AS THE CHIEF OF POLICE, I INTEND TO CONTINUE THE STRONG FOUNDATION OUR DEPARTMENT HAS DEEPLY CEMENTED AND PROVIDING SAFETY AND GREAT CUSTOMER SERVICE TO THE COMMUNITY OF CARLSBAD. I STAND ON THE SHOULDERS OF THOSE THAT CAME BEFORE ME, AND I HAVE TO THANK CHIEF MICKEY WILLIAMS FOR PASSING ON THE BATON AND THE INCREDIBLE WORK HE HAS DONE OVER THE LAST 29 YEARS.

I CERTAINLY DID NOT GET HERE ALONE.

I'VE HAD MUCH SUPPORT OVER MY 18 YEAR CAREER TO INCLUDE FRIENDS, MENTORS, COWORKERS, AND I HAVE TO THANK MY AMAZING FAMILY TO INCLUDE AND ESPECIALLY MY HUSBAND, WHO'S KNOWN WITHIN THE CITY AS THE FIRE CHIEF AND HAS HIS OWN STANDING AS A PUBLIC SERVANT, BUT IS ALSO MY ROCK AND AN AMAZING DAD TO OUR TWO GIRLS.

I UNDERSTAND THE RESPONSIBILITY THIS POSITION HOLDS, SERVING AS THE PUBLIC SERVANT THAT CARRIES THE COMMUNITY'S VOICE BACK TO THE DEPARTMENT.

BUT ALSO SERVING AS THE LEADER TO THE BRAVE MEN AND WOMEN WHO PUT THE BADGE ON EACH AND EVERY DAY, AS WELL AS THE DISPATCHERS AND SUPPORT PERSONNEL THAT HAVE DEDICATED THEIR LIVES LIVES TO PUBLIC SERVICE.

THE MOST VALUABLE ASSET AT THE CARLSBAD POLICE DEPARTMENT IS OUR PEOPLE.

OUR PERSONNEL DO AN INCREDIBLE JOB, OFTENTIMES UNDER THE MOST TRYING CIRCUMSTANCES.

TO THE MEN AND WOMEN THAT MAKE UP THIS GREAT DEPARTMENT.

MANY OF THEM ARE HERE TODAY.

SO REALLY WE DON'T SEE THIS OFTEN IN CITIES A LOT AND THEY'RE IMPLANTS FROM OTHER CITIES THAT COME IN.

AND IT'S JUST A PRIVILEGE TO HAVE THESE TWO AS OUR LEADERS, THANK YOU.

IT'S JUST REALLY COOL TO SEE THAT THERE'S A WOMAN WHO IS GOING TO BE IN LEADERSHIP.

I KNOW YOU HAVE TWO DAUGHTERS, WHICH I'M SURE THEY'RE VERY PROUD.

I SEE THEM HERE.

AND I KNOW YOU'RE A NORTH COUNTY THROUGH AND THROUGH PERSON AND, YOU KNOW CARLSBAD LIKE THE BACK OF YOUR HAND.

SO WE'RE IN REALLY GREAT LEADERSHIP AND I'M REALLY EXCITED TO CONTINUE TO WORK ALONGSIDE YOU.

CONGRATULATIONS. MANY YEARS AGO, YOU TOOK THE PHYSICAL AGILITY TEST TO BECOME A CARLSBAD POLICE OFFICER, AND I WAS ONE OF THE OFFICERS WHO EVALUATED YOU AT THE TIME, HAD NO IDEA WHO YOU WERE.

AND I WANT TO TELL THE STORY BECAUSE IT JUST SHOWS HOW CHRISTIE IS.

SHE RAN THE OBSTACLE COURSE, RAN IT FULL BORE, AND SHE TRIPPED AND FELL AND SKINNED HER KNEES.

THE REST OF US WOULD STOP, LOOK AT OUR KNEES, WIPE OFF THE DIRT, AND THEN KEEP RUNNING.

SHE DIDN'T EVEN LOOK AT HER KNEES.

SHE POPPED UP, CONTINUED, AND CONTINUED TO RUN THAT OBSTACLE COURSE.

THAT MEANT SO MUCH TO ME THAT THAT'S STILL IN MY BRAIN.

I THINK IT'S A BIG COMPLIMENT.

I TALK TO THE POLICE OFFICERS ALL THE TIME, AND ANYTIME THERE'S GOING TO BE A PROMOTION, YOU HAVE SOME DETRACTORS, SOME SUPPORTERS.

THAT'S ANYWHERE YOU GO.

SINCE CHRISTIE WAS ANNOUNCED AS BEING THE NEXT CHIEF, I HAVEN'T HEARD ONE EMPLOYEE, ONE OFFICER SAY ONE THING THAT WASN'T SUPPORTIVE OF YOU, CHRISTIE. AND THAT'S THE FIRST TIME, I THINK, IN A LONG TIME THERE'S BEEN ANY PROMOTIONS IN ANY ORGANIZATION THAT SOMEBODY WASN'T A DETRACTOR.

WE WENT THROUGH A LOT OF CHANGES AND A LOT OF PROGRESS, AND THE ARTS ARE BETTER THAN THEY'VE EVER BEEN, AND I'M VERY PROUD TO HAVE BEEN A PART OF THAT.

AND I LOOK FORWARD TO STAYING IN TOUCH INVOLVED.

SO WHEREAS APRIL 22ND OR 22ND, 2024 MARKS THE 54TH ANNIVERSARY OF EARTH DAY CELEBRATED IN CITIES ACROSS OUR NATION AND IS A CELEBRATION TO UNITE EVERYONE IN AN EFFORT TO PROTECT THE PLANET.

AND WHEREAS THE CITY OF CARLSBAD HAS SEVERAL EVENTS THROUGHOUT THE MONTH OF APRIL FOR RESIDENTS TO CELEBRATE EARTH MONTH AND EMPOWER THEMSELVES WITH KNOWLEDGE TO CONSERVE AND PROTECT OUR PLANET EARTH.

AND WHEREAS, RECOGNIZING THE DETRIMENTAL IMPACT OF SINGLE USE PLASTICS ON OUR ENVIRONMENT AND ECOSYSTEMS, CARLSBAD HAS TAKEN PROACTIVE STEPS TO LEAD IN THE REGION BY IMPLEMENTING BANS ON SINGLE USE PLASTICS AND INITIATING ROBUST OUTREACH PROGRAMS TO EDUCATE AND ENGAGE THE COMMUNITY IN SUSTAINABLE PRACTICES.

AND WHEREAS, LOCAL COMMUNITIES CAN LEAD THE WAY IN TAKING SUCH STEPS TO PROTECT AND PRESERVE OUR NATURAL RESOURCES BY ENCOURAGING SUSTAINABLE WATER AND ENERGY CONSUMPTION, TRANSPORTATION PRACTICES, WASTE REDUCTION AND RECYCLING.

AND WHEREAS, THE CITY OF CARLSBAD IS COMMITTED TO OUR COMMUNITY VALUES OF PRESERVING AND PROTECTING OPEN SPACE AND THE NATURAL ENVIRONMENT, PROMOTING ACTIVE, HEALTHY LIFESTYLES AND ENCOURAGING CONSERVATION.

THROUGH EVENTS LIKE SAN DIEGO FIXIT CLINIC.

WE FOCUS ON THE FOUR R'S THAT PROVIDE THE OPPORTUNITIES FOR EVERY INDIVIDUAL BUSINESS TO BEGIN CREATING A SUSTAINABLE SOCIETY.

REFUSE. SAY NO TO THE PRODUCTS THAT AREN'T NECESSARY.

REDUCE USING LESS AND SHRINKING WHAT YOU CONSUME.

REUSE REPURPOSING AN ITEM PAST ITS ORIGINAL PURPOSE.

ITEM NUMBER FIVE IS THE ANNUAL REVIEW OF THE POLICE DEPARTMENT'S MILITARY EQUIPMENT USE POLICY AND INTRODUCTION OF AN ORDINANCE RENEWING THE POLICY MAKING.

OUR PRESENTATION TODAY IS LIEUTENANT RYAN OPEKA.

ALL RIGHT. GOOD EVENING, STAFF COUNCIL, MR. MAYOR. MY NAME IS RYAN OPEKA I'M A LIEUTENANT WITH THE POLICE DEPARTMENT HERE.

