IT'S A SERIES OF LEGISLATIVE ACTIONS, AS WELL AS SOME QUASI-JUDICIAL DISCRETIONARY ACTIONS HERE TO MAKE THE STAFF PRESENTATION IS ASSOCIATE PLANNER ESTEBAN DANNA.

HI, GOOD AFTERNOON, MEMBERS OF THE PLANNING COMMISSION.

SO THIS IS AN APPLICATION FOR A LAND USE CHANGE AND CONSTRUCTION OF A NEW CHICK-FIL-A RESTAURANT. SO THE PROPERTY IS LOCATED ALONG AVENIDA ENCINAS AND ADJACENT TO THE SOUTHBOUND SIDE OF INTERSTATE FIVE, JUST NORTH OF PALMA AIRPORT ROAD.

THE PROPERTY IS CURRENTLY DEVELOPED WITH A TEN THOUSAND SIX HUNDRED SQUARE FOOT OFFICE BUILDING. THE SITE IS SURROUNDED BY A MIXTURE OF RESTAURANT OFFICE AND LIGHT INDUSTRIAL USES. THE PROJECT CONSISTS OF THE ADOPTION OF A MITIGATED NEGATIVE DECLARATION, A GENERAL PLAN, ZONING MAP AND LOCAL COASTAL PROGRAM AMENDMENT AND AMENDMENTS TO THE EXISTING SITE DEVELOPMENT PLAN AND PLANNED DEVELOPMENT, AS WELL AS A CONDITIONAL USE PERMIT AND A COASTAL DEVELOPMENT PERMIT AND THIS IS TO DEMOLISH THE EXISTING OFFICE BUILDING AND TO CONSTRUCT A NEW THREE THOUSAND NINE HUNDRED AND THIRTY TWO SQUARE FOOT RESTAURANT. AN AMENDMENT TO THE GENERAL PLAN LAND USE MAP IS REQUESTED TO CHANGE THE PROJECT SITE LAND USE DESIGNATION FROM PLANNED INDUSTRIAL TO VISITOR COMMERCIAL.

THE LAND USE AMENDMENT PROVIDES CONSISTENCY WITH THE LAND USE DESIGNATIONS OF THE

REMAINING PROPERTIES IN THE COMMERCIAL CENTER.

AN AMENDMENT TO THE ZONING MAP IS ALSO REQUESTED TO CHANGE THE PROJECT SITE'S ZONING DESIGNATION FROM PLANNED INDUSTRIAL TO COMMERCIAL TOURIST.

THE ZONING MAP CHANGE WILL ALLOW FOR RESTAURANT USES BY RIGHT WITHOUT THE NEED FOR A CONDITIONAL USE PERMIT AND PROVIDE CONSISTENCY WITH LAND USE DESIGNATIONS OF THE REMAINING PROPERTIES IN THE COMMERCIAL CENTER.

THE AMENDMENT TO THE LOCAL COASTAL PROGRAM, LAND USE AND ZONING MAPS IS REQUESTED TO CHANGE THE PROJECT SITE'S LAND USE DESIGNATIONS FROM PLANNED INDUSTRIAL TO VISITOR COMMERCIAL. THESE CHANGES ARE REQUIRED SO THAT LOCAL COASTAL PROGRAMS, LAND USE DESIGNATIONS ARE CONSISTENT WITH THE GENERAL PLAN AND THE ZONING DESIGNATIONS.

THE SITE PLAN SHOWS THE PROPOSED RESTAURANT WILL BE LOCATED TOWARDS THE SOUTHEAST CORNER OF THE PROPERTY, WITH THE PARKING AND CIRCULATION RUNNING ADJACENT TO AVENIDA ENICINAS.

TWO DRIVEWAYS WILL SERVE THE PROPERTY ALONG AVENIDA ENCINAS TOWARDS THE NORTH AND SOUTH AND THE PROPERTY.

THIS RENDERING SHOWS THE PROPOSED RESTAURANTS SOUTH AND WEST ELEVATIONS, WITH AVENIDA ENCINAS RUNNING ALONG THE LEFT SIDE OF THE IMAGE.

THE PROJECT INCLUDES ORNAMENTAL LANDSCAPING AROUND THE PERIMETER OF THE SITE, AS WELL AS WITHIN THE PARKING LOT AND THIS RENDERING SHOWS THE PROPOSED RESTAURANTS NORTH AND WEST ELEVATIONS LOOKING EAST FROM AVENIDA ENCINAS TOWARDS THE FREEWAY.

