IT IS MY PRIVILEGE TO INTRODUCE TONIGHT'S PROCLAMATION RECOGNIZING WOMEN'S HISTORY MONTH.

THIS MONTH IS AN OPPORTUNITY TO HONOR WOMEN WHO HAVE BROKEN BARRIERS, CHALLENGED EXPECTATIONS AND HELPED TO BUILD STRONGER COMMUNITIES FOR ALL OF US.

THEIR LEADERSHIP CAN BE SEEN EVERYWHERE FROM OUR SCHOOLS AND SMALL BUSINESSES TO OUR HOSPITALS, NONPROFITS, AND OF COURSE, YOUR CITY COUNCIL.

AS A MOTHER AND A PUBLIC SERVANT, I'M ESPECIALLY MINDFUL THAT THE EXAMPLE WE SET TODAY HELPS SHAPE WHAT THE NEXT GENERATION OF GIRLS BELIEVES IS POSSIBLE.

SO WITH THAT, I'LL GO AHEAD AND READ OUR PROCLAMATION.

SO WHEREAS NATIONAL WOMEN'S HISTORY MONTH ORIGINATED AS A NATIONAL CELEBRATION IN 1981, AND HAS SINCE BEEN RECOGNIZED ANNUALLY WITH A PRESIDENTIAL PROCLAMATION PROMOTING WOMEN'S ACHIEVEMENTS ACROSS DIVERSE FIELDS THROUGHOUT AMERICAN HISTORY.

AND WHEREAS, THE CITY OF CARLSBAD HAS A PROUD LEGACY OF WOMEN LEADING AND PERFORMING CRITICAL ROLES AT ALL LEVELS OF GOVERNMENT, BUSINESS AND THE COMMUNITY. AND WHEREAS THE OFFICIAL 2026 THEME OF NATIONAL WOMEN'S HISTORY MONTH IS LEADING THE CHANGE, WOMEN SHAPING A SUSTAINABLE FUTURE AND CELEBRATES THE CONTRIBUTIONS OF WOMEN WHO ARE LEADING SUSTAINABILITY EFFORTS ACROSS ENVIRONMENTAL, ECONOMIC, LEADERSHIP AND EDUCATIONAL INITIATIVES.

AND WHEREAS CELEBRATING WOMEN WHO ADVANCE A SENSE OF BELONGING PLAYS AN INSTRUMENTAL ROLE IN OUR LOCAL AND GLOBAL COMMUNITIES TO BUILD A BRIGHTER FUTURE.

AND WHEREAS, WE ENCOURAGE OUR COMMUNITY TO HONOR THE SIGNIFICANT CONTRIBUTIONS OF ALL WOMEN, PAST AND PRESENT, WHO HAVE DELIVERED US TO THIS MOMENT TODAY.

BECAUSE OF THEM, OUR FUTURE GENERATIONS WILL APPRECIATE AND UNDERSTAND THE NEED FOR THIS CELEBRATION.

MY NAME IS KATIE HENTRICH. I'M THE CLIMATE ACTION PLAN ADMINISTRATOR HERE AT THE CITY OF CARLSBAD.

A FUN FACT ABOUT ME. I ATTENDED SCRIPPS COLLEGE, A SMALL WOMEN'S COLLEGE IN LOS ANGELES COUNTY.

THE COLLEGE'S FOUNDER, ELLEN BROWNING SCRIPPS, STATED THAT THE PRIMARY GOAL OF THE COLLEGE WAS TO DEVELOP ITS STUDENTS TO LIVE CONFIDENTLY, COURAGEOUSLY AND HOPEFULLY. I'M THINKING OF HER LEGACY TODAY.

DURING THIS MONTH, AS WE CELEBRATE WOMEN IN SUSTAINABILITY HERE IN CARLSBAD, IT'S IMPORTANT TO THINK OF WOMEN IN SUSTAINABILITY GLOBALLY AS WELL.

ACCORDING TO THE UNITED NATIONS, WOMEN AND GIRLS FACE DISPROPORTIONATE IMPACTS FROM CLIMATE CHANGE WORLDWIDE.

DESPITE THIS AND OTHER SOCIETAL INJUSTICES, WOMEN, AND PARTICULARLY WOMEN OF COLOR, ARE AGENTS OF CHANGE AND KEY TO THE PROGRESS WE SEE AROUND SUSTAINABILITY AND ENVIRONMENTAL JUSTICE.

FOR EVERY RACHEL CARSON. THERE IS AN [INAUDIBLE] FOR EVERY GRETA THUNBERG.

THERE IS A HAZEL JOHNSON. AS A WOMAN IN THE SUSTAINABILITY FIELD, I OFTEN GET ASKED IF MY JOB IS DEPRESSING AS CLIMATE CHANGE INTENSIFIES AND BECOMES

INCREASINGLY POLITICIZED. AND SOMETIMES IT IS TOUGH, BUT IT EMPOWERS ME TO THINK ABOUT WHAT OTHER WOMEN BEFORE ME HAVE DONE, WHAT MY FEMALE COLLEAGUES ARE ACCOMPLISHING TODAY, AND THE LEGACY I'M LEAVING FOR MY THREE NIECES, PENNY, ELLIE AND SOPHIA. HI TO THEM. THEY'RE WATCHING.