AND TONIGHT I'M GOING TO DISCUSS WITH YOU THE POLICE DEPARTMENT'S ANNUAL REPORT ON THE USE OF MILITARY EQUIPMENT, AS WELL AS PROVIDE YOU WITH A RECOMMENDATION FOR MOVING FORWARD WITH AN ORDINANCE TO RENEW THE AMENDED POLICY FOR NEXT YEAR.

DURING THIS PRESENTATION, I WILL PROVIDE AN OVERVIEW OF AB 41 AND A SUMMARY OF OUR POLICY.

I WILL ALSO GIVE YOU A REVIEW OF OUR MILITARY EQUIPMENT INVENTORY, WHILE PROVIDING YOU WITH FINDINGS FROM OUR 2023 MILITARY EQUIPMENT USE REPORT.

AND AFTER OUTLINING THE PROCESS, I WILL SHARE WITH YOU THE STAFF RECOMMENDATION.

ON SEPTEMBER 30TH OF 2021, GOVERNOR NEWSOM SIGNED INTO LAW ASSEMBLY BILL 41, WHICH RELATES TO THE USE OF MILITARY EQUIPMENT.

THIS APPLIES TO ALL CALIFORNIA LAW ENFORCEMENT AGENCIES.

THE INTENT OF THE LAW IS FOR LOCAL POLICE DEPARTMENTS TO ENGAGE WITH THE PUBLIC ABOUT WHAT MILITARY EQUIPMENT IS BEING UTILIZED.

THANK YOU. AND THE GOAL IS TO BETTER INFORM THE PUBLIC TO HELP ELECTED LEADERS SUCH AS YOURSELF, TO DECIDE WHETHER TO FUND, ACQUIRE OR USE SUCH EQUIPMENT IN THE FUTURE. TWO YEARS AGO, CITY COUNCIL APPROVED THE POLICY FOR THE POLICE DEPARTMENT FOR THE FIRST TIME.

AB 41 ALSO REQUIRES THE POLICE DEPARTMENT TO PRODUCE A REPORT.

THIS REPORT IS TO OUTLINE ALL USE OF MILITARY EQUIPMENT DURING THE PREVIOUS YEAR, AND ANY RELEVANT INFORMATION RELATED TO THAT USE.

AND THEN LASTLY, THE STATUTE THAT THE CITY COUNCIL IS TO APPROVE.

IT NEEDS TO BE BY ORDINANCE, THE LAW OUTLINES THAT THAT'S HOW THIS SHALL TAKE PLACE.

WHAT EXACTLY IS MILITARY EQUIPMENT? THE CALIFORNIA GOVERNMENT CODE REQUIRES THAT ALL LAW ENFORCEMENT AGENCIES THAT HAVE MILITARY EQUIPMENT HAVE A MILITARY EQUIPMENT USE POLICY.

THE POLICY MUST BE APPROVED BY CITY COUNCIL EACH YEAR.

NOW, THE TERM MILITARY EQUIPMENT, IT'S NOT DEFINED IN THE LAW.

RATHER, CALIFORNIA GOVERNMENT CODE SECTION 770 LISTS SEVERAL EXAMPLES OF ITEMS DEEMED TO BE MILITARY EQUIPMENT.

THE COMPLETE LIST OF THIS EQUIPMENT IS INCLUDED IN THE STAFF REPORT.

HOWEVER, A FEW EXAMPLES THAT ARE CONTAINED IN THIS LIST INCLUDE DRONES, ARMORED PERSONNEL CARRIERS, COMMAND POST VEHICLES, FIREARMS OF A CERTAIN CALIBER, SPECIALIZED FIREARMS THAT ARE UNDER 50 CALIBER, LESS LETHAL MUNITIONS SUCH AS BEANBAGS, RUBBER BULLETS, AND SPECIALTY IMPACT MUNITIONS AND THEIR RESPECTIVE LAUNCHING PLATFORMS. IN ORDER TO POSSESS THIS EQUIPMENT, WE MUST SHOW A NECESSITY FOR EACH ITEM AND DEMONSTRATE HOW IT IS USED TO SAFEGUARD THE PUBLIC'S WELFARE, SAFETY, CIVIL RIGHTS, AND CIVIL LIBERTIES. THIS INFORMATION IS ALL CAPTURED WITHIN A DOCUMENT WE CALL THE INVENTORY.

I'LL GET INTO THAT A LITTLE BIT LATER.

THE MILITARY EQUIPMENT USE POLICY MUST CONSIST OF A DETAILED DESCRIPTION OF EACH TYPE OF MILITARY EQUIPMENT THAT IS USED.

THIS PART OF THE POLICY, THE INVENTORY THAT I REFERRED TO ON THE PREVIOUS SLIDE HAS TO HAVE THE AUTHORIZED USE FOR EACH TYPE OF MILITARY EQUIPMENT, THE LEGAL AND PROCEDURAL RULES FOR GOVERNING ITS USE, AND THE COST OF EACH ITEM, AS WELL AS THE TRAINING REQUIREMENTS TO USE THOSE ITEMS.

THE POLICY BEYOND THE INVENTORY ALSO LAYS OUT SOME ADDITIONAL ADMINISTRATIVE PROCESSES TO ENSURE COMPLIANCE WHILE LAYING DOWN INTERNAL RULES FOR DEPLOYING THE EQUIPMENT.

ADDITIONALLY, WHILE THE POLICY PROVIDES A MECHANISM TO ENSURE COMPLIANCE, IT MUST ALSO HAVE A METHOD FOR SUBMITTING COMPLAINTS AND QUESTIONS RELATED TO THE MILITARY EQUIPMENT.

OKAY, SOME MORE ON THE INVENTORY.

THE INVENTORY DOCUMENT WAS DESIGNED TO PROVIDE CLEAR, DETAILED INFORMATION IN A FORMAT THAT IS EASILY TO UNDERSTAND FOR THE GENERAL PUBLIC.

EVERY ITEM WITHIN OUR INVENTORY SERVES SOME FORM OF OFFICER OR PUBLIC SAFETY PURPOSE, WHILE ALSO CONTRIBUTING TO OUR OVERARCHING DE-ESCALATION PRINCIPLES.

CARLSBAD EQUIPMENT IS ALSO ESSENTIAL TO MANAGING MANY OF OUR SPECIAL EVENTS THAT WE HOST LIKE THE MARATHON, THE STREET FAIR, CONCERTS IN THE PARK, A LOT OF THE HIGH SCHOOL GRADUATIONS, AS WELL AS RESPONDING TO LARGE SCALE INCIDENTS SIMILAR TO THINGS LIKE THE PROTESTS THAT WE EXPERIENCED BACK IN 2020.

MANY OF THE EQUIPMENT ITEMS ARE UTILIZED TO RESOLVE OUR MOST CRITICAL INCIDENTS.

THIS INCLUDES, BUT IS NOT LIMITED TO ACTIVE SHOOTER RESPONSE, HOSTAGE RESCUE, BARRICADED SUBJECTS, AND A HIGH RISK WARRANT RESPONSE.

ALL ITEMS IN OUR INVENTORY REQUIRE TRAINING.

MANY OF THE ITEMS REQUIRE ONGOING TRAINING, AND IN CASE OF SUCH ITEMS, LIKE THE LESS LETHAL PLATFORMS AND DRONES, THAT REQUIRES RECERTIFICATION FOR THOSE THAT ARE USING THE ITEMS. IF IT'S A DRONE, IT HAS YOU HAVE TO BE LICENSED BY THE FAA BEFORE PILOTING THEM BECAUSE WE USE THEM FOR COMMERCIAL PURPOSES.

AND EACH ITEM WITHIN THE INVENTORY WE MUST COMPLY WITH A VARIETY OF LEGAL REQUIREMENTS AND ALL DEPARTMENT POLICIES TO INCLUDE OUR USE OF FORCE AND DE-ESCALATION POLICIES.

AS YOU CAN SEE ON THE GRAPH HERE THE VAST MAJORITY OF OUR EQUIPMENT IS CONTROLLED BY OUR SWAT TEAM.

TECHNOLOGY SUCH AS UAVS AND OTHER CAMERA PLATFORMS WILL PROVIDE US WITH REAL TIME INFORMATION, ENABLING US TO MAKE BETTER DECISIONS PRIOR TO ENGAGING A HOSTILE SUBJECT OR A PERSON IN DISTRESS.

