CUP 03-06x1 - TAMARACK AT&T WIRELESS
- Request for a retroactive ten year extension of Conditional Use Permit No. CUP 03-06 to allow the continued operation of an existing unmanned Wireless Communications Facility consisting of a 250 square foot equipment room and six (6) panel antennas mounted on a 31 ½ foot tall mono-palm structure located at 4901 El Camino Real in the R-A-10 and C-2-Q/C-2 Zones and in Local Facilities Management Zone 1.

- A request for a recommendation to adopt a Negative Declaration, and recommendation of approval of a Zone Code Amendment and Local Coastal Program Amendment to: 1) repeal and replace the Nonconforming Buildings and Uses - Chapter 21.48 of the Zoning Ordinance, 2) include new and amended associated definitions in Chapter 21.04 - Definitions, 3) amend Chapter 21.46 -Yards to delete Section 21.46.210 and 4) amend Chapter 21.44 - Parking to revise Section 21.44.010. Motion to approve that the Planning Commission ADOPT Planning Commission Resolution No. 6573 RECOMMENDING ADOPTION of a Negative Declaration and ADOPT Planning Commission Resolutions No. 6574 and 6575 RECOMMENDING APPROVAL of ZCA 09-01 and LCPA 09-01 based on the findings contained therein. Moved by Commissioner Douglas, no second required.

Vote to approve that the Planning Commission ADOPT Planning Commission Resolution No. 6573 RECOMMENDING ADOPTION of a Negative Declaration and ADOPT Planning Commission Resolutions No. 6574 and 6575 RECOMMENDING APPROVAL of ZCA 09-01 and LCPA 09-01 based on the findings contained therein. Principal planner, Chris DeCerbo, presented for Staff. Commissioner Baker requested a response from Staff regarding the Brechtel's letter to the Planning Commission. Commissioner Dominguez asked for clarification as it related specifically to the Brechtel's home. Commissioner Baker requested clarification on the trigger for notification of neighbors. Per Mr. DeCerbo, being the Coastal Development Zone. Felicia Brechtel addressed the commissioners to express her concern regarding how the revisions to the abatement code will encourage non-residential uses. Wayne Brechtel addressed the commissioners to explain how these changes to the code would affect their property or their ability and costs of making repairs or additions. Mr. Brechtel is requesting the retention of the 40% rule for modest projects to go forward, remove nonconforming buildings in a residential zone from the abatement process, and remove the abatement phrases altogether or clarify the language. Chairman Montgomery requested Staff to respond to the Brechtel's comments. Assistant City Attorney, Jane Mobaldi, also clarified the intent of the abatement clauses; the law will provide due process, rather than arbitrary abatements. Planning Director, Don Neu, commented that there are variations to the phraseology within the code. Commissioner Baker asked if it would be possible to limit the repairs, etc., by square footage, rather than a percentage of value of the property. Chairman Montgomery offered that many cities limit by restricting additions, etc., conform to the current code. Commissioner Dominguez would like to propose that City Council adopt policies to ensure the code to encourage improvements. Planning Director, Don Neu, explained the intent was indeed to encourage repairing, remodeling, etc., older buildings. Commissioner Douglas requested Staff to clarify whether this code would become part of the City's General Plan; yes. ultimately. Commissioner Boddy commented on all of the Brechtel's suggestions; she could not support them, but is in favor of relaxing some of the abatement procedures.