OUR WORK IS LEAVING THINGS A LITTLE BETTER THAN WE FOUND IT FOR THEM BOTH THE ENVIRONMENT THEY LIVE IN AND THEIR FUTURE OPPORTUNITIES IN ANY SUSTAINABILITY RELATED FIELDS.

ANYONE WATCHING SHOULD HAVE BEEN AGHAST AT THE DISMAL TURNOUT OF PROTESTS, EVEN COUNCIL.

YET MAYOR BLACKBURN CALLED FOR THE VOTE AND EVERYONE SAVE ONE COUNCIL MEMBER PRETENDED 99% OF THE RATEPAYERS IN CARLSBAD HAD BROKEN OUT A BOTTLE OF CHAMPAGNE TO CELEBRATE A CRIPPLING INCREASE IN THEIR WATER BILLS.

WAS IT APATHY? A RIGGED GAME LAWMAKERS DISGUISED AS A CONSTITUTIONAL AMENDMENT? OR WAS IT MAYBE FAILURE OF THE CITY TO COMMUNICATE TO ITS RATEPAYERS? I BELIEVE IT WAS ALL OF THE ABOVE, BUT I'M MORE CONVINCED NOW OF THE LATTER.

AFTER HEARING KEVIN FERGUSON SPEAK ON FEBRUARY 10TH MEETING REGARDING NEW E-BIKE POLICIES, IT SEEMS KEVIN ALSO MISSED THE NEWS ON E-BIKES, ANOTHER MEMO THE CITY IS CONFIDENT WAS WELL COMMUNICATED.

THE FAILURE OF CORPORATE MEDIA, SELECTIVE CONTROL OF ALTERNATIVE MEDIA, AND THE CENSORING OF SOCIAL MEDIA HAS DESTROYED PUBLIC TRUST AND LEFT CITIZENS STRANDED IN THE DOLDRUMS WITHOUT A COMPASS. MOST HAVE NO IDEA WHAT GOVERNMENTS ARE PLANNING, HAVE EXECUTED AND WILL EXECUTE TO MESS WITH THEIR LIVES.

IF YOU READ THE TRANSCRIPTS, THE CITY CLAIMS THEY UTILIZED EVERY MEANS POSSIBLE TO NOTIFY RATEPAYERS OF A THREE YEAR WATER RATE HIKE.

BUT NEIGHBORS I'VE SPOKEN TO WERE CLUELESS OF ANY HEARING TAKING PLACE.

THE CITY DID MARK THE BILLS WITH A NOTICE. HOWEVER FAILED TO CONSIDER MANY NOW RELY ON AUTOMATED PAYMENTS, NEVER LOOKING AT THEIR BILL AND TRUSTING NOTHING COULD HAPPEN LIKE WHAT HAPPENED ON APRIL 22ND LAST YEAR.

WE STILL HAVE TWO YEARS OF INCREASES GOING. WON'T THEY BE SURPRISED IN TWO YEARS WHEN ACCOUNTS RUN SHORT AT THE END OF THE MONTH? SO WHAT WE HAVE HERE, I BELIEVE, IS A FAILURE TO COMMUNICATE.

BUT LIKE COOL HAND LUKE, RATEPAYERS WON'T BE ASKED.

I'M HERE IN CONCERN ABOUT THE VIRAL VIDEO OF THE YOUNG BLACK GIRL BEING DETAINED, HARASSED AND ASSAULTED AT ONE OF YOUR PARKS IN POINSETTIA. AFTER CONSULTING WITH THE MOTHER, WE WANT TO BE CLEAR THAT WE ARE COMMITTED TO ENSURING THIS INCIDENT IS ADDRESSED AND NOT OVERLOOKED, MAKING SURE THAT IN THESE CASES THAT IT'S NOT A STATUS QUO OR SOMETHING ELSE KIDS DO.

SUCH BEHAVIORS ARE DEVELOPED IN ENVIRONMENTS THAT OFTEN GO UNNOTICED, AND WE WANT TO MAKE SURE THAT BRINGING TO YOUR ATTENTION TODAY, AGAIN, I KNOW IT'S NOT ON THE AGENDA, BUT HOPEFULLY WE HAVE IMPLEMENTATION AS FAR AS MAKING SURE THIS DOESN'T HAPPEN AGAIN.

A FULL AND TRANSPARENT INVESTIGATION OCCURS, ACCOUNTABILITY IS CLEAR CONSEQUENCES FOR THE RESPONSIBLE PARTIES, PREVENTIVE MEASURES, AND COMMUNITY EDUCATION THAT ADDRESSES HARMFUL RACIAL AND HOSTILITY AMONG YOUTH.

SUPPORT AND PROTECTION FOR THE CHILD AND THE PARENTS MOVING FORWARD.

I WANT TO BE CLEAR. CARLSBAD HAS TO CHOOSE WHAT KIND OF COMMUNITY IT WANTS TO BE.

IS IT THE COMMUNITY THAT IGNORES RACIAL HARM AGAINST BLACK CHILDREN, OR IS ONE THAT ADDRESSES IT IN HONESTY AND ACCOUNTABILITY AND ACTION? WE EXPECT THE LATTER. LET ME ALSO BE CLEAR THE COMMUNITY IS WATCHING.

