Chairperson Montgomery opened public testimony on the item. Walt Meier, 2332 Stanford Street, stated the units should be spread out along the transportation corridors and public transit areas throughout the city. Wendy Hinman, 2080 Basswood Avenue, read a letter from the Carlsbad Historic Preservation Committee and advised the Commission to preserve the Quarry Creek area. Jan Unanue, 1413 Denise Circle, Oceanside, speaking on behalf of the Carlsbad Historical Society, asked the Commission to preserve the Quarry Creek area and remove the area from the SmartGrowth designation. Commissioner Douglas asked where in Oceanside Ms. Unanue lives. Ms. Unanue stated she lives in the Fire Mountain area. Amy Johnsgard, 7313 Basso Court, law clerk with the Environmental Law Clinic representing Preserve Calavera and Diane Nygaard, stated her opposition to the project. Chairperson Montgomery asked Ms. Johnsgard about the data sources. Ms. Johnsgard stated that the data source for the census is understandable, the others could be more current than what was stated in the staff report. Clint Engleson, 4968 Longbranch Ave, San Diego, also a law clerk with the Environmental Law Clinic representing Preserve Calavera and Diane Nygaard, stated his opposition to the Mitigated Negative Declaration for the project. Bob Eggers, 5810 Riley Street, San Diego, also a law clerk with the Environmental Law Clinic representing Preserve Calavera and Diana Nygaard, stated his opposition to the impacts of the development of Quarry Creek. Commissioner Baker asked Staff if a project would need an EIR at a later date. Mr. Donnell explained.
Anne Hallick, ??, stated the Quarry Creek is ineligible for inclusion of in the 2005-2010 Housing Element. Shelley Hayes-Carron, resides in the Buena Vista Adobe in Carlsbad, stated her opposition to the project. Penny Johnson, 1360 Hillview Court, stated it is imperative to save the Buena Vista Valley and concurred with the previous speakers including the legal issues and environmental issues. Mel Vernon, 1044 North Ivy, ??, Baht, 911 Rosemary Avenue, representing Carlsbad High School's ?? Club, stated his opposition to the project. Diane Nygaard, representing Preserve Calavera, stated her opposition to the project and asked the Commission to remove the Quarry Creek site from the Housing Element. Kathryn Nikias, 1675 Caliandra, read a letter in the record in opposition to the Bridges @ Aviara development. Don Christiansen, 3715 Longview Drive, Carlsbad, gave a brief PowerPoint presentation and stated his opposition to adding Quarry Creek to the Housing Element. Karen Merrill, 6901 Quail Place, showed a movie from Preserve Calavera, Commissioner Douglas asked about the Kohls Shopping Center and the sign. Dennis Huckabay, 2319 California Street, Oceanside, president Buena Vista Audubon Society, would also like to see the Quarry Creek site removed from the Housing Element. Anne Gunter, The Lightfoot Planning Group, speaking on behalf of Hanson Aggregates, gave the Commission updates regarding the reclamation and remediation processes currently underway by Hanson Aggregates. Chairperson Montgomery asked about Ms. Hallick's comments regarding certain contamination levels. Commissioner Dominguez asked approximately when the remediation process will be completed. Ms. Gunter stated to submit the cap in 2010. Commissioner Dominguez asked if the information that is available and if it was made available to the City. Mr. Donnell stated he had been on the web site. Brian Milich, 2750 Womble Road, representing Corky McMillin, stated he is available to respond to questions. He further commented that he would be available to answer any questions from the public regarding issues with the Quarry Creek site.
Ralph Williams, 1665 Docena, stated the Housing Element should not be used to attack zoning, to be used for spot zoning, He stated his opposition to the Bridges at Aviara development. Deana??, 6606 Fiona, commented on the Bridges at Aviara. Julie Leeder 3696 Amante Court, stated her objection to the Bridges at Aviara development. Victoria Scully, 1683 Caliandra Road, spoke in opposition to the Bridges at Aviara development. Mary Jane Jagozinksi, representing La Costa Paloma Apartments, stated she is also concerned regarding the traffic around the proposed Bridges at Aviara development but does support of the Bridges at Aviara. Joyce Gammon, 3258 Pearl Lane, Oceanside and 270 Juniper, Carlsbad, stated her concerns regarding the air pollution from the Hanson Aggregate site, and asked if AB 2345? could be revised through a petition. Chairperson Montgomery closed public testimony.
