ALL RIGHT. I'M REPRESENTING YOUR CARLSBAD SISTER CITY AMBASSADORS, AND LAST YEAR IN 2023, WE COMMEMORATED 35 YEARS OF OUR SISTER CITY RELATIONSHIP WITH FUTTSU IN JAPAN.

AMONGST THE FESTIVITIES, WE HAD A GROUP OF OUR STUDENTS WHO WENT THERE.

THEY SLEPT IN ON THE FLOORS AND THE FAMILIES.

THEY ATE THE FOOD. THEY MET THE KIDS WENT TO THE SCHOOLS, AND THEN IN AUGUST, THEY SENT A DELEGATION OF STUDENTS HERE.

AND AMONGST THE THINGS THAT WE DID, BESIDES ALSO GIVING THEM HOMESTAYS AND A MARVELOUS FESTIVE RECEPTION IN WHICH OUR MAYOR, MAYOR PRO TEM BHAT-PATEL, REPRESENTED THE CITY SO BEAUTIFULLY WITH A NICE DECORATION.

THEN IT WAS TOPPED OFF THE NEXT DAY WHEN LEGOLAND OPENED ITS DOORS FOR FREE TO ALL OF THE STUDENTS TO ASSEMBLE.

THIS LED BY CARLSBAD'S OWN LEAD BRICKLAYER, OUR MAYOR.

SO, WE WANTED TO MAKE THIS PRESENTATION TONIGHT.

I'M HERE BECAUSE I WAS AT THE JANUARY 30TH, CITY COUNCIL MEETING, AND I WAS JUST THERE FOR KIND OF GENERAL INTEREST, AND THIS THING POPPED UP WITH THE HOUSING ELEMENT REZONING PROGRAM, AND THERE WAS OBVIOUSLY A LOT OF WORK AND DISCUSSION THAT WENT INTO IT.

YOU KNOW, PROVING I THINK IT WAS 15 OR 16 OF THE PROPOSED 18 SITES FOR RESIDENTIAL DEVELOPMENT.

AND I KNOW THAT A COUPLE OF THE SITES WERE REMOVED.

ONE WAS SITE EIGHT BECAUSE OF SEVERAL DEVELOPMENTS GOING ON SIMULTANEOUSLY THAT WEREN'T TAKEN INTO ACCOUNT.

MY CONCERN IS WITH SITES TEN AND 11.

I'M NOT SURE IF I MENTIONED I LIVE IN BRESSI RANCH FOR THE LAST 12 YEARS AND WAS NEVER MADE AWARE OR WASN'T AWARE OF THE PROPOSED SITES, AND THEY ARE BOTH WITHIN A THIRD OF A MILE OF EACH OTHER, AND IN BETWEEN IS KENSINGTON SQUARE.

AND IF YOU'RE FAMILIAR WITH THE AREA, THERE'S, A SPROUTS AND THEN, YOU KNOW, THE KENSINGTON TOWNHOMES THAT WERE JUST BUILT IN 2020 OR 2021. SO, MY CONCERN IS, I'M NOT CERTAIN THAT ANY, ANY STUDIES WOULD HAVE INCLUDED KENSINGTON.

AND IF THE STUDIES MADE THE ASSUMPTION THAT BOTH SITES TEN AND 11 WOULD BE APPROVED SIMULTANEOUSLY AND BOTH GO ONLINE IN ADDITION TO KENSINGTON.

SO, YOU KNOW, MY CONCERN IS, AROUND THE CONGESTION IN THAT AREA.

I MEAN, FARRADAY'S REALLY THE ONLY INLET TO ALL OF THE SHOPPING THERE AND THE, THE RESIDENTIAL UNITS.

SO, I JUST WANTED TO GET THIS ON EVERYONE'S RADAR BEFORE IT GOT TOO FAR DOWN THE PATH, BECAUSE I ALSO REMEMBER BEING THERE AND HEARING A CORPORATE GENTLEMAN, PIPE UP ABOUT SITE TEN AND SAID SOMETHING TO THE EFFECT OF, YOU KNOW, I LOOK FORWARD TO WORKING WITH CITY COUNCIL ON DEVELOPMENT OF SITE TEN.

AND SO, I DON'T KNOW IF ANYTHING'S BEEN PROPOSED YET, BUT I KNOW THAT SOMETHING MUST BE IN THE WORKS.

SO, JUST WANTED TO BRING THAT TO EVERYONE'S ATTENTION.

USUALLY, I COME PREPARED TO THESE THINGS WITH A LOT OF WRITTEN, LANGUAGE HERE, BUT THIS TIME I'M GOING TO SPEAK FROM THE HEART.

I WANTED TO TALK ABOUT THE HOUSING ELEMENT AND THE WONDERFUL JOB THAT OUR PLANNER, OUR SENIOR PLANNER, SCOTT DONALD, DID IN THE ACTUAL WORK THAT IS INVOLVED.

AND THE PUBLIC OUTREACH THAT HE DID WAS PHENOMENAL.

AND I'VE BEEN THROUGH AND STUDIED OTHER, HOUSING ELEMENTS THAT WE'VE DONE.

AND, FOR EXAMPLE, MARSHA AKERS WAS NEVER MADE TO THE PUBLIC BACK IN THE DAY.

AND THAT'S THE ONE I REALLY STUDIED.

BUT THIS TIME THE OUTREACH WAS SO PHENOMENAL, AND HE DID SUCH A GOOD JOB.