THIS ENSURES A STATUS IS PROVIDED AND THAT PUBLIC FACILITIES ARE PROVIDED CONCURRENT WITH THAT GROWTH.

THIS ALSO REFLECTS THE ADOPTION OF THE HOUSING ELEMENT.

THIS IS THE SECOND REPORT SINCE THE HOUSING ELEMENT REZONE PROGRAM WAS ADOPTED, AND IMPLEMENTS STATE LAWS AND RESOLUTIONS THAT SUSPENDED CERTAIN PORTIONS OF THE PROGRAM.

THE LOCAL FACILITY MANAGEMENT ZONES OR LFMZ WERE CREATED AFTER THE 1986 GROWTH MANAGEMENT INITIATIVE, AND YET IT'S HARD TO DETERMINE WHAT CRITERIA WERE USED TO EXEMPT 11 OF THE 25 ZONES FROM THE OPEN SPACE REQUIREMENT.

THOSE CONDITIONS SHOULD HAVE BEEN LINKED IN THE REPORT AND ARE NOT.

AND WHILE THE REPORT SHOULD LIST THE PERCENT OF OPEN SPACE IN EACH OF THESE LFMZS, IT DOES NOT EITHER.

AT A RECENT COUNCIL MEETING, STAFFER MIKE STRONG STATED, AS WE HAVE LONG ADVOCATED FOR, PER THE LANGUAGE IN THE 1986 VOTER BROCHURE, THAT 40% OF CARLSBAD LAND SHOULD BE SET ASIDE FOR OPEN SPACE.

THE RECENT. SORRY, THE REPORT DOES NOT ACKNOWLEDGE THIS GOAL AND FURTHERMORE IGNORES ANY DISCUSSION ABOUT POSSIBLE USES FOR THE PONTO REGION.

AS I READ THE WRITTEN COMMENTS FROM BOTH LANCE SCHULTE AND STEVE LINKE ON THIS TOPIC, I WAS STRUCK THAT BOTH GROUPS THAT THEY REPRESENT HAVE REPEATEDLY ASKED FOR CONSIDERATION OR CORRECTION OF CITY POLICIES ON OPEN SPACE AND MOBILITY AND SAFETY ISSUES.

AS SOMEONE WHO HAS BEEN BEFORE THE COUNCIL MULTIPLE TIMES, I KNOW THE FRUSTRATION OF A LACK OF REAL DIALOG WITH COMMUNITY MEMBERS, GIVEN THE STRUCTURE OF THE COUNCIL MEETINGS. WHILE THE CITIZENS COMMITTEE ON GROWTH MANAGEMENT FROM TWO YEARS AGO ADDRESSED MANY ISSUES AND I ATTENDED MANY OF THOSE MEETINGS, I ALWAYS FELT THAT ANSWERS ARE OFTEN NOT FORTHCOMING AND REAL DISCUSSION IS LACKING.

I RESPECTFULLY ASK THAT THE COUNCIL CONSIDER SOME KIND OF WORKSHOPS TO ALLOW FOR FRUITFUL DISCUSSIONS WITH THOSE STAKEHOLDERS ON THESE ISSUES, AND IN THE CASE OF THE OPEN SPACE ISSUES, INVITE THE ENVIRONMENTAL SUSTAINABILITY COMMISSIONERS TO PARTICIPATE WITH THOSE DISCUSSIONS.

FOR THE 10TH YEAR IN A ROW, THE CIRCULATION COMPONENT OF THIS REPORT LACKS THE REQUIRED PEDESTRIAN, BICYCLE AND TRANSIT MULTIMODAL LEVEL OF SERVICE MONITORING, AND ELUA HAS SERIOUS CONCERNS ABOUT THE OVERALL MMLOS SYSTEM, COMPROMISING MITIGATION OF TRAFFIC IMPACTS AND SAFETY.

WE ARE ASKING THE COUNCIL TO ASK THE CITY ATTORNEY HOW THE CURRENT REPORT CAN LEGALLY SATISFY THE ANNUAL GMP REQUIREMENTS GIVEN THE LACK OF MMLOS MONITORING, IT CLEARLY DOES NOT MEET THIS LEGAL STANDARD AND SHOULD BE REJECTED.

GIVEN THE DECADE OF FALSE PROMISES TO ADDRESS MMLOS, THERE SHOULD BE A DATE CERTAIN REVIEW SCHEDULED WITHIN SIX MONTHS.

AS PREDICTED OVER A DECADE AGO, THE MMLOS SCHEME HAS LARGELY PROVEN TO BE USELESS AND UNENFORCEABLE.

THUS, THE ENFORCEABLE VEHICLE LEVEL OF SERVICE CONGESTION MONITORING SHOULD BE RESTORED, WHICH CAN THEN BE USED FOR MULTIMODAL UPGRADES ON BUILT OUT STREETS.

IN PARTICULAR, CONGESTION MONITORING SHOULD BE ADDED FOR EMERGENCY RESPONSE AND EVACUATION ROUTES TO IDENTIFY SAFETY GAPS AND RESTORE SAFETY BASED REVIEW OF DEVELOPMENT PROJECTS.

THERE ARE TWO GENERAL METHODS TO ASSESS THE IMPACTS OF VEHICLES, VEHICLE MILES TRAVELED MEASURES ENVIRONMENTAL IMPACTS UNDER STATE CEQA LAW.

