AND IN KNOWING THE IMPORTANCE OF PARKS AND RECREATION, I THINK EVERYBODY IN THE AUDIENCE IS SUPER APPRECIATIVE OF WHO YOU, WHO YOU REPRESENT AND WHAT YOU DO.

SO WITH THAT.

WHEREAS THE PARKS, CARLSBAD PARKS AND RECREATION DEPARTMENT PROMOTES QUALITY OF LIFE IN THE COMMUNITY HEALTH AND WELLNESS THROUGH THE PREMIUM PARKS AND FACILITIES, THE PARKS AND RECREATION DEPARTMENT.

IT BUILDS COMMUNITY, CHARACTER AND CONNECTEDNESS THROUGH INNOVATIVE AND VERSATILE RECREATION PROGRAMING, ACTIVE LIVING AND SPECIAL EVENTS FOR ALL AGES.

THE PARKS AND RECREATION DEPARTMENT PERMITS AND OFFERS A VARIETY OF SPORTS, ARTS, SCIENCE CLASSES, PROGRAMS, AND OVER 200 YOUTH CAMPS APPEALING TO A WIDE RANGE OF AGE AND FRIENDLY INTERESTS AND ABILITIES.

WHEREAS THE PARKS AND RECREATION DEPARTMENT PROVIDES OVER 35,000 MEALS ANNUALLY TO CARLSBAD SENIORS AS PART OF THE SAN DIEGO COUNTY HEALTH AND HUMAN SERVICES PROGRAM IN THE SENIOR NUTRITION PROGRAM.

WHEREAS, THE PARKS AND RECREATION DEPARTMENT IS THE STEWARD OF MORE THAN 1000 ACRES OF OPEN SPACE PROPERTIES AND OVERSEES OVER 51 MILES OF TRAILS PROVIDING CONNECTIVITY AND ACCESS TO THE NATURAL ENVIRONMENT.

WHEREAS THE PARKS AND RECREATION DEPARTMENT IN ADVANCING SEVERAL CAPITAL IMPROVEMENT PROGRAM PROJECTS, INCLUDING VETERANS MEMORIAL PARK AND OFF LEASH DOG AREA IN BOTH POINSETTIA COMMUNITY PARK AND VILLAGE H SOUTH OPEN SPACE AND A COMMUNITY GARDEN AT STAGECOACH COMMUNITY PARK.

THEREFORE, I'M AT HALL, MAYOR OF THE CITY OF CARLSBAD, CALIFORNIA.

ON BEHALF OF THE CITY COUNCIL, DO HEREBY PROCLAIM THE MONTH OF JULY 2022 AS PARKS AND RECREATION MONTH.

PLEASE SAY A FEW WORDS.

GOOD EVENING, MAYOR AND CITY COUNCIL.

MY NAME IS MIKE LUNA. I'M CHAIR OF THE PARKS AND RECREATION COMMISSION.

I'VE BEEN ON THE COMMISSION NOW FOR SIX YEARS, SO I'VE SEEN A LOT HAPPEN THROUGHOUT THOSE TIME WITH OUR PARKS AND REC PROGRAMS. BUT IT GIVES ME GREAT PLEASURE TO HAVE CITY COUNCIL RECOGNIZED PARKS AND RECREATION MONTH HERE IN CARLSBAD.

I WOULD LIKE TO ESPECIALLY GIVE CREDIT TO THE CARLSBAD PARKS AND RECREATION DEPARTMENT, THEIR STAFF AND MY FELLOW COMMISSIONERS FOR THE GREAT WORK THAT THEY ALL DO.

I BELIEVE CARLSBAD RESIDENTS RECOGNIZE THE TREMENDOUS MENTAL AND PHYSICAL BENEFITS OF THEIR HEALTH, AND WHEN THEY VISIT THE PARKS AND WHEN THEY TAKE PART IN RECREATIONAL ACTIVITIES, THEY ALSO KNOW THE NUMBER ONE THING THEY CAN DO TO IMPROVE THEIR HEALTH IS TO BE PHYSICALLY ACTIVE, AND USING PARKS AND TRAILS IS ALSO A GREAT WAY TO SOCIALIZE AND CONNECT WITH FELLOW COMMUNITY MEMBERS AND YOUR NEIGHBORS.

RECENTLY, THE PARKS AND REC DEPARTMENT OPENED THE TALAVERA HILLS COMMUNITY PARK GATEWAY.

OBTAINED PLANNING COMMISSION APPROVAL ON THE ENVIRONMENTAL PERMITTING ENTITLEMENTS FOR VETERANS MEMORIAL PARK.

THEY ALSO ARE OPENING THE POINSETTIA COMMUNITY DOG PARK AT THE END OF THIS MONTH.

I KNOW I'M LOOKING FORWARD TO THAT WITH MY DOG.

THE DEPARTMENT IS ALSO PLANNING ON A LOW PLUNGE EVENT AT ALGA NORTE COMMUNITY PARK ON JULY 23RD.

IN ADDITION TO CONDUCTING EXTENSIVE SUMMER CAMPS IN A VARIETY OF CLASSES, AND WE CAN'T FORGET THOSE VALUABLE MEALS PROVIDED TO CARLSBAD SENIORS IN NEED.

SO OUR STAFF HAS BEEN PRETTY BUSY.

SO IN ENDING. I ENCOURAGE EVERYBODY, OUR COMMUNITY, TO EXPLORE CARLSBAD, PARKS AND RECREATION, EVERYTHING THEY HAVE TO OFFER PLAYGROUNDS, TRAILS, REC CENTERS, SPORTS LEAGUES, SUMMER CAMPS.

THESE ARE JUST A FEW OF THE THINGS THAT COME TO MIND.

I WOULD ALSO LIKE TO CHALLENGE CITY COUNCIL AND COMMUNITY TO EXPLORE THE UNDISCOVERED ROLES OF THE PARKS AND RECREATION DEPARTMENT LIKE SCIENCE, TECHNOLOGY, ENGINEERING AND MATH PROGRAMS KNOWN AS STEM SENIOR PROGRAMS, INNOVATIVE HEALTH AND WELLNESS OPPORTUNITIES, COMMUNITY CELEBRATIONS, OUTDOOR EDUCATION, AND EVEN BEACH AND TREE MAINTENANCE TO NAME A FEW.

WE ARE VERY FORTUNATE TO HAVE THE FINANCIAL RESOURCES TO PROVIDE THE BEST PARKS, PROGRAMS AND AMENITIES WHICH I FEEL ARE PROBABLY THE BEST IN THE WORLD.

MAYBE A LITTLE BIASED.

I LOOK FORWARD TO CONTINUING OUR EFFORTS IN THE FUTURE FOR THE NEXT GENERATIONS, AND THAT CAN TAKE ADVANTAGE OF OUR REMARKABLE CITY THAT WE CALL CARLSBAD.

THEIR DONATIONS ALLOW THE LIBRARY TO GO FROM BEING A GREAT LIBRARY TO BEING AN AMAZING LIBRARY AND A GREAT ASSET FOR THE ENTIRE COMMUNITY. THE FRIENDS PAY FOR THINGS LIKE OUR CARLSBAD READS TOGETHER, AUTHOR VISITS, REWARDS AND INCENTIVES FOR OUR SUMMER READING ADVENTURE.

IT'S NOT TOO LATE TO START.

YOU STILL HAVE A FEW WEEKS LEFT OF SUMMER TO EARN SOME OF THOSE, AND THEY EVEN PROVIDE FUNDS FOR THINGS LIKE OUR FILAMENT FOR THE 3D PRINTERS IN OUR EXPLORATION HUB, FOR THE COMMUNITY TO USE AND LEARN THAT.

THE DONATION IS A LITTLE LESS THAN IN RECENT YEARS.

BUT WE HAVE GOT BOTH STORES OPEN DOVES GOING FULL STEAM AHEAD.

COLE IS ONLY OPEN FOUR DAYS A WEEK, TUESDAY THROUGH FRIDAY.

AND WHAT I WOULD LIKE TO ASK IS IF ANYONE KNOWS ANYONE WHO WOULD LOVE TO BE A PART OF THIS AND TO BE ONE OF OUR VOLUNTEERS, YOU CAN GO ON THE WEBSITE.

LAST WEEK, ON JULY 5TH, SEVEN DAYS AGO, THE TRAFFIC IMMOBILITY COMMISSION PLACED THIS PROJECT ON THEIR OFFICIAL AGENDA ITEM TO PROVIDE AN UPDATE ON THE PROJECT AND PROVIDE INPUT TO STAFF PLACING THE HYBRID TRAFFIC SIGNAL AND THE PROJECT ON THE AGENDA WAS GREAT BECAUSE FOR 50 MINUTES THE CITY STAFF, TRAFFIC COMMISSION, AND THE PEOPLE OF CARLSBAD ALL WORKED TOGETHER AS ONE TO DISCUSS THE PROJECT AND DISCUSS ALTERNATIVE SOLUTIONS. AT THE END OF DISCUSSING THE AGENDA ITEM, THERE WAS A MOTION.

I MOVE THAT THE TRAFFIC AND MOBILITY COMMISSION RECOMMEND THAT THE CITY COUNCIL DIRECT STAFF.

