get sued the court will uphold the original decision where the city had to allow it.

Will purchase inclusionary housing units. General plan is RLM and open space. Allows single family dwellings. OS designation is a mapping error, general plan amendment will correct that, no habitat value (not sure of the word) change rc to r-1. LCPA will bring the map into compliance. Project consistency, general plan local coastal program and zoning. Migratory bird treaty act, paleontology and noise impacts form El camino real, environmental review. Planning Commission approved.
Blackburn asked about what the project backs up to. what seperates the projects? Funk They abut but slope and landscape create a buffer. 10-50 of vertical seperation. No other questions. Moving from planning to construction phase. applicant. some changes were proposed, overview of changes, desalination plant, recongifuation consolidation, relocation and undergrounding pipelines, selection of backbone alignment. addition of new alignments. several alignments considered in original eir. new alignments have been proposed and that's being proposed tonight. proposed change affect physical aspects of plant and pipeliens, amend all approved permits and require minor text revisions to pdp and sp. with all the changes, they do not alter the desal process that was previously approved. check out the doesn't change slide.

planning commission action on the 19th of august they had 7 speakers. What's changed, plant configuration, structure sizes, undergrounding of some features, visible footprint, distribution pipelines with new alignments. general location is the same, quality of appearance, seawater intake and dischanger desal water output is all the same.
no power plant condition and public dedications, finding of extraordinary public purpose, 2006 eir analysis and findings.

Marco Gonzales, livia borak and silvia ornato, not present but were speakers at planning commission. Coast Keeper attorney, challenge the approval because its incomplete and the addendum is not right, CEQA issues. He provided a letter regarding the failures of the addendum, change in pipeline alignments 6 miles not previously reviewed in the EIR. He said they need to be reviewed because it isn't revealed in the EIR.
He said "in the roadway" for pipeline locations is not adequate. These are going into alternative cities, not make us not responsible to do the eir for other cities.

He refuted all of mr. gonzales comments so just refer to the letter. the stand alone anaylsis is something to comment on. precise pipeline analysis. Project will not be using more energy than originally approved. made it a better project.
some of the written materials claims that internal emails between staff saying we wouldn't comply with mitigation measures. He says that is not true. Peter came back speaks to insertion that no effort to work with surrounding agencies. much effort and support from the 3 oside vista and san marcos neighboring cities. to discuss pipeline corridors thru neighborhoods. held public meetins with other cities and well attended and well received 7:55 public hearing closed
blackburn- gonzales said no eir done on new pipeline- joe monico to answer the question. addendum to eir didn't specifically call out street segments. HE said it is not true, they did look at the new streets in the EIR.
He said all impacts were fully addressed. Hall asked anything in documentation we need to further study? have your read stuff from coast keepers? Scott said they read it briefly but cant answer to all of it but it appears to be same old arguments and issues previously discussed and addressed.
Monico analysis that city is punting impacts on other cities, he said it isn't true, it does take that into acct but some issues are to be resolved by those other cities becauwse those cities have to make those decisions.

Natural increase birth/death in the region. Slide showing how close their forecasts have been to show accuracy. sometimes over estimate and sometime under estimate. age group structures age sex graphs,
steps in the forecasting process. convert general plans for jurisdictions to see where additional growth can occur. estimateing existing plans and policies ep housing and job capacity, starts with existing general plans, includes constraints to development, natural constraints, habitat, steep slopes floodplains, bult enviormnet existing buildings and ingrastructure, policies,parking requirements.
anticipated growth and estimated capacity regionwide. then reviewed regional housing units and jobs, etc.
2040-2050 we run out of housing. need to increase density. in carlsbad 42000 housing units, have capacity of 65000 units. regional smart growth maps throughout the entire region. throughout carlsbad 4 smart growth areas, on existing 3 potential areas. Where do we go from here?
asked for authorization of staff to continue to work with SANDAG to look forward about where to put more housing. conclude presentation Blackburn asked: cooperative effort between sandag and staff. we are happy planning city according to residents needs but sandag asks for things residents don't want. Which is it happy cooperative effort or required changes? Ed said we work in cooperation, make general plan suggestions without asking first. Susan Baldwin sandag, regional housing needs assessment. She said the state makes some mandates so that's the stuff that sandag is more firm about when directing the city. that's what drives the housing element process-state law. But SANDAG does work with how the regional number from the state gets allocated. SB 375 requires sandag to better intergrate tranportation plan, growth forecast and housing needs.
Kulchin 1986 citizens voted on growth management plan, how does this forecasting effect? do you take that into consideration. They said yes because that growth mangment plan is reflected in the general plan and that's what they work with. Packard-which is it-do we have a choice or not? Hall- he thinks sandag is saying there will be a lot of give and take over the next 40 years. values questions for community-open space important to us. how do we as cities that come together, that work to balance out all the housing needs.
Mayor's problem, that sandag pushed housing to the coast instead of spreading it out more in the east county where there is more open space undeveloped areas. need more east west connectors in transportation corridors.

