SDP 06-06(A) - ROBERTSON RANCH PA 19 PARKING TRELLIS
- A request for approval of a Site Development Plan Amendment to allow for the addition of a 3,250 square foot single story trellis structure over the parking lot within the community recreational area of Robertson Ranch Planning Area 19 on property located at 3700 Glen Avenue, within Local Facilities Management Zone 14. Resolution No. 6680

Motion to approve ADOPT Planning Commission Resolution No. 6680 APPROVING Site Development Plan Amendment SDP 06-06(A) based on the findings and subject to the conditions contained therein. Moved by Commissioner L'Heureux, no second required.

Chairperson Douglas acknowledged receipt of the errata sheet. Commissioner Baker asked if the panels will be flat or tilted. Mr. Halverson stated he had been shown flat. Commissioner Nygaard asked about the landscaping because the landscaping looks very mature. Chairperson Douglas asked if the applicant wished to make a presentation. Paul Klukas, Planning Systems, 1530 Faraday Ave, Suite 100, on behalf of Brookfield Homes, gave a brief presentation and stated he would be available to answer any questions. Chairperson Douglas asked if there were any questions of the applicant. Commissioner Dominguez asked if the trellis was part of the original project approval.

- Request for a recommendation of adoption of a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program; a recommendation of approval for a General Plan Amendment and Zone Change to designate an open space preservation lot as Open Space; and a request for approval of a Tentative Tract Map, Planned Development Permit, Hillside Development Permit and Habitat Management Plan Permit for the subdivision and development of a 3.90-acre site into six (6) single-family residential lots with six single family homes, one (1) private drive aisle lot, and one (1) open space lot, on property generally located south of El Fuerte Street and north of Cacatua Street in Local Facilities Management Zone 6. Resolutions No. 6669, 6670, 6671, 6672, 6673, 6674 and 6675

Julie Baker asked if the project is subject to the architectural review of the HOA. Mr. Neu responded. Continue to review further CEQA documents.

Staff recommends a continuance of the project. Chairperson Douglas opened public testimony on the item however the item will be continued until the next meeting. Bob Lattin, 2858 Cacatua Street, Carlsbad, agreed to the continuance of the project however he would like longer than 3 weeks. He stated he asked questions regarding the Mitigated Negative Declaration but never received any answers from Staff. Dr. Phil Chac 264 Chariqui Lane???, stated he would like to see the hillside preserved and he is against the project. Douglas Groset, 2805 Carrillo Way, Carlsbad, stated he thought the property was previously identified as open space. He does support property rights but feels the publicly identified designation should take precedence. Public testimony remains open. Mr. Neu stated the proposed meeting would be April 7, 2010 which gives 20 days review of the CEQA documents. Commissioner Baker stated she is OK with 3 weeks. She asked if the property was subject to the CC&Rs. Mr. Neu stated there is confusion or discrepancy of the CC&Rs. The city's position is to stay out of it. Commissioner Montgomery stated he would like to understand if the home owner's association has jurisdiction.
Mr. Neu stated the Historic Preservation Committee needs an ex-officio member of the committee and asked if there were any volunteers. Let him know. Mr. Neu commented on the Planner's Institute next week, and asked if the Commissioners wished to attend specific meetings.