AND I KNOW IT'S SUCH A HARD, HARD THING TO DO THAT I HOPE THERE IS SOME WAY TO RECOGNIZE HIM FOR THE WORK HE DID ON THIS, ON THIS, HUGE PROJECT, IN GETTING OUR HOUSING ELEMENT DONE AND JUST FOR THE PUBLIC, I WANTED TO MAKE THIS ALL PUBLIC BECAUSE FOR THOSE THAT DON'T KNOW, IF WE DON'T HAVE A A HOUSING ELEMENT AS MUCH AS SOME PEOPLE DON'T LIKE HIGH DENSITIES IN THEIR OWN PARTICULAR BACKYARDS, WHICH I'M ONE OF THOSE.

BUT, THE FACT THAT HE, HE OPENED THIS UP TO THE PUBLIC, AND, AND WE HAD A LOT OF COMMUNICATION INVOLVED.

I'M JUST I JUST WANT TO CONGRATULATE HIM FOR SUCH A GREAT JOB THAT HE DID.

AND I HOPE THE COUNCIL RECOGNIZES HIM AS WELL.

BECAUSE IF WE DIDN'T HAVE A HOUSING ELEMENT, THE DEVELOPER CAN REALLY COME IN AND DO WHATEVER THEY WANT, AND WE WOULDN'T LIKE THAT.

ACTUALLY, THE ONES I NEED TO ADDRESS ARE ITEM NUMBER FOUR AND NUMBER SIX.

SO, ON ITEM NUMBER FOUR, THE COUNCIL WAS BEING ASKED TO TAKE THREE ACTIONS.

THE FIRST TWO WERE TO ADOPT OR TO ADOPT RESOLUTIONS, APPROVING PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS.

THE THIRD REQUEST WAS FOR THE COUNCIL TO ADOPT A RESOLUTION AUTHORIZING THE EXECUTIVE MANAGER OF THE CARLSBAD MUNICIPAL WATER DISTRICT TO EXECUTE A LICENSE AGREEMENT WITH NCTD. THAT THIRD ITEM DOES REQUIRE ADDITIONAL LEGAL REVIEW, AND SO THAT ITEM WOULD BE RETURNED TO STAFF.

AND SO TONIGHT, AS PART OF THE CONSENT CALENDAR, WE'RE ONLY ASKING THE COUNCIL TO TAKE ACTION ON THE FIRST TWO, THE ADOPTIONS OF PLANS AND SPECIFICATIONS.

AND THEN THIS THE LAST CHANGE FOR ITEM SIX.

THIS IS JUST A CLERICAL CHANGE.

BOTH THE STAFF REPORT AND THE RESOLUTION REFER TO THE SIZE OF THE PIPE THAT IS BEING CHANGED OUT AS BEING AN 18-INCH PIPE, AND THE ACTUAL SIZE IS A 24-INCH PIPE, AND THAT WILL BE CORRECTED IN THE RESOLUTION IF THE COUNCIL ADOPTS IT.

I BELIEVE THEY HAVE DONE SIMILAR WORK FOR US IN THE PAST.

AND, IT MIGHT BE A SILLY QUESTION, BUT I FIGURE IF I DON'T ASK, THEN I'M NOT GOING TO KNOW.

SO, YOU KNOW, 350,000 IS PRETTY SIZABLE NUMBER TO ME.

AND I GUESS MY INITIAL THOUGHT IS, WHAT'S BEEN DONE TO GIVE THIS REALLY THE SNIFF TEST IN TERMS OF WHAT'S THEIR OUTPUT, WHAT'S THE SCOPE OF WORK, HOW MANY HOURS, AND WHAT'S OUR EFFECTIVE COST PER HOUR TO GENERATE THAT.

THE ONE THING THAT DID CONCERN ME A BIT WAS, I BELIEVE IT WAS IN ON PAGE 48 OF TONIGHT'S DETAIL AGENDA.

THERE WAS A CONFLICT OF INTEREST NOTED SPECIFICALLY WITH RAJEEV BHATIA, WHO HAD FILED A CONFLICT-OF-INTEREST STATEMENT.

SO, I REALLY WOULD LIKE TO KNOW THE SPECIFICS ABOUT THAT CONFLICT OF INTEREST.

AND, YOU KNOW, IT MIGHT BE SOMETHING, YOU KNOW, VERY MINOR, BUT IT MIGHT BE THAT THEY HAVE PROPERTY INVESTMENTS.

AND NOW WE'RE ASKING THEM TO DEVELOP AND IMPLEMENT A PLAN ABOUT OUR HOUSING ELEMENT PROGRAM.

SO, I DON'T KNOW WHAT THE ANSWER IS, BUT THAT'S WHY I'M ASKING THE QUESTIONS.

SO, REGARDING THE CONTRACT, SO THE CONTRACT IS BEING IS ACTUALLY COVERING A SEVERAL DIFFERENT PROGRAMS. IT'S NOT JUST ONE PROGRAM.

THERE ARE UPWARDS OF FOUR DIFFERENT PROGRAMS THAT ARE IN THE HOUSING ELEMENT THAT THE CONSULTANT IS GOING TO ASSIST US IN DEVELOPING, TASKS AND ACTIONS, ACTION ITEMS RELATED TO THOSE IN COMPLIANCE WITH STATE LAW.

REGARDING THE CONFLICT OF INTEREST, I DON'T KNOW WHAT THE SPECIFICS IS, BUT IT IS GOING TO LIMIT THAT INDIVIDUAL'S ABILITY TO INVOLVEMENT INTO THE CONTRACT.

IT'S A REQUIREMENT OF THE OF THE OF THE CONTRACT.

