Mayor Lewis gave an explanation of the process regarding the presentation of Item No. 1
In conformance with the Brown Act, no Council action can occur on items presented during Public Comment. A total of 15 minutes is provided so members of the public can address the Council on items that are not listed on the Agenda. Speakers are limited to three (3) minutes each. If you desire to speak during Public Comment, fill out a SPEAKER CARD and place it in the clear tray on the wall adjacent to the Deputy City Clerk. If there are more than five (5) speakers, the remaining speakers will be heard at the end of the agenda just prior to Council Reports. When you are called to speak, please come forward and state your name and address.
DEPARTMENTAL AND CITY MANAGER REPORT:
1. AB #20,235 - IMPASSE IN LABOR NEGOTIATIONS BETWEEN THE CITY AND CARLSBAD FIREFIGHTERS ASSOCIATION, INC. To consider resolving the impasse that exists between the City of Carlsbad and the Carlsbad Firefighters' Association, Inc. Resolution Nos. 2010-117 and 2010-118. ACTION:

Steve Berliner from Whitmore, Cassidy and LIemore (??) gave the presentation on behalf of the City. Human Resources Director Julie Clark and Debbie Porter, Sr. Management Analyst in HR. gave the PowerPoint presentation and report.
Mr. Berliner discussed the inflated rate of retirement contribution.
Mr. Berliner explained the city's cost for the firefighter's share to PERS.
Mr. Berliner explained the City's final proposal to the Firefighter's Association.
Mr. Berliner mentioned the amendment to the City Charter. He said that under PERS law and under contract general law the retirement benefits for existing employees cannot be reduced.
The City will be reporting the value of employee uniforms which will add to the retirement formula.
Mr. Berliner explained the amendment to the City Charter - two tiered retirement system for citizens to vote on.
CM Blackburn stated overtime pay is not a persable amount.
Mr. Berliner stated that the vast majority of overtime paid is not persable.
CM Blackburn clarified average base salary + the bilingual pay, the holiday pay, the paramedic license pay.
Mr. Berliner that part of the overall salary that pers will consider to determine the retirement benefits of the employee.
CM Blackburn.The average base pay + the average persable pay determined retirement formula.
CMB those employees fall under the firefighters barganing unit not management. Does a fire captain and fire marshal fall under CFA.
Sb - deputy fire marshall vacant - fire capatin is under CFA.
CM Hall - when you say 90 of their highest salary or is it 97.2%
SB - the maximum is 90%.
CM Packard - pension part of contract - CM Assoc. their recommendations and how does Carlsbad's proposal conform to the recommendations of teh CMs assoc.
SB it the 2nd tier does conform to the three year average.
CM blackbun how many cities have implemented this recommendation - entire package
Julie Clark - within the county, no other city's have not.
ROn Ball - report of the City MAnager's Assoc. to be included in the Minutes. HOld record open to put the report into the Minutes.
Mayor Lewis referred to average gross salary for paramedic fireman, the PERS payment estimatge how much this adds to the salary concept. Mayor total percentage benefit would be for a firefighter.
Debbie Porter is around 45-50% on top of salary currently.
Mayor Lewis asked what the average gross salary as far as male bread winner of each family per year.
Mayor Lewis clarified asking for the median income. = $75-$80,000.
Mr. Chris Platten with the firm Wily, McBride and Platten representing the Carlsbad Firefighter's Association Local 3730. Gave the Association's presentation via a PowerPoint presentation (on file in the Office of the City Clerk).
The ascention of the presidency Ken Sugahara and marked change in the bargaining process may not have been vetted through the process. The proposal that came at the impass meeting there has been a marked change from the initial process as CFA is proposing to go to a two tiered retirement system.
Mr. Patton provided a list of agencies that negotiated labor contracts with fire unions without implementing a 2-tiered system.
Mr. Berliner stated that rates go down the stock market returns reduce the employer's contribution rate. CALPERS assumption is lower than what is actually received.
The slide covers the pension retirement contribution only. Does not include any other costs.
Mr. Patton reviewed the city's financial portfoilio with the Council.
Mr. Patton referred to the retirement observation of John Bartel, the City's Consulting Actuary;.
Mr. Patton provided Council with two alternative proposals to consider. Mr. Patton addressed the amendment to the Charater - is a categorical limitation that is not benefitting any agency by taking away bargainning opportunities. Only one other city has an amendment is SF. You will put the city at an economic disadvantage as employees hire here, they will be immediately testing elsewhere to become employed. Firefighter do not participate in Social Security.
Mr. Patton - pension benefits political issues - see some legislative reform from the state. until this happens or labor market changes would not benefit the citizens of carlsbad to create retirement system in stone. CFA is open to discussing a two-tiered system.
CM Blackburn in the chance that council did take one o the prposal have these alternatives been voted on by the members.
Mr. Patton would write out terms and then be ratified for the Council and CFA.

Walt Meier of Carlsbad came forward to address Council. I was wondering if CFA was asking if the Firefighters were including the Golf Course if ???? was included in ???? (get this) or wanted to know if the charter amendment to be passed required a majority or 2/3 vote. Urged Council to realign their commitment to employees without comprimising safety.
Chris Cate on behalf of San Diego Taxpayers Assoc. Spoke in support of City's proposal. The Association stated that three of their recommendations were realized in the City's offer.
Mr. Ball stated that Council could go into Closed Session to deliberate the proposals from CFA.
Council adjourned into closed session at 6:47 p.m.

CM Blackburn wanted to add to the Minutes the decision to whether we continue and negotiate further he asked to have it split into two pieces. Not opposing the imposition of the pay salary issue, strongly believe we should be considering a much more detailed negotiation on the 2nd year retirement. Mr. Blackburn stated there were other ways to handle the second tier and thought that if the state went to a 2 tiered retirement program his concerns would be eliminated. will prevent the city from attracting any competent employees from staying and taking secondary pay. will support city employees negotiate other compensations of pay

1. GOVERNMENT CODE SECTION 54957.6 - CONFERENCE WITH LABOR NEGOTIATORS. The City Council, by motion, authorizes a closed session to discuss employer-employee relations, salaries, salary schedules and compensation in the form of fringe benefits of its employees represented by CFA with designated staff as labor negotiators (Cynthia Haas, Deputy Manager, Julie Clark, Human Resources Director, Kevin Branca, Assistant Finance Director, Debbie Porter, Senior Management Analyst and Steven Berliner, Liebert Cassidy & Whitmore).
If circumstances necessitate the absence of a specified designated representative, an agent or designee may participate in place of the absent representative so long as the name of the agent or designee is announced at an open session held prior to the closed session.
