Senior Planner Van Lynch responded in detailed to all the issues raised at the previous hearing and stated he would be available to answer any questions. Chairperson Whitton asked if there were any questions. Commissioner Baker stated several letters requested that an EIR be prepared for the project. Commissioner Baker asked what an EIR does for the project and if it stops the project from moving forward. Jane Mobaldi, Assistant City Attorney, stated it would prolong the project but it would not stop the project from progressing. There are review periods and response periods that take time. She further stated there must be substantial evidence that the project will result in a significant impact in order to proceed with an EIR. Staff prepared a Mitigated Negative Declaration and feels those impacts have been mitigated to the point that will not reach a level of significance. The Commission is allowed to consider credibility of the public, however, public opposition in and of itself is not evidence enough. Chairperson Whitton asked if there were any further questions. Seeing none, he asked if the applicant wished to make a presentation. Jack Henthorn, Henthorn and Associates, Balfour Court, responded to all the issues raised at the previous meeting and stated he would be available to answer any questions. Dr. Rick Tavares, Investigative Science and Engineering, 11444 D Street, Ramona...90 dBA is the point at which earplugs need to be worn, at 3 feet, it would be cause permanent hearing damage. Dr. Tavares gave a detailed presentation regarding noise and lighting and stated he would be available to answer questions. Chairperson Whitton asked if there were any questions of the applicant. Chairperson Whitton asked for a description of the light shields. Dr. Tavares explained the shields. Commissioner Montgomery asked about the lighting being mercury vapor lights compared to the low pressure sodium lights. Commissioner Dominguez asked for a comparison between the existing Car Country Carlsbad and this proposed project. Mr. Hofman stated that there is a condition regarding the lighting and that it cannot change unless it is approved by the Commission. Commissioner Dominguez asked about lighting on the ballard lighting. Mr. Hofman stated those are very detailed questions but the Commission can condition those lights to be shielded.
Commissioner Baker commented about the lighting conditions because only a certain amount of light can escape the site. Mr. Neu stated that the condition that was modified should tie back to the lighting study. There will be a post installation study to verify that. Chairperson Whitton asked about the music on site. Mr. Hofman stated there is a condition where the sound emitted from speakers cannot exceed 3 decibels beyond the amibient. Mr. Neu stated that was included in the Errata Sheet. Commissioner Douglas asked if the level of music would be similar to the Forum shops. Commissioner Douglas asked about the hours of operation. Open for business. Sales are open at 8:00. Deliveries? Will be during business hours. Every effort is made to deliver the vehicles to be during business hours. Designated drop off area for the vehicles. Can hold up to 3 car carrier trucks. Commissioner Douglas stated she wants to ensure all possible actions have been taken so that the residential neighborhoods remain safe. Mr. Hofman stated measures have been taken all along during this project. Chairperson Whitton asked about the deliveries will not unload until site opens. Same with used vehicles. Commissioner Montgomery asked Mr. Hofman to respond to the increased traffic generation. Mr. Hofman stated that in the Circulation Study took into account this project as well as the potential future plans for the area. Three mitigation required. The trips were accounted for and mitigation measures were put in place for this project. The peak trips are lower with less impact to roadways.
