AND THE VERY NEXT DAY THE CITY ATTORNEY PRODUCES A DOCUMENT DECLARING THAT A VOTE BY THE 2022 COUNCIL WILL OVERRIDE THE 2023 COUNCIL.

AND THEN THE FOLLOWING DAY, DR.

BHAT-PATEL, WHO REPRESENTS MERELY ONE QUARTER OF CARLSBAD'S CITIZENS, GOES TO SANDAG AND SELLS OUT OUR VOTE TO THE CITY OF SAN DIEGO.

CITIZENS OF CARLSBAD, WE'VE BEEN SANDBAGGED.

CARLSBAD COUNCIL SHOULD CHANGE OUR ORDINANCE TO REFLECT THE DIRECTION OF THE 2023 COUNCIL AND CARLSBAD'S HISTORIC USE OF THE MAYOR. THE ONLY POSITION ELECTED BY MAJORITY OF CARLSBAD TO REPRESENT US AT SANDAG.

IT IS SHAMEFUL THAT HYPER PARTISAN VOTING BY MEMBERS ACOSTA AND PATEL TAKES AWAY THE AGENCY OF THE CARLSBAD CITIZENS.

WE LIVE IN A TIME OF OUT OF CONTROL HIGH INFLATION, OUTRAGEOUSLY HIGH GAS PRICES BECAUSE OF SELF-INFLICTED POLITICAL POLICIES, RENDERING US ONCE AGAIN ENERGY DEPENDENT.

OUR SANDAG REPRESENTATIVE SHOULD REPRESENT WE, THE PEOPLE OF ALL CARLSBAD, NOT THE HYPER PARTISAN CONTINGENT.

CARLSBAD NEEDS A SEAT AND A VOTE AT THE SANDAG TABLE, PARTICULARLY A NO VOTE ON THE MILEAGE TAX.

AND I STARTED GETTING CITY MANAGER UPDATES WHEN I WENT TO HIS CITIZEN'S ACADEMY.

AND I APPRECIATE THE REALLY GOOD.

BUT THE ONE THAT I GOT JANUARY 12TH WAS CITING SEVERAL OF THE BENEFITS OF THE SAFER STREETS APPROACH.

THAT SOUNDED A BIT LIKE A LIFE COACH LECTURE, WHICH SHOULDN'T BE THE ROLE OF CITY GOVERNMENT.

THEY SAID THAT SAFE DRIVING AND WALKING PATHS AND BIKES, BIKE LANES ENCOURAGE MORE PHYSICAL ACTIVITY AND WHEN YOU WALK AND BIKE, YOU CONNECT WITH YOUR NEIGHBORS AND ALL THAT.

AND IT'S PUTTING LIPSTICK ON, MAKING IT HARDER TO DRIVE TO WORK.

IN SOME CASES, THERE HAVE BEEN SOLUTIONS IMPLEMENTED WHERE THERE AREN'T ANY PROBLEMS. I WRITE ELECTRIC SCOOTER ON SUNDAY THROUGH DISTRICT ONE AND THROUGH THE VILLAGE AND ALONG THE BEACH AND THE LAGOON, AND PEOPLE ARE OUT WALKING, RIDING BIKES WHEN THEY CAN'T ALREADY AND DON'T NEED ENCOURAGEMENT TO USE ALTERNATIVES FOR A HEALTHIER LIFESTYLE.

AND PERSONALLY, I HAVE TO DRIVE TO WORK AND I'M NOT.

I CAN'T WALK FROM TAMARACK TO PALOMAR AIRPORT AND I HAVE TO RUN ERRANDS TO PICK UP THINGS FROM THE HARDWARE AND STUFF FOR PROJECTS THAT I WORK ON IN THE LIFE SCIENCE INDUSTRY.

AND I'M NOT GOING TO CARRY A NINE FOOT SURFBOARD FROM HILLSIDE ALL THE WAY OVER TO THE BEACH.

I'VE ASKED THE CITY MANAGER TO PLEASE EXPLAIN THAT.

AT THE LAST CITY COUNCIL MEETING, CITY COUNCIL DID NOT CHOOSE NEW REPRESENTATIVES FOR THE SANDAG BOARD OF DIRECTORS.

THE CITY COUNCIL WILL HAVE AN OPPORTUNITY TO REVISIT THOSE APPOINTMENTS ONCE THE DISTRICT TWO VACANCY IS FILLED.

CONCERNS WERE RAISED DURING THE LAST MEETING THAT CARLSBAD WOULD NOT HAVE A SANDAG REPRESENTATIVE IN THE INTERIM.

UPON FURTHER REVIEW OF THE RESOLUTION APPROVING SANDAG APPOINTEES IN JANUARY OF 22, THE RESOLUTION PROVIDES FOR THE REPRESENTATIVES APPOINTED IN JANUARY 22 TO CONTINUE IN THEIR ROLES UNTIL NEW REPRESENTATIVES ARE CHOSEN.

THAT LANGUAGE IS EXPRESSLY STATED WITHIN THE RESOLUTION.

SO ALTHOUGH FORMER MAYOR MATT HALL WAS ASSIGNED AS THE PRIMARY MEMBER IN JANUARY OF 22, BUT BECAUSE HE IS NO LONGER SERVING IN AN ELECTED CAPACITY, HE'S INELIGIBLE TO CONTINUE IN THAT ROLE.

HOWEVER, MAYOR PRO TEM PRIYA BHAT-PATEL WILL CONTINUE IN THE FIRST ALTERNATE AND MAYOR KEITH BLACKBURN WILL CONTINUE IN THE SECOND ALTERNATE.

THAT'S THE WAY IT WAS LISTED AND THAT 2022 AND I REALIZED THAT IT WAS CONFUSING, I THINK, FOR A LOT OF FOLKS THAT ENDED UP ATTENDING THAT MEETING AS WELL AS IT WAS A LITTLE CONFUSING FOR US AS WELL.

IF THE ORDINANCES ARE APPROVED, ELECTED OFFICIALS COULD RECEIVE UP TO A 6.7% INCREASE IF THE ORDINANCES ARE WAIVED.

ELECTED OFFICIALS WILL NOT RECEIVE AN INCREASE IN 2023.

THE MAXIMUM FISCAL IMPACT FOR CITY COUNCIL INCREASES IS APPROXIMATELY $11,600, BASED OFF THAT 6.6% OR THE 6.7% INCREASE. AND THE MAXIMUM FISCAL IMPACT FOR AN INCREASE IN CITY CLERK OR CITY TREASURER, COMPENSATION IS APPROXIMATELY 2000.

AND MAKING OUR PRESENTATION TODAY IS OUR TRANSPORTATION DIRECTOR, TOM FRANK.

MAYOR. MAYOR, PRO TEM AND CITY COUNCIL MEMBERS.

IT'S MY PLEASURE TO BE PRESENTING OUR SEMIANNUAL TRANSPORTATION REPORT THIS EVENING.

WE ALSO HAVE OUR TRAFFIC MOBILITY COMMISSIONER, MR. BILL FOWLER, WITH US, WHO WILL BE PROVIDING THE COMMISSIONER COMMENTS FOLLOWING MY REPORT.

TODAY'S RECOMMENDATION OR RECOMMENDED ACTION IS TO RECEIVE THE REPORT.

AND FIRST OFF, OUR TEAM HAS THE PLEASURE TO IMPLEMENT WHAT THE CITY HAS INCLUDED IN THE GENERAL PLAN MOBILITY ELEMENT, WHICH IS SIMPLY TO MOVE SAFELY AND EFFICIENTLY THROUGHOUT OUR CITY IN OR ON WHATEVER YOUR CHOICE OF TRAVEL.

IT ALSO SUPPORTS OUR CLIMATE ACTION PLAN, HELPING PEOPLE GET OUT OF THEIR CARS TO REDUCE GREENHOUSE GASES.

AND WHEN PEOPLE DO TRAVEL BY CAR, MAKING IT EFFICIENT TO GET FROM ONE PLACE TO ANOTHER.

