I INVITE GARY BARBERIO TO COME TO THE PODIUM AND IT'S MY PLEASURE TO READ THE PROCLAMATION TONIGHT.IT SAYS, GARY BARBERIO WILL BE RETIRING AFTER A DISTINGUISHED CAREER IN PUBLIC SERVICE OF OVER 40 YEARS, WORKING FOR FOUR DIFFERENT COASTAL CITIES IN SAN DIEGO COUNTY.
IN APRIL OF 2003, GARY BEGAN HIS OVER 22 YEAR CAREER WITH THE CITY OF CARLSBAD IN THE PLANNING DEPARTMENT, SERVING SUCH ROLES AS PRINCIPAL PLANNER, ASSISTANT PLANNING DIRECTOR AND COMMUNITY AND ECONOMIC DEVELOPMENT DIRECTOR.
APRIL OF 2013, GARY BEGAN SERVING IN THE CITY MANAGER'S OFFICE AS ASSISTANT CITY MANAGER.
SINCE 2019, HE HAS SERVED AS THE DEPUTY CITY MANAGER OF THE COMMUNITY SERVICES BRANCH, WHERE HE LED THE ESTABLISHMENT OF THE HOUSING AND HOMELESS SERVICES DEPARTMENT.
GARY HAS PLAYED A SIGNIFICANT ROLE IN NAVIGATING COMPLEX LAND USE ISSUES AND DEVELOPING POLICIES AND ORDINANCES THAT WILL FOREVER PROTECT THE UNIQUE CHARACTER THAT MAKES CARLSBAD A GREAT PLACE TO LIVE, WORK, AND PLAY, AND RAISE A FAMILY.
GARY HAS ALSO HELPED NEGOTIATE HIGH PROFILE REAL ESTATE TRANSACTIONS AND DEVELOPMENT DEALS THAT WILL GREATLY BENEFIT CARLSBAD FOR DECADES, INCLUDING THE CITY'S FIRST COMPREHENSIVE REAL ESTATE STRATEGIC PLAN, SECURING NEW AND TEMPORARY FIRE STATIONS, AGREEMENTS THAT HELPED BRING A FIBER OPTIC CABLE NETWORK TO THE CITY, AND MANY IMPORTANT OPEN SPACE ACQUISITIONS.

BUT THE NAME WILL REMAIN NAMELESS.
I WAS HIRED AS A PLANNING TECHNICIAN, MAKING $8.10 AN HOUR.
FAST FORWARD, 40 YEARS, AND I WILL BE RETIRING AT THE END OF THIS MONTH AFTER 22 YEARS WORKING FOR THE CITY OF CARLSBAD.

I KNOW THAT WAS A VERY LONG PROCESS, BUT REALLY JUST TRYING TO ENVISION WHAT THE BEST POSSIBLE FUTURE COULD BE FOR CARLSBAD WITH WHAT WE HAVE HERE, OTHER FAMOUS MOMENTS.
I MEAN, YOU HAVE SUCH A DEEP KNOWLEDGE OF WHAT OUR CITY HAS GONE THROUGH.
I WAS AT THE CARLSBAD HISTORICAL SOCIETY OPEN HOUSE THIS PAST WEEKEND, AND I WAS THINKING WHO AT THE CITY HAS A DEEPER KNOWLEDGE OF OUR HISTORY IN CARLSBAD THAN YOU, AND I DON'T THINK THERE IS SOMEONE, SO WE GOT TO MAKE SURE TO CAPTURE ALL OF THAT.
WE HAVE LOTS OF BOOKS THOUGH OVER THERE.

I'M A RETIRED LIBRARIAN AND I LIVE A HALF MILE FROM THE DOVE LIBRARY IN THE ALGA HILLS DEVELOPMENT.
ON THE MORNING OF DECEMBER 1ST, AROUND 9:00 A.M. SEVERAL HEAVILY ARMED INDIVIDUALS WEARING MASKS, LONG GUNS, AND TACTICAL VESTS WERE SEEN LESS THAN 100 FEET FROM THE ENTRANCE OF THE DOVE LIBRARY.
MULTIPLE HIGH SPEED VEHICLES WERE OBSERVED ENTERING AND EXITING THE LIBRARY PARKING LOT.
COMMUNITY MEMBERS WHO APPROACHED AND ASKED THE KIDNAPPERS TO IDENTIFY THEMSELVES IN THEIR PURPOSE RECEIVED NO CLEAR EXPLANATION.
A VIDEO DOCUMENTING THIS INCIDENT IS CIRCULATING WIDELY ON SOCIAL MEDIA, AND MANY RESIDENTS, MYSELF INCLUDED, ARE ALARMED.
THIS TYPE OF MILITARIZED ACTIVITY IS INTOLERABLE, ESPECIALLY IN QUIET AREAS FREQUENTED BY THE ELDERLY AND CHILDREN.
THIS IS NOT REFLECTIVE OF CARLSBAD VALUES, AND IT HARMS THE REPUTATION AND SAFETY OF OUR NEIGHBORHOODS AND THE CITY.
THE VERY NEXT DAY, THERE WAS AN ABDUCTION IN LA COSTA NEAR GIBRALTAR AVENUE.
ASIDE FROM THE OBVIOUS CRIMINALITY OF KIDNAPPING, IF THIS ACTIVITY IS BEING CARRIED OUT UNDER GOVERNMENT AUSPICES, THEN CALIFORNIA LAW, INCLUDING SB54, EXPLICITLY RESTRICTS THE USE OF LOCAL RESOURCES FOR FEDERAL IMMIGRATION ENFORCEMENT.
THE PRESENCE OF FEDERAL TACTICAL UNITS USING A PUBLIC LIBRARY PARKING LOT AS A STAGING AREA RAISES SERIOUS QUESTIONS ABOUT COMPLIANCE WITH STATE LAW AND ABOUT THE CITY'S ROLE IN PROTECTING COMMUNITY TRUST.