POLICE LESS LETHAL EQUIPMENT PROVIDES CRITICAL ALTERNATIVES TO LETHAL FORCE IN VIOLENT INTERACTIONS WITH INDIVIDUALS THAT ARE OFTEN ARMED OR REPRESENT A SIGNIFICANT DANGER TO THE PUBLIC.

HAVING MULTIPLE OPTIONS ON A CONTINUUM ALLOWS FOR A MORE NUANCED APPROACH TO RESOLVING VOLATILE SITUATIONS.

THE FIREARMS INCLUDED IN THIS DOCUMENT REPRESENT THOSE ALTERNATIVES TO THE TRADITIONAL PISTOLS THAT ARE CARRIED BY ALL POLICE OFFICERS.

OFFICERS RECEIVE SIGNIFICANT TRAINING IN THE SAFE USE, MANIPULATION AND OPERATION OF THESE FIREARMS. WHEN ALL OTHER ATTEMPTS AT GAINING VOLUNTARY COMPLIANCE HAVE FAILED CHEMICAL AGENTS CAN ENCOURAGE SUBJECTS TO MOVE TO A LOCATION OF DISADVANTAGE AND INCREASE THE POTENTIAL FOR SAFELY TAKING THEM INTO CUSTODY.

AND THEN THE ABILITY TO SUCCESSFULLY GAIN AND SECURE A LOCATION CAN ENABLE US TO APPLY LIFE SAVING AID, AND THE BREACHING EQUIPMENT WITHIN THE INVENTORY ALLOWS US TO DO THAT.

AND THEN LASTLY, HERE WE HAVE THE THREE VEHICLES THAT ARE INCLUDED IN THIS REPORT.

THAT WOULD BE OUR BEARCAT, OUR SWAT AMBULANCE AND THE COMMAND POST.

OKAY. THERE ARE SOME REQUIREMENTS REGARDING THE FINDINGS OF THIS REPORT.

AND IN ORDER TO RENEW THE MILITARY EQUIPMENT USE POLICY, THE CITY COUNCIL MUST DETERMINE, BASED ON THE 2023 MILITARY EQUIPMENT REPORT, WHETHER EACH TYPE OF MILITARY EQUIPMENT IDENTIFIED IN THE REPORT HAS COMPLIED WITH THE FOLLOWING STANDARDS.

ONE, THE MILITARY EQUIPMENT IS NECESSARY BECAUSE THERE IS NO REASONABLE ALTERNATIVE THAT CAN BE ACHIEVED THAT CAN ACHIEVE THE SAME OBJECTIVE OF OFFICER AND CIVILIAN SAFETY. TWO, THE POLICY WILL SAFEGUARD THE PUBLIC WELFARE, SAFETY, CIVIL, CIVIL RIGHTS, AND CIVIL LIBERTIES.

THREE, THE EQUIPMENT IS REASONABLY COST EFFECTIVE COMPARED TO AVAILABLE ALTERNATIVES THAT CAN ACHIEVE THE SAME OBJECTIVE OF OFFICER AND CIVILIAN SAFETY.

AND FOUR, PRIOR MILITARY EQUIPMENT USE, COMPLIED WITH THE POLICY THAT WAS IN EFFECT AT THE TIME, OR IF PRIOR USES DID NOT COMPLY WITH THE POLICY.

CORRECTIVE ACTION HAS BEEN TAKEN TO REMEDY NON-CONFORMING USES AND ENSURES FUTURE COMPLIANCE.

IF THE CITY COUNCIL DETERMINES THAT ANY OF THE EQUIPMENT IDENTIFIED IN THE 2023 REPORT HAS NOT COMPLIED WITH THE STANDARDS OF APPROVAL, THE CITY COUNCIL MAY DECLINE TO RENEW AUTHORIZATION FOR THAT TYPE OF EQUIPMENT, OR REQUIRE MODIFICATION TO THE POLICY TO RESOLVE THE NONCOMPLIANCE.

IN ADDITION TO THESE FINDINGS, ANY AMENDMENTS TO THE POLICY ARE TO BE PROPOSED ALONG WITH THE REPORT FOR APPROVAL.

NOW THAT YOU HAVE A CLEAR PICTURE OF THE GOVERNMENT CODE AND THE MILITARY EQUIPMENT ITSELF, I'D LIKE TO JUMP INTO OUR 2023 REPORT.

THE REPORT HAS SIX AREAS THAT NEED TO BE ADDRESSED.

THOSE SIX AREAS ARE A SUMMARY OF HOW THE EQUIPMENT WAS USED.

A SUMMARY OF ANY COMPLAINTS.

THE RESULT OF ANY AUDITS STEMMING FROM A VIOLATION OF THE EQUIPMENT POLICY AND THE TOTAL COST OF THE EQUIPMENT TO INCLUDE TRAINING MAINTENANCE PERSONNEL.

SO THIS IS HOW OUR EQUIPMENT WAS USED, IN 2023, THE CARLSBAD POLICE DEPARTMENT USED OUR EQUIPMENT ACROSS A WIDE SPECTRUM OF EVENTS.

THE SWAT TEAM CARRIED OUT 23 MISSIONS SEPARATE FROM DAY TO DAY FIELD IMPLEMENTATION.

OF THOSE 23 MISSIONS, 9 WERE HIGH RISK SEARCH AND OR ARREST WARRANTS, 4 CRITICAL INCIDENT CALL OUTS.

ONE WAS A TWO DAY DIGNITARY PROTECTION ASSISTING THE SECRET SERVICE WITH THE FIRST LADY AS SHE STAYED IN CARLSBAD.

AND 9 WERE CLASSIFIED AS QUICK REACTION FORCE DEPLOYMENTS.

SO THESE ARE LIKE PRE STAGED EVENTS.

MAYBE THE STREET FAIR OR HIGH SCHOOL GRADUATIONS WHERE THERE'S VULNERABLE TARGETS.

AND THEN SEPARATE FROM THE SWAT TEAM, BUT ALSO IN CONJUNCTION WITH WE HAD 168 DRONE DEPLOYMENTS.

SO THIS IS OFTENTIMES LIKE OPEN AREA SEARCHES, HIGH RISK CONTACTS MISSING PERSON SEARCHES AND AGENCY ASSISTS.

AS FOR COMPLAINTS RECEIVED BOTH INTERNALLY AND EXTERNALLY REGARDING THE USE OF MILITARY EQUIPMENT, WE HAD ZERO FOR THE YEAR OF 2023.

AND THEN FOR ALL OF 23, SINCE THERE WERE NO REPORTED POLICY VIOLATIONS RELATED TO THE USE OF MILITARY EQUIPMENT, WE HAD ZERO AUDITS.

BUT THE LACK OF ANY AUDITS SHOULD NOT BE MISCONSTRUED TO MAKE ANYONE BELIEVE THE POLICE DEPARTMENT IS NOT REFLECTIVE.

AS A STANDING ORDER, WE'RE CONSTANTLY LOOKING AT WAYS TO IMPROVE AND AND SEEKING THAT IMPROVEMENT.

THE TOTAL COST OF THE MILITARY EQUIPMENT CAN BE FOUND IN THE ITEMIZED INVENTORY THAT'S PUBLISHED WITHIN THE POLICY, AS WELL AS WITHIN THE ANNUAL REPORT.

THE VAST MAJORITY OF THE ASSOCIATED COSTS HAPPEN UNDER OUR SWAT TEAM, AS THEY'RE IN CHARGE OF 83% OF THE EQUIPMENT.

AND THE BREAKDOWN FOR THE COST OF THE SWAT TEAM IS ALSO INCLUDED IN THE ANNUAL REPORT.

THE QUANTITY FOR EACH OF THESE ITEMS IS ALSO CONTAINED IN THIS INVENTORY.

THE LIST CONTAINS 53 SEPARATE ITEMS, ONLY SEVEN OF WHICH ARE UTILIZED OUTSIDE OF THE SWAT TEAM.

MUCH OF THE EQUIPMENT REQUIRES SPECIALIZED TRAINING, CERTIFICATION, RETESTING, AND CONTINUAL PROFICIENCY TRAINING, AND IT'S THEREFORE LIMITED TO THE SWAT TEAM BECAUSE OF THOSE REQUIREMENTS.

