IT READS, WHEREAS THE CONSTITUTION OF THE UNITED STATES OF AMERICA, THE GUARDIAN OF OUR LIBERTIES, EMBODIES THE PRINCIPLES OF LIMITED GOVERNMENT IN A REPUBLIC DEDICATED TO THE RULE OF LAW.

SEPTEMBER 17TH, 2023, MARKS THE 200TH AND 36TH ANNIVERSARY OF THE DRAFTING OF THE CONSTITUTION OF THE UNITED STATES OF AMERICA BY THE 1787 CONSTITUTIONAL CONVENTION.

IT'S FITTING AND PROPER TO ACCORD OFFICIAL RECOGNITION TO THIS MAGNIFICENT DOCUMENT.

IT'S MEMORABLE ANNIVERSARY AND TO THE PATRIOTIC CELEBRATIONS WHICH IT COMMEMORATES.

PUBLIC LAW 915 GUARANTEES THE ISSUING OF A PROCLAMATION EACH YEAR BY THE PRESIDENT OF THE UNITED STATES DESIGNATING SEPTEMBER 17TH THROUGH SEPTEMBER 23RD AS CONSTITUTION WEEK.

THEREFORE, I, KEITH BLACKBURN, MAYOR OF THE CITY OF CARLSBAD, ON BEHALF OF THE ENTIRE CITY COUNCIL, DO HEREBY PROCLAIM THE WEEK OF SEPTEMBER 17TH THROUGH 23RD, 2023 AS CONSTITUTION WEEK IN THE CITY OF CARLSBAD.

AND I INVITE JACKIE TO SAY A FEW WORDS.

WE APPRECIATE IT. GREETINGS.

I'M JACKIE BURNS, THE REGENT OF THE SANTA MARGARITA CHAPTER NATIONAL SOCIETY, DAUGHTERS OF THE AMERICAN REVOLUTION, WHICH WAS CHARTERED IN THE CITY OF OCEANSIDE IN OCTOBER OF 1929. THE UNITED STATES CONSTITUTION, AMERICA'S MOST IMPORTANT DOCUMENT, STANDS AS A TESTAMENT TO THE TENACITY OF AMERICANS THROUGHOUT HISTORY TO MAINTAIN THEIR LIBERTIES, FREEDOMS AND INALIENABLE RIGHTS.

CONSTITUTION WEEK IS CELEBRATED ANNUALLY DURING THIS WEEK OF SEPTEMBER THROUGH 17TH THROUGH THE 23RD TO COMMEMORATE ITS HISTORY IN 1929, DAR CONSTITUTION HALL IN DC WAS BUILT IN TRIBUTE TO THE CONSTITUTION OF THE UNITED STATES BY THE DAUGHTERS OF THE AMERICAN REVOLUTION. IN 1955, THE DAUGHTERS OF THE AMERICAN REVOLUTION PETITIONED CONGRESS TO SET ASIDE SEPTEMBER 17TH THROUGH THE 23RD ANNUALLY TO BE DEDICATED TO THIS CELEBRATION AND OBSERVANCE OF OUR GREAT CONSTITUTION.

THE RESOLUTION WAS ADOPTED BY THE US CONGRESS AND SIGNED IT EXCUSE ME, INTO LAW ON AUGUST 2ND, 1956, BY PRESIDENT DWIGHT D. EISENHOWER. DWIGHT D EISENHOWER.

THE AIMS OF THE CONSTITUTION WEEK CELEBRATION ARE TO EMPHASIZE TO EACH AND EVERY CITIZEN THE RESPONSIBILITY FOR PROTECTING AND DEFENDING THE CONSTITUTION TO INFORM OUR CITIZENS THAT THE CONSTITUTION IS THE BASIS FOR AMERICA'S GREAT HERITAGE AND THE FOUNDATION FOR OUR WAY OF LIFE.

AND TO ENCOURAGE THE STUDY OF THE HISTORICAL EVENTS THAT LED TO THE FRAMING OF THE CONSTITUTION IN SEPTEMBER 1787.

THANK YOU, MAYOR. THIS IS THE INTERNATIONAL OVERDOSE AWARENESS DAY PROCLAMATION, AND I WOULD LIKE TO INVITE THE COMMUNITY HEALTH NURSE CHRISTINA GILMORE, TO THE PODIUM.

AND I WILL READ THE PROCLAMATION, WHICH IS NEAR AND DEAR TO MY HEART AS A MENTAL HEALTH THERAPIST, AND UNDERSTANDING THAT OVER 9000 CALIFORNIANS HAD OVERDOSES BETWEEN JUNE OF 2020 AND JUNE OF 2021.

SO THIS ONE.

IS A TOP TEN CAUSE OF DEATH THAT CAN CAN COMPLETELY BE PREVENTED.

THE PROCLAMATION IS FOR INTERNATIONAL OVERDOSE AWARENESS DAY, AUGUST 31ST, 2023.

WHEREAS THE CITY OF CARLSBAD DOES AFFIRM AND ACKNOWLEDGE THE HARM AND HARDSHIP CAUSED BY DRUG OVERDOSE.

AND. WHEREAS, WE RECOGNIZE THE PURPOSE OF INTERNATIONAL OVERDOSE AWARENESS DAY AS REMEMBERING LOVED ONES LOST TO OVERDOSE AND ENDING THE STIGMA OF DRUG RELATED DEATHS.

AND. WHEREAS, WE RESOLVE TO PLAY OUR PART IN REDUCING THE TOLL OF OVERDOSE IN OUR COMMUNITY, WHICH CLAIMS SO MANY LIVES OF OUR RESIDENTS IN THE PAST YEARS, TOGETHER WITH COUNTLESS MORE AFFECTED FOREVER.

AND. WHEREAS, WE AFFIRM THAT THE PEOPLE AFFECTED BY OVERDOSE ARE OUR SONS AND DAUGHTERS, OUR MOTHERS AND FATHERS, OUR BROTHERS AND SISTERS, AND DESERVING OF OUR COMPASSION AND SUPPORT.

IT'S MY PRIVILEGE TO ACCEPT THE PROCLAMATION FOR INTERNATIONAL OVERDOSE AWARENESS DAY.

I'M CHRISTINA GILMORE, AND I AM THE CITY OF CARLSBAD'S COMMUNITY HEALTH NURSE.

A YEAR AND A HALF AGO, WHEN I BEGAN WITH THE CITY, IT WAS ALREADY WELL ESTABLISHED THAT THE GLOBAL OPIOID CRISIS WAS RELENTLESS, GROWING AND DRIVEN BY FENTANYL.

A SYNTHETIC OPIOID LIVES FROM ALL SOCIOECONOMIC BACKGROUNDS ARE BEING LOST DUE TO OVERDOSE AT AN ALARMING RATE.

ASSESSING THE HEALTH OF OUR COMMUNITY REQUIRED A CLOSE LOOK AT HOW THIS WAS IMPACTING US HERE IN CARLSBAD, AND THE FOLLOWING WAS FOUND IN 2018.

OUR FIRE DEPARTMENT RESPONDED TO 40 INCIDENTS WHERE THE PATIENT WAS TREATED FOR AN OVERDOSE BY ADMINISTERING THE OPIOID REVERSAL MEDICATION, NALOXONE, ALSO KNOWN AS NARCAN. IN 2020, THAT NUMBER HAD DOUBLED TO 80, AND IN 2021, WE RESPONDED 149 TIMES TO A SUSPECTED OVERDOSE THAT REQUIRED TREATMENT WITH NALOXONE.