AND THEN ALSO REGARDING THE COMMENT OR CONCERN REGARDING OUR, THE COST BENEFIT THAT WE DID GO THROUGH A RIGOROUS REQUEST FOR PROPOSAL, THERE WERE APPLICANTS THAT WENT THROUGH, WE WERE REVIEWED THOSE, AND THIS WAS A CONSULTANT THAT, THAT WAS SELECTED ABOVE ALL THE OTHERS BASED ON THEIR EXPERIENCE AND THEIR COST.

MAYOR, MAY I ADD TO THE CONFLICT-OF-INTEREST COMMENT? SURE. OUR CONTRACTS REQUIRE CERTAIN CONTRACTORS TO BE SUBJECT TO THE SAME FILING REQUIREMENTS THAT YOU ALL ARE REQUIRED WHERE THEY HAVE TO FILE FORM 700.

SO, THIS PARTICULAR PIECE OF THE CONTRACT IS NOT IDENTIFYING A CONFLICT.

ON ITEM IN THE HOUSING ELEMENT, WHICH IS UPDATING THE MINOR HOME REPAIR PROGRAM.

AND WITH ME PRESENTING TONIGHT IS AARON PEEK, PROGRAM MANAGER AND HOUSING AND HOMELESS SERVICES.

SO, I'LL TURN IT OVER TO ERIN, TO MISS PEEK TO TALK ABOUT THE EXISTING PROGRAM AS WELL AS THE RECOMMENDED CHANGES.

GOOD EVENING. IN TONIGHT'S PRESENTATION, I'LL START WITH A SHORT BACKGROUND ON THE HOUSING ELEMENT, REVIEW THE CITY'S MINOR HOME REPAIR PROGRAM, AND THEN SHARE OUR RECOMMENDED UPDATES TO THE PROGRAM.

THE CITY'S CURRENT ELEMENT WAS APPROVED BY THE CITY COUNCIL AND THE STATE OF CALIFORNIA HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT IN 2021, WHICH IS FOR YEARS 2021-2029. THE HOUSING ELEMENT PROVIDES AN OUTLINE OF HOW THE CITY WILL MEET ITS ANTICIPATED HOUSING NEEDS THROUGH A NUMBER OF PROGRAMS AND OBJECTIVES.

ONE SUCH PROGRAM IS 3.5 REHABILITATION OF OWNER-OCCUPIED HOUSING, WHICH STATES THAT THE MINOR HOME REPAIR PROGRAM WILL BE UPDATED TO EXPAND ELIGIBLE COSTS AND INCREASE MAXIMUM LOAN LIMIT AMOUNTS.

THE QUANTIFIED OBJECTIVE WAS TO ASSIST UP TO FIVE LOW-INCOME HOUSEHOLDS PER YEAR WITH HOME IMPROVEMENT LOANS OVER THE PLANNING PERIOD.

THIS WOULD PROVIDE ASSISTANCE TO 40 HOUSEHOLDS.

ASSIST LOW-INCOME SENIORS TO AGE IN PLACE OR PERSONS WITH DISABILITIES TO REMAIN IN THEIR HOME AND IN ENHANCE THE SECURITY OF THE HOME THROUGH THE AWARDING OF LOANS. THE PROGRAM PROVIDES FORGIVABLE LOANS UP TO $5,000 TO LOW-INCOME HOMEOWNERS OF ELIGIBLE HOME REPAIRS.

THE LOAN IS PROVIDED AT 0% INTEREST AND FORGIVABLE AFTER FIVE YEARS OF OCCUPANCY.

ELIGIBLE PROPERTIES INCLUDE SINGLE FAMILY HOMES AND MOBILE HOMES IN WHICH THE LAND IS ALSO OWNED, AND ELIGIBLE.

REPAIRS INCLUDING BASIC PLUMBING, CARPENTRY, ELECTRICAL AND ACCESSIBILITY.

SINCE 2008, 13 HOMEOWNERS HAVE BEEN ASSISTED.

THIS PROGRAM HAS NOT BEEN REVISED IN OVER 15 YEARS, ALTHOUGH 13 HOMEOWNERS HAVE RECEIVED LOANS SINCE 2008, ONLY TWO LOANS HAVE BEEN ISSUED IN THE LAST FIVE YEARS.

ANALYSIS OF THE CURRENT PROGRAM SHOWS THE MAXIMUM DOLLAR AMOUNT MAY LIMIT THE VIABILITY OF THIS PROGRAM.

THE COST FOR HOME IMPROVEMENT PROJECTS HAVE EXPERIENCED SIGNIFICANT INCREASES SINCE THE PROGRAM'S INCEPTION.

NORMALLY, INFLATION CAN INCREASE CONSTRUCTION COSTS BY ABOUT 3 TO 7% ANNUALLY.

THE US BUREAU OF LABOR STATISTICS REPORTS CONSTRUCTION COST INCREASES FOR BOTH LABOR AND MATERIALS HAVE GONE UP BY DOUBLE DIGIT PERCENTAGES EACH YEAR SINCE 2019. BASED ON THE INCREASE IN LABOR AND MATERIAL COSTS SINCE 2008, THE CURRENT LOAN LIMIT OF $5,000 IS NOT SUFFICIENT TO COVER MOST IMPROVEMENTS. ADDITIONALLY, THE CITY'S CLIMATE ACTION PLAN CALLS FOR THE PROMOTION OF INCREASED ENERGY EFFICIENCY IN HOMES.