THE NARROWING OF THE BIKE LANE TO THE INABILITY OF LARGE VEHICLES MAKING THE TURN WITHOUT GOING TO INCOMING TRAFFIC.

AND I THINK THIS IS REALLY AN IMPORTANT ISSUE TO HAVE EITHER POLICE OFFICERS OR SECURITY OFFICERS AT OUR SCHOOLS TO HELP PROTECT THE CHILDREN AT ALL OF THE 16 PUBLIC SCHOOLS IN CARLSBAD.

I'M HERE BECAUSE I WANT TO HELP SEE THAT THROUGH.

I'M HERE. I'M OFFERING MY SUPPORT.

I'VE EMAILED IN TO MULTIPLE OF ANYTHING THAT I CAN DO TO HELP.

I'M HERE FOR THAT. IF IT ENDS UP AS AN AGENDA ITEM, I'M HAPPY TO BRING OUT MORE COMMUNITY MEMBERS TO SHOW SUPPORT FOR THE INITIATIVE.

MY UNDERSTANDING SO FAR IS THAT IT REALLY DOES START WITH THE THE CITY COUNCIL EITHER CREATING A FUNDING PROGRAM FROM THE CITY OR IN COOPERATION WITH THE SCHOOL BOARD AND THE POLICE.

I'M SIMPLY LOOKING FOR A WAY TO HARDEN OUR SCHOOLS AS A TARGET SO WE CAN PREVENT SITUATIONS LIKE THE UVALDE SITUATION AT OUR CARLSBAD SCHOOLS, PREVENT SITUATIONS LIKE THE KELLY ELEMENTARY SCHOOL, THAT SITUATION THAT COULD HAVE BEEN WAY WORSE.

LAST WEEK, REPUBLIC SERVICES DID NOT PICK UP THE LANDFILL CANS FOR THREE DAYS.

NOT JUST ON MY STREET, BUT IN THE ALLEYS THROUGHOUT THE ENTIRE COMPLEX.

I CALLED THE PHONE REPRESENTATIVE AND THAT PERSON DIDN'T KNOW ABOUT IT, AND I TALKED TO A LOCAL SUPERVISOR.

THAT SUPERVISOR ALSO DID NOT KNOW ABOUT THIS PROBLEM.

I YESTERDAY DECIDED I WOULD CALL THE CORPORATE OFFICE IN PHOENIX, ARIZONA, KNOWING THAT I REPUBLIC SERVICES, THEY ARE CONCERNED ABOUT SERVICE TO THE PUBLIC HERE.

AND I ENDED UP TALKING TO ANOTHER EXECUTIVE THAT DIDN'T KNOW MUCH ABOUT WHAT WAS GOING ON IN THE CARLSBAD TAKEOVER, SO TO SPEAK.

I WAS TOLD THAT I WOULD BE CALLED BY A PERSON THAT WAS KNOWLEDGEABLE OF THE PARTICULAR PROBLEMS THAT WERE TAKING PLACE.

BUT I NEVER RECEIVED A CALL.

NOW, I SHOULD SAY I'M NOT AN ATTORNEY, BUT IN MY OPINION, THE CITY OF CARLSBAD AND OR REPUBLIC SERVICES IS POSSIBLY IN BREACH OF CONTRACT FOR THE FOLLOWING.

AND I'VE GONE THROUGH WITH BRIEFLY THROUGH THE 75 PAGE CONTRACT, ARTICLE 4.3.

PAGE 13 OF 75, NOT PROVIDING A WEEKLY DISPOSAL OF SOLID WASTE.

THIS IS A SERIOUS PROBLEM IF IT'S ALLOWED TO CONTINUE.

LUCKILY, THEY WERE ON TIME AND EVERYTHING WENT WELL TODAY.

HOPEFULLY THAT WILL CONTINUE, BUT WITHOUT WEEKLY SERVICE, THE INSECTS IN THOSE CANS WILL BREED.

THEY CALL IT THE FLY CYCLE, AND THAT'S JUST NOT A GOOD THING TO HAVE FOR THE CITY OF CARLSBAD.

THE OTHER NUMBER TO THE PUBLIC EDUCATION AND OUTREACH PART OF THIS CONTRACT, PAGE 15, SAYS THAT EDUCATING RESIDENCES AND BUSINESSES AS TO THE NEW STATE LAW REQUIRING FOOD SCRAPS TO BE PLACED IN ORGANIC WASTE IN THIS GREEN, CUTE LITTLE GREEN COMPOST CAN.

IT NEEDS TO BE DONE.

THIS IS AN EXAMPLE.

ANN STARTED HER CAREER AS AN ELEMENTARY SCHOOL TEACHER AT PATRICK AIR FORCE BASE IN FLORIDA AND THEN AS A FIELD REPRESENTATIVE FOR A COUNTY SUPERVISOR IN NORTHERN CALIFORNIA IN THE CITY OF SARATOGA.

THEN RUMOR HAS IT THAT WHEN SHE FOUND OUT THAT SHE WAS MOVING TO CARLSBAD WITH HER HUSBAND, DAVID IN 1978, SHE THOUGHT IT WAS CARLSBAD, NEW MEXICO, AS ANN AND DAVE BECAME VERY INVOLVED IN THE NEW COMMUNITY AND WAS ENCOURAGED TO RUN FOR CITY COUNCIL IN 1980.

THIS WAS AN IMPORTANT TIME IN CARLSBAD.

BY THE MID-EIGHTIES, GROWTH HAD BECOME A VERY CONTROVERSIAL ISSUE, MUCH MORE THAN EVEN TODAY.

AND MANY IN THE COMMUNITY WANTED TO STOP GROWTH ALTOGETHER.

ANN WAS INSTRUMENTAL IN PROVIDING AN ALTERNATIVE VISION, WHICH LATER BECAME KNOWN AS THE GROWTH MANAGEMENT PLAN.

IN FACT, SHE WAS A KEY VOTE TO MAKE THAT PLAN A REALITY.

BECAUSE OF THAT, AS CARLSBAD GREW FROM A POPULATION OF 35,000, WHEN SHE FIRST TOOK OFFICE TO OVER 107,000 WHEN SHE RETIRED. CARLSBAD WAS ALWAYS MAINTAINED AS AN ENVIABLE QUALITY OF LIFE IN STRONG ECONOMY CITY.

HERE ARE A FEW OF THE MANY OTHER SIGNIFICANT CONTRIBUTIONS ANN HAS MADE TO OUR CITY.

WHEN YOU ENJOY A WALK ALONG OUR BEAUTIFUL SEAWALL, YOU HAVE ANN CARLSON TO THANK FOR THAT.

SHE WAS ON THE FOREFRONT OF MAKING THAT HAPPEN.

SHE WAS AN INTEGRAL DRIVER IN CONCEIVING THE DOVE LIBRARY AS AN AMAZING, UNIQUE CULTURAL AMENITY FOR OUR COMMUNITY.

I WANT TO SHARE MY WHOLEHEARTED SUPPORT FOR PASSAGE OF THIS AGENDA ITEM.

THANK YOU FOR THE OPPORTUNITY THIS AFTERNOON TO SPEAK IN SUPPORT OF ITEM 16, NAMING THE COURTYARD AND ENTRANCE TO THE CARLSBAD CITY LIBRARY ON DOVE LANE IN HONOR OF MY MOTHER, ANN KULCHIN. THANKS TO FOR KINDLY MOVING UP THE AGENDA ITEM.

AS A PROUD RESIDENT OF THE CITY, I VALUE AND APPRECIATE THE HARD WORK THAT YOU DO BECAUSE IT IS HARD AND IT DOES TAKE TIME.

MOM SERVED THE CITY FOR MORE THAN HALF MY LIFE AND SHE WAS ALWAYS ALL IN.

SO IT'S NO SURPRISE THAT SHE WAS ALL IN FOR DOVE LIBRARY.

THERE WAS A NEED FOR A LIBRARY IN THE SOUTH PART OF THE CITY, AND SHE WAS DETERMINED TO SEE IT HAPPEN.

SHE SAT ON EVERY COMMITTEE, AS THE MAYOR HAD POINTED OUT, AND SHE REALLY, TRULY CALLED IT HER LIBRARY BECAUSE SHE WAS SO INVESTED IN IT.

TODAY IS AN EMOTIONAL DAY FOR OUR FAMILY.

IT ALSO HAPPENS TO BE THE SECOND ANNIVERSARY OF MY FATHER'S PASSING.

DAD PASSED PEACEFULLY RIGHT NEXT TO MOM, JUST TWO WEEKS SHY OF THEIR 67TH WEDDING ANNIVERSARY IN 2020.

DAD WAS MOM'S BIGGEST SUPPORTER, SO HOW FITTING THAT THE COUNCIL WOULD BE VOTING ON THIS MUCH DESERVED RECOGNITION TODAY OF ALL DAYS? SO WHILE THE DOVE LIBRARY WAS A SPECIAL PROJECT AMONG MANY IN MOM'S LEGACY, IT REALLY WASN'T UNTIL 2020 WHEN THE LIBRARY TRULY BECAME A LIFELINE FOR HER.

WITH DAD'S PASSING AND THE PANDEMIC FALLOUT, MOM TOOK HER ALREADY VORACIOUS READING APPETITE UP ANOTHER NOTCH.