IN CONTRAST, VEHICLE LEVEL OF SERVICE MEASURES CONGESTION, WHICH ADDRESSES QUALITY OF LIFE AND SAFETY RELATED TO EMERGENCY RESPONSE AND EVACUATION TIMES. IT IS REQUIRED BY THE CITY FOR GMP MONITORING AND ASSESSING THE IMPACTS OF PROPOSED DEVELOPMENTS.

DON'T BE FOOLED BY CLAIMS THAT CITIES CAN NO LONGER USE VEHICLE LEVEL OF SERVICE.

VEHICLE LEVEL OF SERVICE IS GRADED ON A SCALE OF A TO F FOR INDIVIDUAL STREET SEGMENTS, BASED ON THE VOLUME OF TRAFFIC AND THE CAPACITY OF THE SEGMENTS.

THE WORSE THE GRADE, THE HIGHER THE CONGESTION WITH E AND F CONSIDERED FAILING GRADES UNDER THE GROWTH MANAGEMENT PLAN AS VOLUME REACHES AND EXCEEDS CAPACITY.

BEFORE 2015, VEHICLE LEVEL OF SERVICE APPLIED TO ALL STREETS.

HOWEVER, THE 2015 GENERAL PLAN UPDATE SUBSTANTIALLY CHANGED THE APPROACH.

IT INCLUDES THE STREET TYPOLOGY MAP, IN WHICH ONLY A FEW ARTERIAL ARTERIAL CONNECTOR AND INDUSTRIAL STREETS WERE RETAINED FOR VEHICLE LEVEL OF SERVICE, WHILE THE REST OF THE STREETS WERE REPRIORITIZED FOR PEDESTRIAN, BICYCLE AND TRANSIT LEVEL OF SERVICE.

CITY STAFF AND THEIR CONSULTANTS AND PEERS CAME UP WITH THIS SYSTEM AND SAID IT WOULD BE TRANSFORMATIONAL.

THE ORIGINAL PURPOSE OF MMLOS WAS TO PROVIDE A MEANS FOR EVALUATING IMPACTS OF INDIVIDUAL DEVELOPMENT PROJECTS, AS WELL AS MONITORING THE LEVEL OF SERVICE FOR INDIVIDUAL STREETS TO ENSURE THAT THEY ARE ALL MEETING THE SPECIFIED STANDARD BY STREET TYPE, UNQUOTE. THE GMP PERFORMANCE STANDARD IS, QUOTE, MAINTAIN LEVEL OF SERVICE D OR BETTER FOR ALL PRIORITIZED MODES OF TRAVEL UNQUOTE.

IN THE NEW STREET, PRIORITIZATIONS WERE TO CREATE A NEXUS TO REQUIRE DEVELOPERS TO MAKE MMLOS UPGRADES.

IT'S EASY TO ASSESS VEHICLE LEVEL OF SERVICE FOR THE IMPACTS OF GROWTH AND PROPOSED DEVELOPMENTS, BECAUSE IT ADDRESSES QUANTITATIVE INCREASES IN VOLUMES OF VEHICLES.

IN CONTRAST, LEVEL OF SERVICE FOR THE ALTERNATIVE MODES IS BASED ON THE QUALITY OF THE AMENITIES SUCH AS SIDEWALKS, CROSSWALKS, PEDESTRIAN SIGNALS, BIKE LANES, BENCHES, SHELTERS, ETC.

SO AT LEAST TWO MAJOR PROBLEMS WITH MMLOS. ONE IS THE TASK OF ASSIGNING SEMI-QUANTITATIVE LETTER GRADES.

THAT IS A SOLVABLE PROBLEM, WHICH I ADDRESSED IN COUNTLESS MEETINGS WITH STAFF WHILE SERVING ON THE TRAFFIC COMMISSION, AND FOR WHICH HUNDREDS OF THOUSANDS OF TAXPAYER DOLLARS HAVE BEEN PAID TO CONSULTANT FARE AND PEERS.

THE MORE COMPLICATED PROBLEM IS THAT ANY STREET SEGMENTS FOUND TO BE DEFICIENT FOR ANY OF THESE ALTERNATIVE MODES WOULD BE CONSIDERED PREEXISTING DEFICIENCIES AND NOT THE RESULT OF GROWTH OR DEVELOPMENT. WHEN THE MMLOS SYSTEM WAS PROPOSED OVER A DECADE AGO, I COMMUNICATED TO THE CITY THAT IT WOULD NEVER WORK BASED ON THIS PROBLEM.

NOW, IN DIRECT CONTRADICTION OF THE GMP AND THE STATED PURPOSE, STAFF IS NOW CLAIMING THAT THE CITY NEVER INTENDED TO MAINTAIN THE MINIMUM PERFORMANCE STANDARD FOR MMLOS, AND THAT BECAUSE ANY DEFICIENCIES IN MMLOS ARE PREEXISTING, THE SYSTEM IS LARGELY UNENFORCEABLE ON DEVELOPERS.

AS A CONSEQUENCE, DEVELOPERS ARE ADDING MORE VEHICLE TRAFFIC TO SOME CONGESTED STREETS WITH LITTLE OR NO MITIGATION.