TONIGHT, I WILL BE PRESENTING OPTIONS FOR THE NEAR TERM AND LONG TERM IMPROVEMENTS ALONG KELLY DRIVE AND PARK DRIVE FOR YOUR CONSIDERATION.
OUR RECOMMENDED ACTIONS INCLUDE ADOPT RESOLUTION DIRECTING THE CITY MANAGER TO PROCEED WITH TWO PROPOSED NEAR TERM MEASURES AND DEVELOP EITHER SAFE ROUTES THE SCHOOL PLAN FOR KELLY ELEMENTARY SCHOOL, WHICH IS OUTLINE ADDITIONAL NEAR TERM AND LONG TERM IMPROVEMENTS, OR DESIGN PLANS AND CONSTRUCTION DOCUMENTS FOR THE TARGETED CORRIDOR IMPROVEMENTS.
FOR REFERENCE, THE PROJECT IS HIGHLIGHTED HERE IN ORANGE.
IT STRETCHES ALONG KELLY DRIVE, WEST OF EL CAMINO REAL, TO PARK DRIVE, AND THEN WEST TO NABINO DRIVE.
THE PROJECT AREA COVERS A VARIETY OF UNIQUE USES, INCLUDING RESIDENTIAL HOMES, A SCHOOL, PARK, AND A TRAIL.
STREET IMPROVEMENTS HAVE BEEN PLANNED IN THIS AREA FOR SEVERAL YEARS WITH PLANNING PROJECT BEGINNING IN 2018.
SINCE THAT TIME, THE CITY HAS WORKED WITH NEIGHBORS AND THE SCHOOL COMMUNITY TO GATHER FEEDBACK ON THE PRIORITIES AND THE NEEDS.
SOME OF THE OUTREACH THAT WAS COMPLETED 2018-2022 INCLUDED PUBLIC WORKSHOPS, IN PERSON AND VIRTUAL MEETINGS, ONLINE SURVEYS, MEETINGS WITH KELLY ELEMENTARY SCHOOL, PRINCIPALS AND THE CARLSBAD UNIFIED SCHOOL DISTRICT, ALONG WITH THE SCHOOL'S PTA.
IN JUNE OF 2025, THE CITY COUNCIL REVISITED THE OPTIONS FOR STREET IMPROVEMENTS ALONG KELLY DRIVE.
THE CITY COUNCIL APPROVED NEAR TERM STREET IMPROVEMENTS WHICH WERE COMPLETED DURING THE SUMMER.
THESE IMPROVEMENTS INCLUDED REMOVING THE EXISTING YELLOW CERAMIC DOMES ON KELLY DRIVE AT THE INTERSECTION WITH HILLSIDE DRIVE AND PARK DRIVE, ENHANCING THE PEDESTRIAN CROSSINGS, AND REPAVING AND RESTRIPING THE INTERSECTIONS OF THE STREET TO THE CITY'S CURRENT STANDARDS.
ALSO, ADDING ALWAYS STOPS AT THE KELLY DRIVE AND INTERSECTIONS WITH PARK DRIVE AND HILLSIDE DRIVE.
ADDITIONALLY, THE CITY COUNCIL DIRECTED STAFF TO EXPLORE FURTHER OPTIONS THAT DO NOT INCLUDE ROUNDABOUTS AS WERE PREVIOUSLY PLANNED.
SINCE THEN, THE TEAM HAS BEEN MONITORING TRAFFIC CONDITIONS, WORKING CLOSELY WITH OUR POLICE AND FIRE DEPARTMENTS, SCHOOL ADMINISTRATION TO ASSESS THE AREA OF CONCERNS AND IDENTIFY OPPORTUNITIES FOR IMPROVEMENT.
FOLLOWING THESE EFFORTS, WE DEVELOPED RECOMMENDATIONS FOR NEAR TERM IMPROVEMENTS, AS WELL AS TWO POTENTIAL LONG TERM OPTIONS FOR YOUR CONSIDERATION.
THE NEAR TERM IMPROVEMENTS WHICH ARE RECOMMENDED REGARDLESS OF WHICH LONG TERM OPTION YOU SELECT INCLUDE RESTRIPING THE EXISTING MEDIAN IN FRONT OF THE SCHOOL TO DISCOURAGE LEFT TURNS OUT OF THE PARKING LOT.
THEN ALSO ADDING RED CURB ALONG KELLY DRIVE IMMEDIATELY SOUTHWEST OF THE INTERSECTION WITH HILLSIDE DRIVE TO ESTABLISH A Q LANE TO ENTER THE SCHOOL PARKING LOT.
BOTH OF THESE IMPROVEMENTS ARE RECOMMENDED TO IMPROVE TRAFFIC FLOW AND ENHANCE THE SAFETY FOR PEDESTRIANS.

OPTION 1 IS TO DEVELOP THE SAFE ROUTES SCHOOL PLAN IN COLLABORATION WITH KELLY ELEMENTARY SCHOOL AND THE CARLSBAD UNIFIED SCHOOL DISTRICT.
THIS IS A RECOMMENDED OPTION THAT THE TRAFFIC SAFETY AND MOBILITY COMMISSION RECOMMENDED TO CITY COUNCIL.
OPTION 2 IS TO MOVE FORWARD WITH SEVERAL FOCUSED IMPROVEMENTS, WHICH I'LL EXPLAIN MORE IN DETAIL SHORTLY.
>> SAFE ROUTES TO SCHOOL PLANS AIM TO IMPROVE SAFETY AND TO REDUCE TRAFFIC CONGESTION.
THEY INVOLVE STAFF WORKING CLOSELY WITH SCHOOLS,

