THIS ITEM ON TONIGHT'S AGENDA IS A SPECIAL USE PERMIT FOR THE OMNI LA CASA GOLF COURSE RENOVATION AND PRESENTING THIS ITEM IS ASSOCIATE PLANNER LAUREN YZAGUIRRE.

GOOD EVENING, COMMISSIONERS.

I WILL BE PRESENTING ON ITEM NUMBER ONE THE OMNI LA COSTA GOLF COURSE RENOVATION.

THIS IS AN APPLICATION FOR A SPECIAL USE PERMIT TO RENOVATE THE CHAMPIONS GOLF COURSE AT OMNI LA COSTA RESORT AND SPA.

THE PROJECT IS LOCATED ON SIX PARCELS SOUTH OF POINSETTIA LN, EAST OF EL CAMINO REAL AND NORTH OF LA COSTA AVE.

THE GOLF COURSE IS ACCESSED THROUGH THE LOBBY AT ASTREA DEL MAR ROAD.

THE PROJECT SITE IS CURRENTLY DEVELOPED WITH AN EXISTING COMMERCIAL GOLF COURSE.

TO THE NORTH OF THE PROJECT SITE IS ALGA NORTE PARK AND OPEN SPACE TO THE SOUTH AND EAST ARE SINGLE AND MULTIFAMILY RESIDENCES AND OPEN SPACE, AND TO THE WEST IS A MIXTURE OF RESIDENTIAL UNITS, OPEN SPACE AND THE REMAINDER OF THE RESORT AND SPA.

THE PROJECT CONSISTS OF A SPECIAL USE PERMIT TO RENOVATE THE EXISTING 18 HOLE CHAMPIONS GOLF COURSE, WHICH IS THE NORTH COURSE IN THE FLOODPLAIN AND ADOPTION OF A MITIGATED NEGATIVE DECLARATION MND AND MITIGATION MONITORING AND REPORTING PROGRAM MMRP.

THE APPLICANT PROPOSES TO RENOVATE AND REPLANT THE EXISTING CHAMPIONS COURSE, WHICH INCLUDES ADJUSTING TEE BOXES AND GREEN LAYOUTS TO INCREASE COURSE PLAY EXPANDING FAIRWAYS AND ADJUSTING ROUGH LOCATIONS TO CREATE A MORE CHALLENGING COURSE LAYOUT REALIGNING GOLF CART PATHS TO ALLOW FOR BETTER INTERNAL CIRCULATION AND ALLOW FOR MORE ROOM TO EXPAND THE COURSE.

REMOVING AND REPLACING BUNKERS TO EXPAND THE FAIRWAY AND CREATE A STRONGER ANGLE OF LINE OF PLAY AND ADDING THREE NEW GOLF CART AND FOOTBRIDGES ACROSS THE STREAM.

OVERALL, THE MODIFICATIONS WILL ALLOW FOR A MORE CHALLENGING COURSE, WHILE ALSO STILL OFFERING OPTIONS FOR NOVICE GOLFERS TO LEARN THE GAME.

THE PROJECT ALSO PROPOSES TO REMOVE TWO MANMADE PONDS TOTALING 2.94 ACRES AND REPLACE THEM WITH [INAUDIBLE] CONSISTING OF MOSTLY GRASSES AND SAND THAT UTILIZE DROUGHT TOLERANT ARID PLANTS.

THE PONDS ARE LOCATED AT THE NORTH CORNER OF THE COURSE SOUTH OF POINSETTIA LANE.

THE PROJECT DOES NOT INCLUDE THE CONSTRUCTION OF OR MODIFICATION TO HABITABLE STRUCTURES, AND NO WORK IS PROPOSED WITHIN THE EXISTING SAN MARCOS CREEK OR DRAINAGES WHICH BISECTS THE COURSE.

THE USE OF PESTICIDES WILL ALSO NOT INCREASE AS A RESULT OF THE PROJECT.

STAFF CONDUCTED AN ENVIRONMENTAL REVIEW, AN ENVIRONMENTAL IMPACT ASSESSMENT OF THE PROJECT, WHICH IDENTIFIED POTENTIALLY SIGNIFICANT IMPACTS TO BIOLOGICAL RESOURCES, CULTURAL RESOURCES AND CONSTRUCTION NOISE.