OVER THE PAST TWO YEARS, HER LIBRARY BECAME A RELIABLE FRIEND, PROVIDING COUNTLESS NUMBERS OF BOOKS AND MANY, MANY HOURS OF GOOD READING.

IT'S DIFFICULT TO CAPTURE THE IMPACT MOM HAS HAD ON A CITY IN JUST 3 MINUTES, AND I PROMISED HER I'D KEEP IT BRIEF.

AS SHE TOLD ME JUST THIS MORNING.

I DON'T LIKE THINGS LIKE THIS.

I ENJOY LEADING THE CHARGE TO CELEBRATE OTHERS.

RECENTLY, I BECAME AWARE THAT THERE HAS BEEN DISCUSSION IN THE CITY TO HAVE ANN KULCHIN RECOGNIZED BY NAMING THE COURTYARD AT THE DOVE LIBRARY IN HER HONOR. I BELIEVE THAT ANN'S CONTRIBUTION TO THE CITY OF CARLSBAD IS NOTEWORTHY OF SUCH AN HONOR AND STARTED HER PROFESSIONAL CAREER AS A SCHOOLTEACHER AND HOLDS LITERACY AS A SPECIAL PLACE IN THE CORE OF WHO SHE IS.

SHE RECOGNIZED THAT FOR EVERY STUDENT TO REACH THEIR POTENTIAL, THEY NEED TO HAVE EDUCATION AS A KEY, FOUNDATIONAL ELEMENT TO THEIR SUCCESS.

ANN WAS MOST INSTRUMENTAL IN WANTING A LIBRARY IN THE SOUTHERN END OF THE CITY TO SERVE THOSE RESIDENTS, ESPECIALLY SCHOOL AGE CHILDREN AND SENIOR CITIZENS. FROM THE INITIAL CONCEPT OF A SELF LIBRARY, OF WHICH I TALKED TO ANN ABOUT ON NUMEROUS OCCASIONS TO ITS COMPLETION AND DEDICATION AND PROVIDED STRATEGIC LEADERSHIP AS TO WHERE IT WOULD BE ITS DESIGN AND LOOK, AND EXPANDING ITS VISION TO INCLUDE BEING A CULTURAL CENTER FOR THE COMMUNITY.

I WOULD BE REMISS BEING FROM THE BUSINESS COMMUNITY IF I DID NOT STOP AND RECOGNIZE ANN'S CONTRIBUTION TO THE BUSINESS COMMUNITY FROM THE FIRST TIME THAT I TALKED WITH ANN.

SHE CONVINCED US TO HEADQUARTER OUR COMPANY, GRAND PACIFIC RESORTS IN CARLSBAD.

HER THOUGHT WAS, IF YOU ARE GOING TO HAVE PROJECTS DEVELOP IN OUR COMMUNITY, THEN YOU NEED TO BE A PERMANENT PART OF THE COMMUNITY AND YOU NEED TO MAKE A CONTRIBUTION.

AND SHE ALWAYS ASKED ME ABOUT THAT.

LOOKING BACK OVER THE YEARS, IT WAS SOME OF THE BEST ADVICE THAT I HAVE EVER RECEIVED.

ANN WAS A FRIEND OF THE BUSINESS COMMUNITY.

BUT SHE WAS ALWAYS FAIR AND BALANCED IN HER APPROACH, DESIRING TO HAVE HARMONY BETWEEN THE QUALITY OF LIFE FOR THE RESIDENTS AND THE NEEDS OF BUSINESS. AND CERTAINLY SHE KNEW FIRSTHAND THAT TO HAVE A GROWING COMMUNITY THAT PROVIDED A QUALITY OF LIFE FOR ITS RESIDENTS, THERE MUST ALSO BE A STRONG,

VIBRANT BUSINESS ENVIRONMENT IN THAT COMMUNITY.

AS WE ALL LOOK BACK FOR THE 32 YEARS THAT ANN SERVED ON THE CARLSBAD CITY COUNCIL, THOSE YEARS WERE THE MOST SIGNIFICANT PERIOD OF TIME WHEN THE CITY GREW AND BECAME WHAT IT IS TODAY.

WE ARE A REMARKABLE CITY AND A LOT OF OUR SUCCESS WAS THE FORESIGHT AND LEADERSHIP OF WHICH N WAS A KEY STAKEHOLDER, MAYOR AND COUNCIL.

I WOULD URGE THE CITY TO CONSIDER NAMING THE COURTYARD AT THE DOVE LIBRARY IN HONOR OF ANN KULCHIN.

AND IT IS VERY DESERVING.

AT THE COUNCIL MEETING ON MAY 24TH, 2022, COUNCIL ADOPTED A RESOLUTION THAT APPROVED THE ENGINEER'S REPORT AND SET TONIGHT'S PUBLIC HEARING.

TONIGHT, I WILL BRIEFLY SUMMARIZE THE ANNUAL ENGINEER'S REPORT FOR THE LIGHT AND LANDSCAPING DISTRICT NUMBER ONE.

AT THE CONCLUSION OF MY PRESENTATION, A PUBLIC HEARING WILL NEED TO BE CONDUCTED AFTER THE PUBLIC HEARING COUNCIL WILL BE ASKED TO APPROVE A RESOLUTION TO APPROVE THE FINAL ENGINEER'S REPORT AND SET ANNUAL ASSESSMENTS FOR THE FISCAL YEAR 2022-23.

DISTRICT ONE WAS FORMED IN 1983 AND ASSESSMENTS IN THE DISTRICT ARE TO BE USED FOR IMPROVEMENTS MAINTAINED THROUGHOUT THE CITY.

THE IMPROVEMENTS THAT ARE MAINTAINED IN EACH ARE IN THE DISTRICT ARE STREET LIGHTING, STREET TREES AND MEDIAN LANDSCAPING.

THE DISTRICT IS SPLIT INTO THREE ZONES, THE STREET LIGHTING IMPROVEMENT ZONE, THE STREET TREE IMPROVEMENT ZONE, AND THE MEDIAN LANDSCAPING IMPROVEMENT ZONE.

ASSESSMENTS FOR EACH ZONE IN DISTRICT ONE ARE COLLECTED ANNUALLY FROM PROPERTY OWNERS.

HOWEVER, ONLY SPECIAL BENEFITS CAN BE ASSESSED TO THE PROPERTY OWNERS, WHICH IS WHY THERE IS A CONTRIBUTION FROM THE GENERAL FUND FOR APPROXIMATELY $172,000.

ALL THREE ZONES RECEIVE CONTRIBUTION FROM DISTRICT NUMBER TWO AS WELL.

THIS IS A REIMBURSEMENT FOR WORK THAT IS DONE.

THOSE CHARGED THROUGH DISTRICT ONE, BUT ATTRIBUTABLE TO DISTRICT NUMBER TWO.

THE ASSESSMENT EXCUSE ME? THE ASSESSMENT FOR AN AVERAGE SINGLE FAMILY PARCEL, WHICH BENEFITS FROM ALL THREE IMPROVEMENT ZONES IN DISTRICT NUMBER ONE HAS BEEN $70.44 FOR THE LAST 26 FISCAL YEARS, AND IT'S PROPOSED TO REMAIN THE SAME FOR FISCAL YEAR 2020 223.

EACH DEVELOPMENT WITHIN DISTRICT TWO IS CONSIDERED A SEPARATE ZONE, WITH THEIR OWN ASSESSMENT BASED ON THE COST FOR THAT PARTICULAR AREA OF THE CITY.

THERE ARE 16 BENEFIT DEVELOPMENT ZONES LOCATED THROUGHOUT THE CITY.

IN EACH OF THE DEVELOPMENT ZONES AND DISTRICT TO A MAXIMUM AND ACTUAL ASSESSMENT RATE IS CALCULATED ON AN ANNUAL BASIS.

THE MAXIMUM ANNUAL ASSESSMENTS INCREASED BY THE INCREASE IN CONSUMER PRICE INDEX FOR THE SAN DIEGO REGION.

THIS ITEM IS A REQUEST FOR THE CITY COUNCIL TO INTRODUCE AN ORDINANCE ACKNOWLEDGING RECEIPT OF AND APPROVING THE CALIFORNIA COASTAL COMMISSION'S SUGGESTED MODIFICATIONS TO THE CITY'S DENSITY BONUS ORDINANCE.

THE COASTAL COMMISSION SUGGESTED MODIFICATIONS TO THE DENSITY BONUS ORDINANCE THAT WAS APPROVED BY THE CITY COUNCIL IN SEPTEMBER OF 2020.

AND AT THAT TIME THE COUNCIL UPDATED THE DENSITY BONUS ORDINANCE TO BE CONSISTENT WITH STATE LAW.

STATE DENSITY BONUS LAW ALLOWS THE CITY TO APPROVE DENSITY INCREASES, RESIDENTIAL DENSITY INCREASES FOR PROJECTS IN EXCHANGE FOR THE DEVELOPMENT OF AFFORDABLE HOUSING.

THE LAW ALSO ALLOWS THE CITY TO GRANT INCENTIVES AND WAIVERS TO DEVELOPMENT STANDARDS FOR DENSITY BONUS PROJECTS.

