BUT PRIMARILY UNDER THE SCOPE OF THE IDEA THAT THE PLANNING DEPARTMENT ACTUALLY IS NOT SIMPLY A FORWARD-LOOKING OPERATION, BUT THAT PLANNING HAS A RESPONSIBILITY NOT JUST TO CONCEPTUALLY, BUT UNDER THE LAW, TO LOOK BACKWARDS ON ITS WORK TO ASSESS THE DECISIONS THAT IT MAKES.

IN THIS CASE, A PERFECT EXAMPLE WOULD BE GARAGES IN GENERAL.

THESE BOILERPLATE IN THE PLANNING THE PERMIT PROCESS STATES THAT THE PERMITTED STRUCTURE, IN THIS CASE GARAGE, IS TO BE PERMANENTLY MAINTAINED AND AVAILABLE FOR THE PARKING OF VEHICLES.

NOW WE CAN CURE A LOT OF OUR PROBLEMS OF THE COMMUNITY ABOUT THE TRAFFIC ISSUES THAT WE'RE GRAPPLING WITH AT THE MOMENT BY DISINCENTIVIZING THE PLACEMENT OF PRIVATE PROPERTY, IN THIS CASE, AUTOMOBILES AND TRUCKS IN THE PUBLIC RIGHTS OF WAY, THEREBY CREATING HAZARDS TO NAVIGATION ON THE ROADWAYS, AND THAT WOULD BE A PERMITTING SYSTEM.

I'VE MET WITH WORKERS OF THE DESALINATION PLANT, AND I'M VERY FAMILIAR WITH THE PLANT. I'VE NEVER BEEN THERE THOUGH.

>> I'VE BEEN ON TWO TOURS, ONE PRIOR TO ITS OPENING ON A FIELD TRIP WHEN MY KIDS WERE IN FIFTH GRADE [LAUGHTER] AND THEN ONE WITH THE PLANNING COMMISSION WHEN WE WENT TO TOUR THAT WHOLE SITE.

I ALSO AM A LITTLE BIT FAMILIAR WITH OTHER EFFORTS THAT HAVE BEEN, NOT FROM POSEIDON'S POINT OF VIEW, BUT FROM OTHER ELEMENTS, SITES THAT HAVE BEEN DESIGNATED AS POSSIBLE SITES FOR DESALINATION, BUT HAVE NOT GONE THROUGH.

IT'S AN INTERESTING PROBLEM.

THIS SINGLE ITEM ON TONIGHT'S AGENDA IS THE INTAKE AND DISCHARGE MODIFICATIONS TO THE CARLSBAD DESALINIZATION PLANT, WHICH CONSTITUTES A CONDITIONAL USE PERMIT, AND A SPECIAL USE PERMIT WHICH IS WITHIN THE COMMISSION'S PURVIEW AS THE FINAL DECISION-MAKING BODY.

SCOTT DONALD IS THE LEAD PLANNER THAT WILL BE PRESENTING ON THIS ITEM. SCOTT.

FIRST OF ALL, I'D LIKE TO START WITH AN INTRODUCTION TO PROVIDE SOME ORIENTATION AS TO THE PROJECT LOCATION.

OF COURSE, ON THE LEFT WE HAVE AN AERIAL PHOTO OF THE POWER STATION, AND THIS IS A PHOTO PRIOR TO ITS DEMOLITION.

BUT IT'S STILL ACCURATE IN HELPING TO SHOW THE LOCATION OF THE PROPOSED PROJECT.

YOU'LL SEE THERE ARE TWO YELLOW BOXES.

THE LARGER ONE IS WHERE THE BULK OF THE IMPROVEMENTS THAT THE PLANNING COMMISSION WILL CONSIDER TONIGHT ARE LOCATED AND THAT IS IN THE SOUTHWESTERN MOST EXTENT OF THE OUTER BASE IN UPPER AGUA, HEADING ON TO LAGOON.

YOU'LL ALSO SEE THAT THERE'S A SMALLER YELLOW BOX WHICH REALLY JUST HIGHLIGHTS THE GENERAL AREA WHERE AN ADDITIONAL PROJECT IMPROVEMENTS ARE LOCATED, WHICH ACTUALLY IN THIS CASE CONSISTS OF SOME TEMPORARY DRIVEWAYS AS WELL AS THE TEMPORARY PARKING LOT.