SO FOR 2024, IN ADDITION TO MAINTAINING OUR CURRENT INVENTORY AND REPLENISHING EXPENDED ITEMS, THE DEPARTMENT IS SEEKING TO MAKE TWO PURCHASES AND ONE EXCHANGE OF EQUIPMENT.

THE CARLSBAD POLICE DEPARTMENT IS SEEKING THE PURCHASE OF FOUR NEW DRONES.

THESE DRONES ARE UPGRADED MODELS AND THEY'RE INTENDED TO REPLACE CURRENT INVENTORY THAT'S BECOME OBSOLETE.

THE TOTAL NUMBER OF DRONES IN THE INVENTORY WOULD NOT EXCEED 12, WHICH IS WHERE WE'RE CURRENTLY AT AS WE WOULD RETIRE WHATEVER WE REPLACE.

TO BOLSTER OUR DE-ESCALATION PRACTICES, THE CARLSBAD POLICE DEPARTMENT INTENDS TO OUTFIT MORE FIELD PERSONNEL WITH HIGHLY ACCURATE, LESS LETHAL 40 MILLIMETER LAUNCHERS.

THIS WOULD BE REPLACING BEANBAG SHOTGUNS, WHICH, AGAIN, ARE ARE KIND OF BECOMING OUT OF DATE AND OBSOLETE.

WE'RE SEEKING TO ADD AT MOST 16 40 MILLIMETER LAUNCHERS TO OUR CURRENT APPROVED INVENTORY OF EIGHT.

AND THEN THE SWAT TEAM WE HAVE TWO MORE THE SWAT TEAM WILL BE EXCHANGING CURRENT THEIR CURRENT RIFLES FOR A SMALLER CALIBER PLATFORM.

THE EXCHANGE OF THESE RIFLES WILL REDUCE AMMUNITION COSTS YEAR OVER YEAR BY SWITCHING TO A CALIBER THAT'S CURRENTLY USED BY THE REST OF THE DEPARTMENT.

AND THEN IN 2023, WE WERE WE APPLIED FOR AND WERE AWARDED A PRIORITY THREE UASI GRANT FOR THE ACQUIREMENT OF A NEW BEARCAT. SHOULD THIS GRANT BE AWARDED, THE PURCHASE WOULD NOT BE REALIZED FOR SEVERAL YEARS AND INTO THE FUTURE, BUT WE FELT THAT WE SHOULD DISCLOSE THAT OUT OF AN ABUNDANCE OF CAUTION.

FOR FUTURE ACQUISITIONS OF ADDITIONAL NON CONSUMABLE EQUIPMENT CURRENTLY HELD IN THE DEPARTMENT'S INVENTORY, THE POLICE DEPARTMENT RECOMMENDS AMENDING THE CURRENT POLICY TO ADD WHAT'S FEATURED HERE IN RED.

THIS AMENDMENT WOULD ALLOW FOR THE DEPARTMENT TO PURCHASE ADDITIONAL ITEMS THAT HAVE ALREADY BEEN APPROVED BY COUNCIL, SHOULD THE NEED FOR EXPANSION OCCUR MID-YEAR.

THIS CHANGE WOULD BRING CARLSBAD POLICE IN ALIGNMENT WITH INDUSTRY BEST PRACTICES, SO OTHER AGENCIES ACROSS THE COUNTY ARE ALREADY OPERATING IN THE PROPOSED WAY. SO AS THE MILITARY EQUIPMENT COORDINATOR WORKING CLOSELY WITH THE CITY ATTORNEY'S OFFICE, I HAVE PREPARED THE FOLLOWING RECOMMENDATION TO RECEIVE THE POLICE DEPARTMENT'S ANNUAL MILITARY EQUIPMENT REPORT.

HOLD A PUBLIC HEARING TO RECEIVE PUBLIC COMMENT.

MAKING OUR PRESENTATION TODAY IS OUR SENIOR PLANNER, JASON GOFF, JASON.

THANK YOU MAYOR. MEMBERS OF THE COUNCIL.

TONIGHT, THE COMMUNITY DEVELOPMENT DEPARTMENT IS HERE TO PRESENT A DEVELOPMENT PROPOSAL TO REPLACE AN EXISTING ATTRACTION WITHIN THE LEGOLAND CALIFORNIA THEME PARK.

MORE SPECIFICALLY, THE CITY COUNCIL IS BEING ASKED TO APPROVE A PROPOSAL TO REPLACE THE LEGOLAND DRIVING SCHOOL AND JUNIOR DRIVING SCHOOL ATTRACTIONS WITH A NEW SPACE THEMED ATTRACTION CONSISTING OF AN INDOOR ROLLER COASTER, A ROTATIONAL TYPE RIDE, A CHILDREN'S PLAY STRUCTURE, AND A PLAY AREA FOR TODDLERS. THE PROJECT IS BEING PRESENTED TO THE CITY COUNCIL BECAUSE THE CARLSBAD RANCH SPECIFIC PLAN REQUIRES THAT ANY DEVELOPMENT PERMIT THAT INCLUDES STRUCTURES OVER 35FT BE REVIEWED AND DECIDED UPON BY THE CITY COUNCIL.

WITH THIS APPLICATION, LEGOLAND IS REQUESTING APPROVAL OF INCREASED BUILDING HEIGHT OR MORE SPECIFICALLY, THE BUILDING THAT IS HOUSING THE INDOOR ROLLER COASTER A S RENDERED HERE ON THIS SLIDE IS A SINGLE STRUCTURE, SINGLE STORY STRUCTURE WITH A PROPOSED BUILDING HEIGHT OF 43FT.

PER THE SPECIFIC PLAN, ALL BUILDINGS WITHIN LEGOLAND SHALL NOT EXCEED A HEIGHT OF 35FT OR THREE LEVELS.

HOWEVER, THE SPECIFIC PLAN DOES ALLOW FOR ADDITIONAL BUILDING HEIGHT UP TO A MAXIMUM OF 45FT THROUGH A SITE DEVELOPMENT PLAN APPROVED BY CITY COUNCIL, PROVIDED THAT THE BUILDING DOES NOT CONTAIN MORE THAN THREE LEVELS.

ALL REQUIRED SETBACKS ARE AT LEAS ARE INCREASED AT A RATIO OF ONE HORIZONTAL FOOT FOR EVERY ONE FOOT OF VERTICAL CONSTRUCTION BEYOND 35FT, AND THE ADDITIONAL SETBACK AREA IS MAINTAINED AS LANDSCAPED OPEN SPACE.

THIS PROJECT MEETS ALL CRITERIA, AND THAT THE PROPOSED BUILDING CONSISTS OF ONE STORY, AND THE EIGHT FEET OF INCREASED BUILDING HEIGHT IS OFFSET BY AN INCREASED LANDSCAPE SETBACK OF GREATER PROPORTION, SPECIFICALLY WHERE THE 43 FOOT LANDSCAPE SETBACK WOULD OTHERWISE BE REQUIRED A 55 FOOT LANDSCAPE ALREADY EXISTS AS MAINTAINED OPEN SPACE.

THE REQUIRED PERMITS ASSOCIATED WITH THIS PROJECT INCLUDE A SITE DEVELOPMENT PLAN FOR THE REASONS PREVIOUSLY DISCUSSED, AND A COASTAL DEVELOPMENT PERMIT BECAUSE THE PROJECT SITE IS LOCATED WITHIN THE COASTAL ZONE.

THE PROJECT WAS ANALYZED FOR CONSISTENCY WITH THE CITY'S GENERAL PLAN, THE MELLOW TWO SEGMENT OF OUR CITY'S LOCAL COASTAL PROGRAM, THE CARLSBAD RANCH SPECIFIC PLAN, AND ALL REQUIRED CITY CODES, POLICIES AND STANDARDS, INCLUDING THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.

THE STAFF REPORT AND RESOLUTION IS BEFORE THE COUNCIL, CONTAINS ALL THE ANALYSIS AND FINDINGS TO SUPPORT THE RECOMMENDATION.

AT THE JANUARY 17TH PLANNING COMMISSION HEARING, THE STAFF PRESENTED THE PROJECT AND THE PLANNING COMMISSION VOTED TO RECOMMEND APPROVAL BY A VOTE OF 6 TO 0.