ADDING TO THIS LIST OF ELIGIBLE ACTIVITIES BENEFITS THE ENVIRONMENT AS WELL AS UTILITY COSTS FOR LOW-INCOME HOMEOWNERS.

STAFF RESEARCHED SIMILAR PROJECTS AMONG LOCAL JURISDICTIONS.

IN THE REGION AND HAVE MADE THE FOLLOWING RECOMMENDATIONS FOR SINGLE FAMILY HOMES.

STAFF PROPOSED THE MAXIMUM LOAN TO BE INCREASED TO 25,000, WITH A 3% SIMPLE INTEREST DUE AND PAYABLE UPON SALE, TRANSFER OR DEFAULT. FOR MOBILE HOMES IN WHICH THE LAND IS ALSO OWNED, STAFF PROPOSED TO INCREASE THE MAXIMUM LOAN TO $10,000 WITH 0% INTEREST DUE AND PAYABLE UPON SALE, TRANSFER OR DEFAULT.

AN ADDITIONAL PROPOSED CHANGE IS THE INCLUSION OF THE ENERGY EFFICIENCY REPAIRS, WHICH IS IN ALIGNMENT WITH ANOTHER HOUSING ELEMENT PROGRAM 1.10.

STAFF PRESENTED ADDITIONAL OPTIONS TO THE HOUSING COMMISSION COMMITTEE, AND THEY RECOMMENDED INCLUDING APPLICANT PRIORITY FOR SENIORS, VETERANS AND OR DISABLED RESIDENTS.

ON DECEMBER 5TH, STAFF BROUGHT FORWARD AN ITEM, A RESOLUTION FOR THE COUNCIL TO CONSIDER AUTHORIZING LETTERS TO PILOTS THAT OPERATE DURING THE VOLUNTARY QUIET HOURS AT PALOMAR AIRPORT.

THE COUNCIL'S DIRECTION AT THAT TIME WAS FOR STAFF TO GO AND RESEARCH AND REPORT BACK ON THE FEASIBILITY OF ISSUING ADVISORY LETTERS TO PILOTS WHO DEVIATE FROM OTHER ASPECTS OF THE VOLUNTARY NOISE ABATEMENT PROGRAM, PARTICULARLY THE FLIGHT PATTERNS OUTLINED IN THAT IN AND PROCEDURES OUTLINED IN THAT PROGRAM FOR MCCLELLAN-PALOMAR AIRPORT. THIS IS THE PILOT HANDOUT GENERATED BY MCCLELLAN-PALOMAR AIRPORT, AND IT DESCRIBES THE VOLUNTARY NOISE ABATEMENT PROCEDURES FOR THE AIRPORT.

ONE OF THE NOTABLE, DIRECTIVES ON THIS, RECOMMENDED PROCEDURES IS THAT JETS ARE TO DEPART ON A 250 DEGREE TRACK OUT OF THE AIRPORT, AND ONE CONCERN IS THAT THAT 250 DEGREE TRACK KEEPS, FLIGHTS TRACKING TO THE NORTH OF PALOMAR AIRPORT, AND THE IDEA BEING THAT THEY GO A MILE OFF THE COAST BEFORE MAKING ONE OF THEIR TURNS.

THAT HELPS AVOID MANY OF THE NOISE SENSITIVE AREAS SURROUNDING THE AIRPORT.

UNFORTUNATELY, THE FAA'S GUIDANCE AND PUBLISHED GUIDANCE ON OPERATIONS COMING OUT OF PALOMAR AIRPORT, PARTICULARLY FOR INSTRUMENT FLIGHT RULES, INDICATE THAT PILOTS SHOULD TAKE OFF AT A 245-DEGREE TRACK, NOT THE 250-DEGREE TRACK CONSISTENT WITH THE NAP.

AND THAT PUTS THEM FURTHER SOUTH OF PALOMAR AIRPORT ROAD.

SO, IN RESEARCHING COUNCIL'S DIRECTIVE, WE DID CONTACT STAFF, CONTACTED SEVERAL REPRESENTATIVES AT COUNTY AIRPORTS AS WELL AS FEDERAL AGENCIES AT THE FAA, THE REGIONAL ADMINISTRATOR'S OFFICE, AND THE FLIGHT STANDARDS DISTRICT OFFICE.

AND WERE DETERMINED THAT NONE OF THOSE AGENCIES MAINTAIN THE TYPE OF DATA THAT WOULD BE REQUIRED TO REGULARLY SEND THE TYPES OF LETTERS THAT COUNCIL WAS INTERESTED IN.

ONE TOOL THAT'S AVAILABLE TO US IS PROVIDED ON THE COUNTY'S WEBSITE.

IT'S CALLED WEB TRACK.

THIS IS A SCREENSHOT FROM THAT, AND IT GENERALLY SHOWS ALL OF THE FLIGHT ACTIVITY OCCURRING AT A GIVEN TIME AROUND THE AIRPORT.

BUT THIS IS STILL DEMONSTRATIVE OF THE IDEA THAT PALOMAR AIRPORT SEES ROUGHLY 10 TO 12,000 TAKEOFFS AND LANDINGS OPERATIONS PER

ONE OPTION THAT DID COME UP IN CONVERSATIONS WITH AGENCY REPRESENTATIVES IS THAT THE FAA OFFERS AN OPPORTUNITY FOR COMMUNITIES TO ENGAGE IN A COMMUNITY ROUNDTABLE PROCESS.

IT'S A PROCESS THAT HAS TO BE CONVENED AT THE AIRPORT OPERATORS REQUEST.