SO IN JUST THREE YEARS, THE NUMBER OF OVERDOSES IN CARLSBAD INCREASED BY 350%.

THE FIRE DEPARTMENT'S EMERGENCY RESPONSE DATA MADE IT CLEAR, AS EXPECTED, WE WERE NOT AN EXCEPTION TO THE SWEEPING OPIOID CRISIS.

WELL, IT'S IMPORTANT TO NOTE THAT OVERDOSE CAN OCCUR FROM NUMEROUS DRUGS, PRESCRIBED OR OTHERWISE.

IT'S OBVIOUS FROM REVIEWING THE INCIDENTS THAT THE VAST MAJORITY WERE THE RESULT OF FENTANYL.

WITH THE SUPPORT OF CITY PERSONNEL, INCLUDING OUR FIRST RESPONDERS, REGIONAL PROGRAMS, THE CARLSBAD UNIFIED SCHOOL DISTRICT, AND MANY COMMUNITY MEMBERS, WE'VE MADE GREAT PROGRESS BY TAKING A PROACTIVE APPROACH AND FOCUSING ON EDUCATION, TRAINING AND AWARENESS.

ONE YEAR AGO, OUR FIRE DEPARTMENT WAS APPROVED TO PARTICIPATE IN THE STATE'S NALOXONE DISTRIBUTION PROGRAM, AND MORE RECENTLY, THE SAN DIEGO COUNTY EMS LEAVE BEHIND NALOXONE PROGRAM.

AS A RESULT, ALL OF OUR PARAMEDICS AND EMTS ARE NOW PROVIDING TRAINING ON SCENE AND LEAVING NALOXONE KITS WITH THOSE DETERMINED TO BE AT RISK OF OVERDOSE AND THEIR CAREGIVERS.

OVERDOSE EDUCATION AND NALOXONE TRAINING HAVE BEEN PROVIDED TO FACULTY IN OUR HIGH SCHOOLS AND BOYS AND GIRLS CLUBS TO PARENTS THROUGH THE PARENT UNIVERSITY PROGRAM AND THROUGH THE POLICE AND SOON TO THE POLICE DEPARTMENT'S JUVENILE JUSTICE PROGRAM AND TO STUDENTS THROUGH ON CAMPUS OUTREACH SESSIONS.

CARLSBAD FIRST RESPONDERS ARE ALWAYS READY TO ANSWER THE CALL AND RESPOND TO THOSE IN NEED OF ASSISTANCE.

HOWEVER, IN MANY OVERDOSE CASES, THE FIRST PERSON TO RESPOND IS OFTEN A LOVED ONE FRIEND OR A BYSTANDER.

AWARENESS, PREPAREDNESS AND QUICK ACTION TAKEN BY THESE INFORMAL FIRST RESPONDERS HAVE SAVED MANY LIVES, AND IT'S IMPORTANT TO ACKNOWLEDGE THE VALUE OF HAVING GOOD SAMARITANS IN OUR COMMUNITY WHO ARE WILLING TO INTERVENE.

REVIEW OF MORE RECENT DATA LOOKS PROMISING.

WHILE THE NUMBER REMAINS HIGH IN 2022, A YEAR AFTER REMARKED THAT 350% INCREASE, THERE HAS NOT BEEN AN INCREASE, BUT ACTUALLY A SLIGHT DECREASE TO 126 SUSPECTED OVERDOSE CALLS.

SO DOWN FROM THE 149.

AND LOOKING AT OUR CURRENT DATA FOR THIS YEAR, WE'RE ON TRACK TO SEE A CONTINUED DECREASE FOR THE FIRST TIME SINCE THE OPIOID CRISIS BEGAN.

SO THERE'S HOPE THAT WE'RE HEADING IN THE RIGHT DIRECTION TOWARD A SAFER AND HEALTHIER CARLSBAD.

AND REMAINING ON THIS PATH RELIES ON HIS CONTINUING TO EDUCATE OUR KIDS, TRAIN OUR TEACHERS AND SCHOOL FACULTY AND CAREGIVERS, GETTING THE LOCKS ON KITS IN THE HANDS OF AS MANY INDIVIDUALS AND THOSE CLOSE TO THEM AS WE CAN DECREASE THE STIGMA OF THOSE STRUGGLING WITH ADDICTION.

ENCOURAGE THOSE WHO EXPERIENCE ADDICTION TO SEEK TREATMENT AND KEEP AWARENESS OF PRIORITY.

I APPRECIATE THE SUPPORT OF THESE CONTINUING EFFORTS.

WE HAVE MAJOR, MAJOR INFRASTRUCTURE ISSUES.

I WENT TO THE PLANNING COMMISSION AND THE ENGINEERING DEPARTMENT WENT THROUGH ALL THE FILES AND ESTABLISHED THAT THERE HAS BEEN NO INFRASTRUCTURE IMPROVEMENTS ON CHINKAPIN STREET, FROM GARFIELD TO THE RAILROAD TRACKS SINCE 1965.

THAT MEANS WE HAVE THE SAME ELECTRICAL LINES, THE SAME SEWER LINES.

THE SAME DRAINAGE PROBLEMS TIMES 7.5 TIMES BECAUSE WE'VE GOT ALL THOSE EXTRA ROOFS.

THESE CHAPTERS ESTABLISH PROCEDURES APPLICABLE APPLICABLE TO ALL PUBLIC MEETINGS AND MATTERS SPECIFIC TO THE ROLES AND RESPONSIBILITIES OF MEMBERS OF THE CITY BOARDS AND COMMISSIONS. CHAPTER 2.15 WAS AMENDED AGAIN IN FEBRUARY 2022, WHEN THE COMMUNITY POLICE ENGAGEMENT COMMISSION WAS ADDED TO THE CITY.

BOARDS AND COMMISSIONS.

AS PART OF THE CONTINUING EFFORT TO REVIEW AND UPDATE, THE MUNICIPAL CODE, STAFF IS RECOMMENDING AMENDMENTS TO VARIOUS CHAPTERS WITHIN TITLE TWO.

THE ACTIONS FOR CITY COUNCIL CONSIDERATION ARE TO INTRODUCE AN ORDINANCE THAT WOULD RENAME THE TRAFFIC AND MOBILITY COMMISSION, THE TRAFFIC SAFETY AND MOBILITY COMMISSION, AS REQUESTED BY THAT COMMISSION.

ALSO, WE WOULD ASK THAT YOU INTRODUCE AN ORDINANCE ADDING THE BEACH PRESERVATION COMMISSION TO THE MUNICIPAL CODE AS A WAY OF BACKGROUND.

THE BEACH PRESERVATION COMMISSION WAS ORIGINALLY FORMED BY RESOLUTION IN 1985 AS THE BEACH EROSION COMMITTEE AND THEN RENAMED THE BEACH PRESERVATION COMMISSION BY RESOLUTION IN JANUARY OF 2020.

IN ORDER TO PROVIDE CONSISTENCY IN THE FORMATION OF ALL BOARDS AND COMMISSIONS, STAFF IS RECOMMENDING THAT CHAPTER 2.34 BEACH PRESERVATION COMMISSION BE ADDED TO THE MUNICIPAL CODE.

THE SPECIFIC LOCATION OF THE PROPOSED SPEED LIMIT REDUCTION IS SOUTHBOUND CARLSBAD BOULEVARD FROM ROUGHLY PALOMAR AIRPORT ROAD TO ISLAND WAY.