THE DENSITY BONUS ORDINANCE IS PART OF THE CITY'S LOCAL COASTAL PROGRAM, AND ANY AMENDMENT TO THE LOCAL COASTAL PROGRAM REQUIRES APPROVAL BY THE COASTAL COMMISSION. THE CITY SUBMITTED THEIR DENSITY BONUS ORDINANCE UPDATE TO THE COASTAL COMMISSION IN NOVEMBER OF 2020, AND DURING THE COMMISSION'S REVIEW OF THE CITY'S APPLICATION, THEY RECEIVED A COMMENT LETTER FROM THE PUBLIC THAT IDENTIFIED A CONCERN WITH ONE PART OF THE ORDINANCE THAT STATED THAT A DENSITY BONUS PROJECT MUST COMPLY WITH ALL REQUIREMENTS OF THE LOCAL COASTAL PROGRAM, WHICH INCLUDES DEVELOPMENT STANDARDS.

THAT LANGUAGE WOULD LIMIT THE CITY'S ABILITY TO GRANT A WAIVER OR A MODIFICATION TO DEVELOPMENT STANDARDS.

THEREFORE, THE COASTAL COMMISSION CRAFTED A MODIFICATION TO THE ORDINANCE TO ENSURE THAT THE CITY'S ORDINANCE COMPLIED WITH STATE LAW.

IN FEBRUARY OF THIS YEAR, THE COASTAL COMMISSION APPROVED THE CITY'S DENSITY BONUS ORDINANCE UPDATE WITH A SUGGESTED MODIFICATION THAT CLARIFIED THAT INCENTIVES, CONCESSIONS AND WAIVERS COULD BE PERMITTED, PROVIDED THE DENSITY BONUS PROJECT COMPLIES WITH THE COASTAL RESOURCE PROTECTION AND PUBLIC ACCESS REQUIREMENTS OF THE CITY'S LOCAL COASTAL PROGRAM.

NOW THE COASTAL COMMISSION'S APPROVAL OF THE CITY'S ORDINANCE WILL NOT BECOME EFFECTIVE UNTIL THE COMMISSION CERTIFIES THAT THE CITY HAS ACCEPTED THE SUGGESTED MODIFICATION. THEREFORE, STAFF IS RECOMMENDING THAT THE CITY COUNCIL INTRODUCE AN ORDINANCE ACCEPTING AND APPROVING THE COASTAL COMMISSION'S SUGGESTED MODIFICATIONS.

THE ACCESSORY DWELLING UNIT ORDINANCE IS PART OF THE CITY'S LOCAL COASTAL PROGRAM.

AND LIKE I MENTIONED IN THE PREVIOUS PRESENTATION, ANY AMENDMENT TO THE LOCAL COASTAL PROGRAM REQUIRES APPROVAL BY THE CALIFORNIA COASTAL COMMISSION.

WE SUBMITTED THE ORDINANCE UPDATE TO THE COASTAL COMMISSION IN NOVEMBER OF 2020 AND DURING THEIR REVIEW OF THE ORDINANCE THEY IDENTIFIED THE NEED TO MAKE MODIFICATIONS TO ENSURE THAT THE ACCESSORY DWELLING UNIT ORDINANCE IS NOT ONLY CONSISTENT WITH ACCESSORY DWELLING UNIT LAW, BUT ALSO THE STATE'S COASTAL ACT.

THE MOST SIGNIFICANT MODIFICATION RECOMMENDED RELATES TO PARKING.

THE STATE'S ACCESSORY DWELLING UNIT LAW STATES THAT IF AN ACCESSORY DWELLING UNIT RESULTED IN THE LOSS OF PARKING ON A RESIDENTIAL PROPERTY, SUCH AS THROUGH CONVERTING AN EXISTING GARAGE TO AN ACCESSORY UNIT, THAT THAT PARKING NEED NOT BE REPLACED ON SITE.

THE STATE LAW ACCESSORY DWELLING UNIT LAW ALSO STATES THAT IT IS NOT INTENDED TO REPLACE THE COASTAL ACT REQUIREMENTS, AND THE COASTAL ACT REQUIRES THAT PUBLIC ACCESS TO THE COAST BE PROTECTED.

AND IF AN ACCESSORY DWELLING UNIT WERE TO ELIMINATE PARKING IN SOME AREAS OF THE COASTAL ZONE, THAT COULD POTENTIALLY IMPACT PARKING FOR VISITORS. THEREFORE, A SUGGESTED MODIFICATION IS PROPOSED THAT WOULD REQUIRE THAT PARKING BE REPLACED.

BE REPLACED IF AN ACCESSORY DWELLING UNIT WERE TO, SAY, CONVERT A GARAGE IN CERTAIN AREAS OF THE COASTAL ZONE, AS YOU SEE ON THE ON THE SCREEN, THE GREEN AREA, THAT PARKING WOULD NEED TO BE REPLACED.

THESE AREAS ARE EAST OF THE RAILROAD, ALONG THE COAST LINE, AND THEN IN THE SOUTHERN PART OF THE CITY, ALSO WEST OF INTERSTATE FIVE, BETWEEN [INAUDIBLE] LAGOON.

SO WITHIN THESE AREAS, ANY PARKING LOTS DUE TO AN ACCESSORY DWELLING UNIT WOULD NEED TO BE REPLACED ON SITE.

OTHERS SUGGESTED MODIFICATIONS INCLUDE CLARIFYING THE EFFECTIVE DATE OF THE ACCESSORY DWELLING UNIT LAW.

ALSO, A MODIFICATION WOULD DELETE REFERENCES TO OTHER CITY CODES OR SECTIONS OF THE MUNICIPAL CODE THAT ARE NOT PART OF THE LOCAL COASTAL PROGRAM.

SO IF THREE NEIGHBORS, ALL AT THE END OF THE CUL DE SAC, WANT TO PUT IN ADUS, THEN THERE'S NO REQUIREMENT FOR OFF STREET PARKING.

THEY CAN JUST TAKE UP ALL THE PARKING SPOTS AT THE END OF THAT CUL DE SAC AND THE RESIDENTS HAVE TO GO FIND SOMEWHERE ELSE TO PARK.

IS THAT ACCURATE? IF A ADU WERE TO CONVERT THE GARAGE OF AN EXISTING HOME, THEY'RE NOT REQUIRED TO REPLACE THAT PARKING.

BUT THERE ARE SOME PARKING REQUIREMENTS FOR ADUS DEPENDING ON THE TYPE OF ADU THAT'S PROPOSED.

BUT THERE ARE THE ABILITY FOR THE CITY TO REQUIRE AN ONSITE PARKING SPACE IT JUST WOULD NEED TO BE IN A GARAGE.

SO THE CITY CAN REQUIRE AN OFF STREET PARKING SPOT IN AREAS OTHER THAN JUST THOSE SPECIFIED BY THE COASTAL ZONE.

WE HAVE THE DISCRETION TO ADD, SAY LIKE AT THE END OF A CUL DE SAC, FOR INSTANCE.

WE DO FOR CERTAIN TYPES OF ADUS, CERTAIN TYPES OF ADUS THAT ARE ATTACHED OR JUNIOR ADUS WE'RE NOT ABLE TO REQUIRE THAT, BUT DETACHED AND LARGER, WE ARE ABLE TO REQUIRE THAT OFF STREET PARKING.

THE ITEM BEFORE YOU TODAY IS THE FISCAL YEAR 2021 SORRY, 2020 2021 GROWTH MANAGEMENT PLAN MONITORING REPORT.

JOINING ME IS NATHAN SCHMIDT WHO WILL GO OVER COMPONENTS RELATED TO STREET FACILITIES.

THE CARLSBAD ZONING CODE REQUIRES THE PREPARATION OF AN ANNUAL MONITORING REPORT ON THE GROWTH MANAGEMENT PLAN.

THE PRIMARY PURPOSE IS TO PROVIDE A STATUS ON COMPLIANCE WITH THE DWELLING UNIT CAPS AND THE PUBLIC FACILITIES PERFORMANCE STANDARDS.

THE PURPOSE IS TO ENSURE THAT PUBLIC FACILITIES ARE PROVIDED CONCURRENT WITH CITY'S GROWTH.

RECENT STATE LAWS HAVE CHANGED THE NATURE OF THIS REPORT AND THE GROWTH MANAGEMENT PLAN, SPECIFICALLY RECENT STATE LEGISLATION THAT WAS ENACTED TO ADDRESS THE STATE'S HOUSING CRISIS. AMONG OTHER THINGS, SB 166 AND SB 330 SETS LIMITS ON LOCAL AGENCIES BY PROHIBITING BOTH RESIDENTIAL GROWTH MORATORIUMS AND RESIDENTIAL GROWTH CAPS.

THE CARLSBAD'S GROWTH MANAGEMENT PLAN UTILIZES BOTH OF THESE TO ENSURE ADEQUATE PUBLIC FACILITIES ARE PROVIDED AS GROWTH OCCURS.

ON APRIL 6TH, 2021, THE CITY COUNCIL ADOPTED TWO RESOLUTIONS CHANGING THE COMPLIANCE WITH THIS GROWTH MANAGEMENT PLAN AND SETTING LIMITS ON THE MORE ON THE UNIT CAPS AND MORATORIUM PROVISIONS.

THIS INFORMATION IS STILL INCLUDED IN THE GROWTH MANAGEMENT PLAN REPORT, BUT IS ONLY FOR INFORMATIONAL PURPOSES.