THE INSET PHOTO THERE ON THE RIGHT, JUST AS AN EXISTING PHOTO OF WHAT THE SITE LOOKS LIKE TODAY.

THIS WAS TAKEN WITHIN THE BOUNDARIES OF THE INCENTIVE POWER PLANTS, SO A VIEW THAT'S NOT AVAILABLE TO THE PUBLIC, BUT WHAT IT DOES HELP TO DO IS SHOW THE AREA WHERE THE BULK OF THE IMPROVEMENTS PROPOSED BY THE PROJECT ARE LOCATED.

THAT CONCRETE STRUCTURE THAT YOU SEE IN THE BACKGROUND IS ACTUALLY THE EXISTING INCENTIVE POWER STATION INTAKE FOR THE SEAWATER THAT COMES THROUGH THE LAGOON.

IN THE FOREGROUND OF THAT IS WHERE THE PROPOSED IMPROVEMENTS WOULD BE LOCATED.

SOME BACKGROUND ON THE PROJECT.

THE DESALINATION PLANT WAS APPROVED BY THE CITY IN 2006.

THE PROJECT BEGAN DELIVERING WATER TO THE SAN DIEGO REGION NINE YEARS LATER.

AT THAT TIME, IT WAS CO-LOCATED OR DEPENDENT ON THE OPERATION OF THE INSIGNIA POWER STATION, BUT THERE WAS ALWAYS THE KNOWLEDGE THAT EVENTUALLY THAT POWER STATION WOULD RETIRE, AND INDEED IN 2018, THE POWER PLANT WAS DECOMMISSIONED.

AS YOU KNOW TODAY, IT'S LARGELY BEEN DEMOLISHED.

REALLY SINCE THAT TIME, THE EFFORT HAS BEEN TO PROVIDE PHASED IMPROVEMENTS TO DEVELOP A COMPLETELY INDEPENDENT STANDALONE DESALINATION PLANT OPERATION.

ONE OF THE FIRST PHASES OF THAT WAS THE CONSTRUCTION OF SOME FISH FRIENDLY PUMPS.

THE SECOND PHASE IS REALLY WHAT'S BEING CONSIDERED TODAY, A DIFFERENT MODIFICATION OR DIFFERENT TYPE OF INTAKE STRUCTURE IN ORDER TO MEET NEW STATE LAW REQUIREMENTS CALLED THE OCEAN PLAN.

I WILL ADD AS WELL THAT THE APPLICANT DOES HAVE A PRESENTATION TO PROVIDE TONIGHT, CAN GO INTO MORE DETAIL ABOUT THE WORKINGS OF DIESEL AND AND WHY THESE CHANGES ARE NECESSARY.

THE PROJECT WOULD MODIFY HOW THE PLANT RECEIVES AND DISCHARGES SEAWATER, AND THE EXISTING INTAKE TO THE POWER PLANT TAKES WATER IN FROM THE AGUA HEDIONDA LAGOON AND THEN DISCHARGES IT INTO A DISCHARGE PLAN THAT THEN IS TRANSFERRED UNDERNEATH CARLSBAD BOULEVARD INTO THE OCEAN.

THE PROPOSED MODIFICATIONS WOULD CONTINUE THAT GENERAL ROUTING OF THE WATER, BUT DO SO IN A MANNER THAT COMPLIES WITH NEW STATE LAWS THAT ESSENTIALLY ALL LOOK AT REDUCING MARINE LIFE MORTALITY.

ANOTHER COMPONENT OF THE PROJECT AS I MENTIONED AT THE BEGINNING OF THE PRESENTATION IS TO ADD TEMPORARY DRIVEWAYS AND PARKING LOT.

THIS IS FOR THE BENEFIT OF THE FISH FARM.

PRESENTLY, THE FISH FARM USES PARKING WHERE PROJECT CONSTRUCTION WILL OCCUR, SO IT'S NECESSARY TO PROVIDE NEW TEMPORARY PARKING TO THE NORTH OF THE FISH POND.