THE SECOND OPTION BEFORE YOU TONIGHT IS MORE FOCUSED IMPROVEMENTS IN THE AREA.
THESE IMPROVEMENTS ARE DETAILED ON THIS SLIDE AND INCLUDE MOVING THE CROSSWALK ON KELLY DRIVE, IMMEDIATELY SOUTH OF THE PARKING LOT EXIT.
ALSO WITH THAT, CONSIDERING AN ALL-WAY STOP SIGN AT THE PARKING LOT EXIT.
CLASS II BIKE LANES IMPLEMENTED ON PARK DRIVE, CLASS I SHARED PATHWAY ON THE SOUTH SIDE OF PARK DRIVE, EVALUATING ALL-WAY STOP SIGNS ALONG PARK DRIVE, AND ADDITIONAL BIKE LANE STRIPING AT THE TRANSITIONS.
THEN LASTLY, EXPLORING ADDITIONAL PARKING IN FRONT OF THE LAGUNA PARK AREA.
THIS OPTION WOULD BE QUICKER TO IMPLEMENT AND INVOLVES MORE TIMELY LIMITED COMMUNITY OUTREACH.
THE OPTIONS INCLUDED HERE WERE DEVELOPED BY CONSIDERING THE COMMUNITY INPUT RECEIVED PRIMARILY BETWEEN 2018 AND 2022, AND MORE RECENT RECOMMENDATIONS FROM OUR STAFF, INCLUDING INPUT FROM OUR FIRE AND POLICE DEPARTMENT PARTNERS.
I SHOULD ALSO NOTE THAT ALL THE IMPROVEMENTS LISTED ABOVE OUR MEASURES THAT COULD BE IMPLEMENTED IN A SAFE ROUTES TO SCHOOL PLAN, DEPENDING ON THE OUTCOME OF THE MORE SIGNIFICANT COMMUNITY ENGAGEMENT THAT WOULD BE COMPLETED UNDER OPTION 1.
UPON CITY COUNCIL'S DIRECTION, STAFF WILL PROCEED WITH WORK ORDERS FOR THE NEAR TERM IMPROVEMENTS COORDINATING WITH SCHOOL DISTRICTS TO MINIMIZE DISRUPTIONS.
THE CURRENT PLAN IS TO COMPLETE THE RESTRIPING DURING THE SCHOOL'S WINTER BREAK.
IF OPTION 1 IS APPROVED, WE WOULD BEGIN SAFE ROUTES TO SCHOOL PLANNING PROCESS AND RETURN TO THE TRAFFIC SAFETY AND MOBILITY COMMISSION, AND THE CITY COUNCIL WITH A DRAFT PLAN TO REVIEW AND APPROVE AT A FUTURE MEETING.
OR IF OPTION 2 IS APPROVED, WE'D CONDUCT COMMUNITY OUTREACH AND DEVELOP PLANS, SPECIFICATIONS, AND A BID DOCUMENT FOR THE FOCUSED IMPROVEMENTS AND SEEK APPROVAL AT A FUTURE MEETING OF BOTH THE TRAFFIC SAFETY AND MOBILITY COMMISSION AND THEN CITY COUNCIL.

AFTER ALL, A COMBINED EFFORT OF THE COMMUNITY NEEDS, PLUS THE EXPERTISE OF STAFF, SEEMED TO BE THE BEST FORMULATION FOR A SUCCESS.
I SUPPORT THE NEAR TERM MEASURES OF ONE RESTRIPING THE MEDIAN ALONG THE SCHOOL FRONTAGE TO DISCOURAGE LEFT TURNS.
IT'S A LOGICAL AND AN INEXPENSIVE WAY TO KEEP TRAFFIC FLOWING EASILY DURING SCHOOL TIME DROP OFFS AND PICKUPS.
I SUPPORT TWO, ADDING THE RED CURBING AT SOUTHBOUND KELLY JUST AFTER HILLSIDE, WHICH WOULD ALLOW A SPECIFIC LANE TO TURN INTO KELLY SCHOOL, THUS ALLOWING THOSE OF US WHO WISH TO RETURN TO OUR HOMES, THE CURRENT LANE TO PROCEED WITHOUT HAVING TO WAIT IN TRAFFIC FOR SCHOOL TO END BY WAITING IN A LONG LINE OF THOSE WISHING TO PICK UP THEIR CHILDREN.
I ALSO SUPPORT OPTION 1, WITH A COLLABORATIVE ENGAGEMENT, AS MENTIONED ABOVE.
SOME OF THE POINTS MENTIONED IN OPTION 2 MIGHT HELP THIS OVERALL PLAN, WHICH COULD BE DISCUSSED IN THE OUTREACH OF OPTION 1.
I STRONGLY OBJECT TO THE RELOCATION OF THE MID BLOCK CROSSWALK TO A LOCATION SOUTH OF THE SCHOOL'S EXIT DRIVEWAY, AS THE FLOW OF TRAFFIC MAKING RIGHT TURNS FROM THE SCHOOL DRIVEWAY EXIT WOULD BE HAMPERED AND MORE SAFETY ISSUES COULD OCCUR SHOULD THE CROSSWALK BE PLACED DIRECTLY IN THE WAY OF EXITING CARS.
I DO LIKE THE IDEA OF PROVIDING A CLASS II BIKE LANES AND TRAFFIC CALMING MEASURES ALONG PARK DRIVE TO ADDRESS THOSE CONCERNS FROM RESIDENTS WHO PRESENTED AT THE LAST MEETING.
I ALSO DO LIKE THE IDEA OF PROVIDING A SIDEWALK ALONG THE SOUTH PORTION OF PARK DRIVE BETWEEN KELLY AND ABELNA.

FINALLY, I'D LIKE THE COUNCIL TO ADOPT COUNCIL MEMBER SHIN'S REQUEST TO PLACE A CROSSWALK BETWEEN THE NORTHWEST CORNER OF KELLY DRIVE AND PARK DRIVE NEXT TO THE TENNIS COURTS DIRECTLY SOUTH WHERE THERE IS NO CROSSWALK CURRENTLY.THIS WOULD ALLOW A DIRECT PATH TO THE KELLY TRAIL AND WESTBOUND FOR PEDESTRIANS TO PROCEED ALONG THE NORTH SIDE OF THE LAGOON. THE RECOMMENDED ACTION ADOPTS A RESOLUTION APPROVING THE CONCEPTUAL LAYOUT OF PERPENDICULAR PARKING ON CHESTNUT AVENUE EAST OF MADISON STREET, CREATING A NEW CAPITAL IMPROVEMENT PROJECT NAME, THE BARRIO PARKING IMPROVEMENT PROJECT AND AUTHORIZING A BUDGET TRANSFER FROM THE BARRIO STREET LIGHTING PROJECT.