WITH COMMISSIONER LAFFERTY RECUSED, NO MEMBERS OF THE COMMUNITY SPOKE AT THE HEARING.

GREAT. THANK YOU SIR. ITEM SEVEN IS THE CALIFORNIA COASTAL COMMISSION SUGGESTED MODIFICATIONS TO AMENDMENTS TO CARLSBAD MUNICIPAL CODE TITLE 22, OR, I'M SORRY, 21 FOR HOUSING ELEMENT PROGRAM IMPLEMENTATION AND THE 2022 ZONING ORDINANCE CLEANUP.

MAKING OUR PRESENTATION TODAY IS OUR CITY PLANNER ERIC LARDY, SIR.

GOOD EVENING, MAYOR AND MEMBERS OF THE CITY COUNCIL.

I'LL START THE PRESENTATION WITH BACKGROUND, GO OVER THE RECOMMENDED ORDINANCE REVISIONS AND CONCLUDE WITH OUR RECOMMENDATION.

THIS ACTION RELATES TO TWO ACTIONS THE CITY COUNCIL TOOK IN 2022.

THE FIRST TO IMPLEMENT HOUSING ELEMENT PROGRAMS IN THE FIRST YEAR OF THE HOUSING CYCLE, AND THE SECOND WAS THE 2022 ZONING ORDINANCE CLEANUP.

BOTH PROJECTS AMEND THE ZONING ORDINANCE, WHICH IS PART OF THE CITY'S LOCAL COASTAL PROGRAM.

THESE AMENDMENTS WERE BATCHED TOGETHER AND SUBMITTED TO THE COASTAL COMMISSION AT THE END OF 2022.

THE COMMISSION TOOK ACTION IN FEBRUARY 2022 ON THE ITEMS, BUT SUGGESTED SOME MODIFICATIONS TO THE ADOPTED LANGUAGE.

SINCE THE MODIFICATIONS ARE DIFFERENT THAN WHAT THE CITY COUNCIL APPROVED, THE CITY COUNCIL NEEDS TO CONSIDER THESE CHANGES.

THIS IS COMMON FOR AMENDMENTS TO OUR ZONING ORDINANCE.

I'LL NOW SUMMARIZE THE SUGGESTED MODIFICATIONS.

FOR THE HOUSING ELEMENT PROGRAMS THE ORIGINAL PROPOSED ACTION WAS TO MODIFY OUR REQUIREMENTS RELATED TO AFFORDABLE HOUSING PROJECTS, CLARIFYING THAT ONLY OBJECTIVE LAND USE STANDARDS COULD BE APPLIED.

THE COASTAL COMMISSION PROPOSED MODIFICATIONS THAT CLARIFIED THAT SUBJECTIVE STANDARDS ARE STILL ALLOWED TO BE APPLIED TO PROJECTS WITHIN THE COASTAL ZONE, IF THEY'RE PROVIDED TO PROTECT COASTAL RESOURCES UNDER THE COASTAL ACT, STATE HOUSING LAW DOES NOT OVERRULE THE STATE COASTAL ACT.

THE FIRST OF THE TWO SUGGESTED MODIFICATIONS FROM THE 2022 ZONING ORDINANCE CLEANUP IS RELATED TO MOBILE HOMES, ADDING REFERENCES THAT MOBILE HOME PARKS MUST COMPLY WITH THE LOCAL COASTAL PROGRAM AS IT'S APPLICABLE.

AND THEN THE SECOND CHANGE RELATED TO THE ZONING ORDINANCE IS RELATED TO SMALL WIRELESS FACILITIES.

AGAIN, ADDING LANGUAGE, JUST CLARIFYING THAT SMALL WIRELESS FACILITIES ARE SUBJECT TO THE LOCAL COASTAL PROGRAM AS WELL AS COASTAL DEVELOPMENT PERMITS IF THEY'RE PROPOSED WITHIN THE COASTAL ZONE.

IT IS OUR RECOMMENDATION THAT THESE MODIFICATIONS BE APPROVED.

IF THEY ARE NOT APPROVED, THE MODIFICATIONS WOULD NOT BE EFFECTIVE IN THE COASTAL ZONE ENTIRELY.

SOME OF THE AMENDMENTS WERE IMPLEMENTING PROGRAMS IN THE HOUSING ELEMENT, AND IF THEY ARE NOT APPROVED IN THE COASTAL ZONE, THE STATE COULD REVIEW OUR ELEMENT FOR COMPLIANCE.

SO THIS CONCLUDES OUR PRESENTATION.

OUR RECOMMENDATION, OUR RECOMMENDED ACTION THIS EVENING, IS TO RECEIVE AN UPDATE ON THE AMENDED MANAGEMENT PLAN AND TO PROVIDE DIRECTION TO CITY STAFF AS APPROPRIATE. TONIGHT WE ARE PRESENTING THE CHANGES TO THE MANAGEMENT PLAN AND GIVING A STATUS UPDATE ON ADDITIONAL ACTIONS THAT WERE APPROVED BY THE CITY COUNCIL ON MARCH 12TH.

THE UPDATED MANAGEMENT PLAN IS INCLUDED IN YOUR STAFF REPORT AS EXHIBIT TWO AND REFLECTS CHANGES TO INCLUDE SECURITY ON SITE AT BOTH LOCATIONS, AND A GUEST CHECK IN AND CHECK OUT PROCEDURE, AND 24/7 REMOTE VIDEO MONITORING.

IN ADDITION TO THE, AS MENTIONED, IN ADDITION TO THE UPDATE TO THE MANAGEMENT PLAN, WE'RE ALSO PROVIDING SOME STATUS UPDATES ON SOME OF THE OTHER ACTION ITEMS THAT WERE RECOMMENDED ON MARCH 12TH.

SO STAFF HAS CONFIRMED THAT THE COUNTY HAS AUTHORIZED USING THE PROJECT'S OPERATING RESERVES FOR ON SITE SECURITY.

SO TO HELP THE PROJECT IN COMING YEARS, THE CITY WILL ADVOCATE TO THE CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR PERMANENT SUPPORTIVE HOUSING PROJECTS TO BE ABLE TO USE A HIGHER PERCENTAGE OF OPERATING RESERVES IN THE FIRST FIVE YEARS THAN IS CURRENTLY ALLOWED.

JUST THIS AFTERNOON, THE COUNTY BOARD OF SUPERVISORS SUPERVISORS VOTED TO DEVELOP A PLAN FOR USING NO PLACE LIKE HOME OPERATING RESERVE FUNDS TO ADD SUPPLEMENTAL SECURITY AT WINDSOR POINTE, AND TO ADVOCATE TO THE STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT TO MAXIMIZE THE FUNDING FLEXIBILITY OF CAPITAL OPERATING RESERVES FOR THE WINDSOR POINTE PROJECT.

WE ARE ALSO WORKING WITH ALL PROJECT PARTNERS TO DIVERT ISSUES TO ON SITE PERSONNEL, AS OPPOSED TO PUBLIC SAFETY.

AT TODAY'S COUNTY BOARD OF SUPERVISORS MEETING, THEY DID VOTE TO CONDUCT A STAFFING STUDY TO ENSURE ADEQUATE STAFFING SEVEN DAYS A WEEK THAT CAN ADDRESS BEHAVIORAL HEALTH CONCERNS ON SITE.

THIS INCLUDES TRAINING FOR ALL ON SITE PERSONNEL TO RECEIVE MENTAL HEALTH FIRST AID TRAINING, AND TO BE TRAINED ON HOW TO REFER PEOPLE TO 24/7 BEHAVIORAL HEALTH RESOURCES. ON RESIDENT SERVICES SIDE, THE COUNTY BEHAVIORAL HEALTH SERVICES HAS CONFIRMED A PART TIME BEHAVIORAL HEALTH CLINICIAN TO BE ON SITE 20 HOURS PER WEEK, AND THIS IS OVER A FIVE DAY PERIOD.

AND THEN AGAIN JUST THIS AFTERNOON, THE COUNTY BOARD OF SUPERVISORS VOTED TO ANALYZE ALL OPTIONS AND OPPORTUNITIES TO MAXIMIZE THE LEVEL OF SERVICES AND HOURS OF ON SITE CASE MANAGEMENT SERVICES AND REFERRALS TO BEHAVIORAL HEALTH SERVICES FOR WINDSOR POINTE, AND TO IMPLEMENT A PILOT PROGRAM TO INCREASE SERVICES FOR RESIDENTS LIVING IN NO PLACE LIKE HOME UNITS TO BE ABLE TO HAVE MORE ENHANCED CLINICAL SUPPORT SERVICES SEVEN DAYS A WEEK.