IMPROVEMENTS ARE CONCENTRATED ALL IN AND NEAR THE LAGOON, BOTH THE TEMPORARY DRIVEWAYS AND PARKING LOT, AS WELL AS THINGS LIKE THE DIFFERENT STRUCTURES TO FILTER THE WATER ARE AS YOU HAVE SEEN IN PRIOR SLIDES, ADJACENT IN THE LAGOON AREA..

THERE ARE TWO PERMITS THAT ARE REQUIRED FOR THIS PROJECT THAT REQUIRE THE PLANNING COMMISSION'S APPROVAL.

THE FIRST IS A CONDITIONAL USE PERMIT, WHICH IS NEEDED FOR ANY IMPROVEMENTS THAT ARE PROPOSED IN THE OPEN SPACE ZONE.

AS YOU MIGHT IMAGINE, THE BULK OF THE LAGOON IS ZONED OPEN SPACE.

THE PLANNING COMMISSION ALSO HAS THE AUTHORITY AS FLOODPLAIN ADMINISTRATOR TO APPROVE ANY IMPROVEMENTS THAT ARE PROPOSED IN THE FLOODPLAIN, SO REALLY IT'S TWO PERMITS BEFORE YOU TONIGHT OVER WHICH YOU HAVE APPROVAL AUTHORITY, A CONDITIONAL USE PERMIT, AND A SPECIAL USE PERMIT.

NOW, WHAT YOU MIGHT FIND CONSPICUOUSLY ABSENT FROM THIS LIST IS A COASTAL DEVELOPMENT PERMIT TYPICALLY FOR OUR PROJECTS SO CLOSE TO THE OCEAN AND THE LAGOON, YOU WOULD ISSUE A CDP.

IN THIS CASE HOWEVER, COASTAL COMMISSION HAS RETAINED PERMIT AUTHORITY FOR ANY COASTAL DEVELOPMENT PERMIT IN THE AGUA HEDIONDA LAGOON AREA.

IN FACT, THE APPLICANT DID RECEIVE APPROVAL OF THAT CDP FROM THE COASTAL COMMISSION JUST THIS PAST MONTH.

THE PERMITS BEFORE YOU, THE CONDITIONAL USE PERMIT, THE SPECIAL USE PERMIT, THE CDP THAT'S BEEN ISSUED ALREADY BY THE COASTAL COMMISSION, AND THERE'S ONE FINAL COMPONENT OF THIS PROJECT THAT ACTUALLY ISN'T SUBJECT TO THE PLANNING COMMISSION'S REVIEW.

THAT IS THE IMPROVEMENTS THAT ARE IN THE PUBLIC UTILITY ZONE.

GENERALLY, THESE ARE IMPROVEMENTS THAT OCCUR ON THE LAND-BASED PORTION OF THE POWER PLANT, NOT IN THE LAGOON BUT THE LAND AREA OF THE FORMER POWER STATION.

WE'LL TAKE A LOOK AT SOME SLIDES THAT HELP TO EXPLAIN WHERE THE OPEN SPACE ZONE IS AND WHERE THE PUBLIC UTILITY ZONE IS, AND THEREFORE WHERE YOUR PURVIEW OR YOUR JURISDICTION LIES.

AN OVERALL SLIDE OF THE PROPOSED IMPROVEMENTS YOU CAN SEE THEY'RE HIGHLIGHTED BOTH HERE PRIMARILY IN GREEN, BUT ALSO SOME BLUE DOTS AND I'LL EXPLAIN THOSE IN JUST A MINUTE.

BUT THE GREEN HIGHLIGHTS ON THE LEFT SIDE OF THIS SLIDE REALLY FOCUS ON THOSE IMPROVEMENTS THAT ARE IN THE LAGOON IN THAT VERY SOUTHWEST PORTION OF THE LAGOON.

THE MAJOR PORTION OF THE IMPROVEMENTS ARE CONSISTING OF WHAT'S KNOWN AS A PROPOSED FINE SCREENING FACILITY, WHICH CONTAINS THE BAFFLES AND THE MECHANISMS IN ORDER TO TREAT THE SEAWATER THAT COMES IN TO MAKE SURE THAT SEAWATER THAT'S ULTIMATELY PRESENTED TO THE PLANT FOR DESALINATION HAS REDUCED THE AMOUNT OF MARINE LIFE MORTALITY.