WE'RE DOING THAT THROUGH OUR TRAFFIC SAFETY EMERGENCY.

AND EVEN BEFORE THAT, WE WERE WORKING ON A ROBUST CAPITAL IMPROVEMENT PROGRAM.

AND TONIGHT, I'D LIKE TO HIGHLIGHT JUST A COUPLE OF THOSE PROJECTS.

OUR PUBLIC WORKS TEAM IS ONE OF THE E'S IN THE TRAFFIC SAFETY EMERGENCY.

THIS ITEM YOU'LL HEAR TONIGHT AND YOUR NEXT ITEM ON YOUR AGENDA AND THE SAFER STREETS EFFORTS.

SO YOU'LL HEAR THOSE SPECIFIC ENGINEERING UPDATES THEN.

I'D LIKE TO TOUCH ON A FEW OF THE LEGACY PROJECTS THAT OUR TEAM HAS MADE GREAT PROGRESS ON AS OF LATE.

THE FIRST BEING CARLSBAD BOULEVARD AND TAMARACK AVENUE IMPROVEMENTS.

THE SECOND TERM ARE COASTAL IMPROVEMENTS.

THE THIRD IS SOUTH CARLSBAD CLIMATE ADAPTATION PROJECT.

AND FINALLY, KELLY DRIVE AND PARK DRIVE COMPLETE STREETS IMPROVEMENT PROJECT.

ESPECIALLY ALONG OUR COASTLINE.

OUR GENERAL PLAN OUTLINES HOW WE'RE TRANSFORMING CARLSBAD BOULEVARD FROM THE OLD HIGHWAY 101, THE OLD PCH TO A SLOWER DOWN VERSION OF A LOCAL ROADWAY WHERE YOU CAN ENJOY THE COASTLINE AND MAKE IT MORE INVITING FOR WALKERS AND CYCLISTS.

WE'VE ALSO BEEN DESIGNING IMPROVEMENTS TO CARLSBAD BOULEVARD AT TAMARACK AVENUE, WHICH WIDENS SIDEWALKS, ESPECIALLY OVER THE NARROW BRIDGE.

IMPROVE CROSSINGS AT THE INTERSECTION AND LASTLY, RELOCATE THAT BUS STOP THAT'S LITERALLY RIGHT IN THE MIDDLE OF THAT INTERSECTION.

WE'VE COMPLETED CONCEPTUAL PLANS.

THE NEXT ITEM OR THE NEXT ITEM ON THIS PROJECT WILL BE TO PRESENT TO OUR TRAFFIC MOBILITY COMMISSION ON MARCH 6TH AND THEN PRESENT THE CONCEPTUAL PLANS IN THE STUDY TO THE CITY COUNCIL.

TO THE SOUTH OF TAMARACK IS THE TERRAMAR COASTAL IMPROVEMENT PROJECT.

WE HAVE COMPLETED 60% ENGINEERING DESIGNS AND BLUFF TOP IMPROVEMENTS.

THE CITY COUNCIL IN THIS PROJECT APPROVED A ROUNDABOUT AT CANNON ROAD AND CARLSBAD BOULEVARD.

AND THE NEXT STEPS INCLUDE THE ENVIRONMENTAL PERMITTING, THE CEQA PROCESS THIS SPRING, AND THEN BRINGING IT TO THE PLANNING COMMISSION LATER THIS YEAR.

AND AS THE SOUTH CLIMATE ADAPTATION STUDY WILL ALSO COME BEFORE YOU AGAIN AS WE LOOK TO PROTECT OUR COASTLINE FROM HAZARDS WHILE MAKING IT MORE INVITING FOR ALL MODES OF TRANSPORTATION.

THIS PICTURE IS FROM EARLIER THIS MONTH, JUST ACTUALLY A FEW WEEKS AGO WHEN WE HAD THE BACK TO BACK STORMS OTHER THAN ON A STORMY DAYS AND LIKE ON ANY OTHER SUNNY DAY, YOU'RE GOING TO FIND LITERALLY THOUSANDS OF PEOPLE OUT ENJOYING THE COASTLINE.

THE LAST PROJECT I WANTED TO HIGHLIGHT IS THE KELLY DRIVE AND PARK DRIVE COMPLETE STREETS PROJECT.

WE DID ANOTHER ROUND OF PUBLIC INPUT LAST YEAR AND PRESENTED OUR RECOMMENDATIONS TO THE TRAFFIC MOBILITY COMMISSION.

THE COMMISSION SUPPORTED BUFFERED BIKE LANES AND A ROUNDABOUT AT THE INTERSECTION OF KELLY DRIVE AND HILLSIDE DRIVE.

THE NEXT STEP IS AGAIN THE ENVIRONMENTAL PERMITTING, THE CEQA PROCESS AND THE FINAL DESIGN.

AND WE'RE TARGETING A PLANNING COMMISSION DATE LATER THIS YEAR.

SO OVER THE LAST SIX MONTHS, HERE'S A SNAPSHOT OF SOME OF OUR ONGOING WORK WITHIN OUR DEPARTMENT.

AND IN THE INTEREST OF TIME, I'M NOT GOING TO COVER IT ALL.

BUT IF YOU LOOK AT THAT NUMBER IN THE LOWER RIGHT, THAT 470,000 LINEAR FEET OF NEW STRIPING, THAT'S THE EQUIVALENT OF 90 MILES OF NEW STRIPING. SO I JUST I LIKE TO SAY THAT BECAUSE WE HAVE A NEW STRIPER TRUCK AND WE'RE REALLY GETTING A LOT OF USE OUT OF IT.

SO THAT'S AN INTERESTING TOPIC, AT LEAST TO ME.

AND SO HERE ARE SOME OTHER PICTURES THAT REPRESENT THE TYPE OF WORK BEING DONE WITHIN OUR DEPARTMENT AND FOR THE CITY.

STARTING IN THE UPPER RIGHT, THIS IS THE RECENTLY COMPLETED SEALING AND RESTRIPING PROJECT ON CANNON ROAD WITH THE WIDENED BUFFERED BIKE LANES.

MOVING CLOCKWISE TO THE LOWER RIGHT IS A PICTURE OF THE COMMUNITY MEETING REGARDING TRAFFIC COMING ON CYLINDER DRIVE.

AND THEN THE LOWER LEFT PICTURE IS FROM OUR LAST ACCESS RAMP PROJECT, BRINGING THE EXISTING CITY CURB RAMPS UP TO THE CURRENT STANDARDS.

AND ALSO EXCUSE ME, AND THE UPPER LEFT.

I CAN'T FORGET THIS IS OUR AMAZING STREET MAINTENANCE TEAM, WHICH IS CLEANING UP MARIN ROAD FOLLOWING AN EROSION ISSUE, UNFORTUNATELY, ON THE ADJACENT PRIVATE PROPERTY.

SO THOSE GUYS ARE ALWAYS OUT THERE.

THEY WERE VERY ACTIVE DURING OUR BACK TO BACK STORMS, KEEPING OUR ROADS SAFE.

SO REALLY APPRECIATE THAT CREW.

WHILE WE'RE ALSO WORKING TO MAKE IT MORE EFFICIENT TO GET FROM ONE PART OF THE TOWN TO ANOTHER, ESPECIALLY FOR COMMUTERS DURING THE MORNING AND EVENING COMMUTES.

WE'VE COORDINATED OUR TRAFFIC SIGNALS TO MOVE GROUPS OF CARS, TECHNICALLY CALLED PLATOONS TOGETHER THROUGH THE CORRIDORS.

AND THE CORRIDORS ARE SHOWN ON THIS GRAPHIC THAT ARE CURRENTLY TIMED AND COORDINATED, AND THEY'RE SHOWN IN THE RUST COLOR.

SO IT'S QUITE A FEW OF THE MAJOR PRIME ARTERIALS AND AND SOME OTHERS AS WELL WITHIN THE COAST VILLAGE AREA.