Linda Ledesma Juvenile Justice Program, more experimentation with alcohol, more truancy, what is the % of first time offenders 1/3 are alcohol or drug related offenses. They get alcohol at parties from adults. This ordinance affixes some responsibility to parents, or adult supervisors to stop serving alcohol to minors. Introduce Aaron Byzack North County Coalition.
President of North Coastal Prevention Coalition. Came forward to address Council to talk about why this is a problem and why we need to take action. The key club at CHS surveyd peers and huge amount have friends who drink underage. Youth coalition to advertise that oside and cbad have social host ordinances. Underage drinking is a major problem especially when adults supply the alcohol.
Some think the fine is too high but it has proven not to be. Long term outcomes-trending downward, % of 11th graders using alcohol is going down for the most part. Continue public awareness.
Not enough police offers in the street. this ordinance helps combat that.
Packard pointed out on slide 3 76% said alcohol was obtained by parents at parties.
Comments: Nicole Pappas spoke in support of the social host ordinance. 16% of 7th graders and 70% of 11 graders had had alcohol. Before the age of 12, 22% had tried alcohol.

City Attorney Ron Ball, 2 items before council for consideration, to raise the limits of liability for taxi cabs and introduce ordinance that would add codification to the principal that taxi cab drivers must have mandotory drug/alcohol testing to get a city license to drive taxi cab. Blackburn-taxi cab insurance limits are too low 100/300. Help from staff and they surveyed other cities and they have 1million limits. PAckard asked-did staff get info about difference in ins rates for those increases on taxi cab drivers. Erin Letsch same forward and did not lookin to it. Blackburn said he called an John Burnham insurance and asked this qeustion. Asked the average of rates for cabbies. Current cost at 100/300 2500 peryear, increase to about 3100 per year to increase to 1milion limit. Packard wants to know if smaller cab companies would go under because of the increase. Returning the documents regarding the public hearing and they have been corrected. docs memorialized the density reduction and single family homes and prohibited big box stores by controlling the size and number of items and food items that could be sold. Those are part of the ordinance and approving resolution. Typo in one section of the ordinance- CS-051 the word and in the line 5, should be and and not or. To make clear the amount of sku's is 30000 or such other less amounts. Council is to determine if less sku's is ok per Ball recommendations.
Blackburn said these were discussed at the last meeting. This prevents a Walmart or something like it from moving into the location. This is allowed by law to prevent stores that are undesired for the area won't be allowed.

He wants overnight parking stickers for Carillo ranch restrictions. subsidizes some water meters for agricultural growing. Concerns about unscyncrenized traffic lights throughout the city. and wants traffic engineers to review traffic lights.
Josephina DiSalvo, Carlsbad, artist and resident, arts on the coast, please put painted crosswalks. During art walks and thursday walks on the coast need more crosswalks inthe areas around grand and state and jefferson. all village intersections with flourescent paint.

Open public hearing at 7:06. Jason Haines neighborhood, give proper color, when the wireless facility was built there was no policy in place. 2nd time this came up, packard said when att offered to move, packard said it would be like putting lipstick on a pig. The city got sued and had to allow the site tocontinue. This is the 3rd extension and he doesn't want it.
He also said this isn't right for the neighborhood. It's an eyesore because it doesn't fit cosmetically. Should be moved elsewhere in the city. doesn't belong in residential neighborhood. Mayor explain the lawsuit. Ball said there is a long history involved it was denied and the court said not sufficient evidence to deny. So nothing is different today so they have no evidence to chance the court decision. if it is denied and they get sued the court will uphold the original decision where the city had to allow it.

Coast Keeper attorney, challenge the approval because its incomplete and the addendum is not right, CEQA issues. He provided a letter regarding the failures of the addendum, change in pipeline alignments 6 miles not previously reviewed in the EIR. He said they need to be reviewed because it isn't revealed in the EIR.
He said "in the roadway" for pipeline locations is not adequate. These are going into alternative cities, not make us not responsible to do the eir for other cities.

steps in the forecasting process. convert general plans for jurisdictions to see where additional growth can occur. estimateing existing plans and policies ep housing and job capacity, starts with existing general plans, includes constraints to development, natural constraints, habitat, steep slopes floodplains, bult enviormnet existing buildings and ingrastructure, policies,parking requirements.
anticipated growth and estimated capacity regionwide. then reviewed regional housing units and jobs, etc.
2040-2050 we run out of housing. need to increase density. in carlsbad 42000 housing units, have capacity of 65000 units. regional smart growth maps throughout the entire region. throughout carlsbad 4 smart growth areas, on existing 3 potential areas. Where do we go from here?
asked for authorization of staff to continue to work with SANDAG to look forward about where to put more housing. conclude presentation Blackburn asked: cooperative effort between sandag and staff. we are happy planning city according to residents needs but sandag asks for things residents don't want. Which is it happy cooperative effort or required changes? Ed said we work in cooperation, make general plan suggestions without asking first. Susan Baldwin sandag, regional housing needs assessment. She said the state makes some mandates so that's the stuff that sandag is more firm about when directing the city. that's what drives the housing element process-state law. But SANDAG does work with how the regional number from the state gets allocated. SB 375 requires sandag to better intergrate tranportation plan, growth forecast and housing needs.
Kulchin 1986 citizens voted on growth management plan, how does this forecasting effect? do you take that into consideration. They said yes because that growth mangment plan is reflected in the general plan and that's what they work with. Packard-which is it-do we have a choice or not? Hall- he thinks sandag is saying there will be a lot of give and take over the next 40 years. values questions for community-open space important to us. how do we as cities that come together, that work to balance out all the housing needs.
Mayor's problem, that sandag pushed housing to the coast instead of spreading it out more in the east county where there is more open space undeveloped areas. need more east west connectors in transportation corridors.
Susan added-with respect to eastern areas, gather forecast data. El Cajon 17k additional units they're taking. some areas are asking to take more units. been saying for 20 years that we have shortage in housing. carlsbad does have potential areas for more housing.