THAT STRUCTURE IS ABOUT 30 FEET WIDE, AS WELL AS 160 FEET LONG, AND IT EXTENDS ABOUT 25 FEET ABOVE THE WATER SURFACE AND ABOUT 15 FEET BELOW THE WATER SURFACE.

IT'S IMPORTANT TO HAVE THAT BELOW WATER SURFACE IN ORDER OF COURSE TO HELP SCREEN OUT THE MARINE LIFE.

YOU'LL SEE IN FRONT OF THAT FINE SCREENING FACILITY THERE'S A PROPOSED FLOATING BOOM THAT ALSO EXTENDS BELOW THE WATER.

AGAIN, THE PURPOSE OF THAT IS ALSO TO HELP SCREEN UP MARINE LIFE, BUT ALSO DEBRIS THAT MIGHT GET INTO

THE WATER THAT THE DESALINATION PLANT ULTIMATELY TREATS.

THEN BEHIND THAT FINE SCREENING FACILITY IS A DECK.

THAT DECK IS SIMPLY TO PROVIDE ACCESS TO VEHICLES, TO MAINTENANCE WORKERS TO ACCESS THE FINE SCREENING FACILITY IN THE MAINTENANCE THAT IS NECESSARY FOR IT.

THE DECK IS PROBABLY THE LARGEST FEATURE OF THE PROJECT.

IT IS ABOUT 200 FEET WIDE FROM LAGOON SHORE TO LAGOON SHORE IN THIS PART OF THE PROJECT, AND IS ABOUT 30 FEET DEEP.

THE OTHER HIGHLIGHTED IMPROVEMENTS IN GREEN THAT YOU SEE TO THE RIGHT ARE THOSE IMPROVEMENTS THAT ARE IN THE PUBLIC UTILITY ZONE, AND THESE PRIMARILY CONSIST OF THE ADDITION OF A NEW SMALL ELECTRICAL BUILDING AS WELL AS THE DEMOLITION OF SOME EXISTING IMPROVEMENTS THAT SERVED THE UNSEEN OF POWER STATION.

THE PUBLIC UTILITY ZONE, WHEN THE DESALINATION PLANT WAS APPROVED IN 2006, REQUIRED THE APPROVAL OF A PRECISE DEVELOPMENT PLAN.

THAT PRECISE DEVELOPMENT PLAN WAS PART OF THE PROJECT APPROVAL AND ACTUALLY GIVES ADMINISTRATIVE APPROVAL OR STAFF APPROVAL OF PROPOSED IMPROVEMENTS, MINOR IMPROVEMENTS THAT ARE NECESSARY TO SUPPORT THE DESALINATION PLANT.

THIS IS JUST AN EXTENSION OF THE PROPOSED IMPROVEMENTS REALLY HIGHLIGHTING IN GRAY TO THE LEFT PART OF THIS SITE PLAN, THE PROPOSED PARKING AREA, AGAIN JUST TO THE NORTH OF THE EXISTING FISH FARM FACILITY AND VERY CLOSE AROUND THE BANKS OF THE AGUA HEDIONDA LAGOON.

GETTING BACK TO THE POINT MADE EARLIER ABOUT THOSE IMPROVEMENTS IN THE OPEN SPACE AND THOSE IMPROVEMENTS IN THE PUBLIC UTILITY ZONE.

GREEN REPRESENTS THE OPEN SPACE WHICH IS THE MAJORITY OF THE AGUA HEDIONDA LAGOON.

GENERALLY, IMPROVEMENTS WITHIN THAT OPEN SPACE DESIGNATION OR WITHIN THE LAGOON ARE SUBJECT TO THE CONDITIONAL USE PERMIT AND THE SPECIAL USE PERMIT THAT THE PLANNING COMMISSION IS BEING ASKED TO CONSIDER FOR APPROVAL.

THOSE IMPROVEMENTS THAT ARE IN THE BLUE OR IN THE PUBLIC UTILITY ZONE ARE THOSE THAT ARE SUBJECT TO STAFF'S APPROVAL PER THE PRECISE DEVELOPMENT PLAN.