THIS IS ALSO AN ONGOING COLLABORATION WITH OTHER AGENCIES LIKE CALTRANS TO CONTROL THE SIGNALS NEAR THE INTERCHANGES AND INTERNALLY WITH OUR IT

I DID WANT TO MENTION IT'S ALWAYS STAFF'S PLEASURE TO BE WORKING ON THE CITY'S MOBILITY GOALS IN UNISON WITH THE TRAFFIC MOBILITY COMMISSION.

WE PRESENTED THIS SIMILAR REPORT TO THE TRAFFIC MOBILITY COMMISSION ON JANUARY 3RD, AND NOW I WOULD LIKE TO TURN OVER THE PRESENTATION TO COMMISSIONER BILL FOWLER FOR HIS COMMENTS.

MR. MAYOR, COUNCIL MEMBERS, I THINK I'M GOING TO HAVE TO STRUGGLE TO BE AS SHORT AS TOM OVER THERE, SO BUT I'LL TRY.

SO FIRST OF ALL, I WANTED TO RELATE TO YOU THE MISSION STATEMENT THAT'S ON OUR WORK PLAN THAT WE GO BY ON OUR BUSINESS.

IT SAYS, THE TRAFFIC AND MOBILITY COMMISSION IS COMMITTED TO ENHANCING SAFE MOBILITY FOR THE CITY AND ITS RESIDENTS BY USING DATA DRIVEN DECISION MAKING AND A FORWARD LOOKING APPROACH TO TRANSPORTATION.

WE ARE TRANSPARENT AND DO THE RIGHT THING THE RIGHT WAY.

SO IN OUR WORK PLAN, WHICH IS RENEWED EVERY YEAR, WE HAVE GOALS AND OBJECTIVES AND THE KIND OF OBJECTIVES WE HAVE.

I'LL GIVE YOU A COUPLE OF EXAMPLES.

PROVIDE OPPORTUNITIES FOR PUBLIC INPUT ON SCHEDULED CITY PROJECTS THAT HAVE THE POTENTIAL TO IMPROVE MOBILITY OPTIONS, REVIEW AND PROVIDE INPUT ON SIGNIFICANT MOBILITY AND SAFETY PROJECTS NEAR SCHOOLS.

REVIEW AND PROVIDE INPUT ON CARLSBAD RESIDENTIAL TRAFFIC MANAGEMENT PROGRAM PROJECTS AND PROPOSE TRAFFIC CONTROL DEVICES SUCH AS PARKING RESTRICTIONS, SPEED LIMITS, STOP SIGNS, ROUNDABOUTS AND TRAFFIC SIGNAL EVALUATIONS.

CRITICAL TO OUR WORK IS TO PROVIDE AS TO LISTEN TO CITIZENS AND COMMUNITIES WITHIN CARLSBAD WHO PROVIDE INFORMATION TO THE CITY ON TRAFFIC CONCERNS OF WHICH THERE ARE MANY.

THIS PROVIDES MUCH DATA, AS MUCH DATA IN OUR DATA DRIVEN APPROACH AS THE NUMERICAL DATA WE OFTEN RECEIVED FROM STAFF. WE HAVE HAD MORE INDIVIDUALS AND COMMUNITY GROUPS ATTEND OUR MEETINGS IN THE LAST SIX MONTHS THAN I HAVE RECALL HAVING IN THE LAST THREE YEARS AS A TRAFFIC COMMISSIONER.

WE HAVE CAREFULLY LISTENED TO THOSE VOICES AND THEY HAVE PROVIDED DATA FOR OUR DATA DRIVEN RECOMMENDATIONS TO STAFF AND THE CITY COUNCIL.

A NUMBER OF COMPELLING THINGS DRIVE OUR WORK AND IN THE LAST YEAR INCLUDE THE DRAMATIC RISE IN E-BIKES USE AND SOME TRAGIC TRAFFIC ACCIDENTS THAT WE'RE ALL AWARE OF.

AND THIS, OF COURSE, CULMINATED IN THE DECLARATION OF EMERGENCY BY THE COUNCIL.

THESE EVENTS PROVIDE A RENEWED FOCUS ON OUR EFFORTS TO IMPROVE MOBILITY SAFETY IN CARLSBAD.

I'M PROUD OF THE WAY THAT THE TRAFFIC AND MOBILITY SAFETY COMMISSION HAS WORKED AS A TEAM WITH CITY STAFF IN CARRYING OUT OUR WORK.

WE DON'T ALWAYS AGREE AMONGST OURSELVES OR WITH STAFF, BUT WE ALWAYS FIND A WAY TO ACHIEVE CONSENSUS, AS SHOULD BE EXPECTED OF US.

AND RECOMMENDATIONS WE MAKE ARE FULLY VETTED AND ALWAYS STRONGLY CONSIDER COMMUNITY INPUTS.

I THINK WE'VE DONE WELL IN OUR WORK.

TONIGHT, WE'RE HERE TO REPORT OUT ON THE CITY'S ACTIONS IN RESPONSE TO THE LOCAL TRAFFIC EMERGENCY, INCLUDING SOME NEW DATA AND THE LAUNCH OF THE NEXT PHASE OF OUR PUBLIC EDUCATION CAMPAIGN.

WE'RE ALSO RETURNING TO THE CITY COUNCIL WITH INFORMATION YOU REQUESTED ON OPTIONS FOR FUNDING, ADDITIONAL ACTIONS THAT HAVE BEEN RECOMMENDED BY THE PLANNING AND TRAFFIC MOBILITY COMMISSIONS.

FINALLY, WE'RE ASKING THE CITY COUNCIL TO CONSIDER RATIFYING ONE CONTRACT THAT WAS EXECUTED UNDER THE CITY MANAGER'S AUTHORITY AS DIRECTOR OF EMERGENCY SERVICES AND TO CONSIDER WHETHER YOU WISH TO EXTEND THE EMERGENCY PROCLAMATION UP TO AN ADDITIONAL 60 DAYS.

TO START, I'D LIKE TO UPDATE THE CITY COUNCIL ON THE CITY ACTIONS TO DATE IN RESPONSE TO THE EMERGENCY.

AS A REMINDER, THE CITY IS TAKING A THREE PRONGED APPROACH TO TRAFFIC SAFETY, WHICH WE CALL THE THREE E'S EDUCATION, ENGINEERING AND ENFORCEMENT.

LIKEWISE, WE'RE FOCUSING ON ALL MODES OF TRANSPORTATION BECAUSE SAFER STREETS REQUIRE THE COOPERATION OF EVERYONE WHO USES OUR ROADS.

THE CITY'S SAFER STREETS TOGETHER PLAN, WHICH WAS PRESENTED TO THE CITY COUNCIL ABOUT 30 DAYS FOLLOWING THE EMERGENCY PROCLAMATION, OUTLINES A COMPREHENSIVE SET OF ACTIONS THAT WILL REDUCE THE NUMBER OF COLLISIONS ON LOCAL ROADS.

THIS INCLUDES POLICIES, PROJECTS AND OTHER ACTIONS THAT HAD ALREADY BEEN AUTHORIZED BY THE CITY COUNCIL AND ARE UNDERWAY.

14 NEW INITIATIVES YOU APPROVED.

WHEN WE PRESENTED THE PLAN ON SEPTEMBER 27, 2022, AND A LIST OF ADDITIONAL ACTIONS TO BE CONSIDERED IN THE FUTURE.

ON THE PUBLIC EDUCATION FRONT, THE CITY CONTINUES TO USE ALL THE CHANNELS AVAILABLE TO KEEP TRAFFIC SAFETY TOP OF MIND FROM LOCAL MEDIA, SOCIAL MEDIA PARTNERING WITH LOCAL SCHOOLS, MOBILITY ORGANIZATIONS AND THE BUSINESS COMMUNITY.

HERE. YOU CAN SEE SOME OF THE VIDEOS THE CITY HAS CREATED TO HELP EDUCATE THE COMMUNITY ABOUT ROAD SAFETY.