CITY COUNCIL ADOPTED A RESOLUTION APPROVING A LANE REDUCTION ON SOUTHBOUND CARLSBAD BOULEVARD AND APPROVING THE CARLSBAD BOULEVARD RESTRIPING PROJECT.

THE PROJECT WAS COMPLETED IN MARCH OF THIS YEAR.

THE PROJECT REDUCED THE NUMBER OF SOUTHBOUND VEHICLE LANES BETWEEN SOLIMAR DRIVE AND ISLAND WAY FROM 2 TO 1.

THIS ALLOWED US TO WIDEN THE BIKE LANES AND ADD BIKE BUFFERS, AS WELL AS ADD A STRIPED SHOULDER ON THE WEST SIDE OF THE ROADWAY THAT CAN BE USED BY PEDESTRIANS. THE PROJECT ALSO ADDED GREEN PAINT TO HIGHLIGHT VEHICLE BICYCLE CONFLICT AREAS AND CREATED SPACE FOR BICYCLE PARKING AND AN ADDITIONAL 13 PARKING SPACES AT THE NORTH PONTO BEACH PARKING LOT.

HERE'S A SHORT VIDEO CLIP LOOKING NORTHBOUND FROM THE NORTH PONTO PARKING LOT AFTER PROJECT COMPLETION.

YOU CAN SEE THE ADDED BIKE LANE ENHANCEMENTS AND THE ADDITIONAL PARKING LOT SPACES THAT WE WERE ABLE TO ADD AFTER REMOVING A SOUTHBOUND VEHICLE LANE.

AFTER THE PROJECT WAS COMPLETE, STAFF CONDUCTED AN ENGINEERING AND TRAFFIC SURVEY IN ACCORDANCE WITH THE SPEED ZONE REQUIREMENTS FOUND IN THE CALIFORNIA VEHICLE CODE AND IN THE CALIFORNIA MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES.

THE 85TH PERCENTILE SPEED, OTHERWISE KNOWN AS THE CRITICAL CRITICAL SPEED, WAS FOUND TO BE 46MPH.

AFTER THE PROJECT, THE CVC AND THE CALIFORNIA MUTCD'S REQUIRES THAT SPEED LIMITS BE ESTABLISHED WITHIN FIVE MILES PER HOUR OF THE 85TH PERCENTILE SPEED.

PRIOR TO THE PROJECT, THE 85TH PERCENTILE SPEED ON THIS PORTION OF CARLSBAD BOULEVARD WAS 51MPH, WHICH CORRESPONDED TO A 50 MILE PER HOUR POSTED SPEED LIMIT. AFTER THE PROJECT, THE 85TH PERCENTILE SPEED WAS FOUND TO BE REDUCED TO 46MPH.

THIS ALLOWS US TO CONSIDER A REDUCTION OF THE SPEED LIMIT TO 45MPH.

AFTER THE ORDINANCE IS INTRODUCED AND ADOPTED, NEW SIGNS FOR THE 45MPH SPEED ZONE WILL BE INSTALLED.

A BRIEF NOTE ABOUT THE CURRENT.

CARLSBAD MUNICIPAL CODE SECTION PERTAINING TO CARLSBAD BOULEVARD.

THE CURRENT CMC LISTS THE SPEED LIMIT OF THIS PART OF CARLSBAD BOULEVARD AS 35MPH.

THE 35 MILE PER HOUR ZONE WAS TEMPORARILY ESTABLISHED IN 2008 DUE TO THE ENCINITAS CREEK BRIDGE REPAIR.

THE BRIDGE WAS RECONSTRUCTED IN 2009 AND AFTER THAT, THE 35 MILE PER HOUR SPEED LIMIT SIGNS WERE REPLACED WITH 50 MILE PER HOUR SIGNS.

BUT THE CARLSBAD MUNICIPAL CODE WAS NOT AMENDED TO REFLECT THAT CHANGE.

THIS ORDINANCE CHANGE WILL RECTIFY THIS OMISSION, AND TO REPEAT, THE RECOMMENDED ACTION IS TO INTRODUCE AN ORDINANCE TO LOWER THE SPEED LIMIT ON PART OF CARLSBAD BOULEVARD FROM 50 TO 45MPH.

A SUMMARY OF STAFF'S COMMUNITY OUTREACH EFFORTS AND PLANNING COMMISSION'S RECOMMENDATION.

THE CITYWIDE OBJECTIVE DESIGN STANDARDS PROJECT APPLIES TO ALL ELIGIBLE MULTIFAMILY HOUSING AND MIXED USE DEVELOPMENT PROJECTS WITHIN THE CITY BOUNDARIES AS HIGHLIGHTED IN GREEN. IT DOES EXCLUDE THE VILLAGE AND BOROUGH MASTERPLAN AREA AS DIRECTED BY CITY COUNCIL.

THE CITY IS PROCESSING SEPARATE STANDARDS FOR THE VILLAGE AND BARRIO AREA, WHICH STAFF WILL PRESENT UNDER THE NEXT AGENDA ITEM.

IN RESPONSE TO THE STATE'S HOUSING CRISIS.

THE STATE IS DOING ALL IT CAN TO INCREASE HOUSING PRODUCTION.

ONE WAY IS THROUGH APPROVING LEGISLATION SUCH AS SENATE BILL 35 ONE 60 SEVEN AND SB 330 THAT WOULD DECREASE HOUSING REGULATIONS WHILE PROVIDING PREDICTABILITY IN THE HOUSING DEVELOPMENT REVIEW PROCESS.

THESE REGULATIONS PRIMARILY APPLY TO CERTAIN MULTIFAMILY HOUSING AND MIXED USE DEVELOPMENT PROJECTS, WHICH WILL IMPACT THE CITY'S CURRENT REVIEW PROCESS FOR THESE TYPES OF PROJECTS. SPECIFICALLY, IT WILL BE REQUIRING LIMITED OR NO PUBLIC HEARINGS.

IT WOULD NOT ALLOW THE APPLICATION OF SUBJECTIVE STANDARDS AS THEY AS THESE STANDARDS REQUIRE.

DISCRETIONARY REVIEW DOES NOT ALLOW THE CITY TO APPLY CHANGE STANDARDS AFTER AN APPLICATION IS DEEMED COMPLETE, AND IT LIMITS THE CITY'S OPTIONS FOR DENYING ELIGIBLE PROJECTS.

THE STATE IS, HOWEVER, ALLOWING CITIES TO DEVELOP NEW, ENFORCEABLE, OBJECTIVE DESIGN STANDARDS.

THESE STANDARDS ARE NOT THE EXPEDITED REVIEW PROCESS ALLOWED UNDER STATE LAW, BUT INSTEAD ARE USED IN THESE PROCESSES THAT CITIES ARE CURRENTLY IMPLEMENTING.

THESE NEW STANDARDS WILL ENSURE THAT THE CITY COMPLIES WITH STATE REQUIREMENTS, IMPLEMENTS THE CITY'S ADOPTED HOUSING ELEMENT PROGRAM 1.11.

AND ENSURES THAT ELIGIBLE PROJECTS ARE DESIGNED IN A WAY THAT IS COMPATIBLE WITH THE EXISTING COMMUNITY CHARACTER.

SO THESE STANDARDS WILL APPLY TO ONLY CERTAIN RESIDENTIAL PROJECTS.

HIGHLIGHTED IN GREEN ARE COMMON EXAMPLES OF APPLICABLE PROJECTS, INCLUDING MULTIFAMILY HOUSING DEVELOPMENT, MIXED USE PROJECTS THAT PROPOSE AT LEAST TWO THIRDS SQUARE FOOTAGE FOR RESIDENTIAL USES AND DUPLEXES.

