Scott Barber, attorney for Newport Audiology, gave a detailed presentation and stated he would be available to answer any questions. Commissioner Baker asked about the use and the timing of the move. Commissioner Dominguez commented on the website as presented in the applicant's presentation and stated that it does not seem very restrictive to only industrial workers as was presented. Mr. Barber stated it is regulated by the zip code entered on the website. Commissioner Cardosa asked about specific zip codes and asked if the general public is restricted from using the site. Commissioner Cardosa asked about HMO referrals. Commissioner Douglas inquired about Table A and stated she could not categorize this use as a retail business. Mr. Neu stated that if it were to be classified as a type it would be classified as medical as allowed in the office zone. Vice Chairperson Montgomery asked if the business provide a substantial amount of industrial uses or more for general public use. Commissioner Douglas asked about the typical business day. Commissioner Douglas asked how long the lease is. Another year and a half. How much spent on tenant improvement. Mr. Barber stated he did not know.

Carlsbad Encina Auto Plaza Specific Plan
Commissioner Cardosa asked about the implementation for the completion of Avenida Encinas. Mr. Lynch stated there is a small westerly portion that would get improved. Mr. Van Peski stated there will be adequate transitions also. Commissioner Baker asked about the ADT comparisons. Mr. Lynch stated it is identified as lower ADTs. Commissioner Baker inquired as to how to make the street safe. Mr. Van Peski stated this project will be conditioned to build the street to its proper alignment. Vice Chairperson Montgomery asked about the frontage improvements. Mr. Van Peski stated it is because it is a remainder parcel. Commissioner Boddy asked if commuters will have the option to park on the street for the train/coaster terminal. Mr. Van Peski stated that when the street is improved on street parking. Commissioner Cardosa asked what would trigger the improvement on the remainder parcel. Mr. Lynch stated.... Jack Henthorn, 5927 Balfour Court, representing the applicant, gave a detailed presentation and stated he would be available to answer any questions. Commissioner Dominguez asked about the auto washing facility. The auto wash facility do use recycled water that is used for washing. Commissioner Dominguez asked if there were any other consideration to manage the employee parking. Mr. Henthorn stated the reason for the design for the parking is to help alleviate any parking issues and managing the parking. Commissioner Baker asked about the remainder parcel and why the entire property was not used. Mr. Henthorn stated he hopes that the Coastal Rail Trail might incorporate it into their site.
Commissioner Baker feels that the remainder parcel will be an eyesore. She asked if it could be used as open space, overflow parking for the transit parking. Commissioner Boddy asked if there was any consideration for drought tolerant plants throughout the site. Mr. Henthorn stated they have selected drought tolerant plants for those areas on the site that are compatible. Commissioner Boddy asked if any green building concepts have been incorporated into the design. Mr. Henthorn stated that some of the materials are recycled, and stated they are definitely seeking LEED certification however they are not far enough into the plans and construction drawings to specify those materials. Marian Donahue, 6458 Surfside Line, stated she is concerned about the traffic and customers test driving the vehicles along Avendia Encinas, car carriers traveling along Avenida Encinas, does not want any LED lights to be used, and the intercom systems. Richard Donahue, 6458 Surfside Line, asked if an EIR was prepared for the project. He is concerned with the scope of the project and the impacts it will have on the area. Tom White, 6453 Franciscan Road, stated the project will have quite an impact on the area. He is concerned with the light pollution from the project, the noise created by the unloading of vehicles, if there will be a CUP associated with the project. Patricia Sanchez, 6498 Franciscan Road, stated she is concerned with the compatibility of the project with the neighborhood and is mostly concerned with the street compatibility, should be the same consideration for setbacks for the west side of the project, light pollution. Ken Vallone, 6462 Franciscan Road, stated he does not support the project. He stated the project is not compatible with the surrounding homes, the light pollution is troublesome, accidents along Avenida Encinas,
Craig Sturgis, 6477 Franciscan Road, stated he is in opposition to the project. Jeff Turpin, 6456 Franciscan Road, stated his opposition to the project. He is concerned with noise and light pollution, construction impacts. Public Testimony closed. Mr. Lynch stated many of the issues are enviromental issues. Mr. Lynch explained the triggers for an EIR, noise guidelines. The light mitigation plan be prepared. Non or low pressure sodium lights to be used. Commissioner Baker Commissioner Dominguez asked about the distance from the street to the building. New lighting source to the first residential building. Mr. Henthorn stated roughly 350 feet. Mr. Lynch stated care should be taken in the car display area to direct lighting to the east and downward. Mr. Henthorn stated a lighting study was prepared. Rick Tavares, lighting specialist, Investigative Science and Engineering, stated a noise and lighting study was prepared. Commissioner Boddy asked about the lighting for the Audi Building. Needs to be updated to include all the dealerships along with a rendering to demonstrate the lighting for night into early morning. Visual depictions of the lighting standards. hours of operation sales end at 9:00, lighting could be cut down at 9:00 instead of 10:00, concerned with security lighting. no outside intercoms. Mr. Lynch stated vehicle speed is regulated through the police department, test plan for the test driving of cars, signal should help traffic at the intersection, not required to widen the road all the way to PAR.
