- A request for approval of a Condominium Permit Amendment to enlarge a detention basin and re-site eight (8) units of a previously approved 37 unit detached air-space condominium project on property located north of Aviara Parkway, south of Corte Orchidia, east of Towhee Lane, and west of Black Rail Road within Local Facilities Management Zone 20. Motion to approve That the Planning Commission ADOPT Planning Commission Resolutions No. 6798 APPROVING a Condominium Permit Amendment (CP 06-19(A)) based on the findings and subject to the conditions contained therein including the August 16, 2011 from Craig Tucker. Moved by Commissioner Schumacher, no second required.

no questions of staff april tornillo, 501 h street, taylor morrison, gave a brief presentation and stated she would be available to answer any questions. no questions for applicant. opened public testimony tawny lawrence, corte orchidia, carlsbad, would like to have taylor morrison buy their home at fair market value. public testimony closed Commissioner Nygaard asked for clarification regarding dust and noise. During the grading there are rules regarding start times and watering for dust control. Commissioner Arnold asked where the home is next to this development. Commissioner Scully asked about problems on the construction site. What is the recourse and procedure. Mr. Neu responded Commissioner Scully asked about signage for the project type. Mr. Neu stated it would be at the developers discretion. Commissioner Siekmann asked if there is a monetary penalty with regards to starting work too early. No. Commissioner Siekmann asked if there will be mesh fencing. Mr. Halverson responded....construction fencing all around the site. Commissioner Siekmann asked if the applicant would be agreeable to more user friendly signage. Under review the price range. Chairperson L'Heureux asked about the early public noticing sign. Mr. Halverson responded. Applicant is responsible for putting the sign up. Commissioner Black asked Ms. Lawrence...Commissioner Black asked DISCUSSION Commissioner Nygaard commented that the new design of the project is a better design. Commissioner Siekmann stated the sooner construction can start the better it will look and could in fact improve everything. Commissioner Arnold stated he can support the larger basin. Commissioner Black stated his support of the project. Commissioner Scully concurred with her fellow Commissioners. Commissioner Schumacher stated his support the project. Chairperson L'Heureux also stated his support for the project.

Commissioner Nygaard stated that on the waterfront concept and transportation modes. Mr. Bhatia stated that is something they will look at. Walking bridge at Chestnut. Commissioner Black asked for clarification regarding the concept areas and the focus areas. Mr. Bhatia stated they needed to look 30 years in the future. Its for a balance of the various uses throughout the city. Commissioner Siekmann asked about hotels. Commissioner Arnold asked about the activity centers.