HOWEVER, CONSTRUCTION NOISE MINIMIZATION MEASURES, REVISIONS TO THE PROJECT PLANS AND MITIGATION MEASURES WOULD PROVIDE MITIGATION TO A POINT WHERE POTENTIAL IMPACTS ARE REDUCED TO A LESS THAN SIGNIFICANT LEVEL.

THE CITY PREPARED A NOTICE OF INTENT TO ADOPT AN INITIAL STUDY MND AND MMRP, WHICH WENT OUT FOR A 30 DAY PUBLIC REVIEW ON SEPTEMBER 23RD, 2022.

THE PROJECT COMPLIES WITH ALL APPLICABLE CODE STANDARDS AND POLICIES, INCLUDING THE HABITAT MANAGEMENT PLAN GROWTH MANAGEMENT PLAN.

LA COSTA RESORT AND SPA MASTER PLAN AND EL CAMINO REAL CORRIDOR STANDARDS.

THE PROJECT IS CONSISTENT WITH THE PLANNED COMMUNITY ZONE AND OPEN SPACE GENERAL PLAN DESIGNATOR.

THE PROJECT ALSO COMPLIES WITH THE FLOODPLAIN MANAGEMENT REGULATIONS OF THE CARLSBAD MUNICIPAL CODE.

THE GRADING ASSOCIATED WITH THE PROPOSED RENOVATIONS WILL ALTER THE GEOMETRY OF THE FLOODPLAIN.

HOWEVER, THE PROPOSED WORK WILL NOT AFFECT THE HYDRAULIC CAPACITY OF THE EXISTING CREEK AND SURROUNDING FLOODPLAIN AREAS.

IN ADDITION, THE BASE FLOOD ELEVATION WILL NOT BE IMPACTED.

STAFF RECOMMENDS THAT THE PLANNING COMMISSION TAKE THE FOLLOWING ACTIONS.

ADOPT A RESOLUTION ADOPTING A NEGATIVE DECLARATION AND MITIGATION MONITORING AND REPORTING PROGRAM, AND ADOPT A RESOLUTION APPROVING THE SPECIAL USE PERMIT. THIS CONCLUDES MY PRESENTATION AND I'M AVAILABLE TO ANSWER ANY QUESTIONS.

YES, THAT WAS THE AREA WAS ANALYZED ON THE OUTSIDE OF THE WITH THE PROJECT, AND IT WAS ANALYZED TO SEE IF THERE WAS ANY EFFECT ON THE PERIMETER FLOODPLAIN CHANGES AND IF THAT WOULD HAVE ANY EFFECT.

THERE WERE NO CHANGES TO THE FLOODPLAIN ITSELF.

IT DIDN'T HAVE ANY EFFECT UPSTREAM OR DOWNSTREAM OF THE AREA OF WORK.

SO AS FAR AS THE STAFF CAN DETERMINE, IT WILL NOT AFFECT HAVE ANY FLOOD HAZARD IMPACTS AT ALL? NO, IT WILL NOT CREATE ANY ADDITIONAL FLOOD HAZARD IMPACTS.

, AND SO THAT'S WHY WE'RE HERE THIS EVENING, BECAUSE WE'RE HERE TO DEAL WITH THE FACT THAT WE NEED AN APPROVAL OF A FLOODPLAIN SPECIAL USE PERMIT TO ALLOW THE REPLANTING AND THE RESTORATION OF THE EXISTING 18 HOLE GOLF COURSE, WHICH IS JUST THE CHAMPIONS SECTION.

SO IT'S JUST THE NORTHERN SECTION OF THE GOLF COURSE.

OMNI RESORT'S PLANNING TO REPLANT AND RENOVATE THE COURSE TO STATE OF THE ART GOLF PROFESSIONAL STANDARDS IN ORDER TO IMPROVE THE GOLF PLAY AND TO ACTUALLY REPLACE THE HIGH WATER USE LANDSCAPING WITH MORE NATURALIZED AND MORE WATER EFFICIENT PLANTINGS AND FEATURES.