HIGHLIGHTED IN RED ARE COMMON EXAMPLES OF NON APPLICABLE PROJECTS WHICH INCLUDE SINGLE FAMILY HOMES, MULTIFAMILY DEVELOPMENT THAT PROPOSE A GENERAL PLAN AMENDMENT AND OFFICE COMMERCIAL INDUSTRIAL PROJECTS.

SO THE PROPOSED OBJECTIVE DESIGN STANDARDS, WHICH ADDRESS BUILDING AND SITE DESIGN, ARE PAIRED WITH EXISTING DEVELOPMENT STANDARDS SUCH AS MAXIMUM HEIGHT AND SETBACKS. ELIGIBLE PROJECTS MUST COMPLY WITH ALL APPLICABLE STANDARDS IN ORDER TO BE APPROVED.

THE PROPOSED OBJECTIVE SCIENCE STANDARD MANUAL IS A STANDALONE DOCUMENT THAT IS INCORPORATED INTO THE MUNICIPAL CODE BY REFERENCE.

THE MANUAL IS ORGANIZED INTO SIX SECTIONS AS LISTED HERE AND INCLUDE A VARIETY OF STANDARDS THAT PROVIDE CLEAR DESIGN DIRECTION THAT ENHANCES THE AREA'S UNIQUE CHARACTER AND SENSE OF PLACE.

STAFF IS ALSO RECOMMENDING EDITS TO CITY COUNCIL POLICY STATEMENT NUMBER 44 TO RETAIN OR REVISE STANDARDS FOR COMPATIBILITY PURPOSES AND RESCINDING CITY COUNCIL POLICY 66.

SINCE THESE GUIDELINES ARE ALL SUBJECTIVE AND THEREFORE CANNOT BE ENFORCED.

HOWEVER, THESE STANDARDS ARE REPLACEABLE BY THE CITYWIDE AND POLICY 44 STANDARDS.

THE PROJECT WAS PREPARED WITH CONSIDERATION FROM THE COMMUNITY INPUT GATHERED THROUGH THE PUBLIC REVIEW OF THE DRAFT ZONING ORDINANCE CHANGES AND MANUAL, AN ONLINE WEBINAR AND A MEETING WITH CERTAIN DEVELOPERS.

ALL ALL APPLICABLE PUBLIC COMMENTS RECEIVED WERE ADDRESSED THROUGH MODIFICATIONS THAT WERE LIMITED TO CLARIFICATIONS AND FORMATTING.

STAFF DO PROMOTE OPPORTUNITIES FOR THE PUBLIC TO PROVIDE INPUT ON THE CITYWIDE STANDARDS THROUGH E-NEWSLETTERS CITY'S SOCIAL MEDIA CHANNELS AND INFORMATION ON THE PROJECT WEBSITE.

ON JULY 19TH, THE PLANNING COMMISSION RECOMMENDED A UNANIMOUSLY RECOMMENDED APPROVAL OF THE CITYWIDE OBJECTIVE DESIGN STANDARDS.

THE CITY PLANNER DETERMINED THAT THE PROJECT IS EXEMPT FROM SEQUA AS THE PROJECT DOES NOT HAVE THE POSSIBILITY TO HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT.

IN CONCLUSION, THE PROJECT WILL HELP STRENGTHEN LOCAL DESIGN REGULATIONS, SINCE THE CITY CURRENTLY CANNOT ENFORCE SUBJECTIVE DESIGN GUIDELINES FOR ELIGIBLE PROJECTS.

IT WILL ENSURE PROJECT COMPATIBILITY WITH THE EXISTING COMMUNITY CHARACTER.

IT WOULD REDUCE PROJECT COSTS AND LONG REVIEW TIMELINES FOR IMPLEMENTING STANDARDS THAT PROVIDE DEVELOPERS A CLEAR DIRECTION, THEREBY CREATING A SENSE OF PREDICTABILITY.

AND LASTLY, IT WILL ENCOURAGE RESIDENTIAL CONSTRUCTION FOR BOTH AFFORDABLE AND MARKET RATE UNITS BY CREATING STANDARDS THAT ARE APPROPRIATE IN MEETING THE CITY'S AFFORDABLE HOUSING NEEDS. IT IS IMPORTANT TO NOTE THAT THE CITYWIDE STANDARDS ARE CONSIDERED A STARTING POINT TO ENSURE THAT THE CITY HAS IN PLACE NEW NEW STANDARDS IN PLACE FOR PROJECTS AS EARLY AS OCTOBER OF THIS YEAR IN COMPLIANCE WITH STATE AND LOCAL REQUIREMENTS.

THESE STANDARDS WILL BE REVIEWED REGULARLY AND UPDATED AS NECESSARY.

STAFF RECOMMENDS CITY COUNCIL INTRODUCE AN ORDINANCE AMENDING THE ZONING ORDINANCE AND ADOPT THREE RESOLUTIONS APPROVING A LOCAL COASTAL PROGRAM AMENDMENT.

CITY COUNCIL POLICY STATEMENT 44 AMENDMENT AND TO RESCIND THE CITY COUNCIL POLICY STATEMENT 66 AS PREVIOUSLY DISCUSSED.

THE THIS RANGE OF TRUE ARCHITECTURAL STYLES PROVIDES A BROAD PALETTE THAT REFLECTS THE DIVERSE, ECLECTIC CHARACTER OF THE VILLAGE AND BARRIO NEIGHBORHOODS. IT IS NOTED THAT WHILE THERE ARE SEVEN STYLES, NOT ALL SEVEN ARE WOULD BE ALLOWED IN EACH OF THE VILLAGE AND BARRIO SUB DISTRICTS. THE DEVELOPERS WILL BE LIMITED TO THE STYLE AND BUILDING TYPE COMBINATIONS THAT ARE ALLOWED IN EACH SUB DISTRICT.

THE CITY MAINTAINED A STEADY STREAM OF INFORMATION ABOUT THE DEVELOPMENT OF THE OBJECTIVE DESIGN STANDARDS AND OPPORTUNITIES FOR PUBLIC INVOLVEMENT.

THIS INCLUDES SENDING EMAIL OR E-NEWSLETTERS TO MORE THAN 16,000 INDIVIDUALS SHARING INFORMATION ON THE CITY'S SOCIAL MEDIA CHANNELS.

THE NEXT DOOR APP AND PUBLISHING INFORMATION ON THE CITY'S WEBSITE.

THE CITY COUNCIL APPOINTED THE DESIGN REVIEW COMMITTEE THAT MET FOUR TIMES WITHIN APPROXIMATE ONE YEAR TIMEFRAME TO REVIEW THE PROJECT, INCLUDING DRAFT PLANS AND INPUT FROM THE COMMUNITY.

THESE MEETINGS WERE OPEN TO THE PUBLIC AND NOTIFICATIONS OF THESE MEETINGS WERE PROVIDED THROUGH THE DIFFERENT FORMS OF MEDIA, AS JUST DISCUSSED.

AT THE LAST COMMITTEE MEETING ON MAY 25TH OF THIS YEAR, THE DESIGN REVIEW COMMITTEE RECOMMENDED THAT CITY COUNCIL APPROVE THE VILLAGE AND BARRIO OBJECTIVE DESIGN STANDARDS.

AND ON JULY 19TH, THE PLANNING COMMISSION ALSO RECOMMENDED APPROVAL OF THE VILLAGE AND BARRIO OBJECTIVE DESIGN STANDARDS.