THIS REPORT, HOWEVER, DOES STILL SHOW COMPLIANCE WITH THE STANDARDS AND INCLUDES AN UPDATE OF ALL 11 PERFORMANCE STANDARDS.

THE CITY IS IN COMPLIANCE WITH 10 OF THE 11 PERFORMANCE STANDARDS, AND NATHAN IS GOING TO GIVE AN OVERVIEW OF THE TWO FACILITIES THAT ARE DEFICIENT.

AND THOSE ARE FOR THE FACILITIES FIRST EASTBOUND AVIARA PARKWAY BETWEEN MANZANITA STREET AND EL CAMINO REAL AND SECOND WESTBOUND AVIARA PARKWAY BETWEEN EL CAMINO REAL AND MANZANITA STREET.

THE NEXT RESOLUTION IS TO ADOPT A RESOLUTION TO DETERMINE THE FOLLOWING FACILITIES TO BE BUILT OUT AND EXEMPT FROM THE LEVEL OF SERVICE PERFORMANCE STANDARDS IN ACCORDANCE WITH GENERAL PLAN MOBILITY ELEMENT POLICY 3-P.9 AND CIFP CIRCULATION PERFORMANCE STANDARD, INCLUDING EASTBOUND AVIARA PARKWAY BETWEEN MANZANITA STREET AND EL CAMINO REAL AND WESTBOUND AVAIARA PARKWAY BETWEEN EL CAMINO REAL AND MANZANITA STREET.

SO SINCE 1988, THE CITY HAS BEEN CONDUCTING ANNUAL MONITORING OF OUR TRAFFIC CONDITIONS, TRAFFIC OPERATIONS CITYWIDE THROUGH OUR ANNUAL MONITORING REPORT THAT INCLUDES COLLECTING NEW TRAFFIC COUNTS AND ANALYZING ROADWAY OPERATING CONDITIONS.

THE FINDINGS OF THIS YEAR'S REPORT ARE SUMMARIZED IN THIS ITEM AND PRESENTED BEFORE YOU TODAY.

I'LL BE GOING OVER THOSE SPECIFIC FINDINGS AND RECOMMENDATIONS FOR EACH OF THESE DEFICIENT SEGMENTS THAT WERE IDENTIFIED.

THAT'S ACTUALLY THE FIRST TIME THAT WE'VE DONE THAT.

THIS INCLUDES ALL STREETS FOR VEHICLE LEVELS OF SERVICE, INCLUDING THE ARTERIAL ARTERIAL CONNECTOR STREETS AND INDUSTRIAL STREETS.

SO THAT INCLUDES 78 LOCATIONS THROUGHOUT THE CITY.

SO THOSE ARE 78 ESSENTIALLY DATA COLLECTION POINTS THAT WE ANALYZED AS PART OF THIS YEAR'S REPORT, THE LEVEL OF SERVICE ANALYSIS, IT'S BASED UPON THE HIGHEST PEAK HOUR DIRECTIONAL VOLUME.

SO WE HAVE AN AM AND PM PEAK AND THOSE WERE TAKEN FROM THREE DAY COUNTS.

SO THE HIGHEST PEAK DURING THE AM AND THE PEAK HOUR WAS BASED ON THOSE THREE DAY COUNTS AND THEY WERE CONDUCTED IN SEPTEMBER, OCTOBER OF NOVEMBER AND NOVEMBER OF 2020, ON A TUESDAY THROUGH THURSDAY WHILE SCHOOL WAS IN SESSION.

NEXT SLIDE. SO THE RESULTS ITSELF, I'LL TAKE YOU THROUGH THEM BY EACH OF THE THREE TYPOLOGIES THAT WERE EVALUATED.

FIRSTLY, 9 DEFICIENT FACILITIES WERE IDENTIFIED ON OUR ARTERIAL STREETS.

ALL OF THOSE WERE PREVIOUSLY EXEMPTED BY CITY COUNCIL, SO THEY WILL CONTINUE TO BE EXEMPT ON THE ARTERIAL CONNECTORS 2 DEFICIENT FACILITIES WERE IDENTIFIED. THESE WERE NEW DEFICIENCIES.

THESE WERE ESSENTIALLY NEW STREETS THAT WERE ANALYZED.

SO THEY HAVE NOT BEEN PREVIOUSLY EXEMPTED BY CITY COUNCIL.

ON THE INDUSTRIAL STREETS, NO DEFICIENT FACILITIES WERE IDENTIFIED.

SO THE 2 DEFICIENT STREET FACILITIES INCLUDE FIRST, AND THESE ARE ESSENTIALLY THE SAME ROADWAY SEGMENT.

THEY'RE JUST IN EACH DIRECTION.

SO IT'S EASTBOUND AND WESTBOUND OF AVIARA PARKWAY BETWEEN MANZANITA STREET TO EL CAMINO REAL.

THE RESULTS SHOW THAT THERE WOULD BE A LEVEL OF SERVICE F THERE IN BOTH DIRECTIONS IN BOTH THE AM AND THE PM PEAK HOURS.

THIS SLIDE HERE SHOWS YOU GRAPHICALLY THAT LOCATION OF THOSE TWO DEFICIENT FACILITIES.

IT'S HIGHLIGHTED IN THE YELLOW DASHED LINES.

ALSO PROVIDED ON THIS MAP IS THE ADT OR THAT'S THE AVERAGE DAILY TRAFFIC VOLUMES FOR REFERENCE, AS WELL AS THE LEVEL OF SERVICE ON THE DEFICIENT SEGMENT THERE.

AS YOU CAN SEE, LEVEL OF SERVICE F AND LEVEL OF SERVICE ON SOME OF THE ADJOINING ROADWAY SEGMENTS.

SO YOU CAN SEE HOW THEY ALL CONNECT TOGETHER THERE.

IT SHOULD BE NOTED THAT THE PRIMARY REASON FOR THE DEFICIENCY IS DUE TO THE CLOSELY SPACED INTERSECTION TRAFFIC SIGNALS AT MANZANITA STREET AND EL CAMINO REAL. THERE'S APPROXIMATELY 450 FEET BETWEEN THESE TWO SIGNALIZED INTERSECTIONS.

SO ONE OF THE PRIMARY LIMITATIONS ON THIS SEGMENT WAS BECAUSE THE SIGNALS ARE SO CLOSELY SPACED, VEHICLES CAN'T GET UP TO AN ACCEPTABLE SPEED TO PRODUCE AN ACCEPTABLE LEVEL OF SERVICE.

SO REALLY THE DEFINING LIMITATIONS HERE IS JUST THAT DISTANCE IN VEHICLES CAN'T GET UP TO TO AN ACCEPTABLE SPEED IN THIS ROADWAY.

STAFF ALSO CONDUCTED SENSITIVITY ANALYSIS TO SEE WHAT COULD HYPOTHETICALLY HAPPEN IF WE DID ADD ADDITIONAL LANES IN EACH DIRECTION.

AND WHAT WE FOUND OUT IS THAT IT WOULD CONTINUE TO FAIL, EVEN WITH THE ADDITION OF ONE AND TWO ADDITIONAL LANES IN EACH DIRECTION.

SO IN ADDITION TO THE OPERATIONS ANALYSIS, BECAUSE IT WAS IDENTIFIED AS A DEFICIENT SEGMENT, STAFF EVALUATED BICYCLE AND PEDESTRIAN IMPROVEMENTS THAT COULD IMPROVE BICYCLE AND PEDESTRIAN ACCESS AT THIS DEFICIENT SEGMENT.

THIS SLIDE HERE SUMMARIZES THOSE WHAT STAFF IS PROPOSING FIRST TO PROVIDE HIGH VISIBILITY CROSSWALKS AT ALL LEGS OF THE INTERSECTION THAT WILL HIGHLIGHT THE PRESENCE OF PEDESTRIANS CROSSING EACH LEG OF THAT INTERSECTION THERE.

AND THEN ALSO TO PROVIDE SOME ADDITIONAL HIGH VISIBILITY STRIPING FOR THE BIKE LANES.

ONE EXAMPLE THERE, WHICH IS CALLED OUT IS THE DASHED GREEN STRIPING AND THAT WOULD BE AT THE WESTBOUND RECEIVING LANE OF AVIARA PARKWAY TO HELP BICYCLES GET THROUGH THAT INTERSECTION A LITTLE BETTER.

AS YOU CAN SEE NOW, THERE'S A GAP IN THE BIKE LANE THERE.

SO PROVIDING ADDITIONAL GREEN STRIPING IN THAT AREA JUST TO HIGHLIGHT THE PRESENCE OF BIKES.

AND THEN ALSO THE OTHER RECOMMENDATION WAS TO LOOK AT REDUCING DOWN THE WIDTH OF SOME OF THE TRAVEL LANES TO PROVIDE ADDITIONAL WIDTH FOR THE BIKE LANES THROUGH THIS THIS DEFICIENT SEGMENT.

NEXT SLIDE, PLEASE. SO CITY COUNCIL HAS THE AUTHORITY TO EXEMPT A STREET FACILITY FROM THE VEHICLE LEVEL OF SERVICE D STANDARD.