WE KNOW PARKING IN THE BARRIO IS A SIGNIFICANT ISSUE.STAFF HAS BEEN EXPLORING WAYS TO ADD MORE PARKING IN THE BARRIO AND THE VILLAGE FOR SEVERAL YEARS.
ADDITIONALLY, IN MARCH OF 2025, THE CITY COUNCIL APPROVED A MINUTE MOTION DIRECTING THE CITY MANAGER TO ASSESS ADDITIONAL PARKING OPPORTUNITIES IN THE BARRIO.
SPECIFICALLY ALONG MADISON STREET AND EAST FROM MADISON STREET, THE CHESTNUT AVENUE.
DURING THE JULY 29TH, 2025 CITY COUNCIL MEETING, STAFF PRESENTED A THREE-PHASED APPROACH TO ADDRESS THE INCREASED PARKING OPPORTUNITIES.
THE FIRST PHASE CONSISTED OF CONVERTING RED CURB TO GRAY CURB.
AN EXAMPLE OF THIS WOULD BE A RED CURB NEAR A DRIVEWAY THAT IS NO LONGER BEING USED, THAT COULD BE CONVERTED TO AVAILABLE PARKING SPACE.
THE SECOND PHASE, WHICH IS WHAT I'LL BE SPENDING MOST OF TONIGHT'S PRESENTATION ADDRESSING INVOLVES EVALUATING PARKING NEXT TO PINE PARK.
THEN THERE'S A THIRD PHASE WHICH INVOLVES AN ANALYSIS OF DIAGONAL PARKING ON SOME OF THE WIDER STREETS IN THE BARRIO.
I WILL SHARE AN UPDATE TO OUR PROGRESS ON THAT PHASE TOWARDS THE END OF TONIGHT'S PRESENTATION.
LOOKING MORE CLOSELY AT PHASE 2, YOU CAN SEE HIGHLIGHTED HERE THE SPECIFIC AREAS NEAR PINE PARK WHERE WE RECENTLY EVALUATED OPTIONS FOR INCREASING PARKING.
IT'S ALONG THE EAST SIDE OF MADISON STREET AND THE NORTH SIDE OF CHESTNUT AVENUE, CLOSEST TO THE INTERSECTION.
HERE'S A DIFFERENT ANGLE OF THE STUDY AREA ALONG CHESTNUT AVENUE.
CURRENTLY, THERE ARE FIVE PARALLEL PARKING SPACES HERE.
CONVERTING THIS AREA TO PERPENDICULAR PARKING STALLS WOULD RESULT IN THE NET GAIN OF FOUR PARKING SPACES.
I WANT TO NOTE THAT THIS DESIGN ALLOWS US TO KEEP THE EXISTING TREES IN THE AREA AND ALSO TAKES INTO ACCOUNT THE EXISTING STORM DRAIN INLET WHERE THE PARKING SPACES ARE NOT FEASIBLE.
NOW LOOKING AT MADISON STREET, HERE'S SHOWING THE FIVE EXISTING PARALLEL PARKING SPACES THAT ARE CURRENTLY OUT THERE.
THEN CONVERTING THIS AREA TO DIAGONAL PARKING WOULD INVOLVE WORKING AROUND THE EXISTING UTILITIES TO REDUCE COSTS AND REROUTING THE EXISTING SIDEWALK.
THERE'S A NET GAIN OF TWO PARKING SPACES WITH THIS OPTION.
ADDITIONALLY, STAFF IDENTIFIED POTENTIAL CONCERNS WITH CONVERTING THIS AREA TO DIAGONAL PARKING, INCLUDING BIKE CONFLICTS, LIMITED VISIBILITY FOR CYCLISTS.
SMALL PORTION OF THE DIAGONAL PARKING MIXED WITH THE PARALLEL PARKING MAY CAUSE SOME CONFUSION FOR BOTH THE DRIVERS AND THE BICYCLISTS.
THIS TABLE SHOWS THE ESTIMATED CONSTRUCTION PER NET GAIN OF PARKING SPACES.
THE NET GAIN OF FOREST PARKING SPACES ON CHESTNUT AVENUE IS ESTIMATED AT APPROXIMATELY 31,000.
IT'S ACTUALLY 31,175 PER SPACE.
A NET GAIN OF TWO SPACES ON MADISON STREET ESTIMATED AT 59,250 PER SPACE.
IN SUMMARY, BASED ON THE PARKING ASSESSMENT OF THE PRELIMINARY COST ESTIMATES PRESENTED, STAFF RECOMMENDS IMPLEMENTING THE PERPENDICULAR PARKING ON THE PORTIONS OF CHESTNUT AVENUE EAST OF MADISON STREET.
THAT'S THE EXTENSION OF THE EXISTING PERPENDICULAR PARKING, AND WE SEE NO MAJOR OPERATIONAL CONCERNS.
WHEREAS, WE'RE NOT RECOMMENDING THE CONSTRUCTION ASSOCIATED WITH THE MADISON STREET IMPROVEMENTS CONSIDERING THE HIGHER COST, THE CONFLICTS WITH THE BIKE LANES, AND THE SHORTER SEGMENT OF DIAGONAL MIXED WITH THE REMAINING PARALLEL PARKING ON MADISON STREET AT THIS TIME.
MOVING ON TO THE PHASE 3 STATUS OF THE ADDITIONAL PARKING OPPORTUNITIES, WE ANALYZED THE FEASIBILITY OF ADDITIONAL DIAGONAL PARKING ON THE WIDER STREETS.
IF APPROVED, STAFF WOULD INITIATE THE ANALYSIS OF THE PARKING ON THE WIDER STREETS, INCLUDING COLLECTING TRAFFIC DATA, CONDUCTING TRAFFIC OPERATIONAL ANALYSIS, PROVIDING A CONCEPTUAL DESIGN OF THE PROPOSED OPTIONS.

YOU'RE GOING TO CONTINUOUSLY LOSE PARKING SPACES.
BY DOING THIS, WHICH IS SELDOM SEEN, BUT THERE ARE SOME IN THE CITY OF SAN DIEGO.
BY PUTTING THE SPACES IN THE MIDDLE OF THE ROAD, IT HELPS SLOW TRAFFIC DOWN ON A ROAD BECAUSE THERE'S JUST LIKE A MEDIAN DOWN THE MIDDLE OF THE ROAD WITH DIAGONAL PARKING AND ON THE OTHER SIDE, PERHAPS PARALLEL PARKING, WHATEVER DEPENDING ON THE SIZE OF THE ROAD, THE WIDTH OF THE ROAD.