IT SWITCHED DOWN TO MIRAMAR.

THE TOWER KNOWS ABOUT VNAP.

THEY, THE FAA AND THE COUNTY HAD IDENTIFIED THESE 60 PILOTS BEING FREQUENT VIOLATORS OF, VNAP BOTH QUIET HOURS AND FLIGHT DEVIATIONS.

SOMEHOW, THEY HAVE THAT DATA TO HAVE INVITED THOSE 60 PEOPLE AND THEY ENCOURAGED THEM.

PLEASE, PLEASE, PLEASE FLY ON THE 250-DEGREE TRACKING.

THEY HAVE THEIR ACCELERATOR GOING.

IT'S LOUD, THEY'RE LOW.

THAT'S WHERE I GET MOST OF THE COMPLAINTS FROM THE COMMUNITY.

SO I ASKED IF WE COULD POSSIBLY GET A LIST OF THE PEOPLE WHO ARE, VIOLATING THE NAP AND DOING THAT.

IF WE COULD JUST SEND THEM A NICE LETTER THAT JUST SAYS, PLEASE BE A BETTER NEIGHBOR AND FOLLOW THE NAP.

AND I WAS TOLD THAT WE CANNOT GET THAT LIST.

THERE'S NO SUCH LIST TO PROVIDE TO US TO SEND TO THE OWNERS OF THE AIRPLANES.

HELP ME UNDERSTAND WHAT, LIKE THE SPEAKER SAID, THAT THERE IS A WAY THAT THEY CAN IDENTIFY THE 60 BIGGEST VIOLATORS, BUT WE CAN'T GET THAT LIST.

THE NAP IS A COUNTY, ADOPTED, PROTOCOL AND, GUIDANCE AND DIRECTION COMING FROM AIR TRAFFIC CONTROLLERS IS COMING OUT OF THE FAA. SO YOU HAVE A BIT OF A DISCONNECT IN TERMS OF OWNERSHIP AND RESPONSIBILITY FOR THAT.

BECAUSE THE FAA MAINTAINS TOTAL CONTROL OVER FLIGHT ACTIVITY ONCE THEY'RE IN THE AIR.

THE COUNTY DOES NOT FOLLOW UP WITH LETTERS TO THOSE PILOTS.

IN REFERENCING THE MEETING OF THE 60 PILOTS IN MY CONVERSATIONS WITH THE FLIGHT SAFETY DISTRICT OFFICE, FLIGHT AND FLIGHT SAFETY INSPECTOR.

THAT MEETING, I BELIEVE, WAS TARGETED TOWARDS PILOTS THAT HAVE ACTUALLY RECEIVED, NOTICES OF VIOLATION OF FAA REGULATIONS.

SO IF THEY'RE GIVEN AIR TRAFFIC CONTROL AND THEY SOMEHOW DEVIATE FROM THAT IN THEIR OPERATION OR THEY, VIOLATE CERTAIN CEILINGS AND OTHER OPERATIONAL, THRESHOLDS, THE FAA WILL GO AFTER THEM WITH AN ENFORCEMENT ACTION.

SO IT MAY BE THAT THOSE, INDIVIDUALS WERE CONTACTED FOR THIS MEETING.

FROM EVERYBODY I'VE TALKED TO.

NOBODY. IS CRAWFORD CROSS-REFERENCING AND MAINTAINING ANY DATA RELATIVE TO ACTUAL OPERATIONS COMPARED TO CONSISTENCY WITH THE VNAP? OKAY, BEFORE WE GO TOO MUCH FURTHER, I WANT TO JUST MAKE SURE THAT THE PUBLIC KNOWS, I'VE BEEN WORKING ON THIS FOR A LONG TIME, AND I'VE BEEN TURNING TO JASON FOR HELP.

THE PROPOSAL AND THE RECOMMENDATION IN FRONT OF YOU IS THAT YOU GIVE DIRECTION TO STAFF TO ENGAGE WITH THE COUNTY AND REQUEST THAT THEY INITIATE THAT, TO ADDRESS THIS ISSUE. IN CONVERSATIONS WITH AIRPORT STAFF, IT'S MY UNDERSTANDING THAT WHEN THE COUNTY AND THE AIRPORT DID THEIR PART 150 STUDY, WHICH IS THEIR NOISE STUDY, I BELIEVE THAT WAS BACK IN THE EARLY 2000.

THEY DID CONVENE A COMMUNITY ROUNDTABLE PROCESS, AND DEVELOPMENT OF THE COUNTY'S NOISE COMPATIBILITY STUDY FOR THE PALOMAR AIRPORT WAS THE PRODUCT OF A OF A COMMUNITY ROUNDTABLE PROCESS.

SO IT WOULDN'T BE, TOTALLY UNUSUAL FOR THEM.

IS THAT SOMETHING WE CAN MAKE A MOTION ON TONIGHT SINCE IT'S PART OF THIS AGENDA ITEM, OR DO WE HAVE TO BRING THAT BACK, THAT THAT IS PART OF THE RECOMMENDED ACTION THAT YOU DIRECT STAFF TO ENGAGE THE COUNTY, TO INITIATE A COMMUNITY ROUNDTABLE PROCESS? A LITTLE BACKGROUND ON THE PAC.

IT'S A NINE-MEMBER VOLUNTEER COMMITTEE, AND IT'S FORMED TO ADVISE THE COUNTY ON MATTERS RELATED TO MCCLELLAN-PALOMAR AIRPORT.

BOTH THE COUNTY BOARD OF SUPERVISORS AND THE COUNTY CHIEF ADMINISTRATIVE OFFICER.