IF THE STREET FACILITY MEETS ONE OR MORE OF THE FOLLOWING CRITERIA FROM GENERAL PLAN MOBILITY ELEMENT POLICY 3-P.9.

THOSE EACH OF THOSE CRITERIA ARE OUTLINED HERE.

THE FIRST IS ACQUIRING THE RIGHTS OF WAY IS NOT FEASIBLE OR THE PROPOSED IMPROVEMENTS WOULD SIGNIFICANTLY IMPACT THE ENVIRONMENT IN AN UNACCEPTABLE WAY AND MITIGATION WOULD

NOT CONTRIBUTE TO THE NINE CORE VALUES OF THE CARLSBAD COMMUNITY VISION OR THE PROPOSED IMPROVEMENTS WOULD RESULT IN UNACCEPTABLE IMPACTS TO THE COMMUNITY VALUES OR GENERAL PLAN POLICIES. OR.

LASTLY, THE PROPOSED IMPROVEMENTS WOULD REQUIRE MORE THAN THREE THROUGH TRAVEL LANES IN EACH DIRECTION.

SO IN THE CASE OF THE DEFICIENT SEGMENTS OF AVIARA PARKWAY BETWEEN MANZANITA STREET AND EL CAMINO, REAL STAFF HAS DETERMINED THAT WIDENING AVIARA PARKWAY TO THREE LANES IN BOTH DIRECTIONS BETWEEN THESE STREETS WOULD REQUIRE THE ACQUISITION OF ADDITIONAL RIGHT OF WAY AND WOULD NOT IMPROVE VEHICLE LEVEL OF SERVICE.

AS NOTED ABOVE, THE STREET SEGMENT IS CONGESTED, IS CONGESTED PRIMARILY BECAUSE OF THOSE CLOSELY SPACED INTERSECTIONS THAT LIMIT THE VEHICLE SPEEDS AND CAPACITY AND NOT DUE TO THE LACK OF ADDITIONAL VEHICLE TRAVEL LANES.

THEREFORE, IN ACCORDANCE WITH THE GENERAL PLAN POLICY, THE ACQUISITION OF ADDITIONAL RIGHT OF WAY IS NOT FEASIBLE BECAUSE IT WOULD NOT ADDRESS THIS DEFICIENCY ALSO. AND FURTHERMORE, IN KEEPING WITH GENERAL PLAN POLICY 3P.9 B AND C, THE CONTINUED EXPANSION OF THE ROADWAYS LEADS TO SECONDARY IMPACTS TO ALTERNATIVE MODES OF TRANSPORTATION, SUCH AS PEDESTRIAN AND BICYCLE ACCESS THROUGH THIS AREA.

NEXT SLIDE. SO ONCE EXEMPTED, WHAT ARE THE REQUIREMENTS FOR THIS SEGMENT? THIS IS OUTLINED IN GENERAL PLAN MOBILITY ELEMENT POLICY 3-P.11, WHICH REQUIRES ANY NEW DEVELOPMENT PROJECT THAT WOULD ADD VEHICULAR TRAFFIC TO THESE DEFICIENT STREET FACILITIES THAT ARE DETERMINED TO BE EXEMPT FROM TO IMPLEMENT THE FOLLOWING STRATEGIES TO MITIGATE THOSE IMPACTS.

THE FIRST IS TO IMPLEMENT TDM STRATEGIES THAT WOULD REDUCE THE RELIANCE ON SINGLE OCCUPANT VEHICLES AND ASSIST IN ACHIEVING THE CITY'S LIVABLE STREETS VISION.

AND SECONDLY, TO IMPLEMENT WHAT WE CALL TRANSPORTATION SYSTEMS MANAGEMENT OR TSM.

AND THESE ARE STRATEGIES THAT IMPROVE TRAFFIC SIGNAL COORDINATION AND IMPROVE TRANSIT SERVICE.

SO ALTERNATIVE WAYS THAN ADDING ADDITIONAL VEHICLE LANES.

THIS ITEM WAS REVIEWED BY THE TRAFFIC AND MOBILITY COMMISSION ON JUNE SIX, 2022, AND THE TRAFFIC AND MOBILITY COMMISSION SUPPORTED STAFF'S RECOMMENDATION TO DETERMINE THAT THE TWO STREET FACILITIES ARE DEFICIENT AND EXEMPT FROM THE VEHICLE LEVEL SERVICE STANDARD.

ALSO, THE COMMISSION DID VOTE TO APPOINT VICE CHAIR LINKE AND HE WILL BE HERE TO DISCUSS THE NEED FOR THE INCLUSION OF MULTIMODAL LEVEL SERVICE MONITORING IN THE ANNUAL GROWTH MANAGEMENT PLAN MONITORING REPORT, AND COMMISSIONER LINKE WILL BE AVAILABLE FOR THOSE COMMENTS AFTER STAFF'S PRESENTATION.

SO WITH THAT AND IN SUMMARY, STAFF'S RECOMMENDATION IS TO REVIEW AND CONSIDER THE TRAFFIC MOBILITY COMMISSION'S RECOMMENDATION TO ADOPT A RESOLUTION ACCEPTING THE FISCAL YEAR 20 2021 GROWTH MANAGEMENT PLAN MONITORING REPORT, AND TO ADOPT A RESOLUTION DETERMINING TO STRIP FACILITIES AS DEFICIENT AND ADOPT A RESOLUTION DETERMINING TO STREET TO STREET FACILITIES BUILT OUT AND EXEMPT FROM THE VEHICULAR LEVEL OF SERVICE PERFORMANCE STANDARD.

AND THAT CONCLUDES STAFF'S PRESENTATION.

NEXT SLIDE, PLEASE. SO TECHNICALLY, MMLOS INCLUDES ALL FOUR MODES OF TRAVEL, BUT FOR SIMPLICITY IN THIS PRESENTATION, I'M JUST GOING TO FOCUS ON PEDESTRIAN BICYCLE AND TRANSIT MODES WHICH ARE GRADED ON A SCALE OF EIGHT THROUGH F.

SO AS BACKGROUND BEFORE 2015, ONLY VEHICLE FACILITIES WERE PART OF GROWTH MANAGEMENT.

HOWEVER, THE MOBILITY ELEMENT AND THE 2015 GENERAL PLAN UPDATE REPRIORITIZED STREETS FOR THE OTHER MODES.

AND THE PASSAGES ON THIS SLIDE ARE FROM THE MOBILITY ELEMENT, FROM THE CITYWIDE FACILITIES AND IMPROVEMENTS PLAN AND STAFF PRESENTATIONS INDICATING HOW THE MMLOS SYSTEM WAS SUPPOSED TO BE APPLIED TO GROWTH MANAGEMENT.

AND THAT INCLUDES USING IT TO BOTH EVALUATE THE IMPACTS OF DEVELOPMENT PROJECTS AND FOR ANNUAL CITY MONITORING LIKE THE PORT OR THE REPORT THAT YOU'RE REVIEWING THIS EVENING. THE GROWTH MANAGEMENT PERFORMANCE STANDARD IN THIS CASE IS TO MAINTAIN A MINIMUM GRADE OF DX FOR EACH OF THE PRIORITIZED MODES ON EACH STREET THAT'S

PRIORITIZED FOR THAT MODE.

THE SYSTEM WAS SUPPOSED TO HELP CREATE THE REQUIRED NEXUS TO CONDITION DEVELOPMENTS TO FUND PROJECTS FOR THOSE PRIORITIZED MODES.

BUT ALMOST NONE OF THIS HAS ACTUALLY HAPPENED IN THE NEARLY SEVEN YEARS SINCE THE GENERAL PLAN WAS ADOPTED.

NEXT SLIDE, PLEASE.

FOR EXAMPLE, NO MMLOS MONITORING, INCLUDING TONIGHT'S REPORT, HAS APPEARED IN ANY OF THE SIX ANNUAL GMP MONITORING REPORTS TO COUNCIL SINCE THAT REQUIREMENT WENT INTO EFFECT IN 2015. THIS SLIDE SHOWS HOW EACH REPORT HAS ADDRESSED THE ABSENCE OF MMLOS MONITORING AND JUST I WON'T GO OVER EVERYTHING HERE.

BUT JUST BRIEFLY, THE FIRST TWO REPORTS SAID THAT THE MMLOS METHODS WERE STILL BEING DEVELOPED AND THAT MONITORING WOULD BEGIN THE FOLLOWING YEAR, WHILE THE THIRD ONE PROMISED THAT A LIST OF NEEDED IMPROVEMENTS WOULD BE REPORTED SEPARATELY TO COUNCIL LATER THAT YEAR.

NONE OF THESE THINGS EVER HAPPENED, AND THEN THE LAST THREE YEARS, INCLUDING THIS YEAR, HAVE INDICATED THAT THE MMLOS METHODS NEED FURTHER REFINEMENT, WHICH WOULD BE DONE IN COORDINATION AND COORDINATION WITH OUR COMMISSION, AND THAT THE RESULTS WOULD BE REPORTED SEPARATELY BY THE END OF THE CURRENT YEAR.

BUT IN EACH CASE, THAT HASN'T HAPPENED EITHER.

NEXT SLIDE, PLEASE.