THAT'S TRUE FOR THE MOST PART, BUT THERE IS AN EXCEPTION, AND THAT'S WHAT THIS NEXT SLIDE HELPS TO SHOW.

FIRST OF ALL, YOU CAN SEE I'VE CALLED OUT HERE THE DASH LINE THAT BASICALLY FOLLOWS THE BOUNDARY OF A LAGOON WHICH MARKS THE LOCATION OF THE FLOODPLAIN.

THAT DASH LINE SERVES TO ALSO BE THE BOUNDARY BETWEEN WHICH THE PUBLIC UTILITY ZONE WHERE STAFF HAS ITS ADMINISTRATIVE APPROVAL AND THE AREA THAT THE PLANNING COMMISSION SERVES AS THE FLOODPLAIN ADMINISTRATOR.

A PORTION OF THIS PROJECT WHILE IN THE PUBLIC UTILITY ZONE IS ALSO WITHIN THE BOUNDARIES OF THE FLOOD ZONE.

BECAUSE OF THAT, THE PLANNING COMMISSION RETAINS PERMIT AUTHORITY TO APPROVE THOSE PORTIONS OF THE PROJECT WITHIN THE FLOODPLAIN.

THAT REALLY EXTENDS TO JUST A SMALL PORTION OF THE DECK THAT'S LOCATED BEHIND THE FINE SCREENING FACILITY.

YOU CAN SEE PERHAPS THAT THAT DECK IS SPLIT BY BOTH ZONING DISTRICTS.

THE MAJORITY OF IT IS IN THE OPEN SPACE ZONE, BUT A PORTION OF IT IS IN THE PUBLIC UTILITY ZONE.

THAT'S JUST SOME OF THE FINER DETAILS OF THE PROJECT TO HELP CLARIFY WHY NOT ALL COMPONENTS OF THIS, THE ELECTRICAL BUILDING, FOR EXAMPLE, SOME OF THE DEMOLITION THAT'S PROPOSED IS NOT SUBJECT TO PLANNING COMMISSION'S APPROVAL.

WE GO BACK TO THE PICTURE OF THE PORTION OF THE BAY WHERE THE MAJORITY OF IMPROVEMENTS ARE PROPOSED.

THAT'S OF COURSE, THE PHOTO THAT YOU'VE SEEN ALREADY ON THE TOP LEFT, THE BOTTOM RIGHT OR THE BOTTOM LEFT, EXCUSE ME, SHOWS THE PROPOSED FINE SCREEN FACILITY, THE DECK THAT'S BEHIND IT, AND WHAT IT WOULD LOOK LIKE FROM THE PERSPECTIVE OF SOMEONE STANDING NEAR THE FISH FARM FACILITY.

AGAIN, ON PROPERTY THAT'S NOT PUBLICLY ACCESSIBLE.

WHILE THIS MAY LOOK LIKE A LARGE STRUCTURE, THE POINT TO REMEMBER IS IT'S NOT READILY VISIBLE TO THE PUBLIC.

THAT'S SIMPLY BECAUSE OF ITS LOCATION, INTERVENING TOPOGRAPHY, STRUCTURES, VEGETATION, OFFENSE, AND PERHAPS MOST IMPORTANTLY, DISTANCE.

THIS FACILITY IS QUITE A DISTANCE FROM ANY ADJACENT HOME OR PUBLIC STREET, GARFIELD STREET, FOR EXAMPLE CHINQUAPIN, ALL OF THOSE LOCATIONS ARE 2,000 FEET OR MORE FROM WHERE THIS CONSTRUCTION WOULD OCCUR.

WHILE IT MAY LOOK PROMINENT IN THE BOTTOM LEFT PHOTO, IN ACTUALITY WHAT'S VISIBLE FROM THE PUBLIC IS NOT OR DOES NOT REPRESENT A SIGNIFICANT IMPACT ON VIEWS.

AS FAR AS ENVIRONMENTAL REVIEW, THE SAN DIEGO COUNTY WATER AUTHORITY, WHICH IS THE LEAD AGENCY FOR THIS PROJECT HAVE PREPARED AND APPROVED WHAT'S KNOWN AS A SEVENTH ADDENDUM TO THE ENVIRONMENTAL IMPACT REPORT THAT THE CITY APPROVED BACK IN 2006.