WE'RE USING A VARIETY OF FORMATS AND ENGAGING MANY DIFFERENT SPOKESPEOPLE TO TELL THE STORY OF SAFETY.

FOR EXAMPLE, A REPRESENTATIVE OF SCRIPPS HEALTH EXCUSE ME SCRIPPS HOSPITAL IS THERE IN THE UPPER LEFT OF THE SCREEN TALKING ABOUT HOW TO FIT A HELMET.

THEN WE HAVE A LOCAL BUSINESS PED-A-GO, EMPHASIS ON THE HEAD IN THE LOWER RIGHT, WHO HOSTED ONE OF OUR POLICE OFFICERS TO GIVE AN E-BIKE SAFETY TIPS OVER THE HOLIDAYS.

AND LOCAL RESIDENTS ON THE LOWER LEFT TALKING ABOUT HOW THEY WORKED WITH THE CITY TO SLOW TRAFFIC IN THEIR NEIGHBORHOOD.

AND FINALLY, YOU CAN SEE AN ANIMATED VIDEO ADDRESSING ONE OF THE MOST COMMON CAUSES OF BIKE COLLISIONS WITH CARS.

AS YOU CAN SEE, WE ARE ACHIEVING SIGNIFICANT REACH WITH THE CITY'S TRAFFIC SAFETY MESSAGES.

CITY STAFF ALSO CONTINUE TO MAKE PROGRESS ON PROJECTS DESIGNED TO SLOW DOWN TRAFFIC AND MAKE MORE ROOM FOR WALKERS AND BICYCLISTS.

YOU HEARD ABOUT SOME OF THESE PROJECTS IN THE PREVIOUS PRESENTATION.

WE'RE ALSO MEETING WITH RESIDENTS TO ADDRESS CONCERNS IN SPECIFIC NEIGHBORHOODS.

ONE OF THE MOST SPECIFIC ONE OF THE MOST SIGNIFICANT ACCOMPLISHMENTS IS THE RESTRIPING OF OVER 200 ROAD SEGMENTS USING PAINT TO SLOW TRAFFIC AND MAKE MORE ROOM FOR BICYCLISTS.

FINALLY, ON THE ENFORCEMENT FRONT, OUR POLICE DEPARTMENT HAS BEEN WORKING WITH ALL FOUR SCHOOL DISTRICTS THAT SERVE CARLSBAD TO EXPLORE WAYS TO EDUCATE YOUR E-BIKE RIDERS ON THE RULES OF THE ROAD BY OFFERING SAFETY CLASSES IN EXCHANGE FOR A PERMIT TO PARK A BIKE ON CAMPUS.

THIS ADDRESSES THE NUMBER ONE CONCERN WE HAVE HEARD FROM RESIDENTS, WHICH IS THAT YOUNG E-BIKE RIDERS WHO DON'T DRIVE YET HAVE NOT HAD MUCH EDUCATION ON THE RULES OF THE ROAD YET. A LICENSE IS NOT REQUIRED TO RIDE AN E-BIKE.

WE'RE HOPEFUL THIS PROGRAM CAN BECOME A MODEL FOR OTHER CITIES AND HELP BRIDGE THE GAP UNTIL STATE LAW CATCHES UP WITH NEW TECHNOLOGY SUCH AS E-BIKES.

I SHOULD MENTION THIS IS IN ADDITION TO WORK THAT OUR STATE LOBBYISTS ARE WORKING ON TO EXPLORE OTHER OPTIONS FOR ADDITIONAL RULES FOR E-BIKES AT THE STATE LEVEL.

NOW HERE YOU CAN SEE SINCE THE START OF THE EMERGENCY, CARLSBAD POLICE HAVE TAKEN NEARLY 4000 ENFORCEMENT ACTIONS RELATED TO TRAFFIC SAFETY, INCLUDING 147 DUI ARRESTS. I ALSO WANT TO CALL ATTENTION TO THE FACT THAT A LITTLE UNDER HALF OF THE TOTAL ENFORCEMENT ACTIONS HAVE BEEN WRITTEN, WARNINGS WHICH DEMONSTRATES THAT OUR POLICE DEPARTMENT IS ALSO SERVING IN A VERY IMPORTANT PUBLIC EDUCATION ROLE.

FINALLY, BECAUSE OF THE CITY COUNCIL'S LEADERSHIP IN PASSING, THE REGION'S FIRST LAW SPECIFIC TO E-BIKES, WERE ABLE TO OFFER THE OPTION OF TAKING A SAFETY COURSE INSTEAD OF PAYING AN E-BIKE CITATION.

FINE ON THE FIRST OFFENSE.

TO DATE, 90 PEOPLE HAVE TAKEN ADVANTAGE OF THIS OPTION.

SO WITH THAT QUICK OVERVIEW OF ACTIONS COMPLETED TO DATE, I WOULD LIKE TO NOW INTRODUCE CHIEF INNOVATION OFFICER DAVID GRAHAM, WHO PROVIDE A DEEPER DIVE INTO THE DATA AND WHAT THE RESULTS OF OUR EFFORTS HAVE BEEN SO FAR.

SO AS WE LOOK AT THE DATA INFORMED ACTIONS AND WHAT WE'VE DONE TO DATE, WE REALLY HAVE BEEN CONSIDERING QUITE A FEW DIFFERENT TYPES OF DATA ASSOCIATED WITH THIS, WHETHER IT'S COMMUNITY ENGAGEMENT, AS YOU SAW, ENFORCEMENT, DATA MAPPING, ALL OF THIS IS DRIVING OUR DECISION MAKING ASSOCIATED WITH WHERE TO MAKE THE MOST TARGETED ACTIONS FOR THE MOST EFFICIENT RESULTS.

SO EARLY ON, YOU'LL BE FAMILIAR WITH THIS.

AND YOU ALSO SAW THE NEAR TERM INTERVENTIONS LIKE DIGITAL MESSAGE BOARDS, SPEED FEEDBACK SIGNS AND TRAFFIC SAFETY BANNERS THAT ARE THROUGHOUT THE ENTIRE CITY SHOWING A FULL APPROACH TO TRY TO ADDRESS THOSE ISSUES.

IN ADDITION, THOUGH, WE ALSO HAVE LOOKED AT TAKING THAT EXACT SAME HEAT MAP AND LOOKING AT THE LONG TERM TYPES OF INTERVENTIONS AS WELL.

SO WHETHER IT WAS THE PLANNED RESURFACING TRAFFIC CIRCLES, THE FUNDED IMPROVEMENTS, HIGH VISIBILITY, GREEN PAINT, THESE ARE ALL THINGS THAT WE HAVE CONSISTENTLY BEEN UPDATING CITY COUNCIL AT DURING THESE BRIEFINGS AND USING THOSE INTERVENTIONS TO DRIVE OUR FURTHER DECISIONS.

NOW WE DID AN ADDITIONAL ANALYSIS THAT LOOKED AT ALL OF THE INJURY COLLISIONS, LOCATIONS SINCE THE BEGINNING OF THE DECLARATION OF THE EMERGENCY IN AUGUST AND HOW THAT MATCHED UP WITH COMPLETED ACTIONS.

FIRST, YOU CAN SEE THE COMPLETED ACTIONS FOR HIGH VISIBILITY, GREEN PAINT IN AREAS THAT WERE SOME OF THE HIGHEST FOR INJURY COLLISIONS OVER THE LAST FIVE YEARS AND PLACES WHERE ADDITIONAL COLLISIONS WERE OCCURRING.

YOU CAN ALSO SEE THE RESURFACING AND RESTRIPING LOCATIONS THROUGHOUT THE CITY, AGAIN, FOCUSED IN PLACES WHERE TRADITIONALLY OVER THE LAST FIVE YEARS THERE WERE A SERIES OF COLLISIONS, BUT ALSO THOSE NEW POINTS SINCE THE BEGINNING OF THE EMERGENCY SIGNAL TIMING, WHICH WAS ALSO MENTIONED FROM A CITYWIDE PERSPECTIVE IN THE PREVIOUS REPORT, HAS ALSO BEEN USED NOT JUST TO DEAL WITH THROUGHPUT, BUT MAKING SURE THAT REGARDLESS OF THE MODE OF TRAVEL, WHETHER IT'S BIKE, PEDESTRIANS OR VEHICLES THAT WERE MAXIMIZING THE OPPORTUNITIES FOR SAFETY OF ALL MODES OF TRANSPORTATION AT KEY INTERSECTIONS.