AND HERE'S A BRIEF HISTORY OF QUOTES FROM STAFF PROMISING TO DO MMLOS MONITORING AT MEETINGS JUST LIKE THIS.

ALWAYS COMING LATER THIS YEAR, WITHIN 12 MONTHS THIS SUMMER, EVERY INSTANCE OF DIRECT VIOLATION OF THE GENERAL PLAN AND GROWTH MANAGEMENT PLAN.

IN 2022, I TESTIFIED HERE AS VICE CHAIR OF THE TRAFFIC COMMISSION, CALLING FOR MMLOS MONITORING, AND THERE WAS A PROMISE THAT IT WOULD HAPPEN WITHIN 6 TO 12 MONTHS.

NOW, FOUR YEARS LATER, THE CURRENT REPORT AGAIN JUST STATES AT A FUTURE DATE.

FOR THE FIRST 25 YEARS OF VEHICLE MONITORING, CARLSBAD USED A FAKE LOS GRADING SCHEME THAT ASSUMED THAT EVERY TRAVEL LANE ON EVERY STREET IN THE CITY HAD A CAPACITY OF 1800 VEHICLES PER LANE PER HOUR.

THAT CAPACITY DOES NOT REFLECT THE EXISTENCE OF SPEED LIMITS, INTERSECTIONS, TRAFFIC SIGNALS, LANE CONFIGURATIONS, MEDIAN TYPES, PARKING, OR ANYTHING ELSE THAT EXISTS IN THE REAL WORLD.

ACTUAL CAPACITIES OF A FEW STREET SEGMENTS ARE SHOWN IN THIS TABLE ON THE FAR RIGHT, WHICH ARE ABOUT HALF OR LESS OF THE FAKE 1800 CAPACITY THAT WAS USED.

IT MIGHT BE DIFFICULT TO SEE THIS, BUT THIS TABLE WAS PRODUCED BY A CITY CONTRACTED CONSULTANT TO SHOW THE DIFFERENCE BETWEEN CARLSBAD'S FAKE GRADING SCHEME, USED FOR OVER 25 YEARS IN THE GREEN BOX. ALMOST ALL A'S AND THE VALID GRADING SYSTEM USED SINCE 2015 IN THE RED BOX, SHOWING ACTUAL GRADES THAT INCLUDE MANY E'S AND F'S.

THIS IS A MAP OF EVACUATION ROUTES FROM THE GENERAL PLAN PUBLIC SAFETY ELEMENT.

THE LIST OF STREETS ON THE RIGHT ARE THE KEY ROUTES FOR EMERGENCY RESPONSE AND EVACUATION THAT WERE REPRIORITIZED FOR NON-VEHICLE TRAVEL.

AS A RESULT OF MMLOS CONGESTION IS NO LONGER MONITORED AND DEVELOPERS ARE NO LONGER REQUIRED TO ADDRESS THEIR CONGESTION IMPACTS ON THESE STREETS.

THIS INCLUDES PROJECTS ENABLED BY STATE LAWS TO BUILD AT HIGHER DENSITIES THAN ALLOWED OR PLANNED FOR BY THE CITY, WHICH CREATES EVEN HIGHER IMPACTS. STATE LAW NOW REQUIRES THAT CITIES IDENTIFY EVACUATION ROUTES AND THEIR CAPACITY, SAFETY AND VIABILITY UNDER A RANGE OF EMERGENCY SCENARIOS.

SO IT IS VERY ALARMING THAT WHEN OUR SAFETY ELEMENT WAS UPDATED IN 2024, IT INCLUDED THE LONG DEBUNKED FAKE 1800 VEHICLES PER LANE PER HOUR CAPACITY ASSUMPTION WHEN CAPACITIES, AS I SHOWED EARLIER, ARE GENERALLY LESS THAN HALF THAT.

AND IN RESPONSE TO SAFETY CONCERNS, CONCERNS SUBMITTED BY RESIDENTS, THE ENVIRONMENTAL IMPACT REPORT FOR THIS SAFETY ELEMENT UPDATE REACHED THE BIZARRE CONCLUSION THAT THE CITY'S MMLOS SYSTEM, WHICH CONVERTS STREETS FROM VEHICLE TO PEDESTRIAN AND BICYCLE PRIORITY, WOULD SOMEHOW ENHANCE THE EVACUATIONS. AS AN EXAMPLE, A LARGE NUMBER OF PROJECTS, MOST OF THEM ARE GOING INTO THE VILLAGE AREA.

HOWEVER, NONE OF THE STREETS THERE ARE SUBJECT TO VEHICLE LEVEL OF SERVICE SERVICE ANY LONGER.

SO DEVELOPERS, INCLUDING THOSE WHO ARE FAR EXCEEDING THE CITY'S MAXIMUM DENSITIES, DO NOT HAVE TO STUDY OR ADDRESS THEIR VEHICLE IMPACTS.

IT IS NOT EVIDENT THAT THE EFFECTS OF STREET CONGESTION HAVE BEEN ASSESSED FOR EMERGENCY RESPONSES OR EVACUATIONS, AND THE GARBAGE STREET CAPACITY DATA IN THE SAFETY ELEMENT AND LACK OF MONITORING COULD ENDANGER LIVES BY NOT SUFFICIENTLY ACCOUNTING FOR POTENTIAL SAFETY ISSUES.