THAT'S SEVENTH ADDENDUM WAS USED TO ANALYZE THE IMPACTS ASSOCIATED WITH THE IMPROVEMENTS THAT ARE BEING PROPOSED.

WHILE THE SAN DIEGO COUNTY WATER AUTHORITY IS THE LEAD AGENCY, THE CITY OF CARLSBAD HAS ITS ROLE AS A RESPONSIBLE AGENCY.

WHICH MEANS IT CAN USE THAT ENVIRONMENTAL DOCUMENT

PREPARED BY THE LEAD AGENCY FOR ITS PURPOSES OR IN OTHER WORDS, FOR ITS PURPOSES TO ISSUE BOTH THE CONDITIONAL USE PERMIT AND THE SPECIAL USE PERMIT.

IN ORDER TO DO SO, HOWEVER, WE NEED TO MAKE A FINDING OF CONSISTENCY THAT THE PROPOSED IMPROVEMENTS ARE CONSISTENT WITH THE ANALYSIS AND THE ADDENDUM.

STAFF, OF COURSE, HAS REVIEWED THE ADDENDUM, FOUND IT TO BE ADEQUATE WITH THE EXCEPTION OF NOT DISCUSSING THE CITY'S PROPOSED FIRE STATION, WHICH IS ALSO TO BE LOCATED ON THE GROUNDS OF THE FORMER POWER PLANT, VERY CLOSE TO THESE PROPOSED IMPROVEMENTS.

FOR THAT REASON, A SUPPLEMENTAL TECHNICAL MEMORANDUM WAS PREPARED TO THE ADDENDUM SIMPLY TO IDENTIFY WHAT IMPACTS MAY RESULT FROM THE PROPOSED DESALINATION MODIFICATIONS ON THE FIRE STATION.

WITH THE ADDENDUM COMBINED WITH THE SUPPLEMENTAL TECHNICAL MEMORANDUM, STAFF IS RECOMMENDING THAT INDEED THE PROJECT CAN BE FOUND CONSISTENT WITH THE ENVIRONMENTAL REVIEW THAT HAS BEEN CONDUCTED.

SPEAKING OF THE TEMPORARY FIRE STATION, JUST TO GIVE YOU AN IDEA OF WHERE THAT'S LOCATED IN RELATION TO THE PROJECT.

AGAIN, WE HAVE THE TWO YELLOW SQUARES.

THEY'RE HIGHLIGHTING WHERE THE MODIFICATIONS ARE PROPOSED FOR THE DESALINATION PLANT.

LITTLE RED CIRCLE THERE INDICATING THE APPROXIMATE LOCATION OF THE TEMPORARY FIRE STATION ABOUT 3-400 FEET TO THE SOUTH.

THE CITY HAS SIGNED A SIX-YEAR LEASE WITH NRG, THE OWNER OF THE POWER PLANT PROPERTY, TO BUILD AND FULLY EQUIP AND STAFF A POWER PLANT AT THAT LOCATION.

CITY ANTICIPATES THE POWER PLANT WILL BE OPERATIONAL EARLY NEXT YEAR, THAT IT WILL USE THE ACCESS ONTO CARLSBAD BOULEVARD THAT EXISTS TODAY.

IT IS THAT TECHNICAL MEMO THAT I MENTIONED EARLIER THAT PROVIDES THE ADDITIONAL ENVIRONMENTAL ANALYSIS NECESSARY TO FIND THAT THE SEVENTH ADDENDUM IS ADEQUATE FOR THE PURPOSES OF DETERMINING THE ENVIRONMENTAL IMPACTS FOR THIS PROJECT.

AS FAR AS ADDITIONAL INFORMATION, WE DID PROVIDE TO YOU AT THE MEETING TONIGHT AN ADDITIONAL MATERIALS MEMORANDUM.

THIS CONDITION SIMPLY, REALLY THE POINT OF IT IS JUST TO TALK ABOUT OR ESTABLISH A TIME LIMIT FOR THE TEMPORARY DRIVEWAYS.