AND THEN ADDITIONALLY, TRAFFIC CALMING STUDIES HAVE BEEN UNDERTAKEN IN FIVE ADDITIONAL LOCATIONS.

THESE ARE JUST SOME OF THE THINGS THAT HAVE BEEN OCCURRING TO DATE THAT WILL HAVE A LONG TERM IMPACT ON CREATING SAFER STREETS.

THEN FINALLY, WE KNOW HOW IMPORTANT THE SCHOOL ZONES HAVE BEEN AND THE RESTRIPING AND REPAINTING, IMPROVING THINGS LIKE OUR HIGH VISIBILITY CROSSWALKS AND ALSO BIKE LANES IN THESE AREAS. YOU CAN SEE THAT THROUGHOUT THE ENTIRE CITY THERE'S BEEN A CONCERTED EFFORT TO RESTRIPING AND REPAINT IN THOSE SCHOOL ZONES.

NOW, WHEN LOOKING AT WHAT THE RESULTS OF THIS MAY BE, YOU'LL REMEMBER THAT AT THE LAST PRESENTATION I PROVIDED SOME ANALYSIS REGARDING ALL MODES OF TRANSPORTATION AS IT RELATED TO INJURY COLLISIONS OVER THE LAST FIVE YEARS.

AND WHILE IN 2017, 2018 AND 2019 THERE WERE SIMILAR TRENDS KIND OF STAYING IN THAT BETWEEN 65 AND MAYBE UPWARDS OF 95 COLLISIONS. WE SAW SOME CHANGES AS WE BEGAN TO MOVE INTO THE LATER YEARS.

FOR EXAMPLE, YOU CAN SEE IN 2020 A SIGNIFICANT DIP IN THE NUMBER OF COLLISIONS, INJURY COLLISIONS DURING THAT ONSET OF COVID WHEN THERE WAS SIGNIFICANT LOCKDOWNS.

BUT TOWARDS THE END OF THE YEAR, YOU SAW THAT ONCE AGAIN WE'RE BACK IN ABOUT THE SAME NUMBERS.

NOW, WHAT WAS REALLY CONCERNING WAS IN 2021 WHEN WE DIDN'T SEE THAT SORT OF LULL IN THE MIDDLE AND WE BASICALLY SAW AN UPWARDS TREND HITTING THE HIGHEST NUMBER OF INJURY COLLISIONS IN THAT FOURTH QUARTER BETWEEN OCTOBER AND DECEMBER.

YOU CAN SEE FOR THOSE PREVIOUS YEARS THAT THERE WAS CONSISTENTLY A TREND IN THOSE WINTER MONTHS IN THAT FOURTH QUARTER BETWEEN OCTOBER AND DECEMBER.

BUT HERE IT CONSISTS IT MOVED AT A MUCH MORE CONCERNING CLIP THAN PREVIOUSLY.

AND THAT'S WHERE, AS WE LOOKED AT THE TREND FOR 2022 AND WHEN THE DECLARATION OF EMERGENCY OCCURRED, NOT ONLY DID WE START AT A VERY HIGH NUMBER, ROUGHLY ABOUT 95

COLLISIONS IN THE BEGINNING OF THE YEAR AT JANUARY TO MARCH, BUT BY JULY AND SEPTEMBER, WE HAD HIT THE HIGHEST NUMBER OF INJURY COLLISIONS OF THE QUARTER FOR ALL MODES OF TRANSPORTATION. NOW IF IT WERE TO HAVE FOLLOWED THE EXACT SAME PATHWAY, SO A 20% INCREASE BETWEEN THAT THIRD AND FOURTH QUARTER THAT HAD HAPPENED IN 2021, WE WOULD HAVE HAD THE HIGHEST NUMBER OF COLLISIONS THAT WE HAVE SEEN IN CARLSBAD IN A VERY, VERY LONG TIME, PUSHING UPWARDS OF 130 INJURY COLLISIONS.

BUT WHAT ENDED UP HAPPENING? WELL, THE DECLARATION OF EMERGENCY OCCURRED IN AUGUST TIME FRAME RIGHT IN THAT THIRD QUARTER.

AND WE, IN FACT, SAW THE OPPOSITE TREND.

WE ENDED UP SEEING A 20% DECREASE FROM THE PREVIOUS QUARTER, WHICH WAS VERY GOOD NEWS INDEED.

EVEN MORE IMPORTANTLY, THOUGH, IF YOU TAKE A LOOK AT THAT 2022 TREND, THAT IS ROUGHLY A 40% DECREASE FROM WHAT COULD HAVE BEEN OCCURRING OR WHAT WAS EXPECTED TO OCCUR.

SO NOT ONLY DID WE SEE SINCE THE BEGINNING OF THE EMERGENCY A REVERSAL IN THE TREND OF AN INCREASE IN THAT LAST QUARTER BETWEEN OCTOBER AND DECEMBER, BUT WE SAW A SIGNIFICANT DECREASE, A TOTAL OF A 40% SWING FROM WHAT WAS EXPECTED TO WHAT WE ENDED UP SEEING.

TRULY, WE CAN SEE THAT INJURIES AND POTENTIALLY LIVES WERE SAVED ASSOCIATED WITH THESE ACTIONS.

AND THE TRENDS ARE PRETTY CLEAR THAT WITH CONSISTENTLY REMAINING VIGILANT AND EDUCATING THE VERY SWIFT ACTION OF THE CITY, AT LEAST AT THIS POINT IN TIME, AND COMPARING THOSE QUARTERS AND COMPARING PREVIOUS YEARS, THERE'S BEEN A SIGNIFICANT TREND THAT IS OUTSIDE OF ANY ANOMALY WE COULD HAVE OTHERWISE EXPECTED TO HAVE SEEN.

SO WHAT ARE THE TAKEAWAYS FROM THE TREND ANALYSIS? WELL, REALLY THAT SAFER STREETS HAS BEEN FOCUSED ON DATA INFORMED.

WHEN YOU LOOK AT THAT QUARTERLY COMPARISON OF INJURY COLLISIONS SINCE THE DECLARATION OF EMERGENCY, A REVERSE TREND IN SUCH A SHORT PERIOD OF TIME IS QUITE TREMENDOUS.

THE COMPREHENSIVE THREE E'S APPROACH HAS BEEN EFFECTIVE DEFINITELY IN REACH IF WE LOOK AT ACTIVITY METRICS, BUT ALSO IN THE OUTCOMES AS WELL.

THE CHALLENGE IS SOMETIMES WHEN THAT ENFORCEMENT GOES AWAY, THEN THE BEHAVIORS CAN COME BACK.

SO YOU WANT TO ALSO LAYER THE WORK WE'RE DOING ON OUR STREETS BY NARROWING THE LANES.

IT MAKES DRIVERS GO A LITTLE BIT MORE SLOWLY.

PUTTING A ROUNDABOUT IN MAKES THEM PAY A LITTLE MORE ATTENTION.

SO THAT'S ALSO A BEHAVIOR.

OKAY. SO IN TERMS OF FUNDING THE CITY'S RESPONSE, ON AUGUST 30TH, 2022, THE CITY COUNCIL APPROVED A $2 MILLION ALLOCATION TO RESPOND TO THE EMERGENCY. THE ALLOCATION WAS BROKEN DOWN AS IT'S LAID OUT ON THIS SLIDE BEFORE YOU WITH THE MAJORITY OF FUNDING TOWARDS INFRASTRUCTURE PROJECTS AND EDUCATION, AS WELL AS OVER STAFFING THE POLICE DEPARTMENT.