THE CITY WORKED WITH OUR FEDERAL ADVOCATES TO SUBMIT A COMMUNITY PROJECT FUNDING REQUEST FOR THE CARLSBAD VILLAGE RAILROAD DOUBLE TRACK TRENCHING PROJECT FOR CONSIDERATION.
WE WERE PLEASED TO SEE THAT CONGRESSMAN LEVIN, WHO NOW SITS ON THE HOUSE APPROPRIATIONS COMMITTEE WAS ABLE TO PUT $1 MILLION FOR THE PROJECT INTO THE FISCAL YEAR 2026 HOUSE TRANSPORTATION HOUSING AND URBAN DEVELOPMENT BILL.
CONGRESS IS STILL WORKING TO FINALIZE THIS SPENDING BILL AND WE CONTINUE TO ADVOCATE FOR THE FUNDING.
OUTSIDE OF APPROPRIATIONS BILLS, THE CONGRESS ALSO WORKED TO ADVANCE ADDITIONAL LEGISLATIVE ITEMS ON A WIDE RANGE OF TOPICS.

THIS PAST YEAR ALSO SAW A CHANGE IN THE ADMINISTRATION WITH THE INAUGURATION OF PRESIDENT DONALD TRUMP FOR HIS SECOND TERM.
OVER THE PAST 11 MONTHS, THE TRUMP ADMINISTRATION HAS BEEN HIGHLY ACTIVE ACROSS A WIDE RANGE OF POLICY ACTIONS, MANY OF WHICH HAVE TAKEN PLACE UNDER EXECUTIVE ORDERS.
OUR FEDERAL ADVOCATES HAVE MADE SURE THAT THE CITY IS STAYING ON TOP OF THESE ACTIONS, AND THEY REGULARLY PROVIDE THE CITY WITH DETAILED MEMOS ON THESE ACTIONS, INCLUDING ON TOPICS RELATED TO EXECUTIVE ORDERS AND IMPOUNDMENT.

IN THE SENATE, YOU USED TO BE ABLE TO DO 40 BILLS.
LEADERSHIP HAD MADE AN ANNOUNCEMENT THAT MEMBERS WERE GOING TO BE LIMITED TO 35 BILLS FOR EACH TWO YEAR SESSION IN AN EFFORT TO HAVE MORE THOUGHTFUL ANALYSIS AND DEBATE SURROUNDING BILLS.
THAT BEING SAID, WE STILL HAD OVER 2,800 BILLS INTRODUCED THIS YEAR.
WHAT HAPPENS DURING A TWO YEAR SESSION IS BILLS CAN ACTUALLY BE HELD IN A COMMITTEE AND BE TAKEN UP THE FOLLOWING YEAR IF THEY NEED MORE WORK.
OF THE BILLS THAT WERE INTRODUCED, 917 MADE THEM TO THE GOVERNOR'S DESK, 794 WERE SIGNED AND 123 WERE VETOED.
THAT'S ACTUALLY A LITTLE LOWER THAN THE GOVERNOR'S NORMAL VETO RATE, AND HIS VETO MESSAGES SURROUNDING BILLS WERE ALL REGARDING THE STATE'S ONGOING BUDGET CHALLENGES.
THE VARIOUS THEMES THAT WE HAD, AS I MENTIONED, WERE THE STATES LEGISLATIVE OR THE BUDGET DEFICIT, WHICH REALLY WAS A CLOUD ON ALL BILLS THAT HAD A COST RELATED TO THEM, AS WELL AS THE BUDGET AND VARIOUS PROGRAMS THAT ARE IMPORTANT TO CITIES THAT ARE FUNDED THROUGH THE STATE BUDGET.
ALSO, WE CONTINUED TO SEE MORE HOUSING LAWS AIMED AT TARGETING LOCAL AGENCIES.
THAT'S VERY MUCH THE NARRATIVE UP IN SACRAMENTO.
ONE TALKING POINT THROUGHOUT THE ENTIRE YEAR WAS THE COST OF LIVING AND AFFORDABILITY.
WE REALLY DIDN'T SEE THAT ADDRESSED THROUGH LEGISLATION UNTIL A SERIES OF GUT AND AMENDS.
THE LAST IT WAS ACTUALLY 72 HOURS BEFORE SESSION ADJOURNED, WHICH ACTUALLY THE SERIES OF GUT AND AMENDS LED TO A LEADERSHIP CHANGE IN THE SENATE BECAUSE THERE WAS FRUSTRATION OVER THE LACK OF TRANSPARENCY AND INVOLVEMENT AMONGST MEMBERS TO BE INVOLVED IN WHAT THOSE BILLS ULTIMATELY LOOK LIKE.

ON THE GOVERNMENT RELATIONS, AND WE CONTINUE TO FOCUS ON OPPOSING BILLS THAT REQUIRE THE CITY TO PERFORM ADDITIONAL DUTIES WITHOUT ANY ADDITIONAL FUNDING, WHICH ULTIMATELY REQUIRES THE CITY TO USE AND REDIRECT LIMITED RESOURCES TO THE MAYOR'S POINT AND THE ITEM PREVIOUS TO THIS.
THIS YEAR, WE SAW IT REALLY TARGETED AT TRANSIT ORIENTED DEVELOPMENT AND MITIGATING VEHICULAR TRAFFIC IMPACTS.
CITY POSITIONED ON A NUMBER OF SOBER LIVING HOMES BILLS.
THERE WAS A STUDY DONE THAT REALLY FOCUSED MORE ON THE DEPARTMENT OF HEALTHCARE SERVICES AND WHAT THEY CAN DO BETTER.
THOSE WERE GENERALLY WHAT THE BILLS THIS YEAR PROVIDED.
CLIMATE CHANGE, WE DID THAT BY SUPPORTING THE EXTENSION OF CAP AND TRADE AS WELL AS ALLOCATING PROP $4 THROUGH THE STATE BUDGET THIS YEAR.