THE RECOMMENDED MODIFICATIONS ARE SIMPLY TO ALLOW MORE TIME FOR THOSE TEMPORARY DRIVEWAYS TO REMAIN, AND ALSO TO GIVE MORE FLEXIBILITY TO THE CITY ENGINEER IN TERMS OF DECIDING WHETHER OR NOT THEY CAN REMAIN, NOT JUST BASED ON THAT THE APPLICANT IS ACTIVELY PROCESSING APPLICATIONS, PERHAPS TO MAKE THOSE TEMPORARY DRIVEWAYS PERMANENT, BUT FOR OTHER REASONS AS WELL.

THESE CONDITIONS OR THIS MODIFICATION TO THE CONDITION HAS BEEN REVIEWED BY BOTH THE APPLICANT AS WELL AS THE CITY ENGINEER, AND OF COURSE WE'RE RECOMMENDING APPROVAL OF THAT AS AN AMENDMENT TO YOUR MOTION.

RAW SEAWATER THAT COMES IN GOES THROUGH THE MEDIA FILTERS.

THIS IS MAINLY TO REMOVE THE LARGE PARTICLE SIZE AND FOLLOWED BY MICRON FILTERS, THE SECOND PICTURE YOU SEE.

THE SYSTEM REMOVES SMALLER PARTICLES UP TO 20 MICRONS.

THEN ONCE YOU HAVE CLEAN SEAWATER, WHICH IS ALL SALT, IT'S PUMPED THROUGH HIGH-PRESSURE PUMPS TO PUSH THE WATER THROUGH REVERSE OSMOSIS MEMBRANES, WHICH ACTUALLY SEPARATES THE SALT MOLECULE FROM THE WATER MOLECULE.

THEN NUMBER 5, THE YELLOW EQUIPMENT THAT YOU SEE, IT IS A ZOOM VERSION OF THE NEXT SLIDE.

THIS IS ACTUALLY ONE OF THE KEY PART OF THE DIESEL PLANT AND HOW DIESEL CAME INTO THE PLAY.

FINALLY, IT'S A POST-TREATMENT, WHICH IS ESSENTIALLY THE WATER THAT GOES THROUGH SOME CALCITE FILTER TO STABILIZE THE WATER.

THEN ASPECT OF DRINKING WATER REGULATIONS, FLUORIDE, CHLORIDE, AMMONIA, AND PH IS BALANCED TO MAKE SURE THAT WATER IS READY TO BE SENT FOR DRINKING PURPOSES.

IN SUMMARY, I MEAN JUST FOR DIESEL, THIS IS OUR SEVENTH YEAR OF OPERATION.

WE HAVE PRODUCED MORE THAN 90 BILLION WITH A B, GALLONS OF HIGH-QUALITY WATER AND DROUGHT-PROOF WATER IN SAN DIEGO COUNTY.

IT'S THE LARGEST SOURCE OF LOCAL WATER SUPPLY HERE IN THE REGION AND PROVIDES 10 PERCENT OF THE REGION'S WATER SUPPLY.

AS YOU KNOW, WITH THE ONGOING DROUGHT, IT HAS INSULATED SAN DIEGO REGION FROM THE SEVERE WATER USE RESTRICTION THAT OTHER COUNTIES AND CITIES HAVE FACED IN CALIFORNIA.

NOW THAT WE HAVE GONE THROUGH JUST ONE-ON-ONE OF DIESEL AND IT'S A VERY QUICK ONE-ON-ONE I MUST SAY, LET'S TALK ABOUT WHY WE ARE HERE TODAY.

IN 2010, I THINK AS SCOTT ALLUDED TO, CALIFORNIA WATER RESOURCES CONTROL BOARD ADOPTED A ONCE-THROUGH COOLING POLICY, WHICH EFFECTIVELY PHASED OUT THE ONCE-THROUGH COOLING FOR POWER PLANT.

AS A RESULT, ENCINA POWER STATION DOMINATED ITS OPERATION IN DECEMBER 11, 2018.

IN 2015, ANOTHER REGULATION CAME ABOUT.