THE PROJECT PROPOSES ATTRACTIVE ARCHITECTURAL BUILDING ELEMENTS SUCH AS STONE VENEER, PRECAST CONCRETE, DARK BRONZE, ALUMINUM SHADE, AWNINGS AND TRELLISES.

THE DESIGN OF THE RESTAURANT IS ALSO COMPATIBLE WITH THE DESIGN OF THE ADJACENT IN-N-OUT RESTAURANT TO THE SOUTH.

THE PROJECT COMPLIES WITH ALL APPLICABLE CODES, STANDARDS AND POLICIES, INCLUDING THE VISITOR COMMERCIAL GENERAL PLAN LAND-USE DESIGNATION, THE COMMERCIAL TOURIST ZONING DISTRICT, THE QUALIFIED DEVELOPMENT OVERLAY ZONE AND COMMERCIAL VISITOR SERVING OVERLAY ZONE, THE PARKING ORDINANCE, THE NONRESIDENTIAL PLANNED DEVELOPMENT ORDINANCE, THE MINOR CONDITIONAL USE PERMIT REQUIREMENTS, THE LOCAL COASTAL PROGRAM, THE AIRPORT LAND USE COMPATIBILITY PLAN AND GROWTH MANAGEMENT.

A STAFF RECOMMENDS THAT THE PLANNING COMMISSION ADOPT RESOLUTION NUMBER SEVEN FOUR THREE THREE, RECOMMENDING APPROVAL OF THE MITIGATED NEGATIVE DECLARATION WITH THE MITIGATION, MONITORING AND REPORTING PROGRAM.

ADOPT RESOLUTION SEVENTY FOUR POINT THIRTY FOUR RECOMMENDING APPROVAL OF THE GENERAL PLAN AMENDMENT. ZONING MAP AMENDMENT AND LOCAL COASTAL PROGRAM AMENDMENT AND FINALLY, ADOPT RESOLUTION 7435 RECOMMENDING APPROVAL OF THE AMENDMENTS TO THE SITE DEVELOPMENT PLAN AND PLANNED DEVELOPMENT, AS WELL AS THE CONDITIONAL USE PERMIT AND COASTAL DEVELOPMENT PERMIT FOR THE CONSTRUCTION OF THE RESTAURANT.

BUT THE TSM REQUIREMENT IN THE GENERAL MOBILITY ELEMENT APPLIES TO PALOMAR AIRPORT ROAD, AND THAT SIGNAL WILL NOT MEANINGFULLY IMPROVE THE CIRCULATION THERE.

SO TO MEET THE TSM REQUIREMENT UNDER THE MOBILITY ELEMENT, THE PROJECT SHOULD FUND ITS FAIR SHARE TO STUDY THAT INTERSECTION AND FUND ANY IDENTIFIED IMPROVEMENT PROJECTS, WHICH IS ROUTINELY DONE ON EXEMPTED STREETS AND WITH REGARD TO TDM, THEY'RE CITING A SO-CALLED TIER ONE TDM ORDINANCE PLAN.

AGAIN, THOSE SUCH PLANS ARE ONLY DESIGNATED TO ADDRESS OR ONLY DESIGNED TO ADDRESS THE ENVIRONMENTAL IMPACTS OF EMPLOYEES THAT ARE DRIVING TO WORK.

AND ONE WAY TO KIND OF WRAP YOUR HEAD AROUND THIS IS SIMPLY THAT THE ADDED CAPACITY OF THE TRAFFIC SIGNAL IS GREATER THAN THE POTENTIAL DELAY DUE TO THE ADDED TRAFFIC OF THE PROJECT. I THINK THERE WAS SOME CONCERN EXPRESSED THAT IF YOU DID SORT OF THIS TEMPORARY EFFORT, YOU WOULDN'T SEE NECESSARILY ALL THE BENEFITS AND YOU WOULD JUST HAVE THIS NOT FULLY IMPLEMENTED PROMENADE AS AN EXAMPLE THAT WOULDN'T BE REPRESENTATIVE OF THE ULTIMATE PROJECT AND I THINK THAT WAS THE PRIMARY THING THAT OH, I'M SORRY THE OTHER ONE TO PROBABLY ADDRESS COMMISSIONER LAFFERTY WOULD DEFINITELY BE INTERESTED IN THIS.

COUNCIL DID SUPPORT THE ESTABLISHMENT OF A HISTORIC DISTRICT IN THE VILLAGE IN BARRIO AND I THINK AS YOU'VE HEARD THERE IS WORK GOING ON ABOUT IMPLEMENTING THE MILLS ACT AND DEVELOPING ORDINANCES FOR THAT.

THAT'S A VOLUNTARY PROGRAM.