TO DATE THROUGH JANUARY OF 2023, THE CITY HAS SPENT $500,000 IN RESPONSE TO THE EMERGENCY.

IT IS ALSO ENCUMBERED $600,000 OR COMMITTED TO BE SPENT.

AND THAT LEAVES APPROXIMATELY $863,000 REMAINING.

THE MAJORITY OF USES OF THESE DOLLARS SO FAR HAVE INCLUDED GREEN PAINT, BIKE LANE ENHANCEMENTS, TRAFFIC, MANY MESSAGE BOARDS, STAFF, OVERTIME, AS WELL AS PUBLIC EDUCATION AND OUTREACH.

THE $2 MILLION ALLOCATION WAS FUNDED FROM THE GENERAL FUND'S ANNUAL SURPLUS IN FISCAL YEAR 2022 AND WAS CARRIED FORWARD INTO THE CURRENT YEAR'S BUDGET TO FUND THESE ITEMS. THERE ARE, OF COURSE, ALTERNATIVE MEANS FOR FUNDING PROJECTS WHICH INCLUDE THE CITY'S CAPITAL IMPROVEMENT PROGRAM, THE ANNUAL OPERATING BUDGET, AND ALSO THROUGH THE REPRIORITISATION OF PREVIOUSLY FUNDED ITEMS AND PROJECTS.

ON DECEMBER 6TH, 2022, AT THE REQUEST OF CITY COUNCIL STAFF, HAD PRESENTED THE RECOMMENDED ACTIONS BY BOTH THE PLANNING AND TRAFFIC AND MOBILITY COMMISSIONS FROM THE MENU OF ADDITIONAL PROJECTS TO BE CONSIDERED.

THE PLANNING COMMISSION RECOMMENDED A TOTAL PROJECT LISTING TOTALING $5.1 MILLION AND ONE TIME COSTS WITH $1.5 MILLION IN ONGOING COSTS. THE TRAFFIC AND MOBILITY COMMISSION RECOMMENDED A FEW LESS PROJECTS, BUT STILL TOTALING 3.4 MILLION AND ONE TIME COSTS AND 620,000 IN ONGOING COSTS. THE CITY COUNCIL HAD REQUESTED STAFF TO RETURN ONCE AGAIN TO DISCUSS REVENUE AND OR FUNDING OPPORTUNITIES FOR THESE PROJECTS.

BEFORE WE GET INTO THE POTENTIAL OPTIONS, I WOULD LIKE TO BRIEFLY DISCUSS THE CITY'S FINANCIAL STATUS.

MANY OF THESE BULLETS WE'VE HEARD BEFORE, BUT I DO WANT TO REITERATE THEM ONCE MORE.

THE CITY CONTINUES AND HAS BEEN FOR A NUMBER OF YEARS, TRANSITIONING FROM A TIME OF GROWTH TO A TIME OF MAINTENANCE.

ECONOMIC UNCERTAINTY STILL REMAINS.

AND FOR WELL OVER A YEAR NOW, IT HAS BEEN FUELED BY GEOPOLITICAL CONFLICT, SUPPLY CHAIN DISRUPTIONS AND SUSTAINED INFLATIONARY INCREASES, PENSION FUNDING AND THE LACK OF LOCAL CONTROL OVER HOW THE CITY'S CONTRIBUTIONS THAT WE MAKE TO CALPERS ARE ACTUALLY INVESTED AND HOW CALPERS IS INVESTMENT PERFORMANCE HAS VOLATILITY FROM ONE YEAR TO THE NEXT. ALSO HAS HAS A CONTRIBUTING FACTOR IN TERMS OF HOW MUCH THE CITY WILL BE PAYING FROM ONE YEAR TO THE NEXT.

AGAIN, HIGH INFLATION HAS IMPACTED THE CITY'S OPERATING BUDGET ALMOST IMMEDIATELY AS WELL AS COSTS FOR CONSTRUCTION.

AND WHILE THERE ARE GENERALLY POSITIVE IMPACTS FOR LOCAL GOVERNMENTS DURING PERIODS OF INCREASED INFLATION, EVENTUALLY DEMAND FOR GOODS AND SERVICES DIMINISHES, AND THAT TRANSLATES TO A RELATIVE REDUCTION IN REVENUE.

EVERYTHING THAT I'VE MENTIONED THUS FAR, IT CONTRIBUTES TO THE OBSERVATION THAT WE'VE BEEN SEEING IN RECENT PERIODS AS WELL AS OUR PROJECTION FOR THE FUTURE.

THAT IS, EXPENDITURES ARE GROWING AT A FASTER RATE THAN THE CITY'S REVENUES.

CONTINUING THAT TREND INTO THE FUTURE, WE'RE ANTICIPATING ACTUAL OR PROJECTED EXPENDITURES TO EVENTUALLY EXCEED PROJECTED REVENUES BEGINNING IN FISCAL YEAR 2526. STAFF WILL, OF COURSE, CONTINUE TO MONITOR THESE ECONOMIC AND FISCAL TRENDS AND BRING MORE INFORMATION BEFORE THE CITY COUNCIL NEXT MONTH FOR THE MID-YEAR REPORT AND THEN AGAIN AS PART OF THE PRELIMINARY BUDGET FOR FISCAL YEAR 2324.

IN MAY OF 2023.

NOW, AS FOR ADDITIONAL FUNDING OPTIONS AND REVENUE ENHANCEMENTS, I WON'T GO INTO A WHOLE LOT OF DETAIL ON EACH OF THESE, BUT I DID WANT TO COVER THEM BRIEFLY.

AS FAR AS TAX OPTIONS ARE CONCERNED, BACK IN APRIL OF 2022, STAFF AT THE DIRECTION OF CITY COUNCIL HAD PRESENTED A REVENUE STUDY WHICH LOOKED AT PRELIMINARY POLLING SURVEY RESULTS AND ALSO ANALYZE THE FISCAL IMPACT OF A SALES TAX MEASURE, TRANSIENT OCCUPANCY TAX, AS WELL AS CANNABIS.

AT THAT TIME, THERE WAS NO FURTHER DIRECTION DIRECTED FOR CITY STAFF, BUT IN IF IN THE FUTURE CITY COUNCIL HAD DIRECTED STAFF TO MOVE FORWARD, WE WOULD PERFORM SIMILAR PROCEDURES, STUDYING AND RESEARCHING AND BRINGING THOSE FINDINGS AND RECOMMENDATIONS BACK TO CITY COUNCIL ACCORDINGLY.

THE GENERAL FUND RESERVE IS ANOTHER FUNDING SOURCE AND CITY COUNCIL DOES HAVE THE AUTHORITY TO COMMIT THE USE OF THIS GENERAL FUND RESERVE FOR ONE TIME OPPORTUNITY COSTS IN ACCORDANCE WITH CITY COUNCIL POLICY.

STATEMENT NUMBER 74.

AS OF JUNE 30, 2022, THE GENERAL FUND RESERVE RATIO WAS APPROXIMATELY 60% AND IN COMPLIANCE WITH THE POLICY STATEMENT, WHICH SETS FORTH A MINIMUM RESERVE BALANCE EQUAL TO 40% OF THE PREVIOUS FISCAL YEAR, IS ADOPTED.

BUDGET. AS FOR CAPITAL GRANTS AND NON-RESOURCES, THE CITY HAS ALREADY TAKEN ADVANTAGE OF MANY FEDERAL, STATE AND COUNTY LEVEL GRANTS.

STAFF PLAN TO CONTINUE PURSUING ADDITIONAL GRANT FUNDING AND OPPORTUNITIES.

ASSUMING THAT THE SCOPE, TIMING AND ELIGIBILITY OF THESE GRANTS ALIGN WITH THE CITY'S PROJECTS.

IN ADDITION, THE CITY RECEIVES NON-DISCRETIONARY RESOURCES FROM THE STATE AND COUNTY, INCLUDING GAS AND TRANSNET TAXES EACH YEAR.