IT BEING THE SECOND YEAR OF A TWO YEAR SESSION, MEANING THAT WE'LL HAVE POLICY COMMITTEE HEARINGS AND ANY BILL THAT'S CURRENTLY IN ITS HOUSE OF ORIGIN WILL HAVE TO BE VOTED OUT OF THAT HOUSE OF ORIGIN BY THE END OF JANUARY.
ADDITIONALLY, THE GOVERNOR IS GOING TO BE RELEASING HIS 26/27 BUDGET PROPOSAL, AND THE LEGISLATIVE ANALYST HAS ANTICIPATED AN $18 BILLION DEFICIT THAT WILL NEED TO BE ADDRESSED AND THEN FEBRUARY 20 WILL BE THE BILL INTRODUCTION DEADLINE.
I HIGHLIGHT THAT FOR THE PURPOSES OF WHAT WE'RE GOING TO BE DISCUSSING PAST THIS.
IN TERMS OF POLICY TRENDS, IT BEING AN ELECTION YEAR, YOU'RE GOING TO SEE A LOT OF BALLOT MEASURES THAT ARE USED TO PUT PRESSURE ON THE LEGISLATURE TO TAKE ACTION THROUGH BILLS.
WE'RE GOING TO SEE THINGS HAVING TO DO WITH LOCAL MEASURES AS WELL AS AT THE END OF SESSION, THERE WAS AN ATTEMPT TO ADDRESS OR TO MAKE CHANGES TO PROPERTY TAX LIMITS AND TRANSFER TAXES.
IT WAS AGAIN, ANOTHER GOT AN AMEND AT THE LAST WEEK OF SESSION.
THERE REALLY WASN'T AN APPETITE TO EVEN ADDRESS IT SO THE INTENT IS TO GO AFTER THE ULA MEASURE IN LA.
BUT OF COURSE, THE STATE TENDS TO LOOK AT HOW CAN WE MAKE THIS A STATEWIDE BILL.
SB 423 WAS THE BILL, AB 698 BY WIX IS A BILL THAT WOULD REQUIRE STUDIES TO BE DONE ON WHAT A TRANSFER TAX WOULD ACTUALLY PROVIDE BECAUSE THAT WAS THE MISGUIDED PART IN WHAT HAPPENED IN LOS ANGELES.
THIS YEAR THROUGH THE BUDGET BILL, WE DID A NUMBER OF SQL REFORM BILLS, PRETTY SWEEPING BROAD REVIEWS, AND THERE'S A LOT OF PROMISES THAT HAVE BEEN MEANT IN TERMS OF CLEAN UP REGARDING THOSE BILLS.
WE'RE LOOKING TO SEE SOME SQL REFORMS, AND THEN AGAIN, I MENTIONED THE LOCAL GOVERNMENT OPERATIONS MEASURES.
THAT GOES INTO WHAT WE SAID REGARDING THE ELECTION.
ELECTION YEARS ARE ALWAYS REALLY INTERESTING UP IN SACRAMENTO AS PEOPLE ARE EITHER RUNNING FOR REELECTION OR RUNNING FOR THEIR NEXT JOB.
WE DO HAVE ALL 80 ASSEMBLY MEMBERS WHO ARE GOING TO BE UP FOR REELECTION OR TURNING OUT IN THEIR OPEN SEATS AS WELL AS HALF OF THE SENATE WITH 20 SENATORS SO THE GOVERNOR'S RACE HAS ALSO BECOME REALLY INTERESTING.
WE'VE GOT A NUMBER OF CANDIDATES.
IT DOESN'T LOOK LIKE THERE'S QUITE ENOUGH CANDIDATES AS MORE SEEM INTERESTED IN PUTTING THEIR NAME IN THE RING, AS WELL AS A COUPLE OF LEGISLATIVELY APPROVED BALLOT MEASURES THAT HAVE BEEN APPROVED BY THE LEGISLATURE AND WITH THAT, I WILL KICK IT BACK TO MR. HABER.
I WILL CONTINUE THROUGH THE REST OF THE PRESENTATION AND WE CAN TAKE QUESTIONS AT THE END ON ANY PIECE OF THIS.
AS I MENTIONED EARLIER, THE FIRST ACTION YOU'RE BEING REQUESTED IS TO ADOPT A RESOLUTION, ADOPTING THE PROPOSED 2026 LEGISLATIVE PLATFORM.
THIS IS REALLY ROOTED IN TWO CITY COUNCIL POLICIES.
CITY COUNCIL POLICY 39 PROVIDES THE FRAMEWORK OVERVIEW OF HOW THE CITY FRAMES ITS INTERGOVERNMENTAL AFFAIRS PROGRAM AND DOES LEGISLATIVE ADVOCACY, AND A RESOLUTION THAT WAS ADOPTED BY THE CITY COUNCIL IN 2019 ESTABLISHED

THE LEGISLATIVE SUBCOMMITTEE AND TASKED THAT SUBCOMMITTEE WITH AN ANNUAL REVIEW OF THE LEGISLATIVE PLATFORM.ANY PROPOSED AMENDMENTS THAT ARE RECOMMENDED BY THE SUBCOMMITTEE ARE THEN PRESENTED TO THE CITY COUNCIL AS NEEDED TO APPROVE THE CHANGES.
THROUGHOUT THAT PROCESS, STAFF ENGAGES DEPARTMENTS ACROSS THE CITY, OUR LEGISLATIVE CONSULTANTS, AND THROUGH THE SUBCOMMITTEE.
THERE IS OPPORTUNITY FOR PUBLIC REVIEW AND INPUT TO BE INCORPORATED IN WHAT'S ULTIMATELY RECOMMENDED TO THE CITY COUNCIL.

FIRST E-BIKES, THAT INCORPORATES CITY COUNCIL DIRECTION THAT WAS PROVIDED AT YOUR LAST MEETING AROUND ADVOCACY RELATED TO E-BIKES, PARTICULARLY FOR UNDER 16 RIDERS, BANNING E-BIKE RIDERSHIP UNDER 16 AS WELL AS PROHIBITING CARRYING PASSENGERS AND REQUIRING HELMETS FOR CLASS TWO E-BIKES.
YOU'LL ALSO RECALL THAT THE CITY COUNCIL RECENTLY REFERRED A DISCUSSION ON SOBER LIVING GROUP HOMES, RECOVERY BASED GROUP HOMES TO THE LEGISLATIVE SUBCOMMITTEE.
THAT POLICY DISCUSSION ALSO OCCURRED AND THERE'S A RECOMMENDED CHANGE IN THE POSITION STATEMENT CONCERNING ADDITIONAL OVERSIGHT, PERMITTING AND INSPECTION AUTHORITY FOR CITIES RELATED TO GROUP HOMES.
SEVERAL POSITION STATEMENTS RELATED TO HOUSING AND LAND USE ARE ALSO UPDATED IN THE PROPOSED PLATFORM, AS WELL AS RELATED TO FIRE PROTECTION INITIATIVES.