JUST THIS MORNING, THE CITY COUNCIL LEGISLATIVE SUBCOMMITTEE MET TO SUPPORT EFFORTS TO ADVOCATE REGARDING ADVOCACY TO ADDRESS THE COORDINATED ENTRY PROCESS REFERRAL PROCESS, AND ALSO MATTERS RELATED TO INCOME CAPS FOR VETERANS.

WE ALSO FOUND OUT THIS AFTERNOON THAT REPRESENTATIVE LEVIN HAS BEEN ENGAGED ON THIS ISSUE, AND WILL SOON INTRODUCE LEGISLATION TO EXCLUDE VA DISABILITY COMPENSATION AND PENSION BENEFITS FROM HUD'S DEFINITION OF INCOME.

I WANT TO POINT OUT THAT THIS UPDATE THIS EVENING IS JUST TO BRING BACK THE CHANGES TO THE MANAGEMENT PLAN, AND A NUMBER OF OTHER ACTIONS APPROVED BY THE CITY COUNCIL IN MARCH ARE STILL IN PROGRESS AND IN PROCESS.

OUR WORK IS CONTINUING AND AS DIRECTED IN MARCH, WE WILL COME BACK IN AUGUST WITH AN UPDATE ON THE REST OF THOSE ADDITIONAL ACTIONS.

ONE IS IN THE AUGUST MEETING TO HAVE A REPORT OUT ON METRICS.

SO ARE THE ACTIONS THAT HAVE BEEN TAKING BEING EFFECTIVE AT REDUCING THE WORKLOAD ON THE POLICE.

SEEMS LIKE A STRAIGHT FORWARD THING TO DO AND WE CAN ACCESS WHETHER THE ACTIONS ARE BEING SUFFICIENT OR NOT IN TERMS OF THE PACE OF PROGRESS.

SO THAT WOULD BE ONE. THE SECOND IN REVIEWING THE AFFIRMATIVE HOUSING'S CONTRACT AT WHAT THEY CALL THEIR PROPERTY MANAGEMENT PLAN, IT'S VERY HEAVY ON MAKING SURE THE RENT GETS PAID AND IT'S FAIRLY BASED ON CONTENT.

AND IF YOU LOOK AT THE SECTION THAT TALKS ABOUT CAUSES FOR EVICTION, IT REFERS TO THE GUEST POLICY AND SOME OTHER THINGS IN VERY VAGUE WAYS.

I KNOW COUNCIL HAS TAKEN ACTION TO IMPROVE THE SITUATION AND I THANK YOU FOR THAT.

BUT IS IT MOVING FAST ENOUGH? THE RECOMMENDATIONS WERE CHANGED FOR CHANGE WERE MADE ONE YEAR AGO IN A LETTER TO THE CITY AND COUNCIL.

THE WINDSOR RESIDENTS NEED MORE HELP AND OUR COMMUNITY NEEDS MORE PROTECTION FROM CRIME.

I URGE COUNCIL TO MOVE FASTER, TO BUILD ON THE PROGRESS YOU'VE ALREADY MADE, TO ADD MORE MENTAL HEALTH PROFESSIONALS, TO EASE THE BURDEN ON OUR POLICE DEPARTMENT, AND TO EVICT THOSE THAT ARE CREATING AN UNSAFE ENVIRONMENT.

THIS SITUATION IS AFFECTING ALL OF US, NOT JUST THE PEOPLE WHO LIVE NEARBY.

MAKE FASTER PROGRESS BY PRIORITIZING STRICTER RULES SO THAT ALL CARLSBAD CITIZENS, INCLUDING THE GOOD CITIZENS WHO LIVE AT WINDSOR POINTE, CAN ENJOY A SAFE AND CALM ENVIRONMENT.

THERE'S 23 KIDS ON THE BLOCK.

I JUST HEARD A STORY FROM A LOCAL MOM THAT SHE MET ONE OF THE TENANTS WHO TOLD HER THAT HE HAD JUST BEEN RELEASED FROM PRISON FOR MURDER.

AND THEN HE STALKED HER.

NOW I'M 100% FOR GOOD SOLUTIONS FOR THE HOMELESS PROBLEM.

WINDSOR POINTE IN ITS CURRENT ITERATION IS NOT ONE OF THEM.

TENANTS CANNOT BE PROPERLY SECURED FROM OUTSIDER INFILTRATION, MAKING TENANTS AND NEIGHBORS UNSAFE.

THE ONLY THING WE SHOULD BE TALKING ABOUT AT THIS POINT IS, IS THIS THE RIGHT LOCATION FOR WINDSOR POINTE? CLEARLY IT IS NOT OR WE WOULDN'T STILL BE TALKING ABOUT THIS.

IN ADDITION, IN THE LAST FEW WEEKS SOCIAL MEDIA POSTS THE NEWS REPORTS HAVE UNCOVERED INTERNAL EMAILS AND OTHER DOCUMENTATION FROM THE CITY WHICH REVEAL MANY MANY DISTURBING ISSUES ABOUT WINDSOR POINTE'S ORIGIN AND OPERATION.

WE WOULD LIKE SOME ANSWERS TO THE FOLLOWING QUESTIONS, THOUGH I KNOW THIS ISN'T QUESTION AND ANSWER AND ANSWERS CAN FROM THE LATER.

THESE QUESTIONS WERE PREVIOUSLY PROVIDED BY EMAIL AND THERE ARE MORE DETAILS ON THOSE EMAILS.

QUESTIONS TO THE CITY MANAGER.

WAS THE CITY MANAGER AWARE THAT AFFIRMED HOUSING WROTE STAFF REPORTS FOR WINDSOR POINTE AND SENT STAFF REPORTS TO THE PRINCIPAL PLANNER, DAVID [INAUDIBLE] DE CORDOVA, JUST PRIOR TO THE FINAL APPROVALS AT WINDSOR POINTE? IS IT NORMAL PRACTICE TO HAVE OUTSIDE VENDORS WRITING STAFF REPORTS? IS THIS WHY NO PLACE LIKE HOME FUNDING OBLIGATIONS THAT ARE EXTREMELY HARMFUL TO THE COMMUNITY WERE OMITTED FROM THE CITY COUNCIL PRESENTATION MATERIALS.

DID YOU EXPLAIN TO THE COUNCIL WHAT THE NO PLACE LIKE HOME PROGRAM WAS AND WHAT ITS OBLIGATIONS ARE? WAS THERE ANY KIND OF INFORMATION WORKSHOP ABOUT IT SO THAT THEY CAN MAKE INFORMED DECISIONS? DID YOU COMMUNICATE THAT IT WOULD LITERALLY IMPORT HOMELESS WITH CRIMINAL HISTORIES FROM OTHER PARTS OF THE COUNTY, AGAIN, OTHER PARTS OF THE COUNTY AND DROP THEM INTO A NEIGHBORHOOD FULL OF KIDS.

DID YOU EVEN KNOW WHAT THE WINDSOR POINTE WHAT THE NO PLACE LIKE HOME PROGRAM OBLIGATION WERE.

IT APPEARS THAT EITHER YOU DIDN'T KNOW WHAT THIS PROGRAM'S OBLIGATIONS WERE, OR YOU WILLFULLY WITHHELD THEM FROM THE COUNCIL.

WHAT IS THE CURRENT STATUS OF THE FOUR POINT OF THE $4 MILLION LOAN? HOW MUCH HAS BEEN REPAID, AND WHAT'S THE INTEREST ON THAT LOAN? HOW MUCH HAS BEEN SPENT IN CITY SERVICES FOR THE APPROXIMATELY 800 CALLS FOR FIRST RESPONDER NEEDS.

