SUP 09-06- TU CASA REVETMENT
- Request for approval of a Floodplain Special Use Permit to perform maintenance on a wave and tide rock revetment along the north shore of the Agua Hedionda Lagoon for the Tu Casa Homeowners Association on property located at 4747 Marina Drive, in the Agua Hedionda Lagoon Segment of the Local Coastal Program and in Local Facilities Management Zone 1. Tu Casa Revetment Staff Report
Motion to approve that the Planning Commission ADOPT Planning Commission Resolution No. 6664 ADOPTING a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program, and ADOPT Planning Commission Resolution No. 6665, APPROVING a Special Use Permit (SUP 09-06) based on the findings and subject to the conditions contained therein including the errata sheet and the additional condition Moved by Commissioner L'Heureux, no second required.
Vote to approve that the Planning Commission ADOPT Planning Commission Resolution No. 6664 ADOPTING a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program, and ADOPT Planning Commission Resolution No. 6665, APPROVING a Special Use Permit (SUP 09-06) based on the findings and subject to the conditions contained therein including the errata sheet and the additional condition (Approved) (Recorded at 00:20:59)
Chairperson Douglas acknowledged receipt of a letter from the HOA president. What becomes of the newly improved area?. Presently the area is entirely covered by the tide. CCC may require that through issuance of the CDP. Michele Alves, Hofman Planning and Engineering, gave a brief presentation and stated she would be available to answer any questions. Chairperson Douglas asked if there were any questions of the applicant. Public testimony opened and closed.
Commissioner L'Heureux stated that he is concerned with the timing of the approval from Coastal Commission. He stated he would like a condition to provide a notification to the residents 15 or 20 days prior to the start of construction. Ms. Mobaldi stated that would be allowed. Commissioner L'Heureux also stated his concern with the equipment being used. Dave Skelly, 5741 Palmer Way, stated that due to the tidal constraints, work will only occur a few hours a day. There should be about 4 dump truck trips. No loud machinery. Low impact equipment. Mr. Skelly asked for clarification regarding the noticing. Commissioner L'Heureux stated a mailed notice to the homeowners would be adequate. Ms. Alves stated the HOA is in agreement to noticing 2 calendar weeks prior to the commencement of construction and is consistent with the coastal requirements which is 100' and to include the access route and staging area.

CDP 05-33x1(A) - POINSETTIA RIDGE
- Request for the approval of a Coastal Development Permit Amendment to allow for the revisions to previously approved floor plans, elevations and plotting plan for 16 single-family detached residential dwelling units on previously subdivided lots generally located on the southeast corner of Song Bird Avenue and Black Rail Road within the Mello II Segment of the Local Coastal Program and Local Facility Management Zone 20. Tom Tupman, representing Warmington Homes, 3090 Pullman Street, Costa Mesa, gave a detailed presentation and stated he would be available to answer any questions. Tanwy Lawrence, Corte Orchidia, stated her concerns regarding construction occuring on Saturdays per the notice she received. Glen Van Peski, Senior Civil Engineer, stated the working hours are 7:00 - sunset M-F and 8:00-sunset on Saturday. Weekend work requires a special procedures and does not happen unless there are special considerations. The inspections department can Commissioner Baker asked if workers are being a nuisance who can residents contact. Code Enforcement or Construction Inspections. Commissioner L'Heureux asked if the Code Enforcement contacts the complaintant with a follow-up to inform the residents what actions were taken. Mr. Van Peski stated yes. Mr. Neu stated that for a project under construction, the project Building Inspector would be the first person to speak with. Mr. Tupman stated his number will be on the sign along with the superintedents.
Commissioner Baker reminded the Commission of the Power Plant Hearings. Mr. Neu stated there is a fact sheet regarding the Pontebello Project.