[NOISE] WESTERN STATES PETROLEUM AND CHEVRON, ACCOUNTED FOR 83% OF THE INDUSTRY'S EXPENDITURE IN 2024, BROKE THEIR PREVIOUS SPENDING RECORD WITH THE COMBINED $30.6 MILLION LAST YEAR.
WHAT DO CORPORATE POLLUTERS GET FOR THEIR LOBBYING? THEY GET TO MAXIMIZE THEIR PROFITS WHILE KILLING URGENTLY NEEDED CLIMATE POLICY.

DUE TO THE STATE'S BUDGET DEFICIT ACCORDING TO THEM, $12.3 BILLION, WE CAN EXPECT THAT MORE HOUSING BILLS WILL REQUIRE CITIES TO CONTINUE TO PAY FOR THESE NEW UNFUNDED MANDATES.
THE AMENDMENT WOULD DEMONSTRATE THAT THE COUNCIL'S BROAD SUPPORT FOR RESTORATION OF LOCAL CONTROL THROUGH EITHER LEGISLATIVE OR CONSTITUTIONAL CHANGES.
IT IS IMPORTANT TO INCLUDE CONSTITUTIONAL CHANGES BECAUSE THEY ARE A FAR MORE POWERFUL TOOL AS THIS COULD ADDRESS A MULTIPLE OF LAWS.
IN JUNE 2025, OUR CITY COUNCIL NARROWLY OPPOSED OUR NEIGHBORHOOD VOICES CONSTITUTIONAL AMENDMENT BY A TWO TO THREE VOTE.
CONCERNS SEEM TO BE ABOUT THE VETTING OF THAT ORGANIZATION AND LANGUAGE EXPRESSED IN THEIR PROPOSED AMENDMENT.
THIS PROPOSED AMENDMENT DOES NOT ENDORSE ANY SPECIFIC ORGANIZATIONS OR LANGUAGE, AND THERE IS NO COMMITMENT TO SPEND ANY PUBLIC RESOURCES FOR CAMPAIGNING ON ANY BALLOT MEASURE.

ONE SUCH CRITICAL BILL, AS YOU'VE HEARD IS THE POLLUTERS PAY CLIMATE SUPERFUND ACT, WHICH WOULD EMPOWER CAL EPA TO IDENTIFY THE POLLUTERS MOST RESPONSIBLE FOR HISTORIC GREENHOUSE GAS EMISSIONS IN OUR STATE, AND FORCE THEM TO PAY FOR THE CLIMATE DESTRUCTION FROM WHICH THEY CONTINUE TO PROFIT.
ACROSS OUR STATE AND ALL COASTAL STATES, WE'RE SEEING INSURANCE COMPANIES DROP EXISTING CUSTOMERS, REFUSE TO COVER NEW BUILDS, AND RAISE THE COST OF HOME INSURANCE OUT OF REACH OF THE AVERAGE HOME OWNER.
WHY? BECAUSE THE RISKS OF WILDFIRE AND FLOOD DESTRUCTION RISE EXPONENTIALLY WITH EXTREME WEATHER EVENTS WHICH ARE MADE WORSE WITH CLIMATE CHANGE, AND THE COST TO INSURE AGAINST THEM IS UNSUPPORTABLE.
JUST MONTHS AGO, BOTH WEALTHY AND LOW INCOME NEIGHBORHOODS ALIKE IN LA, EXPERIENCED SOME OF THE MOST DEVASTATING WILDFIRES IN HISTORY, CAUSING AN UNPRECEDENTED $250 BILLION IN DAMAGE, DESTROYING MORE THAN 16,000 STRUCTURES, AND KILLING 29 PEOPLE.
THESE ARE FOSSIL FUEL DRIVEN DISASTERS.
FOR DECADES, THE FOSSIL FUEL INDUSTRY HAS KNOWN THAT THEIR ACTIONS WOULD TRIGGER CLIMATE CHANGE, YET THEY CONTINUED THEIR DESTRUCTIVE PRACTICES AND SUPPRESSED SCIENCE ON THE TOPIC TO COVER THEIR TRACKS.
SINCE THE 1960S, FOSSIL FUEL COMPANIES LIKE EXXON HAVE BURIED THE FINDINGS OF EVEN THEIR OWN SCIENTISTS ABOUT THE PLANET WARMING EFFECTS OF THEIR EMISSIONS, AND THEY CONTINUE TO REAP MASSIVE PROFITS AT THE EXPENSE OF OUR COMMUNITIES.
THE STATE OF VERMONT AND THE STATE OF NEW YORK HAVE LED THE NATION BY PASSING THEIR OWN POLLUTER PAY ACTS.
ADDING THIS CLAUSE TO OUR LEGISLATIVE PLATFORM WILL MEAN THAT CARLSBAD WILL BE ABLE TO ADVOCATE FOR THE POLLUTERS PAY CLIMATE SUPERFUND ACT.
WHEN PASSED, THIS WOULD MEAN MORE FUNDING FOR CLIMATE MITIGATION AND INFRASTRUCTURE ADAPTATION, INCLUDING PUBLIC TRANSPORTATION AND UPDATING OUR AGING STORMWATER SYSTEMS WHILE REBUILDING AND REINFORCING OUR COMMUNITIES.
ADDITIONALLY, WITH 40% OF THE FUNDS BEING RESERVED FOR FRONTLINE COMMUNITIES, THOSE MOST AFFECTED WILL RECEIVE DIRECT FINANCIAL SUPPORT.

WE'RE ASKING THE CITY OF CARLSBAD TO ADD OUR CLAUSE TO THE LEGISLATIVE PLATFORM.THE PROPOSED CLAUSE IS SUPPORT LEGISLATION THAT HOLDS POLLUTING AND GREENHOUSE GAS EMITTING INDUSTRIES RESPONSIBLE FOR THE CLIMATE DAMAGES THEY'VE CAUSED.
ALSO, WE ARE ASKING FOR A LETTER TO STATE LEGISLATORS, SUPPORTING BILLS SB 684 AND AB 123 OF THE SUPERFUND.
THESE ARE SOME OF THE EXISTING CLAUSES ON YOUR PLATFORM THAT SUPPORT OUR PROPOSED ONE.
THEY ARE UNDER AREAS SUCH AS HEALTHY CITIES, ENVIRONMENTAL QUALITY, AND PUBLIC SAFETY.

AS YOU MAY KNOW, WILDFIRES RAVAGED LOS ANGELES EARLIER THIS YEAR, AND MILLIONS OF PEOPLE LOST THEIR HOMES WITH A TOTAL OF $250 BILLION IN DAMAGE.
THE QUESTION IS, WHO IS GOING TO PAY?