WAS THE CITY MANAGER AWARE THAT AFFIRMED HOUSING WAS MAKING ESCALATING THREATS TO THE CITY STAFF REGARDING AFFIRMS DESIRE NOT TO HAVE WINDSOR POINTE DISCUSSED AT CITY COUNCIL MEETINGS? WAS THE CITY MANAGER AWARE THAT AFFIRMED HOUSING TOLD CITY STAFF THAT DESPITE PROMISING THE COMMUNITY THAT THERE WOULD BE TENANT BACKGROUND CHECKS, THAT THERE WOULD BE NON TENANTS LIVING AT WINDSOR POINTE AND I QUOTE FOR SUPPORT.

WHO WOULD NOT BE BACKGROUND CHECKED OR EVEN KNOWN TO AFFIRMED OR THE PROGRAM MANAGERS.

WAS THE CITY MANAGER AWARE THAT CITY STAFF DID NOT HAVE EVEN A BASIC UNDERSTANDING OF HOW SECURITY AT WINDSOR POINTE WOULD WORK? SO MUCH SO THAT AFFIRMED LITERALLY WROTE THE ANSWERS FOR STAFF ON THE FAQ PAGE OF THE WINDSOR POINTE WEBSITE OF THE CITY OF WINDSOR POINTE'S WEBSITE.

WAS THE CITY MANAGER AWARE THAT AFFIRMED WAS ASKING TO MEET WITH RESIDENTS WITHOUT CITY STAFF PRESENT.

UNDER SIX UNDER SECTION 6.5 OF THE GROUND LEASE THE CITY ALLOWED IS ALLOWED THE RIGHT OF INSPECTION TO THE 24 TO THE PROPERTIES WITH 24 HOUR NOTICE.

HAS THE CITY EVER INSPECTED THE PROPERTY TO ENSURE THAT IT'S BEING KEPT IN GOOD REPAIR, AS REQUIRED UNDER THE GROUND LEASE? THE CITY PURPORTS THAT WINDSOR POINTE, WINDSOR POINTE IS IS VETERAN HOUSING, BUT MANDY MILLS SAID AT THE LAST MEETING THAT IT DOES NOT TRACK THE NUMBER OF VETERANS.

IS THERE ANY MONITORING MONITORING OF WINDSOR POINTE OBLIGATIONS AT ALL UNTIL WE ASK QUESTIONS? WHY DOES THE STAFF REPORT IGNORE A PREMIER SAFETY EXPERT, THE CHIEF OF POLICE, WHO RECOMMENDS A 24 /7 ENHANCED SECURITY TEAM FOR BOTH LOCATIONS.

AND LET ME READ YOU FROM HIS HIS LETTER ON SEPTEMBER 5TH, 2023.

UNIFORM SECURITY.

HE'S ADVOCATING FOR UNIFORM SECURITY ON SITE AT BOTH LOCATIONS 24 HOURS A DAY, SEVEN DAYS A WEEK.

HE WANTED TO CHANGE THE POLICY AND REQUIRE ALL VISITORS TO CHECK IN AND OUT OF THE FACILITY TO INCLUDE RECORDING THEIR IDENTIFICATION AND VEHICLE INFORMATION OF VISITORS.

HOWEVER, WE GET THE CITY STAFF REPORT RECOMMENDATIONS AND IT'S SIMPLY ON SITE SECURITY AT BOTH LOCATIONS 12 HOURS PER NIGHT AND REQUIRING VISITORS TO SIGN A GUEST BOOK.

THAT SEEMS LIKE SOME PRETTY HARSH DISRESPECT FOR THAT OFFICE.

ARE YOU AWARE THAT THERE ARE NOW MORE SECURITY RESTRICTIONS IN PLACE FOR PEOPLE ATTENDING THE CITY SPONSORED CONCERTS IN THE PARK THAN THERE ARE PEOPLE ENTERING WINDSOR POINTE? IF A GUEST BOOK IS EFFECTIVE SECURITY AT WINDSOR POINTE, WHY DON'T WE JUST USE A GUEST BOOK AT THE ENTRANCES TO THOSE CONCERTS INSTEAD OF USING A METAL DETECTOR WAND?

AND WHY ARE THE TERMS OF THE GROUND LEASE NOT ENFORCED? IN THIS GROUND LEASE WERE AFFIRMED HOUSING, SOLARI AND OTHERS, WERE THEY IN GOOD STANDING WITH THE SECRETARY OF STATE AT THE TIME OF THE LEASE WAS SIGNED, AS REQUIRED BY PAGES 2 AND 47 OF THE LEASE, AND HAS THIS SECTION OF THE LEASE BEEN BREACHED? ON PAGE 19 OF THE GROUND LEASE, THE SIGNATORIES ARE REQUIRED TO RUN A QUALITY OPERATION, WITH THE LITANY OF ON SITE CRIMES SO EXTENSIVE THAT THE CHIEF OF POLICE HAD TO WRITE A LETTER OF COMPLAINT.

DO YOU BELIEVE AFFIRMED AND THE PROPERTY MANAGEMENT COMPANY ARE IN COMPLIANCE WITH THAT REQUIREMENT? IS THIS A QUALITY OPERATION? HAS THIS SECTION OF THE LEASE BEEN BREACHED? WHEN THE CHIEF OF POLICE REQUESTED A FIRM TO OBTAIN PRIVATE SECURITY AT WINDSOR POINTE, THEY STATED THEY COULDN'T AFFORD SECURITY, BUT INSTEAD SPENT MORE THAN $600,000 ON POLITICAL CAMPAIGNS.

IS THIS A BREACH OF THE REQUIREMENTS ON PAGE 20 OF THE GROUND LEASE TO ABATE ANY MATERIAL VIOLATION OF THE GROUND LEASE? AND DO YOU BELIEVE AFFIRM IS IN MATERIAL VIOLATION OF ANY, ANY SECTION OF THE GROUND LEASE? IF SO, WHY IS THE CITY NOT PURSUING LEASE TERMINATION AS PROVIDED ON PAGES 44 AND 45 OF THE GROUND LEASE? DO ANY PROPERTY MANAGERS UNDER UNDER AFFIRMED, SOLARI OR [INAUDIBLE] HAVE BACKGROUNDS IN DEALING WITH RESIDENTS WITH SEVERE MENTAL ILLNESS? THAT'S ALSO A VIOLATION OF THE LEASE.

AND KNOWING THAT A PERSON HAS FALLEN OUT OF THE THIRD STORY BALCONY, THERE WAS A CHILD MOLESTED ON SITE AND ATTEMPTED MURDERERS.

DO YOU BELIEVE THE CURRENT $2 MILLION IN TOTAL INSURANCE COVERAGE IS ADEQUATE FOR WINDSOR POINTE? SHOULD THE GROUND LEASE BE TERMINATED DUE TO AFFIRMED OTHERS NOT BEING IN GOOD STANDING WITH THE SECRETARY OF STATE'S OFFICE AT THE TIME OF SIGNING, AND FOR MULTIPLE BREACHES OF THEIR OBLIGATIONS.

AND WHY WAS THE CALIFORNIA STATE CONSTITUTION ARTICLE 34 IGNORED AT THE TIME OF DEVELOPMENT? IT REQUIRES NEW, AND, I QUOTE, LOW RENT HOUSING PROJECTS FINANCED IN WHOLE OR IN PART BY A PUBLIC BODY, BE AUTHORIZED BY PUBLIC VOTE.

FOR MANDY MILLS, HOW MANY WINDSOR POINTE RESIDENTS HAVE CRIMINAL HISTORIES AND HOW MANY ARE RECENTLY OUT OF INCARCERATION? WE'VE BEEN ABLE TO CONFIRM THREE RESIDENTS SO FAR, AND 100% OF THEM HAVE CRIMINAL RECORDS, INCLUDING MURDER.

NOW THERE ARE SOME NOT SPEAKING UP TONIGHT.

NOT COMING HERE BECAUSE THEY FEEL COMMUNITY CONCERNS ARE CONCERNS ARE NOT RESPECTED.

SAYING WHY BOTHER? IS THAT THE KIND OF GOVERNING THAT YOU WANT TO RUN HERE? ARE YOU GOING TO FIX THIS FOR THE NEIGHBORHOOD? INSTEAD OF SPINNING POLICE CALL STATISTICS AND IGNORING THE OVERWHELMING POSITION OF THE COMMUNITY, IT'S TIME TO VIEW THE CURRENT ITERATION OF WINDSOR POINTE AS A TEACHABLE MOMENT THAT NEEDS REMEDY.

THAT REMEDY IS IMPROVEMENT.