Chairperson Montgomery asked Staff to respond to the issues brought up during public testimony. Mr. Donnell stated the Housing Element is policy document. It simply establishes a frame-work for The Housing Element will not change any existing open space designation. El Salto Falls and Buena Vista Creek Valley is acknowledged as a sensitive site containing sensitive resources. Regarding outdated data as cited by Environmental Law Clinic, the data is acceptable by HCD. In Staff's opinion, the MND is adequate and are considered at a program level and the mitigation is adequate. Deleting any sites from the Housing Element would further delay the Housing Element. Regarding Bridges at Aviara project would occur with or without the Housing Element. The affordable component is required by the Inclusionary Housing Ordinance. Alternative sites have been looked at within the City but there are too many restrictions, etc. Ms. Mobaldi stated CEQA does provide... Commissioner Douglas asked staff to respond to spot zoning. Mr. Donnell stated that comment was in regards to the Bridges at Aviara project. Commissioner Douglas asked about traffic congestion. Mr. Donnell responded. Commissioner Douglas asked about lack of financing. Mr. Donnell responded. Commissioner Douglas asked about hazardous soil, water and vapor, and lateness in the delivery of the Housing Element. Mr. Donnell responded. Commissioner Dominguez asked if the DEH issued a concurrence letter on the CAP. Mr. Donnell deferred the question to Ms. Gunter or Mr. Milich. Commissioner Dominguez asked about the inventory of public property throughout the city of Carlsbad. Mr. Donnell stated the City does not have an abundance of land available. Commissioner Douglas asked about the value of the property at Quarry Creek. Mr. Donnell stated.... Commissioner Douglas asked about the property on Avenida Encinas. Mr. Donnell stated that property is under a deed restriction for waste water treatment. Commissioner Nygaard stated the Housing ELement does not guarantee that housing would be built during the life of the document. Mr. Donnell stated that was correct.
Chairperson Montgomery directed the Commission's attention to page 6.2 of the Draft Housing Element so that the Commission could go through the Element in general. Chairperson Montgomery asked Staff to discuss the siting methods used in the Housing Element. Commissioner Dominguez asked if any property owner declined increasing their zoning designations. Mr Donnell stated there were a few. Commissioner Baker stated she agrees with adding additional units to downtown, the Barrio and the shopping centers. She stated the appropriate time to discuss the issues regarding zoning at particular sites would be when a project is before the Commission. Commissioner L'Heureux asked for clarification regarding Ms. Hallick's comments concerns the timing of the Housing Element. Mr. Donnell responded. Ms. Mobaldi responded. Commissioner Baker asked about... Mr. Neu commented about the timeliness of the Housing Element. The primary option would be to go back to find a site, or sites, that are compatible. Mr. Neu.... Commissioner Dominguez asked about the final number of units. Commissioner Schumacher asked about the potential Commissioner Douglas reminded the Commission about the La Costa Town Square project. Commissioner Douglas asked if more units could be added to the Barrio area. Mr. Neu responded. Chairperson Montgomery asked if the City is projecting to achieve even further units in the future. Mr. Donnell stated yes. Mr. Neu stated....
Ms. Mobaldi stated the City runs the risk without a certified housing element. Commissioner Baker stated the Commission is not approving any development and it not saying yes or no to any projects. Commissioner L'Heureux stated the Commission is struggling with the issues, and acknowledges Staff has done a phenomenal job evaluating the sites. Commission Douglas motion to continue. 7-0 vote Commissioner Douglas asked about homeless shelters, emergency shelters and transitional housing. Mr. Donnell directed the Commission's attention to the slide and discussed the issues. Debbie Fountain, Housing and Redevelopment Director, gave a brief explanation. Chairperson Montgomery asked about the Excess Dwelling Unit Bank. Mr. Donnell stated it will be significantly drained to implement the programs of the Housing Element. Commissioner Dominguez asked for clarification regarding the Excess Dwelling Unit. Commissioner Douglas asked about density in the Barrio. 28 is the highest proposed. Chairperson Montgomery asked about the Barrio and if there will be a specific plan to help guide the development. Mr. Neu stated....
Commissioner Douglas asked how much funding would be lost if there is not a certified Housing Element. Mr. Donnell stated roughly a $100,000/yr. Ms. Fountain... Commissioner Nygaard stated it is really important for the Commission to move forward with this as quickly as possible. Incremental funding would not be affected. Commissioner Dominguez stated the document does have some impacts and that is why the MND is required. Chairperson Montgomery inquired about the potential environmental impacts. Mr. Donnell responded....
Commissioner Baker thanked Staff for the hard work. She stated this document does not convey development rights. It is something that has to be done for the state of California. She can support the Housing Element. Commissioner L'Heureux thanked the public for bringing up all of the issues regarding the Housing Element and potential development in the city. He feels Staff has done an exhaustive job with the document. He stated he can support the document. Commissioner Nygaard stated she can support the document. The City needs to do it whether the Commission likes it or not. This is a feasibility forecast. She thanked Staff for their hard and extensive work. She also thanked the public for coming out and voicing their opinions. Commissioner Schumacher also thanked the community for stating their concerns, and he stated his support for the document. Commissioner Dominguez also thanked Staff as well as the public. He feels there is enough uncertainty regarding the Buena Vista Creek development and other areas that he cannot support the document. Commissioner Douglas commented on the beauty of the site and hopes that the Commission can achieve some sort of balance. She agrees the Staff has done a great job and she understands the City's obligation to the state. Chairperson Montgomery stated that the City's obligation to the state is enough to garner his support of the document.