THIS IS THE OCEAN PLAN AMENDMENT WHICH YOU ALSO HEARD ABOUT AND THAT WAS THAT ANY INTAKE TO THE DIESEL PLANT HAVE TO MAKE SURE THAT WE USE ONE-MILLIMETER SCREEN MESH AND THE APPROACH VELOCITY HAS TO BE HALF A FOOT PER SECOND.

IT HAS TO BE VERY SLOW JUST TO MINIMIZE THE IMPACTS TO MARINE LIFE.

IN 2019, WE GOT A PERMIT FROM THE REGIONAL WATER QUALITY CONTROL BOARD, WHICH REQUIRED US TO IMPLEMENT THIS, BUT IN A PHASED APPROACH.

THE PHASE 1 PART WAS COMPLETED IN JUNE OF 2020 WHERE WE INSTALLED A NEW FISH-FRIENDLY DILUTION PUMPS.

THE ONE I TALKED ABOUT IS USED TO DILUTE THE BRINE.

THE SECOND PART OF THE PHASE 1 WAS TO TRUNCATE OURSELVES FROM THE POWER PLANT SO THE POWER PLANT COULD START THEIR DEMOLITION PROCESS.

WE TRUNCATE IT AND STILL ARE USING PART OF THEIR ASSETS RIGHT NOW FOR THE PHASE 1.

THE PHASE 2 IS THE TOPIC OF TODAY.

THAT'S THE ONE WE ARE GOING TO BE INSTALLING, THE NEW SHORELINE PERMANENT MODIFICATION, AND ALSO ABANDONING REMAINING ASSETS THAT THE POWER PLANT COULD NOT DEMOLISH ONCE WE ARE UP AND RUNNING.

AGAIN, TO CONSTRUCT THIS INTAKE INTO SHOCK MODIFICATION, AS YOU KNOW, WE MUST REQUIRE AND GET APPROVAL FROM MULTIPLE AGENCIES AND SAN DIEGO COUNTY WAS A LEAD AGENCY FOR SEQUELS.

THEY COMPLETED THAT IN MAY.

SINCE THEN, WE HAVE GOT OTHER TWO DISCRETIONARY PERMITS, ONE FROM THE REGIONAL WATER QUALITY CONTROL BOARD AND THE SECOND ONE WITH THE CALIFORNIA, OF COURSE, THE COMMISSION THAT GOT APPROVED IN SEPTEMBER, AND HERE WE ARE IN FRONT OF THE COMMISSION TODAY FOR THE SUP AND CUP TODAY.

FOLLOWED BY TWO OTHER PERMITS WHICH ARE IN PROCESS RIGHT NOW, WHICH IS THE 404 WITH THE ARMY CORPS AND WATER QUALITY CERTIFICATION FROM THE REGIONAL WATER QUALITY BOARD.

WE NEED TO GET ALL THESE BEFORE WE START CONSTRUCTION AND BE ANTICIPATING TO GETTING THE ARMY CORPS AND REGIONAL BOARD BY THE END OF THE MONTH.

IN SUMMARY, I THINK JUST WANTED TO SAY THAT WE'VE ALREADY HIRED A CONTRACTOR THAT IS PROGRESSING THE DESIGN.

THE DESIGN HAS ALREADY GONE THROUGH 30 PERCENT PLUS PHASE AT THIS POINT OF TIME.

ONCE WE HAVE ALL THE PERMITS, WE WOULD BE GOING IN FOR FINANCING AND FINALIZING THE CONTRACT WITH OUR CONTRACTOR TO EXECUTE THIS CONSTRUCTION WORK.

WE USE A SIMILAR SCREENS, BUT THEY'RE NINE-MILLIMETER SIZE.

IT REMOVES THE DEBRIS, IT REMOVES THE OTHER MARINE THINGS THAT CAN, WHICH ARE AGAIN DISPOSED OF BACK INTO THE LAGOON, THE ORGANICS ARE SEPARATED AND REMOVED BACK INTO THE LAGOON ON THE DISCHARGE SIDE.

THE WATER THEN FLOWS TO THE DESAL PLANT.

WE TAP INTO THAT AREA AFTER THE SCREEN INTO THE DESAL PLAN.

THAT'S THE ONE WHICH IS EXISTING RIGHT NOW.