MOST OF THESE FUNDS ARE ALREADY DEDICATED OR COMMITTED TO THE CITY'S 15 YEAR CAPITAL IMPROVEMENT PROGRAM.

THE CITY COUNCIL HAS ALREADY AUTHORIZED TRAFFIC SAFETY RELATED PROJECTS TO BE EXPEDITED UTILIZING THESE RESOURCES.

HOWEVER, IF THE CITY COUNCIL COULD CONSIDER REPRIORITIZING ADDITIONAL CIP PROJECTS TO FUND ADDITIONAL TRAFFIC SAFETY PROJECTS.

NEXT IS GENERAL OBLIGATION BONDS.

THESE ARE DEBT INSTRUMENTS ISSUED BY STATE AND LOCAL GOVERNMENTS TO COVER A WIDE RANGE OF MUNICIPAL INFRASTRUCTURE PROJECTS.

THEY ARE BACKED SOLELY BY THE CREDIT AND THE TAXING POWER OF THE ISSUING JURISDICTION, AND COMMONLY USED WHEN LOCAL GOVERNMENTS CHOOSE TO FINANCE A PROJECT RATHER THAN FUNDING IT WITH CASH. THE LAST ITEM ON THE SLIDE IS ENHANCED INFRASTRUCTURE FINANCING DISTRICTS.

THIS ENABLED THE CREATION OF THESE GOVERNMENTAL ENTITIES WHEREBY ONE OR MORE MAY BE ESTABLISHED WITHIN A CITY TO FINANCE THE CONSTRUCTION OR REHABILITATION OF A WIDE VARIETY OF PUBLIC INFRASTRUCTURE PROJECTS THROUGHOUT THE BOUNDARIES OF THE DISTRICT ITSELF.

SO TO SUMMARIZE, THE CITY REMAINS VERY FINANCIALLY AND FISCALLY HEALTHY.

HOWEVER, IT IS BECOMING INCREASINGLY IMPORTANT TO DEVELOP A LONGER TERM STRATEGY FOR MANAGING WHAT'S TO COME, NOT JUST FOR PERIODS OF ECONOMIC DECLINE, BUT ALSO FOR FUTURE OPERATIONS OF MAINTENANCE REQUIRED FOR THE CITY'S CAPITAL IMPROVEMENT PROGRAM.

THERE ARE NO DECISIONS BEING ASKED AS IT PERTAINS TO ADDITIONAL FUNDING OR TO PURSUE ADDITIONAL REVENUE OR FUNDING ENHANCEMENTS, AS THERE WILL BE ADDITIONAL OPPORTUNITIES FOR THAT THROUGHOUT THE COURSE OF THE BUDGET PROCESS.

I'M HERE TODAY HOPING THAT YOU WILL LISTEN TO THE RESIDENTS THAT DRIVE THAT ROAD EVERY DAY BEFORE YOU ADOPT ITEM TWO FROM THE JANUARY 3RD SESSION TO 2022.

EAST WEST QUARTER'S EMERGENCY RESURFACING AND RESTRIPING PROJECT NUMBER 600122E.

CANNON ROAD IS NOW A DANGEROUS ROAD TO TRAVEL AS A HIGH SPEED ROAD WITH LARGE VEHICLES THAT TRAVEL ON IT EVERY DAY.

SEMI-TRUCKS, FIRE TRUCKS, BUSSES, RVS, TRAILERS WITH ONLY TEN FOOT WIDTH IN THE LANE AND A POSTED SPEED LIMIT OF 50 MILES PER HOUR.

MANY CARS ARE NOW TRAVELING IN THE NEWLY PAINTED BUFFER LANE BECAUSE THEY CANNOT MAINTAIN IN THE SINGLE SMALL TEN FOOT WIDTH.

GOOD EVENING, HONORABLE MAYOR AND CITY COUNCIL.

WE'RE HERE TONIGHT ASKING CITY COUNCIL TO CONSIDER NEW VILLAGE ARTS REQUEST FOR $228,411 IN ADDITIONAL CITY FUNDING FOR THE NEW VILLAGE ARTS TENANT IMPROVEMENT PROJECT AND DISCUSS OPTIONS AND PROVIDE DIRECTION TO STAFF.

FOR SOME HISTORY ON THE PROJECT.

THE BAUER LUMBER BUILDING, WHICH IS 9400 SQUARE FEET, WAS ACQUIRED BY THE CITY'S REDEVELOPMENT AGENCY IN 1997.

NEW VILLAGE ARTS HAS LEASED THE BUILDING SINCE 2006.

IN JULY OF 2021, THE CITY ENTERED INTO A TEN YEAR LEASE AGREEMENT WITH TWO FIVE YEAR EXTENSION OPTIONS.

AS PART OF THAT AGREEMENT, THERE WAS A CONSTRUCTION AND REIMBURSEMENT AGREEMENT THAT NEEDED TO BE NEGOTIATED WHEREBY THE CITY WOULD CONTRIBUTE UP TO $573,000 FOR BUILDING IMPROVEMENTS THAT COVERED 470,000, FOR EXTERIOR IMPROVEMENTS TO THE SOUTH AND EAST WALLS AND AN ADDITIONAL 103,000 FOR INSTALLATION OF SOLAR PANELS.

IN ADDITION TO THE CITY CONTRIBUTION OF $573,000 SINCE 2017, THE CITY HAS PAID $292,637 TO REMOVE AND REPLACE THE ROOF AND THE WEST WALL OF THE BUILDING.

AND ADDITIONALLY, AS IT RELATES TO CULTURAL ARTS, SINCE 2013, 27, ART GRANTS TOTALING $206,638 HAVE BEEN GRANTED TO NEW VILLAGE ARTS, INCLUDING 50,000 FOR A RECENTLY COMPLETED MURAL ON THE WEST WALL.

TOTAL CITY CONSIDERATION ABOVE WHAT WAS IN THE 2021 LEASE AGREEMENT FROM 2013 TO PRESENT IS $1,072,275 AND THAT DOES NOT INCLUDE FORGONE RENT OPPORTUNITIES WHICH, HAD WE LEASED IT AT MARKET RATES, COULD HAVE BEEN UPWARDS OF $450,000 PER YEAR OR $9 MILLION OVER THE 20 YEAR TERM OF THE LEASE AGREEMENT, NOT INCLUDING ANNUAL INCREASES.

UNDER THE LEASE. THERE IS NO OBLIGATION UNDER THE LEASE AND CONSTRUCTION REIMBURSEMENT AGREEMENT.

THE CITY IS UNDER NO LEGAL OBLIGATION TO PROVIDE ADDITIONAL FUNDING BEYOND THE $573,000 REIMBURSEMENT.

HERE ARE SOME PHOTOS.

THE PROJECT THIS WAS ACTUALLY TAKEN YESTERDAY IS NEAR COMPLETION AND SHOULD BE DONE WITHIN THE NEXT COUPLE OF WEEKS.

THUS THE REQUEST BY NEW VILLAGE FOR ADDITIONAL FUNDING UP TO $228,411.

BUT DOES THAT INCLUDE IF YOU WANTED TO SAY A REPAYMENT? SO IS THAT CONSIDERED A LOAN OR JUST HERE'S A CHECK? MY UNDERSTANDING IS THAT IT'S HERE'S A CHECK.

SO THE FIRST OPTION WE PRESENTED WAS IF THE COUNCIL WAS TO DIRECT STAFF TO TO RENEGOTIATE THE LEASE AND THE CONSTRUCTION AGREEMENT, BECAUSE THAT IS THOSE ARE THE TWO DOCUMENTS THAT DETAIL THE CITY'S $573,000 CONTRIBUTION UNDER THE CONDITIONS FOR THAT. WE WOULD ASK YOU IF THAT'S THE OPTION YOU'RE WISHING TO PROVIDE SOME DIRECTION ON.

