ZCA 07-02/LCPA 07-03 - MISCELLANEOUS ZONE CODE AMENDMENTS
- A request for a recommendation of approval for a Zone Code Amendment and Local Coastal Program Amendment to make various minor amendments to the text of the Zoning Ordinance. Resolutions No. 6696 and 6697
Motion to approve That the Planning Commission adopt Planning Commission Resolutions No. 6696 and 6697 recommending approval of ZCA 07-02 and LCPA 07-03 based on the findings contained therein. Moved by Commissioner L'Heureux, no second required.

Staff Report
No questions of Staff. No public testimony. Commissioner L'Heureux stated he is concerned with the definition of family. In developing the Growth Management Plan, assumptions were made as to how many people would be living a given unit. Can truly change the character of the neighborhoods with the change of the definition of family. He is also concerned with child care or day care. By limiting the requirement there could be 8 kids on a 12000 square foot lot. This could also potentially change the character of the neighborhoods. Suggested the council look at these issues very carefully. Atty Mobaldi stated the law does not ...the change does not change the intent of the Growth Management Plan. Commissioner Baker asked if there are maximum occupancy number in the City. Mr. Neu stated there is the Uniform Building Code. From time to time the person per dwelling unit changes. Commissioner Nygaard asked if there is a maximum capacity for child care. Ms. Mobaldi stated for large is up to 14 kids. The City can restrict parking and concentration, but cannot prohibit day care use. Commissioner Dominguez stated that is it relates to licensing. Commissioner Schumacher asked if there is a possible conflicts with HOAs within the city. Ms. Mobaldi stated that CC&Rs could prohibit it. Chairperson Douglas stated that page 44 of Attachment 4, how is the new family definition going to be incorporated into agreement. Mr. Neu responded. The parking ordinance addresses parking for the type of dwelling. Atty Mobaldi pointed out that the current definition does not ... Commissioner Nygaard stated this is not a new law; its that the city is just coming into compliance. Chairperson Douglas commented on the second dwelling unit and how that would apply to the parking. Mr. Neu stated that the second dwelling unit has to have one parking space. Mr. Funk explained the changes to the second dwelling unit code. Commissioner Dominguez asked about the affidavit. Commissioner Baker asked about the parking Commissioner Montgomery asked Mr. Neu about the second dwelling units and granny flats. Mr. Neu stated the terms are used interchangeably. Commissioner Nygaard asked... Commissioner Dominguez asked Commissioner Montgomery Chairperson Douglas....bringing something into play that wasn't there before. Commissioner Dominguez stated that was presented at briefings was different than what was discussed at this meeting. Clouding the title with more restrictions. Commissioner Schumacher stated he too is concerned. Ms. Mobaldi... Commissioner Nygaard stated that by building the second dwelling units they are fulfilling the inclusionary housing requirement. It is not any different than what it was. Commissioner Baker stated she would like to see the Commission or Council revisit the idea regarding rent restricting second dwelling units for individual homeowners. Commissioner Dominguez stated he does not feel individual homeowners should not be forced to participate in the program.

Memo
Chairperson Douglas asked about the Desalination Plant. Mr. Neu responded. Commissioner L'Heureux asked about the hotel and Ponto and Coastal Commission. CCC denied the Vision Plan. The City feels significant work needs to be done. Use it as a guidance document in terms of design standards. Hotel was approved by the City because the designations required for hotel.