THE COURSE WAS CONSTRUCTED BACK IN 1965, OVER 50 YEARS AGO.

SO IT HAD ONE RESTORATION IN 2003.

SO IT'S TIME FOR FOR ANOTHER RESTORATION, AND SO THE PRESENT EFFORT THAT WE'VE GOT BEFORE YOU TONIGHT, IT REALLY DOESN'T INVOLVE ANY HUGE CHANGES.

THE LIMITS OF THE COURSE, THE COURSE LAYOUT, THE SEQUENCE OF PLAY IS ALL GOING TO REMAIN BASICALLY THE SAME.

I KNOW YOU'RE AWARE THAT THE RESTORATION OF THIS COURSE IS ALL IN PREPARATION AND GETTING READY FOR THE NCAA CHAMPIONSHIPS, WHICH WERE AWARDED TO THIS COURSE FOR THREE YEARS STARTING IN 2024, AND SO THIS PROPOSED RESTORATION WORK IS A CRITICAL PART OF PREPARING THE COURSE FOR THAT POPULAR AND WIDELY TELEVISED TOURNAMENT EVENT.

SO THE PLANNING COMMISSION'S CHARGE PER CARLSBAD FLOODPLAIN REGULATIONS ARE TO DETERMINE WHETHER OR NOT THIS PROJECT WILL DECREASE THE ABILITY OF THE SITE TO HANDLE THE 100-YEAR FLOOD.

WITH OUR PROPOSED DESIGN, THE WATER COURSE IS NOT GOING TO BE ALTERED.

THE FLOOD CARRYING CAPACITY OF THE FLOODWAY WON'T CHANGE.

NO HABITABLE OR OTHER STRUCTURES ARE PROPOSED WITHIN THE FLOODPLAIN.

THE OVERALL ELEVATIONS WILL WILL NOT SUBSTANTIALLY CHANGE AND THE HYDRAULIC CAPACITY OF THE FLOODPLAIN AREA WILL NOT CHANGE.

SO WE AGREE WITH YOUR STAFF THAT THE FINDINGS FOR APPROVAL OF SPECIAL USE PERMIT CAN BE MADE.

WE'VE PROVIDED ALL THE REQUIRED NOTICES TO THE PUBLIC OF THIS SPECIAL USE PERMIT.

OVER 1000 NOTICES, TWO SEPARATE TIMES REQUESTING REQUESTING THE PUBLIC COMMENTS.

AS LAUREN MENTIONED, WE DIRECTED PEOPLE RECEIVING THE NOTICES TO A WEBSITE THAT WE CREATED.

THE WEBSITE HAD HAD SEVERAL PAGES OF INFORMATION ON EVERY HOLE AND WE RECEIVED A GOOD NUMBER OF COMMENTS AND QUESTIONS.

A NUMBER OF THE COMMENTS JUST SUPPORTED THE RESTORATION PROJECT.

A NUMBER OF THEM ACTUALLY, NONE OF THEM HAD ANY QUESTIONS ON FLOOD CONTROL, WHICH IS WHY WE'RE HERE, BUT MANY OF THE COMMENTS HAD TO DO WITH HOW'S A VIEW GOING TO CHANGE FROM MY PATIO? SO ANYWAY, I BELIEVE WE RESPONDED TO ALL OF THEM, INCLUDING SENDING THEM READABLE PLANS FOR THE GOLF COURSE HOLES OR FAIRWAYS BEHIND THEIR HOUSES.

IN OUR OPINION, ALL THE VIEWS TO THE COURSE ARE GOING TO IMPROVE BECAUSE IT'S GOING TO LOOK LIKE A BRAND NEW COURSE.

SO WE'RE NOT EXPANDING THE GOLF COURSE FOOTPRINT AT ALL.

WE AVOID THE TAKING OF ANY HABITAT.

WE AVOID IMPACTS TO JURISDICTIONAL WATERS.