SO THIS WOULD BE SORT OF A COMPANION EFFORT TO THAT TO FURTHER CREATE INCENTIVES, I THINK, WAS WHAT THE COUNCIL WAS INTERESTED IN FOR PEOPLE TO MAINTAIN EXISTING STRUCTURES RATHER THAN DEMOLISH THEM AND CONSTRUCT A NEW.

SO THERE WAS SOME DISCUSSION ABOUT PERHAPS REDUCING PARKING STANDARDS IF SOMEONE WAS TO REUSE A BUILDING VERSUS TEARING DOWN AND REPLACING.

SO THOSE WERE THE DECISIONS THAT WERE MADE, AND WE'LL BE MOVING FORWARD TO IMPLEMENT SOME OF THOSE THINGS. LET ME ASK YOU, I KNOW WHEN THE PLANNING COMMISSION WAS HAVING PUBLIC HEARINGS IN REGARD TO THE VILLAGE AND BARRIO MASTER PLAN, GRAND AVENUE, THERE WAS DISCUSSIONS IN REGARD TO BICYCLES AND BICYCLE DEDICATED BICYCLE PATHS ON GRAND AVENUE.

DID THE COUNCIL EXPAND ON THAT OR COULD YOU EXPAND ON THAT FOR US AS TO THAT ELEMENT? SURE. YEAH, TO MY RECOLLECTION, THEY DIDN'T GET INTO THAT LEVEL OF DETAIL ON GRAND.

THE MASTER PLAN AT SOME CONCEPTS FOR A PROMENADE, AND THEY BASICALLY JUST DEALT WITH THE IDEA OF HOW BEST TO DO FURTHER STUDIES TO MAKE A DECISION ON WHETHER TO GO FORWARD WITH ACTUALLY CONSTRUCTING SOMETHING.

SO WHAT'S THE NEXT STEP? I THINK FOR THAT PARTICULAR THING, IT'S REALLY I WOULD ENVISION IT BEING PROBABLY SOMETHING SIMILAR TO A TRAFFIC STUDY OF SORTS TO MAKE SURE THAT BY ELIMINATING CERTAIN VEHICLE LANES, IT DOESN'T CAUSE OTHER UNINTENDED CONSEQUENCES AND THEN AS PART OF THAT, LOOKING AT HOW IT CONNECTS WITH PEDESTRIAN AND BICYCLE CIRCULATION.

OK, SO NEXT STEP IN REGARD TO THE VILLAGE AND THE BARRIO MASTER PLAN FOR THAT IN GENERAL AND SO, YOU KNOW, THERE'S A NUMBER OF THESE THINGS THAT AREN'T ACTUAL AMENDMENTS TO THE PLAN. THEY'RE KIND OF COMPANION EFFORTS.

SO THOSE WILL WILL BE INITIATED AND THEN FOR THE PLAN IN GENERAL, WE HAVE A NUMBER OF THINGS THAT WOULD POTENTIALLY BE AMENDMENTS TO THE PLAN.

BUT OVERALL, I THINK WE'RE STILL TRYING TO PRIORITIZE WHICH IS GOING FIRST AND HOW TO START IT. SOME OF THE ITEMS WE DID INDICATE TO THE COUNCIL THAT WE WOULD NEED CONSULTANT ASSISTANCE AND THERE WERE SOME COST ESTIMATES.

SO I THINK WE'LL BE GOING OUT AND GETTING PROPOSALS ON THOSE AND THEN RETURNING TO THE COUNCIL AND MAKING SURE THAT THEY WOULD APPROVE THE FUNDING FOR THOSE IN ORDER FOR US TO IMPLEMENT THEM. GREAT.

I LIVE NEAR THE HIGH SCHOOL AND I ROUTINELY VISIT DOWNTOWN AND INCREASINGLY, THERE ARE LITERALLY PLATOONS OF TEENAGERS, BY TEENAGERS, I'M TALKING 12, 13, 14 YEARS OLD WHO ARE DRIVING AROUND ON THESE ELECTRICAL BIKES THAT CAN GO UP TO TWENTY FIVE MILES AN HOUR, AND THEY SEEM CAVALIER IN IGNORING STOP SIGNS.

I FORESEE A REAL PROBLEM IN POTENTIAL LITIGATION WHEN PEOPLE GET INJURED, MR. KEMP. WELL, YOU KNOW, DON CAN CORRECT ME IF I'M WRONG, BUT I WOULD THINK HE WOULD CONTACT THE DEPARTMENT OF TRANSPORTATION FIRST, AND IF HE THINKS HIS VIOLATIONS GOING ON, HE CAN, OF COURSE, CONTACT THE POLICE DEPARTMENT.
