PLANNING COMMISSION PUBLIC HEARING

CUP 204(E) - SAINT PATRICK PARISH SCHOOL
- Request for approval of a Conditional Use Permit Amendment to include the operation of "Saint Patrick’s Ye Olde Garage Sale" as an additional use and to retroactively extend the approval of the Saint Patrick Parish and School uses, which include nine mobile classroom buildings, on property generally located north of Tamarack Avenue, south of Magnolia Avenue, east of Pio Pico Drive and west of Adams Street, within Local Facilities Management Zone 1.

Planning Director Mr. Neu introduced Agenda Item 1 and stated Assistant Planner Greg Fisher would make the staff presentation.
Chairperson Whitton opened the public hearing on Agenda Item 1.
Mr. Fisher gave a brief presentation and stated he would be available to answer any questions.
Chairperson Whitton stated 2 letters have been received. Mr. Fisher stated two emails have been received.
Chairperson Whitton asked if there were any questions of Staff.
Commissioner Douglas inquired about the yearly review with Conditional Use Permit and why this garage sale was not noticed. Mr. Fisher stated the use was not included in any of the previous amendments. As for the annual review, given the conditions of approval, it would be very hard to notice the way the building is constructed. Commissioner Douglas asked about inspecting the interior of the building during the annual review. Mr. Fisher stated the owners are not typically interviewed. Mr. Neu stated only if there are special conditions placed on the property would the owners be interviewed. No advance warning. Intermittent on the site is why it was not noticed. Commissioner Douglas asked if the property was inspected after the emails from the neighbors were received. Mr. Fisher stated he did.
Commissioner Baker asked about the email received about the garbage and trash. Mr. Fisher stated that at first the letter claims the trash in on her property but staff does not know where that property is. A second complaint has been received from the same person about trash. The Code Enforcement Department reviewed the complaint the next day and did not find anything. Are thrift stores typically allowed in that neighborhood. Mr. Fisher stated staff has found it to be compatible, it’s well hidden, parking is in the parking lot and not on the street. It’s an incidental part of the church with limited hours of operation. Open to the public and donations are received from the public.
Chairperson Whitton asked if the applicant wished to make a presentation. Seeing none, he asked if there any members of audience who wished to speak on the Item. Seeing none, Chairperson Whitton opened and closed public testimony on the item.
Commissioner Cardosa asked from the July 30, 2007 email stated there was significant personal injury and wanted to know if there were any police reports filed. Nothing filed. No traffic problems reported either. Ed Davidson could not find any issue of violation. Forwarded a letter to the church inquiring about a daycare business or landscape property. Church has until March 3 to respond to that letter.
Commissioner Douglas asked what the next step would be if this project is approved. Mr. Fisher stated that a business license would be required to be legal, need to meet a sideyard setback. The church is aware of the issue and it will be addressed.

Deacon Mike Frazee, 294 Linda Lane, stated that he met with a general contractor this afternoon to assist with the setback issue. In regards to the daycare issue, the caretaker’s family is quite large with 11 children and there are grandchildren as well. Some of the older children work for a landscaping business which might lend some people to think there is something else going on.

- Request for denial of a Coastal Development Permit for the illegal construction of an existing 503-square-foot enclosure over an existing patio area, a fireplace/chimney, a built-in barbeque, and a block wall on the eastern portion of an existing single-family residence; and denial of a Variance to allow the block wall and a portion of the patio cover and fireplace/chimney to encroach up to 2.5 feet into the future public right-of-way of Ocean Street within the City’s Coastal Zone located at 5013 Ocean Street within the Mello II Segment of the Local Coastal Program (LCP) and Local Facilities Management Zone 1. Discussion
Commissioner Boddy stated she could agree with the CUP for the church and the school but did not support the retroactive approval of the new use. She cannot support the new use. She asked if the resolution can be biforcated.
Commissioner Cardosa can support the use.
Commissioner Dominguez stated that the City Staff is just as culpable as the applicant.