THE PROJECT DOESN'T REQUIRE ANY PERMITS FROM THE RESOURCE AGENCIES, AND HYDRAULIC ANALYSIS CONCLUDES THAT THE PROPOSED PROJECT WILL RESULT IN NO SUBSTANTIVE CHANGE TO THE EXISTING DOCUMENTED WATER SURFACE ELEVATION UNDER THE 100-YEAR FLOOD SITUATION.

SO THE PROJECT DOESN'T RESULT IN ANY FLOODWAY IMPACTS.

I DO THINK I'D LIKE TO MENTION A FEW WORDS ABOUT THE GOLF COURSE ARCHITECT.

THE GOLF COURSE ARCHITECT IS GIL HANSE.

HIS FIRM HAS DESIGNED MANY OF THE PREEMINENT GOLF GOLF COURSES ACROSS THE GLOBE.

MANY OF GIL'S COURSES ARE RANKED IN THE TOP 100 IN THE WORLD.

HE'LL BE OUT THERE OVER THE NEXT SEVERAL MONTHS PUTTING ALL THE FINE TOUCHES ON THE GOLF COURSE DESIGN, THE PLAY DESIGN.

HE'S DESIGNED DOZENS OF COURSES IN COUNTRIES THROUGHOUT THE WORLD.

HE'S CHOSEN TO DESIGN THE COURSE OR HE WAS CHOSEN TO DESIGN THE COURSE FOR THE 2016 OLYMPICS IN RIO DE JANEIRO. I CAN'T NAME ALL THE COURSES HE'S DESIGNED.

THE COUNCIL DID ADOPT BY A SECOND READING BOTH THE CALIFORNIA BUILDING STANDARDS CODE UPDATE, SO THAT WILL BE EFFECTIVE JANUARY 1ST, AND THEN THE OTHER IS THE AMENDMENTS TO CHAPTER 2.42 AND TITLE 22 OF THE MUNICIPAL CODE TO ADDRESS HISTORIC PRESERVATION AND THE MOST PREDOMINANT FORM WAS THE MILLS ACT PROGRAM. SO PART OF THE OUTREACH WITH THE HISTORIC PRESERVATION COMMISSION, BOTH ON NOVEMBER 4TH AND THEN EXPECTED IN THEIR FIRST MEETING IN JANUARY IN THE NEXT YEAR, IS TO TALK ABOUT THE TARGETED OUTREACH TO PROMOTE AWARENESS OF THE PROGRAM BECAUSE IT IS A VOLUNTARY PROGRAM WHERE THE HOMEOWNER ELECTS AND DECIDES TO SUBMIT THE APPLICATION TO THE CITY. SO THE BIG EFFORT ON THE CITY'S END WILL BE TO REACH OUT TO THOSE ELIGIBLE PROPERTY OWNERS TO INFORM THEM ABOUT THAT OPPORTUNITY.

IT IS ANTICIPATED THAT THE OUTREACH WILL BE CONDUCTED BY THE END OF THE WINTER OR EARLY SPRING SO THAT ANY PRELIMINARY APPLICATIONS OR APPLICANTS CAN COME TO THE CITY TO LEARN MORE ABOUT THE PROCESS AND WHAT THE EXPECTATIONS ARE WITH THE GO LIVE DATE OF RECEIVING APPLICATIONS IN JUNE OR JULY, AND THAT WOULD ALLOW THE TIMELY PROCESS OF THAT APPLICATION TO BE CONSIDERED BY THE HISTORIC PRESERVATION COMMISSION FOR RECOMMENDATION TO CITY COUNCIL BY THE END OF THAT CALENDAR YEAR.

SO IT CAN GO ON THE NEXT ASSESSMENT ROLL WHERE THE PROPERTY OWNER RECEIVES A REDUCTION IN PROPERTY TAXES.

THE OTHER MATTER THAT THE HISTORIC PRESERVATION COMMISSION WILL BE ADDRESSING IN 2023 ARE OTHER INCENTIVES AND BENEFITS TO ENCOURAGE HISTORIC PRESERVATION OF PROPERTIES.

THEY MAY INCLUDE REGULATORY ITEMS THAT WOULD AMEND TITLE 21.