OKAY, BEYOND THE FACT THAT THE MOSQUE HAS NOT YET BEEN MONITORED SINCE 2015, I WANTED TO HIGHLIGHT SOME STATEMENTS OVER THE PAST COUPLE OF YEARS THAT SHOW WHAT I WOULD VIEW AS AN EROSION OF ITS POTENTIAL IMPACT ON GROWTH MANAGEMENT.

FOR EXAMPLE, IN THE 2018-19 MONITORING REPORT, STAFF INTERPRETED COUNCIL'S ADOPTION OF THE CLIMATE ACTION PLANS TDM PROGRAM AS SUFFICIENT TO ASSIGN A TRANSIT LEVEL OF SERVICE D CITYWIDE, EFFECTIVELY EXEMPTING THE ENTIRE CITY FROM HAVING TO DO ANY TRANSIT UPGRADES TO REACH THAT LEVEL, DESPITE THE FACT THAT THE TDM PROGRAM REALLY DOES NOTHING TO IMPROVE TRANSIT CONDITIONS.

I THINK THAT SINCE BEEN RESCINDED ALSO THAT YEAR, THE REPORT BEGAN TAKING THE STANCE THAT THE CITY NEVER REALLY INTENDED TO MAINTAIN MINIMUM MMLOS D STANDARD FOR ANY ALREADY DEVELOPED PORTION OF THE CITY ONLY UNDEVELOPED PARTS.

BUT THAT'S NOT HOW THE LANGUAGE READS IN THE MOBILITY ELEMENT OR THE CIFP, OR HOW IT WAS PRESENTED AS A TRANSFORMATIVE NEW APPROACH TO TRANSPORTATION PLANNING.

AND BECAUSE THE CITY HAS LARGELY BUILT OUT THIS NEW OPINION, WOULD MAKE MOS LARGELY IRRELEVANT.

SO OUR COMMISSION HAS HAD THE REVIEW OF THE MMLOS METHODS ON OUR WORKPLAN FOR THE LAST THREE YEARS.

I THINK SINCE NOVEMBER OF 2019, WE FORMED AN AD HOC COMMITTEE TO WORK WITH STAFF ON THAT, AND THE GOAL WAS TO FINISH THAT UP QUICKLY AND GET THE RESULTS OUT THAT SAME, THAT FIRST YEAR. BUT WE'RE NOW PUSHING THREE YEARS AND THE I WOULD SAY THE GOALPOSTS KEEP GETTING MOVED AROUND.

AND THEN EVEN MORE RECENTLY, WE'VE BEEN HEARING THAT NOT ONLY WAS IT NEVER THE CITY'S INTENT TO MAINTAIN MMLOS D AS PART OF MONITORING, BUT THAT MAY ALSO NOT BE PLAUSIBLE TO USE MMLOS TO ASSESS THE IMPACTS OF INDIVIDUAL DEVELOPMENTS BECAUSE ANY IDENTIFIED DEFICIENCIES WOULD BE CONSIDERED PREEXISTING AND A NEXUS CAN'T BE ESTABLISHED FOR THAT.

AGAIN, THIS IS EXACTLY THE OPPOSITE OF HOW THE SYSTEM WAS ORIGINALLY PRESENTED.

AND I RAISED THESE CONCERNS BACK IN 2015 BEFORE THE SYSTEM EVEN WAS ADOPTED.

AND I'VE BEEN ASKING, ALONG WITH THE COMMISSION FOR ABOUT A YEAR NOW, TO GET A PRESENTATION AND ANSWERS TO THESE TYPES OF QUESTIONS TO HELP US GUIDE OUR COMMISSION ON HOW WE CAN HELP IMPLEMENT THE MOBILITY ELEMENT.

BUT NOTHING HAS HAPPENED YET.

HERE ARE JUST A FEW EXAMPLES OF POTENTIAL MMLOS IMPROVEMENTS THAT HAVE APPEARED IN EARLIER GROWTH MANAGEMENT REPORTS LIKE TONIGHT'S.

THEY INCLUDE SAFETY LIGHTING FOR ALL ALL THREE MODES.

CROSSWALKS FOR PEDESTRIAN AND TRANSIT, CURB EXTENSIONS, IMPROVED BIKE LANES AND TRANSIT BENCHES AND SHELTERS.

OUR COMMISSION'S AD HOC MMLOS COMMITTEE HAS SPENT COUNTLESS HOURS TRYING TO HELP DEVELOP A MEANINGFUL MMLOS SYSTEM THAT INCLUDES THESE TYPES OF IMPROVEMENTS.

BUT WE ALWAYS SEEM TO END BACK ON SQUARE ONE WHERE BASICALLY COMPLETING ANY MISSING SIDEWALK SEGMENTS AND MAYBE PUTTING A BENCH NEXT TO A TRAFFIC STOP ARE REALLY THE ONLY REQUIREMENTS THAT ARE FELT WE CAN BE MADE AND EXCEPTIONS ARE MADE EVEN IN THOSE CASES.

AND OUR COMMISSION STAFF HAS ALSO WORKED VERY HARD TO DEVELOP A DEVELOPING THE SUSTAINABLE MOBILITY PLAN, WHICH INCLUDES A LONG LIST OF THESE TYPES OF MULTIMODAL PROJECTS. AND I THINK THAT WAS RECEIVED POSITIVELY BY THE COUNCIL.

BUT STAFF HAS LIMITED BANDWIDTH AND FUNDING FOR THOSE TYPES OF PROJECTS AND CAN ONLY DO A FEW YEARS.

SO IT SEEMS TO MAKE SENSE FOR DEVELOPERS THROUGH GROWTH MANAGEMENT TO HELP FUND THEM AND EXPEDITE THOSE PROJECTS.

OKAY, LAST SLIDE.

SO TO CONCLUDE, I THINK WE NEED TO HAVE THE TRANSPORTATION, COMMUNITY DEVELOPMENT AND LEGAL DEPARTMENTS GET TOGETHER AND DECIDE WHAT THE CITY IS ACTUALLY ABLE TO DO ON MMLOS AND THEN PRESENT THAT TO OUR COMMISSION TO HELP DETERMINE WHAT THE CITY IS WILLING TO DO TO ACTUALLY IMPLEMENT THE SYSTEM AND THEN MONITOR AND REPORT THE RESULTS

SO THAT'S VERY IMPORTANT FOR THAT AS WELL.

AND I THINK WE NEED TO HAVE A TRANSPARENT DISCUSSION ON IT AND I'LL LEAVE IT AT THAT AND HOPE THAT OR THE WISH OF THE COMMISSION IS TO SORT OF GET THIS GOING, BECAUSE IT'S BEEN SIX YEARS NOW AND EACH YEAR WE SAY, WELL, NEXT YEAR WE'LL DO IT.

I THINK BASED ON THE FACT THAT THE GROWTH MANAGEMENT CITIZENS COMMITTEE IS MEETING ON THIS, WE NEED TO DECIDE, CAN WE DO THIS? WAS IT WAS IT EVER PLAUSIBLE? AND MOVE FORWARD, MOVE THINGS FORWARD.

WE'VE HAD FOUR MEETINGS. THE AD HOC COMMITTEES HAD FOUR MEETINGS WITH CITY STAFF.

I MEAN, WE HAD GOOD, I THINK, A GOOD RELATIONSHIP WITH THE TRANSPORTATION STAFF AND DEVELOPED SOME GOOD WHAT I THOUGHT WERE GOOD MMLOS METHODS TO MOVE THINGS FORWARD.

BUT THEN I THINK IT WENT TO A DIFFERENT DEPARTMENT AND IT CAME BACK AND THEY SAID, WE'RE NOT, WE DON'T WANT TO DO ANY OF THAT.

SO THEN WE WENT BACK TO SQUARE ONE AT OUR LAST MEETING A FEW MONTHS AGO, AND THAT'S KIND OF WHY I WANTED TO GET THIS TO YOUR ATTENTION TO LET'S TRY TO MOVE THINGS FORWARD, EITHER WE CAN DO IT OR WE CAN'T DO IT.

GREAT. AND THEN MY SECOND QUESTION IS ABOUT THE COMMISSION BEHIND YOU TODAY.

THEY APPOINTED YOU TO COME SPEAK TO US.

AND WAS IT SPECIFICALLY ABOUT THE MMLOS KIND OF THE LACK OF PROGRESS ON GETTING THE DATA AROUND THE MMLOS? YEAH. SO AT OUR MEETING WE ALL SUPPORTED THE EXEMPTIONS FOR THE VEHICLE.

IN THIS CASE, THEY'RE RATHER INCONSEQUENTIAL THOUGH.

I THINK ONE OF THE PORTIONS OF WHAT YOU'RE APPROVING TONIGHT IS THE GROWTH MANAGEMENT MONITORING REPORT IN TOTAL, AND THAT INCLUDES ALL FACILITIES. PART OF IT WAS THE EXEMPTIONS OF FOR THE VEHICLE.

SO I THINK THE COMMISSION'S VIEW IS THAT PART OF THIS REPORT SHOULD HAVE INCLUDED PEDESTRIAN, BICYCLE AND TRANSIT LEVEL OF SERVICE AS WELL. SO AT THE BEGINNING OF THE PRESENTATION, MR. SCHMIDT SHOWED A SLIDE SAYING THAT THERE IN THE CIRCULATION PORTION, THERE ARE ONLY TWO DEFICIENCIES, AND THAT WAS THE TWO VEHICLE DEFICIENCIES.