ONE OF THE FEW AREAS THE CITY STILL HAS THE POWER TO ENFORCE, DESPITE THE MULTITUDE OF STATE HOUSING LAWS USURPING ITS AUTHORITY.

SO AGAIN, I'M GOING TO GO BACK TO OUR RECOMMENDATIONS.

PLEASE, IF YOU DON'T DO ANYTHING ELSE, ASK THE CITY ATTORNEY HOW THE CURRENT REPORT CAN LEGALLY SATISFY THE CITY'S ANNUAL GMP MONITORING REQUIREMENT, GIVEN THE LACK OF MMLOS MONITORING INCLUDED. AND I SAW ON THE INITIAL SLIDE THAT STAFF HAD PUT YES FOR FOR EVERYTHING EXCEPT THEY PUT VEHICLE ONLY ON THE ON THE CIRCULATION COMPONENT. AND WHEN STREETS ARE SHOWN TO BE BUILT OUT, THEN THE DEVELOPER OR WHOEVER CAN BE COMPELLED TO MAKE MULTIMODAL UPGRADES INSTEAD, AND FINALLY CONDUCT ROBUST QUANTITATIVE VEHICLE LEVEL OF SERVICE MONITORING OF ALL EMERGENCY RESPONSE AND EVACUATION ROUTES TO IDENTIFY ANY SAFETY GAPS AND HOPEFULLY RESTORE THE CITY'S ABILITY TO AT LEAST REVIEW HAVE DISCRETIONARY REVIEW OF DEVELOPMENT PROJECTS FOR THEIR SAFETY IMPACTS.

THIS RESULTED IN PONTO NOW BEING DEVELOPED AT A AT A DENSITY THAT'S 40% HIGHER THAN THE REST OF THE CITY OF CARLSBAD, PER US CENSUS DATA. THE USABLE OPEN SPACE DEFICIT AT PONTO IMPACTS ALL CARLSBAD CITIZENS BY REMOVING NEEDED COASTAL RECREATION, A.K.A USABLE OPEN SPACE LAND USE AT PONTO THAT IS VITAL.

IT IS VITAL TO CARLSBAD'S ECONOMIC AND SOCIAL SUSTAINABILITY.

PONTO IS AT THE CENTER OF A SIX MILE LENGTH OF COASTLINE.

WITHOUT A TRUE COASTAL PARK, PONTO IS THE ONLY SIGNIFICANT VACANT AND CURRENTLY UNPLANNED AND UNCERTIFIED LCP LAND LEFT IN THE SEVEN MILES TO PROVIDE A TRUE COASTAL RECREATION, I.E.

PUBLIC PARK, AS OUTLINED IN THE CITY'S CURRENTLY AND COASTAL COMMISSION'S CURRENTLY CERTIFIED LOCAL COASTAL PROGRAM FOR PONTO.

THAT CURRENT LCP REQUIRES THE CITY TO CONSIDER THESE COASTAL ISSUES NEEDS THESE OPEN SPACE ISSUE NEEDS.

CARLSBAD CITIZENS RESPECTFULLY ASK EACH COUNCIL MEMBER TO PLEASE, PRETTY PLEASE.

EXCUSE ME. I PREPARED A COUPLE OF NOTES HERE ASSUMING THAT MMLOS WAS GOING TO COME UP BASED ON IT BEING RAISED IN SOME OF THE PUBLIC COMMENT AND DURING THE TRANSPORTATION COMMISSION. WHEN THE CITY INCORPORATED MMLOS INTO THE GENERAL PLAN, CIRCULATION ELEMENT AND GROWTH MANAGEMENT PROGRAM PERFORMANCE STANDARDS, MMLOS WAS AN EMERGING CONCEPT THAT HAD NOT BEEN IMPLEMENTED ANYWHERE FOR SEVERAL YEARS.

WITH THE ASSISTANCE OF A CONSULTANT AND A TRAFFIC SAFETY AND MOBILITY COMMISSION SUBCOMMITTEE STAFF ATTEMPTED, WITHOUT SUCCESS, TO DEVELOP A WORKABLE METHODOLOGY FOR DETERMINING COMPLIANCE WITH THE MMLOS CRITERIA.

NO OTHER CITY OR METROPOLITAN PLANNING ORGANIZATION, INCLUDING SANDAG, HAS IMPLEMENTED MMLOS CRITERIA AND SEVERAL JURISDICTIONS HAVE ABANDONED THE EFFORT AFTER EXPERIENCING SIMILAR CHALLENGES.

STAFF REQUIRE FURTHER GUIDANCE FROM THE CITY COUNCIL TO DETERMINE WHETHER TO CONTINUE EFFORTS TO DEVELOP A WORKABLE MMLOS METHODOLOGY, OR TO STUDY AND PRESENT POTENTIAL AMENDMENTS TO THE CIRCULATION ELEMENT AND GROWTH MANAGEMENT PROGRAM PERFORMANCE STANDARDS FOR THE CITY COUNCIL'S CONSIDERATION.