CITY PLANNER DETERMINED THAT THE PROJECT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, SINCE THE PROJECT DOES NOT HAVE THE POSSIBILITY TO HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT.

IN CONCLUSION, THE PROJECT WILL HELP STRENGTHEN LOCAL REGULATIONS, SINCE THE CITY CURRENTLY CANNOT ENFORCE EXISTING SUBJECTIVE DESIGN GUIDELINES.

IT WILL ENSURE PROJECT COMPATIBILITY WITH THE EXISTING COMMUNITY CHARACTER BY REQUIRING ELIGIBLE PROJECTS TO BE BUILT USING AN ECLECTIC MIX OF ACCURATE ARCHITECTURAL STYLES THAT HAVE BEEN TRADITIONALLY BUILT THROUGHOUT THE VILLAGE AND BARRIO NEIGHBORHOODS.

IT WILL REDUCE PROJECT COSTS AND LONG REVIEW TIMELINES THROUGH IMPLEMENTING STANDARDS THAT PROVIDE DEVELOPERS CLEAR DIRECTION, THEREBY CREATING A SENSE OF PREDICTABILITY.

AND LASTLY, IT ENCOURAGES RESIDENTIAL CONSTRUCTION FOR BOTH AFFORDABLE AND MARKET RATE UNITS BY CREATING OBJECTIVE STANDARDS THAT ARE APPROPRIATE IN MEETING THE CITY'S AFFORDABLE HOUSING NEEDS.

IT IS ALSO IMPORTANT TO NOTE THAT THESE STANDARDS ARE CONSIDERED STANDARD STARTING POINT TO ENSURE THAT THE CITY HAS STANDARDS IN PLACE AS EARLY AS FALL OF THIS YEAR IN COMPLIANCE WITH STATE AND LOCAL REQUIREMENTS.

THESE STANDARDS WILL BE REVIEWED REGULARLY AND UPDATED AS NECESSARY.

THEREFORE, STAFF RECOMMENDS THAT CITY COUNCIL INTRODUCE AN ORDINANCE APPROVING AN AMENDMENT TO THE VILLAGE AND BORROW MASTER PLAN AND ADOPT A RESOLUTION APPROVING A LOCAL COASTAL PROGRAM AMENDMENT.

SO SB 330 IS A LAW THAT CERTAIN MULTIFAMILY AND HOUSING PROJECTS APPLY TO.

IT LIMITS DISCRETIONARY REVIEW TO SUBJECTIVE STANDARDS.

AND HOWEVER, THOSE PROJECTS WOULD STILL GO THROUGH THEIR NORMAL HEARING PROCESS WITH HEARINGS AT THE PLANNING COMMISSION AND CITY COUNCIL.

THE PLANNING COMMISSION, CITY COUNCIL WILL BE RESTRICTED BY THE OBJECTIVE STANDARDS AND LOOKING AT HEALTH AND SAFETY ISSUES WITH RESPECT TO THE PROJECT.

WE HAVE ABOUT FOUR PROJECTS IN PROCESS RIGHT NOW THAT ARE CURRENTLY SB 330 PROJECTS.

ONE OF THEM IS THE 4K APARTMENTS PROJECT, WHICH IS LOCATED OUTSIDE OF THE VILLAGE AREA.

ONE OF THEM IS THE HOPE APARTMENTS PROJECT, WHICH IS LOCATED WITHIN THE VILLAGE THAT INCLUDES THE CARL'S JUNIOR ON THE CARLSBAD VILLAGE DRIVE.

WE HAVE THE CARLSBAD VILLAGE MIXED USE PROJECT, WHICH IS THE SMART AND FINAL SHOPPING CENTER.

AND THEN WE HAD THE FPC RESIDENTIAL PROJECT IS LOCATED IN THE PONTO BEACHFRONT AREA.

YOU MENTIONED IN THE REPORT THAT DEVELOPERS COULD APPLY AND REQUEST RATHER UP TO FOUR WAIVERS.

I JUST WOULD LIKE TO PROVIDE THE PUBLIC WITH AN EXAMPLE OF WHY WHAT A WAIVER WOULD BE A DEVELOPER WOULD ASK THE CITY FOR.

THAT DIDN'T MAKE ANY SENSE AT ALL.

BUT DO YOU KNOW WHAT I MEAN? RIGHT. SO THE WAIVERS THAT ARE BUILT IN COULD BE SOMETHING SUCH AS USING A SLIGHTLY DIFFERENT BUILDING, MATERIAL CHANGING ONE OF THE SETBACKS OR SOMETHING THERE.

SO THE WAIVERS WOULD HAVE TO BE LIMITED TO ONE ITEM AS A PART OF THE DESIGN STANDARDS.

IT CAN'T BE WAIVING AN ENTIRE DESIGN STYLE.

WE WE PUT IN THE WAIVERS TO PROVIDE SOME FLEXIBILITY GIVEN THAT THERE IS GOING TO BE DIFFERENT SIZE LOTS, DIFFERENT SIZE PROJECTS AND DIFFERENT DENSITIES SO THAT THERE WOULD BE SOME FLEXIBILITY BUILT IN, BUT NOT BUT STILL HAVING THE STANDARDS.

RIGHT. WE STILL HAVE THOSE OBJECTIVE STANDARDS.

OKAY. AND THEN YOU MENTIONED IN THE REPORT THERE ARE 400, ALMOST 425 SURVEY PARTICIPANTS.

CAN YOU TELL ME WHAT'S THE MAJORITY OF RESPONSES FROM 9 TO 0 ZERO EIGHT IN THE VILLAGE? YOU KNOW, WHAT WERE THOSE NUMBERS? SO PULLING UP A BACKUP SLIDE.

BUT A MAJORITY OF THE RESPONDENTS WERE IN 92008, A LITTLE OVER 50%, WITH 228 OF THE 422 RESPONDENTS.

THE OTHER MOST OF THEM WERE FROM OTHER COMMUNITIES THAT OVERLAPPED WITHIN CARLSBAD, AND THERE WERE A FEW THAT WERE OUTSIDE OF CARLSBAD.

THE VILLAGES ARE HIGHER DENSITY THAT ARE MORE LIKELY TO HAVE MIXED USE.

THIS IS AN EXAMPLE OF ONE OF THE DISTRICTS THAT'S WITHIN THE VILLAGE, THE VILLAGE CENTER, WHICH HAS THE HIGHEST DENSITY APPLIED TO IT, BUILT INTO THE MASTER PLAN, THERE'S TABLES LIKE THIS THAT SHOW WHAT ARE THE TYPES OF BUILDINGS THAT ARE ALLOWED AND WHAT ARE THE STYLES THAT ARE ALLOWED WITHIN EACH DISTRICT.

AND SO THIS TABLE SHOWS THAT SEVERAL OF THE USES ARE ALLOWED.

BUT THE VICTORIA, VICTORIAN AND COLONIAL CAPE COD ARE NOT, BECAUSE THOSE DON'T TRANSLATE WELL INTO THE LARGER BUILDINGS THAT WE EXPECT TO SEE.

WHEREAS IN OPPOSITE OF THAT, IF YOU GO TO SLIDE, I THINK 31.

A MAJORITY OF THE COMMITTEE THOUGHT THAT THOSE WERE OPTIONS THAT DID WORK FOR CARLSBAD AND THAT THERE SHOULD BE FLEXIBILITY.