BUT DEPENDING ON HOW YOU INTERPRET OUR MMLOS POINT SYSTEM, YOU COULD SAY THAT THERE ARE DEFICIENCIES IN PEDESTRIAN, BICYCLE AND TRANSIT ALL ACROSS THE CITY, HUNDREDS OF DEFICIENCIES.

AND THAT'S ONE OF THE CONUNDRUMS WE'RE IN, IS THAT IF WE DEFINE AS AN MMLOS SYSTEM THAT WOULD HAVE NEW PROJECTS HAVE TO FUND THEM, THAT MEANS THAT THEY WOULD HAVE TO HAVE A LOWER THAN D RATING.

BUT THEN THEY WOULD THEY WOULD SHOW UP IN YOUR REPORTS AS ALL DEFICIENCIES, UNLIKE VEHICLE LEVEL OF SERVICE, WHICH AS YOU ADD MORE AND MORE TRAFFIC, A DEVELOPMENT CAN CAUSE A DEGRADATION OF LEVEL OF SERVICE TO C OR D OR E, BUT WITH PEDESTRIAN BICYCLE AND TRANSIT, IT'S AMENITY.

IT'S AN AMENITY BASED SYSTEM.

SO WHAT IS THE QUALITY? IT DOESN'T MATTER HOW MANY USERS THERE ARE.

SO IT'S A PREEXISTING CONDITION THAT THIS PART OF THE CITY DOESN'T HAVE A BUFFERED BIKE LANE OR THIS PART OF THE CITY DOESN'T HAVE BUS SHELTERS.

SO IF WE WERE TO MONITOR, WE WOULD SAY, WELL, THERE'S DEFICIENCIES ALL ACROSS THE CITY WHICH WOULDN'T LOOK GOOD.

SURE. YEAH, I UNDERSTOOD I UNDERSTOOD THE IMPORTANCE OF LOOKING AT KIND OF THE BIGGER PICTURE AND HOW EVERYTHING FITS TOGETHER.

AND I ALSO DID NOTE THE KIND OF BIKE LANE SUGGESTIONS FOR THIS PARTICULAR STRETCH.

SO I KNOW THAT THERE WAS SOME ALLUSION TO THAT AS WELL IN THE PRESENTATION.

IT IS A CHALLENGE, AS COMMISSIONER LINKE DID ALLUDE TO, AND REALLY LOOKING TO HARMONIZE THE WANTS OF THE DEVELOPERS AS WE ANALYZE DEVELOPMENT PROJECTS, HOW THAT HOW WE CAN BALANCE THAT WITH GMP MONITORING AND THEN ALSO MEET THE NEEDS OF OUR DEPARTMENT TRANSPORTATION TO BUILD GOOD MULTIMODAL PROJECTS.

NOW WE ARE BEFORE YOU THIS EVENING WITH ANOTHER OPPORTUNITY TO REDUCE THE ASSESSMENT AMOUNTS FOR PROPERTY OWNERS DUE TO FAVORABLE INTEREST RATES.

WE ARE ANTICIPATING OR ESTIMATING AT THIS TIME APPROXIMATELY $165 IN ANNUAL SAVINGS ACROSS THE 2143 PARCELS WITHIN THE DISTRICT.

THE REFUNDING BONDS WILL MAINTAIN THE SAME MATURITY AS THE PRIOR BONDS AND ALSO HAVE A LOWER TOTAL PRINCIPAL, WHICH WILL OF COURSE ACHIEVE CASH FLOW SAVINGS ON AN ANNUAL BASIS.

THE BONDS RECEIVED RECENTLY AN A RATING FROM S&P STANDARD & POOR'S, AND THEY WILL BE INSURED BY BUILD AMERICA MUTUAL, ALSO COMMONLY REFERRED TO AS BAM AND WILL BE PROVIDING A 50% RESERVE FUND SURETY.

AND THEN TGIF, OF COURSE, I GOT THE OPPORTUNITY TO GO INTRODUCE THE BAND.

AND THEN IN TERMS OF SOME OF THE WORK THAT WE'VE BEEN WORKING ON, ESPECIALLY YESTERDAY WE HAD OUR ECONOMIC DEVELOPMENT SUBCOMMITTEE MEETING, THE MAYOR AND I DID, AND WE WERE ABLE TO DIVE REALLY DEEP INTO CONVERSATION SPECIFICALLY AROUND THE STRATEGIC PLAN DOCUMENT THAT WILL BE PUT TOGETHER FOR ECONOMIC DEVELOPMENT.

AND SO WE WERE JUST, YOU KNOW, WE PROVIDED A LOT OF FEEDBACK ON THAT.

THERE ARE DIFFERENT OBJECTIVES AND I WON'T GO INTO DETAIL.

YOU CAN FIND IT ON THE CITY WEBSITE, BUT THERE WERE DIFFERENT OBJECTIVES THAT THE MAYOR AND I WERE ABLE TO PROVIDE SOME FEEDBACK ON, WHICH WILL BE FILLED IN WITH AN ACTION PLAN AND HOPEFULLY THEN WE'LL BE PRESENTED TO THE REST OF THE COUNCIL AFTER WE'VE HAD AN OPPORTUNITY TO LOOK AT IT.

THE OTHER PIECE OF IT WAS JUST LEARNING FROM OUR ECONOMIC SECTOR A LITTLE BIT MORE LIKE THE CHAMBER OF COMMERCE AND CVA, WHAT SOME OF THE ISSUES ARE THAT CONTINUE TO AFFECT THE BUSINESS INDUSTRY.

AND SO, OF COURSE THE WORKFORCE TALENT AND JUST ATTRACTION AND RETENTION IS SOMETHING THAT WE CONTINUE TO HEAR.

FOR YEARS WE'VE WORKED SO HARD ON STUDYING THE NUMBERS AND FIGURING OUT HOW WE'RE GOING TO MAKE IT WORK TO PROCURE CLEAN, GREEN, RENEWABLE ENERGY SOURCES.

AND A YEAR AGO IN JUNE, WE LAUNCHED CLEAN ENERGY ALLIANCE AND IT STARTED PROVIDING THE SERVICES FOR ALL OF CARLSBAD AS WELL AS THE OTHER CITIES IN OUR JPA.

WE TALKED ABOUT SOME OF THE CHANGES, AND I JUST WANTED TO REPORT OUT TO THE COUNCIL.

I KNOW WE TALKED ABOUT THE BROWN ACT.

WE BROUGHT THAT TO THE COUNCIL TO ADD TO OUR LEGISLATIVE PLATFORM THAT WE WANTED MORE FLEXIBILITY USING THE TECHNOLOGY THAT HAS PROVEN ITSELF TO BE WORKABLE FOR COUNCIL MEETINGS DURING THE PANDEMIC.

WE WANTED TO MAKE THAT AN AVAILABLE OPTION FOR THE FUTURE, AND THERE WERE A COUPLE OF BILLS THAT WOULD ALLOW THAT.

BUT SOMEHOW DURING THE THE PROCESS, GOING THROUGH COMMITTEES AND HAVING DIFFERENT PEOPLE SAY WHAT THEY WANTED TO ADD TO THE BILL, THE BILLS, THERE WERE THERE WERE TWO OR THREE OF THEM. THESE BILLS BECAME KIND OF FRANKENSTEIN'S.

THEY BE THEY ADDED SO MANY THINGS IN THOSE BILLS THAT THEY NO LONGER BECAME THEY WERE NO LONGER REALISTIC OR GOOD OPTIONS FOR US.

SO WE ARE NOT SUPPORTING THEM.

WE'RE NEUTRAL NOW ON THOSE BILLS.

LIKE IF THEY WE WERE ALMOST IN A POSE, IF THEY FORCED US TO DO THINGS LIKE TRANSLATE ALL OF OUR MEETINGS SIMULTANEOUSLY ONLINE WHILE HAVING THEM, YOU KNOW, IN MULTIPLE LANGUAGES, YOU KNOW, THEY SEEMED LIKE ONEROUS ADDITIONS.

THE TWO BILLS THAT THE CITY IS SPONSORING, THE LIFEGUARD BILL THAT WOULD ALLOW OCEAN LIFEGUARDS TO BE ABLE TO MORE EASILY TRANSITION TO CITY POOL LIFEGUARDS, THAT ONE'S IN SUSPENSE AND APPROPRIATION BECAUSE OF OF A POTENTIAL COST.

BUT WE'RE HOPING THAT WILL STILL GET PUSHED THROUGH BECAUSE WE ARE CONTRACT LOBBYISTS THAT WE WORK WITH ARE PUSHING BACK ON THE ESTIMATE FOR THE COST OF THAT. AND THEN THE OTHER ONE THAT WAS A RESCUE VESSEL, OCEAN LIFESAVING RESCUE VESSEL, BILL, THAT THAT ONE IS STILL MOVING AHEAD.

AND THAT ONE WOULD NOT IT WOULD IT WOULD SAY IT WOULD NOT IT WOULD REQUIRE THAT IT WOULD NOT REQUIRE THAT AN OCEAN SAY LIFESAVING OCEAN RESCUE VESSEL GOT IT WOULD NOT HAVE TO COMPLY WITH THE FIVE MILE PER HOUR SPEED LIMIT.