WE'RE CERTAINLY NOT PREVENTED FROM IMPROVING WINDSOR POINTE.

THAT IMPROVEMENT WOULD BE RELOCATING TENANTS TO A PROPERLY DESIGNED, CENTRALIZED BUILDING WHERE SINGLE, WHOSE SINGLE ENTRANCE CAN BE PROPERLY SECURED TO PREVENT NONRESIDENT INFILTRATION.

TENANTS ARE CLEARLY NOT SAFE AS IT IS, AND NEIGHBORS ARE CLEARLY NOT SAFE AS IT IS.

AND MY FATHER, WHO'S A VETERAN, ASKED ME TO ASK FOR US TO CHECK THE VETERAN STATUS FOR HONORABLE DISCHARGES OF VETERANS THAT WE HAVE LIVING THERE. THANK YOU.

LISTEN TO YOUR CONSTITUENTS, THEY NO LONGER FEEL SAFE.

ADDING SECURITY DOES NOTHING FOR THE SURROUNDING NEIGHBORHOOD.

THE CITY'S OWN HOUSING PLAN AND WEBSITE STATES THAT THIS ENTIRE PROJECT OF WINDSOR POINTE IS FOR PERSONS OF LOW INCOME.

LAST I CHECKED, 100% IS MORE THAN 49%.

THIS PROJECT IS IN VIOLATION OF ARTICLE 34 OF THE CALIFORNIA CONSTITUTION.

AND BY THE WAY, THIS PROJECT IS IN VIOLATION OF THE CARLSBAD CITY CHARTER AS WELL.

THE CARLSBAD CITY CHARTER ARTICLE THREE, SECTION 300 STATES THE INTENT OF THE CHARTER IS TO ALLOW THE CITY COUNCIL AND THE VOTERS TO EXERCISE THE MAXIMUM DEGREE OF CONTROL OVER LAND USE MATTERS WITHIN THE CITY OF CARLSBAD.

THE CITY COUNCIL DID NOT LET THE CITIZENS VOTE ON THIS PROJECT.

PERHAPS IT'S SOMEONE THAT DOES DAILY LIVING SKILLS CARE OR SOMETHING LIKE THAT.

WHAT IS WHAT IS THE AFFIRMED OR [INAUDIBLE] COMPANIES PROCEDURE FOR QUALIFYING SOMEONE AS A SUPPORT PERSON? DO WE KNOW? YEAH.

SO THE IN-HOME SUPPORTIVE SERVICES WORKER WOULD GO THROUGH THE SAME BACKGROUND CHECK AS A TENANT, AND THEY HAVE TO SIGN THE SAME LEASE AGREEMENT AS A TENANT.

AND AT THIS POINT IN TIME, THERE IS ONE IN HOME SUPPORTIVE SERVICES AT WINDSOR POINTE.

THERE'S ONE TENANT THAT HAS SUPPORT SERVICE.

AN IN-HOME.

IN-HOME. THAT'S THE OTHER THING IS THAT I GUESS IT'S BEEN A LITTLE BIT CONFUSING FOR COMMUNITY TO UNDERSTAND IF SOMEONE'S THERE AND THEY STAY ONE NIGHT, THAT'S OKAY, BUT THEY CAN'T EXCEED A CERTAIN NUMBER OF NIGHTS UNTIL THEY HAVE TO BE EITHER ON THE LEASE OR BE DEEMED ONE OF THESE SUPPORT PEOPLE.

SURE. OF COURSE. SO THERE'S TWO DIFFERENT METHODS FOR BEING ACCEPTED OR REFERRED TO WINDSOR POINTE.

SO FOR THE 24 NO PLACE LIKE HOME UNITS, THOSE RESIDENTS ARE REFERRED THROUGH THE COORDINATED ENTRY SYSTEM.

SO THAT'S REGIONAL TASK FORCE ON HOMELESS.

AND THEY HOUSE OR MANAGE THE THE REFERRAL PROCESS FOR THE WHOLE REGION.

AND SO THOSE ARE FOLKS THAT THEY ARE CHRONICALLY HOMELESS OR AT RISK.

AND THEY ARE ALSO HAVE A SERIOUS MENTAL ILLNESS.

SO THEY ARE CONSIDERED THEY WOULD BE CONFIRMED THROUGH THE COUNTY BEHAVIORAL HEALTH TO HAVE A DIAGNOSIS OF A SERIOUS MENTAL ILLNESS.

THEN THOSE WOULD BE REFERRED TO [INAUDIBLE] AND THEY WOULD DO THE BACKGROUND CHECK.

AND I WOULD SAY ON THE VETERANS STATUS FOR THOSE, IT IS STILL A PREFERENCE FOR THOSE 24 UNITS, NOT A LOT OF FOLKS HAVE BEEN REFERRED OR ACTUALLY HAVE ACCEPTED A UNIT THERE, BECAUSE THERE ARE A NUMBER OF OTHER UNITS.

I GUESS THIS IS GOOD NEWS AND BAD NEWS.

THERE ARE A NUMBER OF OTHER UNITS WITHIN THE COUNTY THAT ARE A VETERAN ONLY, YOU KNOW, PROGRAM.

AND SO UNITS GENERALLY FOLKS WHO HAVE A VETERAN STATUS THROUGH COORDINATED ENTRY ARE REFERRED TO A VETERAN ONLY UNIT BECAUSE OTHERWISE IF THAT IF THERE IS NOBODY TO PLACE IN THAT UNIT OR TO REFER TO THAT UNIT, THAT UNIT DOES GO EMPTY.

THAT'S DIFFERENT THAN THIS BECAUSE THIS IS A PREFERENCE.

SO THAT'S ONE REASON WHY ON THE NO PLACE LIKE HOME SIDE, YOU'RE NOT SEEING A LOT OF YOU'RE NOT SEEING VETERANS THERE.

IN ADDITION TO THAT, WE DISCUSSED THE REASON FOR THIS EXCLUSION OF VA INCOME IS THE INCOME REQUIREMENT FOR THE NO PLACE LIKE HOME UNITS IS EXTREMELY LOW AND WITH VA BENEFITS, IF SOMEBODY WERE TO HAVE, YOU KNOW, PENSION, DISABILITY, A VARIETY OF OTHER VA RESOURCES THEY MIGHT EXCEED THE INCOME REQUIREMENT AND BE DENIED.

SO THAT'S ON THE NO PLACE LIKE HOME SIDE.

AND THEN ON THE OTHER 24 UNITS THAT ARE SUPERVISED BY THE CITY'S REGULATORY AGREEMENT, AS WELL AS TAX CREDIT RULES, THOSE IT'S AN APPLICATION PROCESS FROM INDIVIDUALS.

AND THEN THERE IS A WAITING LIST.

SO FOLKS THAT ARE CARLSBAD AND VETERAN STATUS WOULD RECEIVE THE HIGHEST POINTS IN THAT PREFERENCE SYSTEM.

AND THEY WOULD MOVE TO THE TOP OF THE LIST.

AFTER THAT IT'S VETERAN STATUS AND THEN AFTER THAT IS A CARLSBAD AFFILIATION STATUS.

AND SO ORIGINALLY AT MOVE IN, THERE WERE 12 VETERANS THAT MOVED INTO THOSE 24 UNITS.

AND SINCE THEN, YOU KNOW, PEOPLE MOVE IN AND OUT.

AND AT THIS POINT IN TIME THERE ARE SIX.

WHEN YOU TALK ABOUT THAT THE APARTMENTS DEDICATED FOR NO PLACE LIKE HOME ELIGIBLE APPLICANTS, THERE ARE ADULTS WITH SERIOUS MENTAL ILLNESS, CHILDREN WITH SEVERE EMOTIONAL DISORDERS AND THEIR FAMILIES AND PEOPLE WHO REQUIRE OR ARE AT RISK OF REQUIRING ACUTE PSYCHIATRIC INPATIENT CARE, RESIDENTIAL TREATMENT, OR OUTPATIENT CRISIS INTERVENTION BECAUSE OF A MENTAL DISORDER WITH A SYMPTOM OF PSYCHOSIS, SUICIDALITY, VIOLENCE, HOMELESS, CHRONICALLY HOMELESS, OR AT RISK OF CHRONIC HOMELESSNESS.

AND THE COUNTY IDENTIFIES THOSE FOLKS.