CURRENTLY, ALL MEMBERS OF THE PACK ARE NOMINATED BY THE FIFTH DISTRICT SUPERVISOR AND THEN APPOINTED BY THE SAN DIEGO COUNTY BOARD OF SUPERVISORS.

AND UNDER THE CURRENT FRAMEWORK, THE CITY OF CARLSBAD CAN IDENTIFY ONE RESIDENT FOR NOMINATION.

BACK ON NOVEMBER.

SO BACK UP JUST A MOMENT.

WITH REDISTRICTING AT THE COUNTY, THERE WAS KIND OF A REALIZATION THAT HAVING ALL OF THE APPOINTMENTS MADE BY THE FIFTH DISTRICT SUPERVISOR WAS NOT REPRESENTATIVE.

AND SO, THERE HAS BEEN ONGOING DISCUSSION BETWEEN THE DISTRICT THREE REPRESENTATIVE SUPERVISOR AND THE DISTRICT FIVE SUPERVISOR.

AND ON NOVEMBER 7TH, A RESOLUTION WAS INTRODUCED AND ADOPTED BY THE COUNTY BOARD OF SUPERVISORS, DIRECTING COUNTY STAFF TO RETURN WITHIN A TIME PERIOD WITH PROPOSED AMENDMENTS TO THE COUNTY CODE RELATIVE TO HOW PAC MEMBERS ARE NOMINATED AND SELECTED.

ON NOVEMBER 14TH, THE CITY'S LEGISLATIVE SUBCOMMITTEE REVIEWED THE PROPOSED AMENDMENTS, AND THOSE IN FINAL FORM WERE JUST INTRODUCED BY THE COUNTY ON FEBRUARY 7TH.

WHEN THE LEGISLATIVE SUBCOMMITTEE REVIEWED THE PROPOSAL, THEIR DISCUSSION LED TO A SERIES OF RECOMMENDATIONS FOR THE CITY COUNCIL TO CONSIDER IN CRAFTING A LETTER TO THE COUNTY.

AND THAT'S PRESENTED TO YOU TONIGHT.

THE COUNTY'S ORDINANCE IS SCHEDULED FOR ADOPTION, COMING UP ON FEBRUARY 28TH.

SO, THE PROPOSED COUNTY CODE AMENDMENTS UNDER THE NEW FRAMEWORK WOULD BE, RATHER THAN ALL NINE SEATS BEING NOMINATED BY THE FIFTH DISTRICT SUPERVISOR, FOUR SEATS WOULD NOW BE NOMINATED BY THE DISTRICT THREE SUPERVISOR.

TWO OF THOSE WOULD BE, INDICATED FOR CARLSBAD RESIDENTS TO BE IDENTIFIED BY THE CITY, AND TWO WOULD BE FOR DISTRICT THREE RESIDENTS AT LARGE.

THE FIFTH DISTRICT SUPERVISOR WOULD ALSO NOMINATE FOUR SEATS, ONE EACH FOR THE CITIES OF VISTA, SAN MARCOS, AND OCEANSIDE RESIDENTS.

EXCUSE ME. AND ONE DISTRICT FIVE RESIDENT AT LARGE.

ONE SEAT IS ALSO INDICATED FOR THE COUNTY'S CHIEF ADMINISTRATIVE OFFICER TO NOMINATE, AND THAT IS, SPECIFIED AS AN INDUSTRY REPRESENTATIVE WITH EXPERTISE AND EXPERIENCE AT PALOMAR AIRPORT IN AVIATION OR AERONAUTICAL AIRPORT BUSINESS OPERATIONS.

AND TO EXPAND ON THAT, THE CODE LANGUAGE GOES A LITTLE FURTHER, INDICATING THAT MIGHT INCLUDE INDIVIDUALS SUCH AS PILOTS, MECHANICS, AIRPLANE OWNERS,

AIRPORT PROPERTY, BUSINESS OWNERS WHO ARE A LESSEE OR SUBLESSEE OR OTHER RELATED FIELDS, AND WHO HAVE A DEMONSTRATED INTEREST IN THE ECONOMIC VIABILITY OF THE AIRPORT. THE NEW LANGUAGE ALSO PROPOSES TO DELETE AN EXISTING PROVISION IN THE COUNTY CODE, WHICH STATES THAT NO MORE THAN THREE MEMBERS OF THE COMMITTEE SHALL BE FINANCIALLY INTERESTED IN ANY BUSINESS HAVING A LEASEHOLD INTEREST IN PALOMAR AIRPORT.

SO, THE NEW PROPOSAL WOULD, ELIMINATE THAT CLAUSE.

SO PAC MEMBER TERMS. UNDER THE NEW FRAMEWORK, MEMBERS NOMINATED BY ONE OF THE SUPERVISORS WOULD SERVE TERMS THAT RUN CONCURRENT WITH THE APPOINTING SUPERVISOR'S TERM, AND THEN THE CEO'S APPOINTMENT WOULD RUN CONCURRENT WITH THE DISTRICT THREE SUPERVISORS' TERM.

SO, THE LEGISLATIVE SUBCOMMITTEE'S RECOMMENDATION UPON REVIEWING THESE PROPOSALS WAS TO RECOMMEND TO THE CITY COUNCIL THAT YOU AUTHORIZE STAFF TO PREPARE A LETTER FOR THE MAYOR'S SIGNATURE, REQUESTING THAT THE BOARD OF SUPERVISORS CONSIDER THE FOLLOWING REGARDING THE ORDINANCE AND SELECTION PROCESS.