STAFF DELAYED SEEKING THE REQUIRED POLICY GUIDANCE UNTIL THE CONCLUSION OF THE APPEAL, AND THE LAWSUIT BROUGHT BY NORTH COUNTY ADVOCATES BECAUSE THE APPEALS POTENTIAL EFFECT ON AVAILABLE OPTIONS. THE APPELLATE COURT ISSUED ITS DECISION IN THE CITY'S FAVOR IN DECEMBER 2025, AND NORTH COUNTY ADVOCATES DID NOT SEEK REVIEW BY THE CALIFORNIA SUPREME COURT.

ASSUMING NO FURTHER DEVELOPMENTS IN THE NORTH COUNTY ADVOCATE'S CASE THAT WOULD AFFECT AVAILABLE OPTIONS, STAFF'S PLAN IS TO RETURN TO THE CITY COUNCIL BY SEPTEMBER TO SEEK THE REQUIRED POLICY GUIDANCE.

IN SHORT, THE GROWTH MANAGEMENT PLAN HAD REQUIREMENTS AND STANDARDS, BUT IT HAD TWO ENFORCEMENT MECHANISMS. ONE IS AN ABSOLUTE UNIT CAP, THE OTHER IS A MORATORIUM PROVISION.

THE RECENT STATE LAWS HAVE SAID THAT IN ORDER TO ENACT A MORATORIUM, YOU HAVE TO HAVE SPECIFIC PUBLIC HEALTH AND SAFETY FINDINGS.

AND THE STATE HAS OPINED AND THROUGH CORRESPONDENCE TO THE CITY THAT SOMETHING SUCH AS JUST ROADWAY CAPACITY DID NOT MEET THOSE FINDINGS.

AND SO THERE WAS A SERIES OF LETTERS AND ACTIONS THAT LED UP TO THE CITY'S SUSPENSION OF CERTAIN PROVISIONS OF THE GROWTH MANAGEMENT PROGRAM IN APRIL OF 2021, WITH THE ADOPTION OF THE ORIGINAL HOUSING ELEMENT. ALL RIGHT. SO I'M GOING TO AGAIN, I'M GOING TO TRY TO SIMPLIFY THIS.

WE HAVE A GROWTH MANAGEMENT PLAN THAT SAYS IF YOUR INFRASTRUCTURE CAN'T HANDLE THE DEVELOPMENT THEN YOU STOP DEVELOPMENT.

STATE OF CALIFORNIA COMES IN AND SAYS, WE DON'T CARE IF YOU CAN'T HANDLE.

IF YOUR INFRASTRUCTURE CAN'T HANDLE THE DEVELOPMENT, YOU WILL CONTINUE TO DEVELOP AS WE INSTRUCT YOU TO.

THAT IS NOT SUSPENDED, BUT THE TREND FROM STATE LEGISLATION HAS BEEN TO REDUCE WHAT WE CAN REQUIRE FOR PROJECTS, FOR THEIR VMT IMPACTS, INCLUDING UP TO LAST SUMMER WHEN BILLS WERE ADOPTED TO FURTHER TAKE AWAY AUTHORITY AND ADD MORE RESTRICTIONS ON HOUSING DEVELOPMENT PROJECTS.

IN 2017, THE CITY COUNCIL APPROVED THE PARKING MANAGEMENT PLAN, WHICH IDENTIFIED A SERIES OF STRATEGIES TO IMPROVE THE EFFICIENCY AND EFFECTIVENESS OF THE PARKING SYSTEM WITHIN THE VILLAGE, BARRIO AND THE BEACH AREAS.

IN THE ENSUING YEARS, IN RESPONSE TO GROWING HOUSING AFFORDABILITY CRISIS, STATE LAW CHANGED TO MAKE IT EASIER AND FASTER TO BUILD HOUSING, ESPECIALLY NEAR TRANSIT CENTERS LIKE THE CARLSBAD STATION, AN AREA FOCUSED BY THE STATE, INVOLVES THE ABILITY OF CITIES TO REQUIRE PARKING.

MOST NOTABLY, IN 2022, AB 2097 WAS PASSED BY THE STATE, WHICH PROHIBITS CITIES FROM ENFORCING PARKING PARKING REQUIREMENTS FOR RESIDENTIAL, COMMERCIAL OR OTHER PROJECTS LOCATED NEAR PUBLIC TRANSIT STATIONS SUCH AS CARLSBAD VILLAGE TRANSIT STATION, AS PART OF THE PARKING MANAGEMENT PLAN. STAFF PRESENTED THE RESULTS OF AN ANNUAL PARKING SURVEY, WHICH IS BASED ON SURVEYS CONDUCTED IN THE SUMMER MONTH.

ONE DAY DURING THE WEEK AND ONE DAY ON THE WEEKEND, THE RESULTS ARE PROVIDED TO CITY COUNCIL IN THE FORM OF A COUNCIL MEMO.

THE RESULTS OF THE 2024 SURVEY FOUND THAT WHILE PARKING IS GENERALLY ADEQUATE, THERE ARE AREAS WHERE THERE IS PARKING CHALLENGES WHICH MIGHT FURTHER PREVENT OR FRUSTRATE THE ABILITY PARKING AND THAT PARKING SEEMS TO BE WORSENING.

SINCE THE ADOPTION OF THE 2017 PARKING MANAGEMENT PLAN, THE CITY HAS COMPLETED AND IMPLEMENTED THE FOLLOWING PROGRAMS AND STRATEGIES.

