CDP 07-11 - MORRISON RESIDENCE
- Request for approval of a Coastal Development Permit to allow for the construction of a 2,225 square foot single family residence within the City’s Coastal Zone located at 4338 Highland Drive south of Hoover Street within the Mello II Segment of the Local Coastal Program and Local Facilities Management Zone 1.

Morrison Residence Staff Report
Commissioner Dominiguez stated that he lives within the noticing area for the project and recused himself from the dais. Assistant Planning Director Gary Barberio introduced Agenda Item 1 and stated Assistant Planner Greg Fisher would make the staff presentation. Mr. Fisher gave a brief presentation and stated he would be available to answer any questions. Chairperson Whitton asked if there were any questions of staff. Commissioner Cardosa asked Staff to elaborate on the grading violations regarding the project. Mr. Fisher stated that the grading volumes were in excess of the grading ordinance which caused a stop work order on the project. Mr. Fisher stated the applicant will need to apply for a grading permit and it would then go through a review. Commissioner Cardosa asked about the utilities that are currently on site. Commissioner Montgomery asked the Commission was acting too soon on this application. Mr. Fisher stated that a grading permit would require this application to have been approved. Ms. Mobaldi stated that according to Condition No. 19 Commissioner Baker asked why grading occurred on the site prior to approval or prior to a grading permit being issued. Mr. Barberio stated it would be considered illegal grading. Commissioner Baker inquired why the applicant Commissioner Douglas asked about the existing home on the property. Mr. Fisher stated the existing home on the front of the property is slightly encroaching on this proposed site. Mr. Fisher directed the Commissions attention to a slide to indicate the property line and the existing structure on the front of the property. Commissioner Montgomery stated that the existing property is actually encroaching about 12 feet because of the side yard setback requirement. Mr. Fisher explained the options. Mr. Barberio stated.... Ms. Mobaldi stated..... Commissioner Baker asked if staff has verified on a map where the actual property line is. Mr. Van Peski stated that staff does not survey properties. Commissioner Baker suggested the project be continued so that these issues can be worked out. Commissioner Whitton asked if the applicant was required to submit a current survey of the property. Commissioner Montgomery commented that he would like to have the project continued so that more information can be obtained. Commissioner Boddy inquired if a survey would be required before issuance of a building permit. Mr. Van Peski stated that it would be required for a grading permit. Ms. Mobaldi stated that if a variance is required it should be done now and not later.
Motion to continue that the Planning Commission continue the item to August 6, 2008. Moved by Commissioner Baker, seconded by .

CUP 07-04 - ROBERTSON RANCH PA 22
- Request for a determination that the project is within the scope of the previously certified Robertson Ranch Master Plan Final Program EIR and that the Program EIR adequately describes the activities for the purposes of CEQA and a request for approval of a Conditional Use Permit to construct a temporary RV storage area within a portion of Planning Area 22 of the Robertson Ranch Master Plan located near the southeast corner of the intersection of Cannon Road and future Wind Trail Way in Local Facilities Management Zone 14.

Mr. Barberio introduced Agenda Item 2 and stated Associate Planner Barbara Kennedy would make the staff presentation. Commissioner Dominguez returned to the dais. Ms. Kennedy gave a brief presentation and stated she would be available to answer any questions.
Ms. Kennedy stated that a letter was submitted from Preserve Calavera regarding the project. Commissioner Dominguez asked for staff to expand on the meaning of pervious paving. Mr. Van Peski gave a detailed explanation of the term. Commissioner Dominguez inquired as to what type of pervious paving would be used. Commissioner Douglas asked about the security for the site. Ms. Kennedy stated that it would be enclosed with a brick wall. Commissioner Douglas further asked about how the Rancho Carlsbad community would be effected by this project. Ms. Kennedy directed the Commissions attention to a slide to indicate the location of the project and the location of Rancho Carlsbad. Commissioner Douglas inquired as to the future plans for the vacant area surrounding the RV Site. Commissioner Douglas asked about the future school site. Commissioner Boddy asked if the pervious paving would be used for the entire site or only a portion. Ms. Kennedy stated that it would be for a portion of the site and directed the Commissions attention to a slide to indicate the proposed area for the paving. Commissioner Boddy inquired about a vegetated bioswale. Mr. Van Peski responded. Chairperson Whitton asked if there were any further questions of staff. Seeing none, he asked if the applicant wished to make a presentation. Paul Klukas, 1530 Faraday Ave, Suite 100, gave a brief presentation and stated he would be available to answer any questions. Clarify intent of PA 14. Commissioner Montgomery asked about the intent for the permanent RV storage. Mr. Klukas stated that they are investigating PA 22 as the permanent RV site. Commissioner Boddy asked staff to identify the RV Storage lot on a slide in the presentation. Commissioner Dominguez asked where the permanent site is within the Master Plan. Commissioner Whitton asked if there were any further questions of the applicant. Seeing none, he opened public testimony for the item. Russ Kohl, 3317 Don Pablo, stated he is supportive of the temporary RV Site as proposed. Asked about conditions of approval within the EIR. Ms. Kennedy stated those conditions do not apply to the temporary RV site but will apply to the future plans. Bill Arnold, 3432 Don Ortega, president of the Rancho Carlsbad HOA, stated he supports the project.Does not want the capacity increased to 40 vehicles. Chairperson Whitton closed public testimony and asked if there were any further questions of staff. Commissioner Dominguez asked if staff could reasonably ensure the Rancho Carlsbad residents that it would not increase the amount of vehicles.