ONE TO CLARIFY THE SEATS THAT ARE TO BE OCCUPIED BY CURRENT PAC MEMBERS.

YOU'LL RECALL TOWARDS THE END OF LAST YEAR, THE CITY, WENT THROUGH A RECRUITMENT PROCESS AND IDENTIFIED A PRIMARY AND AN ALTERNATE CANDIDATE TO BE CONSIDERED FOR PACK APPOINTMENT.

AND SHIRLEY ANDERSON WAS NOMINATED BY SUPERVISOR DESMOND AND APPOINTED BY THE BOARD OF SUPERVISORS AT THE END OF LAST YEAR.

ANOTHER RECOMMENDATION TO CLARIFY THE TERMS TO BE SERVED BY CURRENT MEMBERS, BECAUSE MISS ANDERSON WAS APPOINTED BY SUPERVISOR DESMOND.

THERE'S A QUESTION, AND IT'S NOT CLEAR IN THE PROPOSED CODE LANGUAGE WHETHER HER TERM WOULD RUN CONCURRENT WITH SUPERVISOR DESMOND OR WHETHER SHE WOULD, ALTERNATELY OCCUPY ONE OF THE DISTRICT THREE DESIGNATED SEATS AND HER TERM NOW RUN WITH THE DISTRICT THREE REPRESENTATIVE'S TERM.

A RECOMMENDATION THAT THE COUNTY BOARD OF SUPERVISORS AND OUR DISTRICT THREE SUPERVISOR SPECIFICALLY ADVANCE THE NOMINATIONS AND APPOINTMENT OF THE PRIMARY AND ALTERNATE CANDIDATES THAT WERE IDENTIFIED IN THE CITY COUNCIL RESOLUTION.

SO, RATHER THAN INITIATING ANOTHER SOLICITATION FOR INTEREST, THAT WE FORWARD THOSE TWO NAMES FOR CONSIDERATION IN SEATING UNDER THE NEW FRAMEWORK.

AND AGAIN, THAT THOSE RECOMMENDATIONS ACTUALLY BE NOMINATED AND APPOINTED AS IDENTIFIED BY THE CITY.

ANOTHER RECOMMENDATION TO RETAIN THE LIMITS ON THE NUMBER OF COMMITTEE MEMBERS WITH A FINANCIAL INTEREST IN THE AIRPORT, AND TO PROHIBIT A MAJORITY OF COMMITTEE MEMBERS FROM HAVING A FINANCIAL OR PROFESSIONAL INTEREST IN THE AIRPORT.

AND THEN FINALLY, TO ENSURE A SEAMLESS TRANSITION AS THE NEW FRAMEWORK IS ADOPTED AND IMPLEMENTED TO AVOID ANY GAPS IN SERVICE.

SO, THE CITY COUNCIL'S OPTIONS FOR TONIGHT ARE TO DIRECT STAFF TO PREPARE A LETTER THAT'S CONSISTENT WITH THE RECOMMENDATIONS OF THE LEGISLATIVE SUBCOMMITTEE.

I'VE BEEN ATTENDING THE PAC MEETING SINCE 2018, WHEN I WAS AT A WORKSHOP FOR THE MASTER PLAN FOR PALOMAR AIRPORT, FOUND OUT ABOUT THE PAC FROM ANOTHER GUEST WHO WAS AT THE SAME MEETING, AND MY HUSBAND AND I STARTED ATTENDING THE MEETINGS.

THE MEETINGS ARE HELD BI-MONTHLY.

AND THEY'RE AT A DAIS MUCH LIKE YOU ARE.

CFR OPPOSED THE RECENT CHANGES APPROVED BY THE BOARD OF SUPERVISORS BECAUSE WE BELIEVE THE COUNTY'S APPROACH IS INCORRECT AND INCOMPLETE.

THE CAO IS APPOINTING SOMEBODY WHO'S SUPPOSED TO BE ON A WATCHDOG COMMITTEE FOR COUNTY STAFF.

SO YOU HAVE STAFF APPOINTING THE WATCHDOG FOR STAFF.

BUT, YOU KNOW, WE LOST THAT BATTLE.

SO WE HAVE SOME I HAVE SOME SUGGESTIONS THAT MIGHT EVEN HELP SOME MORE.

NOMINATIONS FORWARDED BY THE CITIES WHO HAVE ALLOCATED SEATS SHOULD BE SEATED ON THE PAC RIGHT NOW.

THE SUPERVISOR CAN CAN, OVERRIDE THAT AND SEAT WHOEVER THEY WANT.

AND, AS A MATTER OF FACT, WHEN SHIRLEY WAS SEATED, THE VISTA CITY COUNCIL PUT FORTH A UNANIMOUS BIPARTISAN CANDIDATE FOR BY THEIR CITY COUNCIL.

THE DEFY SUPERVISOR DIDN'T EVEN DIDN'T EVEN INTERVIEW HER.

INSTEAD, HE PUT A GUY WHO RAN FOR CITY COUNCIL, LOST FOR CITY COUNCIL, WHO'S PULLED HIS PAPERS TO RUN FOR D FIVE SUPERVISOR IN HER PLACE INSTEAD.

SO HE JUST COMPLETELY IGNORED THE CITY COUNCIL'S UNANIMOUS DECISION.

SO I THINK THE CITY NEEDS TO ASK THAT THERE'S NO SUPERVISOR OVERRIDE BY THE CANDIDATES THAT THE CITY'S PUT FORTH, AND THAT SHOULD BE FOR ALL THE CITIES.