AND AS WE CONSTRUCTED AND HAD EARLY INPUT WITH THEM ON THOSE TABLES THAT I WAS SHOWING, THEY THOUGHT IT WOULD BE BETTER TO HAVE SOME FLEXIBILITY WITHIN EACH OF THE DISTRICTS GIVEN THE DIFFERENT NATURE OF EACH OF THE DISTRICTS.

SO THAT'S HOW WE ARRIVED AT GOING FROM THE FIVE TO THE SEVEN AS PART OF THIS PROCESS.

SORRY, CAN I CLARIFY ACTUALLY, SO THE DESIGN REVIEW COMMITTEE, SOME OF THE PEOPLE WHO VOTED AGAINST THE DOCUMENT DIDN'T WANT THE MODERN, TRADITIONAL, MODERN OR THE CALIFORNIA CONTEMPORARY IN THE VILLAGE CENTER.

THEY WERE OKAY WITH HAVING ALL THE STYLES, BUT JUST NOT IN THE VILLAGE CENTER.

UM, BUT I THINK THERE WAS ALSO CONCERN THAT THE EXISTING MULTI-FAMILY BUILDINGS THAT USE THESE STYLES WERE NOT DESIGNED WELL. SO I THINK WITH THESE STANDARDS WE WOULD ENSURE THAT THESE TYPE OF STYLES WOULD BE WOULD MEET THE STANDARDS REQUIRED BY THE CITY OF CARLSBAD.

AND SO WE INCLUDED ADDITIONAL DESIGN ELEMENTS INCORPORATED IN THE BASE, MIDDLE AND TOP FOR THESE TWO STYLES.

BUT WHAT HAPPENS IF THE END RESULT, THE ULTIMATE PROJECT, DOES NOT LOOK ANYWHERE AS GOOD AS WHAT WAS APPROVED? SO THE WHAT TYPICALLY HAPPENS FOR A PROJECT IS IT GOES THROUGH A DISCRETIONARY REVIEW AND THAT'S WHERE THEY GET THEIR THEIR PLANS FROM THE PLANNING COMMISSION AND CITY COUNCIL. THEN LATER ON, EITHER THEMSELVES OR ANOTHER PROPERTY OWNER WOULD SUBMIT THROUGH THEIR BUILDING PERMITS.

WITH THAT BUILDING PERMIT, WE DO A PLAN CHECK AND COMPARE IT TO THE ORIGINAL APPROVED ENTITLEMENTS.

AND IF THEY ARE NOT CONSISTENT, WE ASK THEM TO CHANGE IT.

NOW WHAT WE DO HAVE IS A PROCESS THAT HAS BEEN USED ON SOME PROJECTS, WHICH IS CALLED A CONSISTENCY DETERMINATION PROCESS.

AND THAT LOOK HAS A SERIES OF TEN FINDINGS THAT NEED TO BE MADE AND COMPARE IT TO HAS IT BEEN SUBSTANTIALLY DIFFERENT FROM WHAT HAS APPLIED? AND WE ARE AWARE OF THE CRITICISM AND WE GOT COMMENTS RELATED TO THE COMMUNITY ABOUT SOME PROJECTS THAT WENT THROUGH THAT CONSISTENCY, DETERMINATION PROCESS.

THE FIRST WILL BE A FISCAL YEAR 22-23 INTERNAL AUDIT UPDATE AN UPDATE OF ACTIVITIES SINCE OUR LAST PRESENTED TO YOU IN FEBRUARY OF THIS YEAR.

THE SECOND ITEM I'LL PROPOSE THE FISCAL YEAR 23-24 INTERNAL AUDIT PLAN.

THIS EVENING. THE PROPOSED ACTION IS TO ADOPT A RESOLUTION APPROVING THE FISCAL YEAR 23-24 INTERNAL AUDIT PLAN.

AND BEFORE I GET INTO THE DETAILS OF THE AUDIT PLAN, I'D FIRST LIKE TO PROVIDE YOU WITH THAT INTERNAL AUDIT UPDATE THAT I REFERENCED SINCE THE LAST TIME PRESENTING TO YOU IN FEBRUARY OF THIS YEAR.

WE'VE HAD TWO INTERNAL AUDIT ENGAGEMENTS THAT HAVE COMPLETED.

THE FIRST OF WHICH IS THE VICE NARCOTICS INVESTIGATIVE UNIT BY FUND REVIEW.

AND TO GIVE YOU A LITTLE BACKGROUND, THE BY FUND IS ESSENTIALLY THE PETTY CASH OR THE CASH FUND THAT THE INVESTIGATIVE UNIT USES FOR THEIR OPERATIONS, FOR THEIR UNDERCOVER OPERATIONS, WORKING WITH CONFIDENTIAL INFORMANTS AND THE LIKE.

SO THAT'S WHAT THAT BUY FUND IS.

THE NEXT ENGAGEMENT THAT WAS COMPLETED IS THE TRANSIENT OCCUPANCY TAX REVIEW ENGAGEMENT.

SO THOSE ARE THE TWO ITEMS THAT I'LL GO INTO A LITTLE BIT MORE DETAIL FOR YOU HERE.

FIRST IS THE BY FUND REVIEW.

AS I MENTIONED, THE BY FUND REVIEW IS A CASH FUND UTILIZED BY THE NARCOTICS OR THE NARCOTICS INVESTIGATIVE UNIT.

IT'S A $10,000 ANNUAL FUND, WHICH IS A LARGE CASH COUNT, A LARGE CASH BALANCE FOR A CITY.

AND SO ONE OF OUR PROCEDURES WAS TO PERFORM A CASH COUNT.

WE PERFORMED A CASH COUNT TO VERIFY SIMPLY THAT THE ACCURATE THEY KEEPING ACCURATE RECORDS.

THE RECORDS ON HAND TIED TO THE BALANCE ON HAND AND EVERYTHING CHECKED OUT TO THE PENNY.

SO EVERYTHING WAS WELL DOCUMENTED AND THE CASH COUNT.

WE ALSO PERFORMED AN EVALUATION OF THE PROGRAM'S INTERNAL CONTROLS.

AND WHAT THIS WAS COMPRISED OF WAS EVALUATING THE POLICIES AND PROCEDURES THAT ARE ASSOCIATED WITH THE PROGRAM THROUGHOUT THE CITY.

AND SO THERE'S THREE ESSENTIAL POLICIES THAT APPLY TO THE PROGRAM.

THERE'S POLICE DEPARTMENT POLICY, 607 AND 608, WHICH ESSENTIALLY GIVE THE POLICE DEPARTMENT'S INVESTIGATIVE UNIT A FRAMEWORK FOR HOW THEY ARE TO WORK WITH INFORMANTS, UTILIZE THEIR FUNDS, REPORT THEIR ACTIVITIES.

SO IT JUST GIVES A REAL BROAD FRAMEWORK OF HOW OF FRAMEWORK WITHIN WHICH TO OPERATE.

THE OTHER PROCEDURE THAT'S RELEVANT IS ADMINISTRATIVE ORDER NUMBER 85, WHICH IS THE CITY'S CASH FUND POLICY.

IT PROVIDES A FAIRLY BROAD CASH HANDLING STANDARDS FOR THE CITY TO FOLLOW.

SO, YEAH, SO THOSE ARE THE THREE POLICIES THAT WE REVIEWED AND EVALUATING THE INTERNAL CONTROLS OF THE PROGRAM.

AS A RESULT, THERE ARE FOUR INTERNAL AUDIT RECOMMENDATIONS THAT WERE RECOMMENDED.