EXXONMOBIL AND CHEVRON REPORTED $36 BILLION AND $21 BILLION IN PROFITS FOR 2023.
THESE COMPANIES HAVE SCIENTISTS WHO TOLD THEM THAT THEIR PRODUCTS WOULD CAUSE CLIMATE DISASTERS SINCE THE 60S.
THEY'VE MISLED THE PUBLIC AND AVOIDED ACCOUNTABILITY.

EMISSION ATTRIBUTION STUDY BY CALEPA TRACKS WHO IS RESPONSIBLE FOR EMISSIONS.
MONEY WILL GO IN A SUPERFUND TOWARDS PROJECTS RESPONDING AND MITIGATING CLIMATE CHANGE AND COMBATING ITS EFFECTS.
FOURTY PERCENT OF FUNDS MUST GO TOWARDS FRONTLINE COMMUNITIES.
HOW DOES IT WORK? IT WILL BE ENFORCED ON COMPANIES IF THEIR OIL AND GAS PRODUCTS RESULT IN OVER 1 BILLION TONS OF GREENHOUSE GAS EMISSIONS BETWEEN 1990 AND 2024.
THE FUNDS WILL GO TO IMPROVED INFRASTRUCTURE, DECARBONIZATION, FOSSIL FUEL TRANSITION, PUBLIC TRANSIT, EMERGENCY DISASTER MANAGEMENT, AND MANY MORE.
CARLSBAD WOULD BENEFIT CONTINUALLY FROM THIS BILL'S FUNDING, INCLUDING THE CITY'S GOALS OF REDUCING AIR POLLUTION, SUPPORTING LOCAL ECONOMIC DEVELOPMENT, AND IMPROVING PUBLIC HEALTH.
THESE FUNDS WILL HELP THE CITY STAY ON TRACK WITH ITS CLIMATE ACTION PLAN AND PROJECTS SUCH AS STORMWATER INFRASTRUCTURE, SEA LEVEL RISE, WILD FIRE PREPAREDNESS, NCTD, AND CLEAN ENERGY.
ALL PEOPLE ARE AFFECTED BY CLIMATE CHANGE, BUT YOUTH WILL BE AFFECTED.
THE CITY HAS A DUTY TO FIGHT FOR OUR RIGHTS.
HERE ARE SOME COMMONLY ASKED QUESTIONS.
WON'T OIL COMPANIES RAISE PRICES? NO, THIS BILL ONLY TARGETS THE LARGEST POLLUTING COMPANIES LEAVING PLENTY OF OTHER COMPANIES TO OFFER COMPETITIVE PRICES.

I HAVE SOME CONCERNS THAT WE MIGHT BE PUNISHING SMALL BUSINESSES FOR SOMETHING THAT OCCURRED WHEN IT WAS NOT A LAW, NOT BREAKING A LAW.
I'M NOT ENTIRELY SURE HOW THAT WOULD LOOK.
I THOUGHT THE STATEMENT WAS PRETTY WIDE IN ITS BREADTH AND I DIDN'T THINK IT AS THE COUNCIL MEMBER SAID, REALLY DRILLED INTO THE POLLUTERS PAY AGENDA, AND THAT IT MIGHT HAVE IMPACTS ON SMALL BUSINESSES.
I WAS VERY CONCERNED ABOUT THAT AND HOW TO ESSENTIALLY MEASURE AND WHAT TYPES OF ENFORCEMENT ACTIONS.
HOW WOULD WE ENFORCE IT? HAVING SAID ALL THAT, WE DO HAVE LANGUAGE IN THE PLATFORM THAT ALLOWS US TO IF A BILL COMES THIS WAY, WE WATCH, WE FOLLOW, WE SUPPORT, OR WE OPPOSE, AND WE STILL HAVE THAT ABILITY TO DO THAT.

THEN I SAW THE FAMILIES TRYING TO WONDER, WHEN I WENT DOWN THE HILL, WHERE ARE THE FAMILIES? IN 2003, WE WITNESSED THE CEDAR FIRE HERE IN SAN DIEGO COUNTY WHERE WE HAD AT LEAST 10 PEOPLE DIED TRYING TO EVACUATE THEIR HOME.

I UNDERSTAND THAT THE CITY'S LEGISLATIVE PLATFORM ALREADY INCLUDES BROAD POSITION STATEMENTS IN SUPPORT OF LOCAL CONTROL OVER LAND USE DECISIONS AND ALLOWING LOCAL LAND USE PLANNING AND ZONING LAWS TO OVERRIDE CONFLICTING STATE LAWS.
WE'VE ALSO ADOPTED POSITIONS IN FAVOR OF PROTECTING THE CITY'S ABILITY TO DETERMINE THE EXTENT AND METHOD OF FIRE HAZARD MITIGATION IN AND AROUND WILD LAND AND PROTECTED HABITAT AREAS.

JUST TO END ON A POSITIVE NOTE TONIGHT, I'M A GUY, AND JUST BEING A GUY, WHEN I WAS TOLD I WAS GOING TO BE GOING AROUND THE COUNTY, DOING SOMETHING LIKE 10 CHRISTMAS TREE LIGHTINGS, I THOUGHT, BOY.
BUT I WAS ABLE TO INVITE MY GRANDCHILDREN TO GO WITH ME ON SOME OF THESE TO WATCH THE KIDS AT THESE CHRISTMAS TREE LIGHTINGS, AND ALMOST ALL OF THEM HAD SANTA CLAUSES THERE AND TO WATCH THE KIDS THE LITTLE KIDS SCREAMING AT THE TOP OF THEIR LUNGS AND THE PARENTS TAKING PICTURES SO THEY CAN SHOW THEM THE PICTURES WHEN THEY'RE 16 AND THE EIGHT, NINE, 10 YEAR OLD BELIEVING THAT WITH THE REAL SANTA CLAUS AND NOT ONE OF HIS HELPERS WAS JUST HEARTWARMING.
I'M USUALLY A BAH HUMBUG GUY, BUT THIS CHANGED MY ATTITUDE.
THERE WAS CALLERS, THERE WAS ENTERTAINMENT AT MOST OF THESE TREE LIGHTINGS.
IF YOU'RE IN A BAH HUMBUG MOOD, GO TO A TREE LIGHTING.