TWO PLAIN AND SIMPLY, PAC MEMBERS SHOULD NOT HAVE ANY FINANCIAL INTERESTS IN AIRPORTS AND ITS BUSINESSES.

PLEASE ASK THAT THE COUNTY TO CODIFY ALL CONFLICT OF INTERESTS.

FUNNY LITTLE SECRET WHEN THEY GO FOR FAA FUNDING.

THERE'S A LITTLE TICK MARK ON THERE THAT SAYS, HAS THERE BEEN ANY COMMUNITY INPUT? THE PAC'S APPROVAL OF THOSE PLANS? IS THAT COMMUNITY INPUT? SO YOU NOW HAVE PEOPLE SITTING ON AN ADVISORY COMMISSION APPROVING THINGS TO GET MONEY FOR MONEY FOR THE AIRPORT THAT ACTUALLY PUT MONEY IN THEIR POCKETS.

AT THE LAST PAC MEETING, THE CO-CHAIR WHO OWNS A LEASING BUSINESS AT PALOMAR AIRPORT REFUSED TO RECUSE HIMSELF EVEN AFTER HE WAS ASKED BY OTHER MEMBERS OF THE PAC. THE PAC WAS DISCUSSING AND VOTING ON WHETHER TO RECOMMEND WHETHER THOSE LEASES OF WHICH HE BENEFITED GO OUT FOR BID OR JUST AUTOMATICALLY BE RENEWED TO THE TUNE OF MILLIONS OF DOLLARS.

NOT HUNDREDS OF THOUSANDS, NOT TENS, MILLIONS OF DOLLARS.

NOTHING HAPPENED.

SO I THINK IF PAC MEMBERS, I THINK THE CITY SHOULD ASK PAC MEMBERS DON'T RECUSE THEMSELVES.

THEY NEED TO BE, YOU KNOW, KICKED OFF THE COMMITTEE AND FINALLY, COUNTY POLICIES.

SO I'M NOT QUITE SURE I UNDERSTAND WHY IT WAS CHOSEN.

PICKLEBALL IS LOUD.

IT IS LOUDER THAN TENNIS.

THIS IS BECAUSE FROM MY RESEARCH, IT IS A MID-FREQUENCY NOISE.

AND BECAUSE OF ITS IRREGULARITY, IT BECOMES QUITE ANNOYING.

I ALSO HAVE NO CONFIDENCE IN THE CITY OR THE PARK PREVENTING PICKLEBALL FROM BEING. OUTSIDE OF THE HOURS OF THE PARK.

AND THIS IS FROM MY EXPERIENCE WITH THE BASKETBALL COURT.

I HAVE CALLED THE POLICE NUMEROUS TIMES BECAUSE THEY HAVE BEEN OUT THERE 11:00, 12:00, 3 A.M.

PLAYING BASKETBALL.

I'M RIGHT ACROSS THE STREET FROM THAT.

I FEEL THE NOISE WILL BE DETRIMENTAL TO OUR PEACE AND POTENTIALLY OUR PROPERTY VALUES.

I JUST HOPE THAT THESE ISSUES WILL BE TAKEN INTO CONSIDERATION.

IT'S ALSO CONSIDERABLY MORE DISTANT THAN THE PICKLEBALL COURTS AT POINSETTIA COMMUNITY PARK.

IN TERMS OF SOUND ATTENUATION.

LIKE WITH POINSETTIA COMMUNITY PARK, WE FULLY INTEND TO USE WHAT IS CALLED ACOUSTIC FENCE MATTING THAT GOES AROUND THE PERIMETER OF THE COURT ENCLOSURE, AND IT'S A SOLID MAT THAT DOES KNOCK DOWN SOME OF THE DECIBEL LEVEL.

IT WOULD GO ALL THE WAY TO THE TOP OF THE ENCLOSURE.

SO TEN FEET TALL.

AND. IN ADDITION, WE WOULD BE LOCKING THE COURTS OVERNIGHT, WHICH IS SOMETHING THAT WE HAVE, IMPLEMENTED AT POINSETTIA PARK AS A RESULT OF WHAT THE SPEAKER REFERENCED, INDIVIDUALS COMING IN AND STARTING EARLY BEFORE THE 8 A.M.

SO, DEFINITELY WAS A PACKED AND EXCITING MEETING WITH REGARDS TO CAL CITIES.

COUNCIL MEMBER. ACOSTA AND I BOTH WILL BE IN FISH CAMP FOR OUR BOARD MEETING NEXT WEEK.

SO THAT'LL BE GOOD BECAUSE WE'LL BE DISCUSSING MANY OF THE DIFFERENT THINGS THAT WE'LL BE WORKING ON FOR CITIES, CONTINUING TO WORK ON FOR CITIES THROUGHOUT THE STATE. THE SAN DIEGO COUNTY WATER AUTHORITY LAST WEEK HAD AN ALL DAY BOARD MEETING ON THURSDAY, AND WE TALKED ABOUT LONG RANGE PLANNING FOR OUR OUR RATES. IT'S REALLY, YOU KNOW, DIFFICULT TO PREDICT WHAT THE WEATHER IS GOING TO BE.

AND, YOU KNOW, WHERE WE MIGHT HAVE EXTREME WEATHER EVENTS, FLOODING, DROUGHT.

IT'S JUST SO HARD.

AND SOMETIMES OUR PROJECTIONS WHEN WE'RE LOOKING TEN, 20 YEARS OUT ARE OFF, REALLY OFF.