SO IN THE EVENT THAT THE HISTORIC PRESERVATION COMMISSION SUBMITS A RECOMMENDATION TO MAKE AN AMENDMENT TO A ZONING STANDARD OR PROVISION THAT WILL BE UNDER THE PURVIEW OF THIS COMMISSION. SO THE PLANNING COMMISSION WILL HAVE AN OPPORTUNITY TO WEIGH IN ON THOSE MEASURES.

SO THERE MIGHT BE SOME SYMBIOTIC RELATIONSHIP BETWEEN THEIR WORK AND THE COMMISSION'S PURVIEW HERE.

IT'S A GREAT PROGRAM.

IT'S BEEN A LONG TIME COMING.

OTHER QUESTION FOR YOU IN REGARD TO THAT, YOU WERE SAYING OUTREACH: HAS THE CITY ALREADY IDENTIFIED THE PROPERTIES THAT WOULD QUALIFY? AS TO IDENTIFYING THOSE PROPERTIES AND THOSE PROPERTIES WILL BE NOTIFIED SPECIFICALLY OR IS IT MORE OF A GENERAL TYPE OF NOTIFICATION? THE CITY HAS NOT CONDUCTED A SURVEY OF HISTORICAL PROPERTY SINCE 1991.

WOW. SO IT'S BEEN DATED IN TERMS OF QUALIFYING PROPERTIES ARE ELIGIBLE FOR HISTORIC DESIGNATION, BUT THAT EXISTS.

THAT LIST DID EXIST AND IT STILL IS SOMETHING THAT WE CAN REFER TO, AND THAT SAME LIST WAS UTILIZED DURING THE PROGRAM TO DEVELOP THE MILLS ACT PROGRAM ITSELF.

SO THOSE PROPERTY OWNERS HAVE ALREADY RECEIVED NOT ONCE BUT TWICE NOTIFICATION FROM THE CITY THAT WE WERE PROACTIVELY WORKING ON THAT TYPE OF PROGRAM.

SO PROSPECTIVELY, MOVING FORWARD, WE PROBABLY UTILIZE THAT SAME LIST THAT WAS CREATED IN 1991, AND OBVIOUSLY THERE'S BEEN IN THE INTERVENING YEARS, MORE PROPERTIES HAVE GAINED SOME HISTORICAL RELEVANCE OR CONTEXT.

SO AFTER THAT, IF THERE ARE OTHER PROPERTIES THAT CAN BE IDENTIFIED THROUGH THE HISTORIC PRESERVATION OR OTHER INTERESTED PARTIES, WE WOULD LOVE TO RECEIVE THAT INFORMATION, AND THE ALTERNATIVE CITY STAFF WOULD LIKELY DO A BROAD GENERAL OUTREACH TO NOTIFY EVERYONE IN THE CITY OR ANY STAKEHOLDER OF THE PROGRAM.

SO THE APPLICANT OR I SHOULD SAY THE PROPERTY OWNER WOULD PUT IN AN APPLICATION TO BE VIEWED AS TO IF THEIR PROPERTY IS QUALIFIED OR NOT.

DOES THE STATE OF CALIFORNIA GET INVOLVED WITH THAT WHATSOEVER, OR IS IT PURELY JUST A LOCAL REVIEW AND APPROVAL PROCESS? THERE IS A NATIONAL REGISTER, A STATE REGISTER, AND NOW THERE IS A LOCAL REGISTER.

SOMEONE MAY SUBMIT FOR A LOCAL REGISTER AND BE A MUTUALLY EXCLUSIVE PROCESS FROM THE STATE AND FEDERAL.

HOWEVER, THOSE PROPERTIES THAT ARE ELIGIBLE FOR THE LOCAL DESIGNATION ARE ALSO ELIGIBLE FOR THE STATE AND NATIONAL.

SO IT WOULD MAKE THE MOST SENSE FOR A PROPERTY OWNER TO PURSUE OTHER MULTIPLE DESIGNATIONS, BUT THEY DON'T NECESSARILY TO TAKE ADVANTAGE OF THAT MILLS ACT PROGRAM.

THEY JUST NEED TO BE ENROLLED IN THE LOCAL REGISTER.