I DO WANT TO NOTE THAT THROUGH THE PROCEDURES THAT I JUST REFERENCED, THE FINDINGS, EVEN THOUGH THERE'S FOUR AUDIT RECOMMENDATIONS, THE FINDINGS THROUGH THIS PROCESS FOUND THAT THE UNIT MAINTAINED ACCURATE RECORDS, FOLLOWED THE FRAMEWORK THAT THEY HAD AVAILABLE TO THEM, WHICH IS POLICY 607 608.

AND SO THEIR ATTENTION TO DETAIL AND PROCEDURES THAT THEY FOLLOWED WERE ALL WELL DONE.

WITH THAT SAID, WE DID RECOMMEND FOR INTERNAL AUDIT RECOMMENDATIONS FOR MANAGEMENT TO CONSIDER SIMPLY TO STRENGTHEN INTERNAL CONTROLS FOR THE CITY.

IT'S A $10,000 BY FUND, WHICH IS SIGNIFICANT.

SO THE FIRST RECOMMENDATION IS SIMPLY FOR THE UNIT TO IDENTIFY A SECOND APPROVER.

AT THE TIME OF THE REVIEW, IT WAS NOTED THAT THE NARCOTICS UNIT'S SUPERVISOR WAS RESPONSIBLE FOR OVERSEEING THE DISBURSEMENT OF CASH, THE SECURING OF CASH, AND ALSO ESSENTIALLY APPROVING PRE DISTRIBUTION WOULD APPROVE THE TRANSACTIONS AND THEN ON A MONTHLY BASIS THERE WOULD BE A REVIEW OF THAT ACTIVITY. SO THERE WAS A REVIEW MECHANISM.

HOWEVER, WE THE RECOMMENDATION IS THAT THEY HAVE A SECOND APPROVER IN PLACE THAT WOULD APPROVE THOSE TRANSACTIONS PRIOR TO THEM TAKING PLACE AS MUCH AS THEY CAN.

THEY HAVE OPERATIONS IN THE FIELD THAT ARE THAT ARE SOMEWHAT FLUID AND SO THEY CAN'T ALWAYS PRE-APPROVE TRANSACTIONS.

BUT HAVING A SECOND APPROVER JUST AS A STANDARD WILL STRENGTHEN, STRENGTHEN THE CONTROLS AND A RELATED RECOMMENDATION ALONG WITH THAT IS FOR THOSE SAME INDIVIDUALS, THE SUPERVISOR FOR THAT UNIT.

AND THEN ALSO THE SECOND APPROVER IS FOR THEM TO TAKE ANNUAL CASH HANDLING TRAINING.

AND THAT'S SIMPLY A STANDARD ACROSS THE CITY.

ANYBODY THAT HANDLES CASH OR OVERSEES CASH IS REQUIRED TO TAKE THIS TRAINING.

THE NEXT RECOMMENDATION. THE THIRD RECOMMENDATION IS FOR FINANCE, FOR THE FINANCE DEPARTMENT TO EVALUATE AND UPDATE CASH REPLENISHMENT PROCESS.

WE FOUND THAT THE CASH REPLENISHMENT PROCESS CONSISTED OF THE FINANCE DEPARTMENT ISSUING A PETTY CASH CHECK TO THE UNIT AND THEY WOULD MEET THE

UNIT AT THE BANK.

THEY WOULD DEPOSIT THE OR THEY WOULD CASH THE CHECK WITH THE BANK.

THE BANK WOULD HANDLE THE CASH TO THE OFFICER AND THE OFFICER WOULD TAKE THE CASH BACK TO THE CITY.

AND SO VERY SECURE CASH.

IT'S BEING TRANSPORTED BY, YOU KNOW, POLICE PERSONNEL ACROSS TO THE CITY, BACK TO THE SAFE WHERE IT'S LOCKED.

HOWEVER, THERE ARE ARMORED TRANSPORT SERVICES THAT CAN DELIVER THE CASH DIRECTLY TO THE POLICE HEADQUARTERS.

SO OUR RECOMMENDATION IS FOR FINANCE TO MAKE AN EVALUATION OF WHETHER THAT'S FEASIBLE AND FINANCIALLY, YOU KNOW, AN EXPENSE THAT WE CAN INCUR.

AND IT'S REASONABLE. AND THEN THE FOURTH AND FINAL RECOMMENDATION IS SIMPLY TO PUBLISH CASH HANDLING PROCEDURES FOR THE UNIT TO FOLLOW.

AS I MENTIONED, THERE'S A FRAMEWORK IN THOSE POLICIES THAT I REFERENCED EARLIER, BUT THEY REALLY PROVIDE A VERY BROAD GUIDELINE SET OF GUIDELINES.

SO I'M RECOMMENDING THAT THE FINANCE DEPARTMENT WORK WITH THE NARCOTICS UNIT TO BASICALLY PUT TOGETHER DETAILED PROCEDURES ON HOW THEY ARE TO MANAGE THE CASH IN THEIR UNIT. A SECOND ENGAGEMENT THAT I REFERENCED IS THE TRANSIENT OCCUPANCY TAX REVIEW AND THE PROCEDURES INVOLVED IN THIS REVIEW. THIS REVIEW CONSISTS OF THE CITY SELECTING ANYWHERE FROM 6 TO 12 HOTELS ON AN ANNUAL BASIS.

WE ENGAGE A LOCAL CPA FIRM, AND THAT LOCAL CPA FIRM WILL REVIEW THE TRANSIENT OCCUPANCY TAX AND THE BUSINESS IMPROVEMENT DISTRICT RECORDS OF EACH OF THOSE HOTELS. AND THEY GO THROUGH A VERY PRESCRIBED SET OF PROCEDURES AND REVIEW THE HOTEL'S RECORDS TO ENSURE THAT THEY'RE COMPLIANT WITH THE CITY'S REQUIREMENTS FOR REMITTING AND REPORTING THEIR TOTS AND THEIR BUSINESS IMPROVEMENT DISTRICT ASSESSMENTS.

AS A RESULT OF THIS ENGAGEMENT AND REVIEWING THE 11 THE 11 HOTELS, WE IDENTIFIED $159,000 WORTH OF UNDERPAID TOTS, PENALTIES AND INTEREST.

SO THAT'S THAT'S THE $159,000 IS IS ALL THOSE ITEMS. GROSSED UP. AND SO.

IN ADDITION TO THE UNDERPAYMENTS IDENTIFIED, WE ALSO IDENTIFIED AND IMPROVED UPON ON THE SPOT DURING THE ENGAGEMENT SEVERAL PROCEDURES THAT THE REVENUE OFFICE HAS OR THE REVENUE DEPARTMENT HAS FOR RECEIVING AND REVIEWING REMITTANCES FROM THE HOTELS.

SO WE'VE ALREADY MADE ON THE SPOT ADJUSTMENTS TO THE PROCEDURE TO FIRM UP THEIR PRACTICES.

AND LASTLY, WE IDENTIFIED A NUMBER OF IMPROVEMENTS TO MAKE TO THE ORDINANCE PERTAINING TO OUR TOT PROGRAM.

AND THOSE IMPROVEMENTS ARE BEING PUT IN PLACE AND WILL BE BROUGHT FORWARD TO THE CITY COUNCIL BEFORE THE END OF THE CALENDAR YEAR.

