Mr. Neu commented on the letter received from the HOA and the response to the HOA from the City Attorney. Commissioner Montgomery stated that the items he was previously concerned with have been resolved with this new redesign. Commissioner Dominguez asked if the Commission would consider restricting the home on lot 1 to a single story. Commissioner Baker stated she is opposed to that as it would set a precedent. She stated it is not an issue the Commission should be involved in Vice Chairperson L'Heureux opened the public testimony on Agenda Item 1. Marco Gonzales, representing Coastal Environmental Rights Foundation, stated that he had submitted a letter this afternoon. Asked that the Commission postpone the decision. No comments from the applicant. Ross Campbell, representing Coastal Environmental Rights Foundation, stated the letter was submitted electronically at 3:00 to Mr. Westman. Equivalency findings not evaluated. CEQA process = EIR is required. Ms. Mobaldi responded. RECESS @ 6:20 Meeting called to order Mr. Neu addressed a few of the comments brought up in the letter submitted by Ross Campbell. Mr. Westman also addressed comments from the letter. Noise Study and noise attenuation. Project is not required to provide mitigation for any surrounding existing homes. Grading plans have been explained. View impacts - no view preservation ordinance in the City; within CEQA a scenic corridor is not being impacted. Staff is confident the environmental analysis has been done correctly and thoroughly. Hossein Zommorrodi, 7801 Mission Center Court, San Diego, civil engineer for the project, questioned the true motive of the attorneys at the last minute. Public testimony closed. Discussion. Commissioner Montgomery stated that the subdivision's redesign makes it a better project. As far as the HMP issues, he believes it is a mapping error and it is unfortunate that it was included in the preserve area. He is still concerned about the project. Commissioner Schumacher stated he satisfied with the process the city has followed for the CEQA and HMP process. He believes it is a mapping error; would like to add a minute motion for the additional piece of sidewalk. Commissioner Baker stated she can support the project. Staff has done its due diligence. She can support the project as well as the suggestion for the additional sidewalk. Commissioner Dominguez stated he can also support the project and concurred with his fellow Commissioners. Commissioner Nygaard commented she can support the project. She also concurred with her fellow Commissioners. Agrees with the minute motion. Vice Chairperson L'Heureux stated he has a problem with this project as it is designed as 7 separate lots as opposed to 1. Too much of an impact to the existing, surrounding neighborhood. He sees this is an infill project and should be handled with more sensitivity from the Commissioner.

- A request for approval of a Variance to the Sign Ordinance (CMC Chapter 21.41) to exceed the letter height and sign area allowances for a recently approved commercial building located at the southwest corner of Palomar Airport Road and El Camino Real in Local Facilities Management Zone 5. Resolution No. 6709
Motion to approve PLANNING COMMISSION ACTION: Moved by Commissioner Nygaard, seconded by Commissioner Dominguez.
Staff Report
Bill Hofman, Hofman Planning and Engineering, 3152 Lionshead Avenue, Carlsbad, stated the Lowe's sign and visibility is very important to the company. The sign does work but is very close to the area of visual discomfort. Perry Holliday, site development manager for Lowe's, 1530 Faraday Avenue, gave a brief presentation and pointed out that the lettering is the only section that is illuminated. Opened and closed public testimony. Discussion Commissioner Schumacher stated he can support it as it is proposed. Revisit the sign ordinance. Commissioner Baker can support the project Commissioner Dominguez stated this is a good settlement. Commissioner Nygaard can support the project. Chairperson L'Heureux can also support the project.
Motion to approve to add the item of a workshop to a future PC Agenda. Moved by Commissioner Baker, seconded by Commissioner Nygaard.
Commissioner Dominguez spoke about the subject of infill. Thinks it would be a great subject for a workshop. Ms. Mobaldi asked for specifics in regards to the workshop about concerns infill. Commissioner Dominguez asked for better construction schedules. Commissioner L'Heureux stated it is compatibility with the neighborhoods. Commissioner Dominguez also stated.... Commissioner Montgomery stated he would like artificial raising of pads to increase views. Commissioner Schumacher asked for a philosophical discussion to be had at a workshop. Ms. Mobaldi stated ultimately council would be the final decision making body. Follow existing procedure. PC Agenda Item to discuss infill projects, vote to take it to council workshop. Mr. Neu responded. Will add it to a future agenda for PC to discuss.