WE WOULD SUGGEST THAT YOU DIRECT THAT OPTION AND WE WOULD GO INTO CLOSED SESSION AT A LATER DATE AND DISCUSS PRICE AND TERMS. AND SO IF THE COUNCIL WANTED TO AMEND THE LEASE TO CHANGE THE DOLLAR PER YEAR RENT PAYMENT TO SOME OTHER AMOUNT, THAT OVER TIME WOULD HELP CONTRIBUTE OR FULLY CONTRIBUTE TO REPAYING THE 228,000, THAT IS SOMETHING THE COUNCIL COULD DIRECT.

OKAY. SO, SO PROPOSING THAT WE GIVE THEM A LOAN OF THE $228,000, HAVING MET OUR OBLIGATIONS CONTRACTUALLY THAT WE AGREED WITH THEM AND GONE I THINK ABOVE AND BEYOND THAT IN FACT, AND THEN ENTER INTO CLOSED SESSION TO DISCUSS PRICE IN TERMS COME BACK WITH SOME SORT OF AN AGREEMENT THAT SAYS YOU WILL PAY THIS ALONG WITH WHATEVER RENT OR EVEN IF THAT IS THE RENT, WHATEVER THOSE NEGOTIATIONS COME UP WITH, THEN THAT WOULD ALL BE INCLUDED IN ITEM NUMBER ONE.

IT COULD BE, YES, DEPENDING ON THE COUNCIL'S DIRECTION.

OF COURSE, BECAUSE THAT'S MY CONCERN, IS THAT I'M ALL FOR SUPPORTING IN VA AND AND GIVING THIS THIS LAST LITTLE BIT OF MONEY THAT THEY NEED TO GET FINISHED AND, YOU KNOW, DOT THE T'S AND CROSS THE T'S AND DOT THE I'S.

BUT I THINK IT'S FAIR THAT WE HAVE GONE ABOVE AND BEYOND THAT THEY SHOULD HAVE SOME SKIN IN THE GAME AND HAVE TO PERHAPS REPAY THIS.

IT DOESN'T EVEN HAVE TO BE INTEREST BEARING AT THIS POINT.

IT COULD JUST BE A GOOD FAITH EFFORT TO SHOW THAT THEY APPRECIATE WHAT WE'VE DONE FOR THEM AND WE APPRECIATE THAT WHAT THEY DO FOR THE ARTS IN THE COMMUNITY, BECAUSE IT REALLY IS A FANTASTIC FACILITY AND IT'S GOING TO BE EVEN BETTER WITH THESE WITH THIS FACELIFT.

SO WE WERE SUPER EXCITED.

IT WAS A WEDNESDAY MORNING, THE TUESDAY NIGHT.

PREVIOUSLY WE HAD VOTED FOR THE ECONOMIC DEVELOPMENT STRATEGIC PLAN, SO I WAS VERY EXCITED TO SHARE WITH THEM THAT THAT WAS SOMETHING THAT IS GOING TO HELP THEM IN THE

VILLAGE AND GOT A REALLY GOOD POSITIVE FEEDBACK ABOUT THAT.

WE THINK ALL OF US ATTENDED THE CARLSBAD PD AWARDS, WHICH IS A WONDERFUL CEREMONY ACKNOWLEDGING SOME OF OUR FANTASTIC STAND OUT OFFICERS.

AND THEN WE GET TO KICK OFF THE GREAT KINDNESS CHALLENGE.

AND DR. BHAT-PATEL AND I WERE AT JEFFERSON ELEMENTARY, ALONG WITH CHIEF WILLIAMS AND CHIEF CALDERWOOD AND A BUNCH OF OTHER PD AND ABOUT 5000 ELEMENTARY SCHOOL KIDS THAT WE ALL HIGH FIVED.

SO THAT WAS A GREAT OPPORTUNITY FOR US TO BE OUT IN THE COMMUNITY AND AND SUPPORT THE SCHOOL.

ALSO TODAY AT 9 A.M., AFTER THE CHAMBER OF COMMERCE RISING STAR AWARDS, WE HAD THE CITY COUNCIL LEGISLATIVE SUBCOMMITTEE, AND COUNCILMEMBER BURKHOLDER AND I WERE HERE IN THIS ROOM FOR OVER AN HOUR WITH OUR LEGISLATIVE REPRESENTATIVES AND OUR CONTRACT LOBBYISTS ON THE PHONE JUST TALKING ABOUT LEGISLATION AND HOW WE CAN ADVOCATE BETTER FOR THE CITY OF CARLSBAD IN OUR COMMUNITY AT STATE AND FEDERAL LEVELS.

OTHER THAN THAT, I WAS TRYING TO REMEMBER THINGS THAT MAYBE COUNCILMEMBER BURKHOLDER HADN'T YET GOTTEN TO.

DID YOU MENTION THE SAFER STREETS CAMPAIGN, THAT WE'RE GOING TO KICK THAT OFF TOMORROW? SO THAT'S GOING TO BE VERY EXCITING.

THAT'S MORE THAN 500 CITY OFFICIALS FROM ALL OVER THE STATE.

AND WE HAD A STRATEGIC PLANNING MEETING THIS PAST WEEKEND.

SO WORKING OVER THE WEEKEND.

ALSO THIS THURSDAY, I'VE GOT THE SAN DIEGO COUNTY WATER AUTHORITY MEETING AND THAT WILL BE EXCITING BECAUSE IT'S MY FIRST FULL ONE.

WE HAD A KIND OF A MINI ONE VIRTUALLY LAST WEEK, AND THIS IS MY FIRST FULL SAN DIEGO COUNTY WATER AUTHORITY MEETING THIS THURSDAY.

SO I'M LOOKING FORWARD TO ALL THE ACTIVITY.

IT IS A BUSY WEEK AND I AM LOOKING FORWARD TO ALL OF THE EXCITEMENT OF MANY IMPORTANT DECISIONS HAPPENING RIGHT NOW.

DAY. I WAS AT THE NAACP EVENT AND IT WAS GREAT TO CELEBRATE THE LEGACY OF MARTIN LUTHER KING THIS PAST FRIDAY.

COUNCILMEMBER BURKHOLDER AND I WERE AT THE OMNI LA COSTA'S GROUNDBREAKING FOR THE GOLF COURSE, AND SO REALLY EXCITED TO SEE THAT COME TO FRUITION IN THE NEXT COUPLE OF YEARS AND HOPEFULLY HOST SOME NCAA FOLKS HERE.

AND THEN THE GREAT KINDNESS CHALLENGE WAS MENTIONED.

MY SON AND I HAD THE OPPORTUNITY TO GO, I'VE GONE FOR THE PAST FEW YEARS, BUT THIS WAS THE FIRST TIME I GOT TO BRING MY SON AND HE HAD FUN SCREAMING KINDNESS WITH THE KIDS WHILE THEY WERE DOING THEIR LITTLE, YOU KNOW, SCREAM OFF.

IT'S ALMOST LIKE A DANCE OFF.

BUT THEY HAD THE SCREAM OFF.

AND I KNOW THE MAYOR LED THAT.

WE WERE THERE WITH THE MAYOR AS WELL.

THE HOMELESSNESS COUNT THAT WE'LL BE HAVING ON THURSDAY DOES START AT FOUR IN THE MORNING.

SO I KNOW MANY OF US WILL BE THERE BRIGHT AND EARLY.

AND WE DO HAVE THE CTA MEETING, BOARD MEETING, REGULARLY SCHEDULED BOARD MEETING ON THIS THURSDAY AS WELL.

THE CAL CITY'S TRANSPORTATION COMMUNICATION AND PUBLIC WORKS COMMITTEE IS THE ONE THAT I CHAIR WITH MANY DIFFERENT IT'S ALMOST LIKE 60 TO 70 DIFFERENT LEGISLATORS ACROSS THE STATE SINCE I'M CHAIRING THAT.

THE SAME DAY IS ALSO THE SANDAG MEETING.

SO THE MAYOR WILL ACTUALLY BE ATTENDING INSTEAD FOR THAT PARTICULAR MEETING.