SOME OF THE IMPROVEMENTS IN THERE IS ESSENTIALLY TO GIVE THE CITY, GIVE THE ORDINANCE GREATER A LITTLE GREATER DETAIL, TO GIVE THE CITY BETTER LANGUAGE FOR THE HOTELS SO THE HOTELS CAN UNDERSTAND BETTER THE ORDINANCE AND ALSO GIVE US A BETTER WAY OF COMMUNICATING THE REQUIREMENTS AND ALSO OBTAINING RECORDS AND CONDUCTING THIS REVIEW THAT I'M THAT I'M REPORTING REPORTING ON HERE.

SO TO GIVE YOU A LITTLE SNAPSHOT OF THE FINDINGS FROM THE TOT REVIEW.

OF THE $159,000 OF UNDERPAYMENTS, YOU CAN SEE THAT ROUGHLY $21,000 WERE ASSOCIATED WITH TOT REMITTANCES AND $85,000 WAS ASSOCIATED WITH THE BID ASSESSMENTS.

THAT'S THE CARLSBAD TOURISM BUSINESS IMPROVEMENT DISTRICT ASSESSMENTS.

AND THEN ABOUT $52,000 WAS ASSOCIATED WITH PENALTIES AND INTEREST FROM THOSE FINDINGS.

AND THE LAST ITEM I'D LIKE TO JUST PRESENT TO YOU BRIEFLY HERE IS THE FISCAL YEAR 2324 INTERNAL AUDIT PLAN.

THIS CONSISTS OF FIVE DISTINCT ENGAGEMENTS.

THE FIRST OF WHICH IS A TRANSIENT OCCUPANCY TAX ENGAGEMENT LIKE I JUST TALKED ABOUT.

I TRUST OUR POLICE OFFICERS AND I THINK THEY'RE GOOD.

AND THERE'S AN OPTION UNDER RECOMMENDATION FORM THAT SAYS IF ARMORED TRANSPORT IS NOT UTILIZED, I WONDER WHAT THAT WOULD COST UNLESS IT'S JUST IN THEIR RUN AND IT DOESN'T COST US ANY EXTRA MONEY. BUT I MEAN, I THINK THEY NEED THIS CASH SOMETIMES AND YOU CAN'T ORDER THE TRUCK UP TO GET IT OR IT'S NOT ON THE DELIVERY SITE. IT SAYS IT'S RECOMMENDED THAT AP SECURE THE PETTY CASH CHECK UNTIL JUST PRIOR TO THE FINANCE DEPARTMENT STAFF MEETING THE NEW SUPERVISOR AT THE BANK. THIS WILL ALSO SERVE TO REDUCE THE RISK.

THE CHECK IS UNSECURED FOR PERIODS OF TIME PRIOR TO BEING CASHED AT THE BANK.

ITEM NUMBER EIGHT IS CITY COUNCIL POLICY STATEMENT ON CITY COUNCIL PROCLAMATIONS, CERTIFICATES OF RECOGNITION AND CONGRATULATORY LETTERS MAKING.

OUR PRESENTATION TODAY IS OUR LEGISLATIVE AND CONSTITUENT SERVICES DIRECTOR, SHEILA COBIAN.

I'M SORRY. THE ITEM BEFORE YOU THIS EVENING IS TO CONSIDER APPROVING A COUNCIL POLICY REGARDING CITY COUNCIL PROCLAMATIONS, CERTIFICATES OF RECOGNITION, AND CONGRATULATORY LETTERS.

ON JUNE 1ST, STAFF REQUESTED THAT COUNCIL PROVIDE FEEDBACK ON ANY DESIRED CHANGES TO CARLSBAD MUNICIPAL CODE.

CHAPTER 1.20 MEETINGS.

COUNCIL VOTED UNANIMOUSLY TO HAVE STAFF RETURN WITH AN ITEM TO DISCUSS HOW PROCLAMATIONS ARE PRESENTED.

FOLLOWING THAT DIRECTION, STAFF BEGAN BY SURVEYING THE OTHER CITIES IN SAN DIEGO COUNTY AND FOUND THAT LESS THAN HALF THE CITIES HAVE A WRITTEN POLICY IN PLACE REGARDING PROCLAMATION PRESENTATIONS.

BASED ON CITY COUNCIL'S FEEDBACK AT THE JUNE 1ST MEETING, STAFF ARE RECOMMENDING THE FOLLOWING REQUEST FOR CITY COUNCIL PROCLAMATIONS WILL BE PROCESSED BY THE CITY MANAGER AND REQUIRE THE MAYOR'S APPROVAL REQUESTS MUST BE MADE BY CITY OF CARLSBAD RESIDENT COUNCIL MEMBER OR EMPLOYEE.

REQUESTS SHOULD BE MADE AT LEAST 30 DAYS BEFORE THE DATE.

THE PROCLAMATION IS NEEDED AND SHOULD BE IN WRITING AND INCLUDE THE FOLLOWING A CONTACT PERSON'S NAME, PHONE NUMBER AND ADDRESS A BRIEF SUMMARY OF THE EVENT OR ORGANIZATION, A SPECIFIC NAME AND DATE FOR THE DAY, WEEK OR MONTH OR EVENT TO BE PROCLAIMED THE EXACT DATE THE PROCLAMATION IS NEEDED.

A DRAFT TEXT OF THE PROCLAMATION, INCLUDING 4 TO 5, WHEREAS CLAUSES THAT PROVIDE THE BASIC FACTS THAT AND REASONS JUSTIFYING THE PROCLAMATION.

FOR PRESENTATIONS OF THE PROCLAMATION STAFF IS PROPOSING THAT THE CITY COUNCIL HOLD A CEREMONIAL GATHERING EACH MONTH FOR THE PURPOSE OF PRESENTING PROCLAMATIONS.

THE CITY CLERK WOULD ESTABLISH A SCHEDULE FOR THESE GATHERINGS TO BE APPROVED BY THE CITY COUNCIL WHEN THE REGULAR CITY COUNCIL MEETING CALENDAR IS ESTABLISHED EACH YEAR, THE MAYOR, IN CONSULTATION WITH THE CITY MANAGER AND THE CITY CLERK, WOULD DETERMINE WHICH PROCLAMATIONS WILL BE PRESENTED AT THE GATHERINGS.

ALL OTHER PROCLAMATIONS WILL BE MAILED TO THE RECIPIENT OR MADE AVAILABLE FOR PICKUP AT CITY HALL.

AT THE CEREMONIAL GATHERING, THE MAYOR OR A CITY COUNCIL MEMBER WILL PRESENT THE PROCLAMATION TO THE INDIVIDUAL OR REPRESENTATIVES OF AN ORGANIZATION OR GROUP RECEIVING THE PROCLAMATION.

IF THE CRITERIA FOR A PROCLAMATION ARE NOT MET, THE MAYOR MAY ISSUE A CERTIFICATE OF RECOGNITION OR A CONGRATULATORY LETTER TO AN ORGANIZATION OR INDIVIDUAL TO RECOGNIZE AN ACHIEVEMENT OR SIGNIFICANT CONTRIBUTION TO THE COMMUNITY.

JUST HAPPENED ABOUT A WEEK AGO.

AGAIN, IN ADDITION, THERE IS ALREADY A PARKING PROBLEM ON THE STREET.

AND AS THE ADOPTIVE FATHER OF A GIRL WITH SPINA BIFIDA AND CEREBRAL PALSY, PARKING IS ALREADY EXTREMELY DIFFICULT.

I HAVE APARTMENT NEIGHBORS TELLING ME THAT I SHOULD NOT PARK IN FRONT OF MY OWN HOUSE, AND JOHN'S ALREADY SPELLED OUT THE STORM DRAIN ISSUE ALREADY.
