PLANNING COMMISSION PUBLIC HEARING

1. SDP 97-25(A)x2 - KELLY CORPORATE CENTER - Request for a Site Development Plan Extension to allow the construction of a 50,000 square foot, two-story multi-tenant office building on a 25.28 acre site generally located adjacent to and on the south side of Palomar Airport Road between Hidden Valley Road and Aviara Parkway in Local Facilities Management Zone 5.

Motion to approve that the Planning Commission ADOPT Planning Commission Resolution No. 6537 APPROVING a retroactive four-year time extension of SDP 97-25(A)x1 (from October 6, 2008 to October 5, 2012) based upon the findings and subject to the conditions contained therein. Moved by Commissioner Douglas, seconded by Commissioner Dominguez.

Mr. Neu introduced first item. Staff gave a brief presentation. Chairperson asked for questions of staff. Commissioner Dominguez asked when the retro extension would apply. 2. CUP 08-22 - VERIZON CARLSBAD HIGH SCHOOL WCF - Request for approval of a Conditional Use Permit to allow the removal of an existing Wireless Communication Facility (WCF), the placement of a temporary mobile WCF on site during the construction phase of improvements, and the installation, operation, and maintenance of a new unmanned Wireless Communication Facility consisting of three (3) sectors of four antennas, (12 total), and one microwave antenna mounted to a new athletic field sports light standard with an equipment enclosure near the base of the light pole within the Carlsbad High School property located at 3557 Monroe Street (Lancer Way) and in Local Facilities Management Zone 1.

Motion to approve that the Planning Commission ADOPT Planning Commission Resolution No. 6536 APPROVING CUP 08-22 for a period of ten (10) years, based on the findings and subject to the conditions contained therein. Moved by Commissioner Douglas, no second required.

Mr Neu introduced the second item and stated Planner Dan Halverson will give brief presentation. Chairperson asked if there are any questions of staff. Chairperons asked if any other cell providers are expected to bring in applications. Staff stated no. Commissioner Boddy asked if there was any way to co-locate the two companies cell towers. Staff stated there would be interference in frequencies. Applicant: Todd Petty 3848 Campus Drive #118 Newport Beach CA Commissioner Dominguez asked if it would ever be possible to co locate the equipment shelters. Mr. Petty stated yes they could but have a corporate policy in place barring them from sharing shelters for security reasons. Commissioner Dominguez stated the Commission is still on a learning curve and will not try to change policy. Commission Cardosa asked what the life span of the visibility of the equipment. Mr. Petty stated the antennas usually get upgraded every 5-10 years. Open and closed public testimony. Motion

Public Comment not on agenda: Plastic manhole covers. Karl Higgins, 1517 Roma Drive, Vista Representing a home grown company in Vista producing plastic manhole covers. Mr. Higgins gave a brief presentation. Explained that concrete manholes leak. Plastic covers will not. Gave numerous points of what these covers can provide the city. Mr Dominguez asked if any cities that have already used these covers Mr Higgins stated yes San Diego is already using them and Fallbrook and Leucadia are in the process of inputting these in their cities. Mr. Montgomery asked if they can be retrofitted. Mr Higgins stated yes. Referenced slide. Danny Jimenez 853 Pinewood Drive Oceanside, (Carlsbad). spoke about Car Country Carlsbad. Stated the car business is in a big slowdown. States Car Country needs a new updated sign to display incentives for all businesses in the area. Would like guidance from the Commission on how to get the sign. Chairperson Montgomery stated he will pass on his comments.