Commissioner Montgomery... Mr. Hofman stated that with the proposed mitigation the impacts are less. What benefit is the over the existing. Increase in taxes that the City will get. Commissioner Dominguez asked about the improvements to Avenida Encinas. Mr. Lynch stated that it would be built to full width but only striped to one lane until such a time that warrants. Commissioner Boddy...clarification on traffic increase. Mr. Van Peski stated.... Chairperson Whitton asked about traffic signals. Mr. Van Peski stated the project proposes a traffic signal at the main entrance to the coaster station. Chairperson Whitton acknowledged receipt of the letters and the Errata sheet for the project. Commissioner Montgomery asked for clarification on the remainder parcel. Commissioner Montgomery is concerned with the City carrying the burden of the project. Ms. Mobaldi reminded the Commission that the minor subdivision is not part of the approval tonight. Commissioner Montgomery.... Mr. Neu stated the remainder parcel is of a size and shape that it would not create a dividable lot. Through the SP, the road could be improved now and the applicant can be reimbursement at a later date. Commissioner Montgomery asked if it could go away...The commission does not have any authority to make the remainder parcel go away. The
Mr. Neu stated that Errata does include those provisions. Commissioner Cardosa asked if the reports are public and asked if Mr. Vallone has inspected any of the reports. Mr. Lynch stated no. Chairperson Whitton commented on public testimony. Patricia Sanchez, ??? Franciscan Road, stated that a traffic light is not wanted. The light is light pollution. Ms. Sanchez asked if the light could be angled. Mr. Van Peski stated there is a procedure for shields to be placed on the lights. Bill Wisener, 64?? Surfside Lane, commented on the signage. North and south bound only and not illuminated. Eric Hall, 6459 Franciscan Road, asked if the Commission and Staff had considered the cumulative effects of noise on the surrounding neighborhoods. Has the test track been tested for noise. Horns and decibels levels. Did traffic study contemplate employee trips, patrons coming for sales, deliveries, patrons for service, the variety of the trips per day. Project should have a focused EIR. Mr. Van Lynch deferred to the accoustical engineer. Dr. Tavares stated that cumulative effects were examined. Tommy White, 6453 Franciscan Road, stated the ultra modern design of the project does not belong in this area. Craig Sturgis, 6477 Franciscan Road, stated the train is intermittent unlike the noise from the dealership. Mr. Van Peski stated the SANDAG.....
Ken Vallone, 6462 Franciscan Road, stated that the benefit for the City or the citizens has not been addressed. The operational hours for Office Commercial are less. Against the project. Commissioner Montgomery asked for clarification regarding the intermittent noise of the railroad. Dr. Tavares stated there is also the noise from the PCH, the freeway. The sound on site does not get any lower to the mid 50's. Commissioner Baker asked Staff to discuss the comment period for the Negative declaration. Mr. Lynch stated that throughout the project there have been many notices. CEQA for 30 days.
Commissioner Dominguez asked Ms. Mobaldi about fair argument standards. Ms. Mobaldi stated that the Commission needs to look at the project as a whole..... Commissioner Dominguez asked if there is such a thing as a focused EIR. Mr. Neu stated yes and there would only be those issues that were felt to be pertinent to the project. Mr. Neu pointed out to the Initial Study. The technical studies are not available on the website. DISCUSSION Commissioner Cardosa can support the project as presented. Commissioner Boddy does not see a great benefit to the project and feels the site is properly zoned as it is. Commissioner Douglas stated she is concerned with the proximity to the residential. Commissioner Dominguez stated the dynamics with this project as compared to Car Country Carlsbad is completely different. He further stated he agrees with Commissioner Boddy. Commissioner Baker stated this is a good thing for the City and provides increased sales taxes. She stated the project is conditioned with all the lighting and noise studies. Test garden on rectangular property. She is not objected to this project. Commissioner Montgomery stated he agrees with Commissioner Boddy.Would like to pause and consider effects on the area as a whole. Chairperson Whitton stated he can support this project. Impacts have been treated.

Currently no plans to stub future solar panels but will stub for solar heating. Commissioner Boddy asked if the conservation is for during the construction or after the homes are built. Water conservation is for post construction. Commissioner Baker asked Mr. Pevney if there are fire retardant protections. Allison Moreland, 415 S Cedros, Solana Beach, stated the wood is a wood laminate.

Commissioner Boddy does not see a great benefit to the project and feels the site is properly zoned as it is. Commissioner Douglas stated she is concerned with the proximity to the residential. Commissioner Dominguez stated the dynamics with this project as compared to Car Country Carlsbad is completely different. He further stated he agrees with Commissioner Boddy.