THE CITY EVALUATED AREAS OF THE DOWNTOWN AREA TO CONVERT RED CURB TO GRAY CURB, RESULTING IN 22 ADDITIONAL SPACES IN THE VILLAGE AREA AND 22 ADDITIONAL SPACES IN THE BARRIO AREA. THE POLICE DEPARTMENT HIRED TWO COMMUNITY SERVICE OFFICERS FOR IMPLEMENTATION OF PARKING STRATEGIES RELATED TO ENFORCEMENT AND PARKING REGULATIONS AND TIME LIMITS.

THE CITY ESTABLISHED THE CARLSBAD COMMUTER PROGRAM REQUIRED BY THE CITY'S TDM ORDINANCE, FURTHER BOLSTERING EMPLOYER BASED TDM OPPORTUNITIES.

FOLLOWING THIS ITEM, PUBLIC WORKS IS PROPOSING IMPROVEMENTS ALONG GRAND AVENUE THAT WILL RESULT IN 14 NEW SPACES.

THE CITY COUNCIL ALSO RECENTLY APPROVED THE CONVERSION OF PARALLEL PARKING TO PERPENDICULAR PARKING ON CHESTNUT AVENUE,

BUT THE SURVEY IS A SMALL SNAPSHOT IN TIME, AND A MORE ROBUST SURVEY COVERING THE PARKING NEEDS FOR A YEAR IS NECESSARY TO HELP FORMULATE A DATA DRIVEN SET OF RECOMMENDED ACTIONS THAT CAN BE CONSIDERED. THE ANNUAL PARKING SURVEY STATES THAT THERE'S GENERALLY SUFFICIENT PARKING DURING HIGH TOURISM SEASON, WHICH IS PARKING IS TYPICALLY MOST IMPACTED. HOWEVER, IT ONLY SHOWS PARKING CONDITIONS AND CHALLENGES FOR THAT MONTH AND DOESN'T PAINT A WHOLE PICTURE OF WHAT THE PARKING CONDITIONS AND CHALLENGES ARE THROUGHOUT THE YEAR.

MOREOVER, IN ADDITION TO AB 2097, WHICH LIMITS THE ABILITY OF THE CITY TO IMPOSE MINIMUM PARKING REQUIREMENTS, THE CITY HAS RECEIVED AND PROCESSED A NUMBER OF HOUSING DENSITY BONUS PROJECTS THAT REDUCE ON SITE PARKING, SHIFTING DEMAND TO CURBSIDE PUBLIC SPACES, AND THAT TREND IS ACCELERATING.

SIMPLY PUT, THERE'S MORE HOUSING COMING TO THE DOWNTOWN AREA THAN WHAT HAD BEEN PREVIOUSLY ANTICIPATED.

PROFESSIONAL SERVICES ARE NEEDED TO EVALUATE WHETHER THE EXISTING STRATEGIES ARE ADEQUATE FOR CHANGING FUTURE CONDITIONS.

PUBLIC PERCEPTION OF PUBLIC PARKING SUPPLY VARIES.

SOME SAY THERE'S SUFFICIENT PARKING, WHILE OTHERS SAY THERE ISN'T. PUBLIC FEEDBACK REMAINS THAT PARKING IS CHALLENGING IN THE DOWNTOWN AREA, AND THIS STUDY WILL PROVIDE THE NEEDED INFORMATION TO FRAME FUTURE PARKING POLICY CHANGES.

THE CITY HAS CONDUCTED ANNUAL SURVEYS WHICH EVALUATES THE CURRENT CONDITIONS DURING THE TIME OF THE SURVEY.

THE CITY HAS NOT PERFORMED A COMPREHENSIVE EVALUATION SINCE 2017.

THE CITY REEVALUATED THE EFFECTIVENESS OF THE PARKING MANAGEMENT PLAN IN 2023.

HOWEVER, GIVEN THE RECENT CHANGES IN STATE LAW, THERE'S A NEED TO ASSESS FUTURE PARKING DEMAND AND CONDITIONS.

A COMPREHENSIVE PARKING STUDY WILL DO JUST THAT AND PROVIDE RECOMMENDATIONS BASED ON THE NEW PARKING DATA AS NECESSARY.

THE SCOPE OF THE PROJECT, AS SHOWN ON THE SLIDE, SHOWS THAT THERE WILL BE THREE SURVEYS COMPLETED EACH QUARTER FOR A TOTAL OF 12.

DATA INVENTORY COLLECTION FROM PREVIOUS ANNUAL STUDIES AND OTHER RELEVANT PARKING DATA WILL BE CONSOLIDATED AND RECONCILED WITH THAT DATA TO DEVELOP PARKING TRENDS OVER TIME.

ON SITE INTERCEPT SURVEYS IN ALL THREE NEIGHBORHOODS WILL BE AVAILABLE IN ENGLISH AND SPANISH.

PREPARATION OF PARKING STUDY DATA AND ANALYSIS WILL INCLUDE FEATURING PARKING, SUPPLY AND DEMAND ANALYSIS TO COORDINATE FUTURE LAND USE AND TRANSPORTATION PROJECTIONS DEVELOPING SHORT TERM AND LONG TERM RECOMMENDATIONS BASED ON PARKING SURVEY AND DATA ANALYSIS.

AS PREVIOUSLY MENTIONED, THE STUDY WILL BE CONDUCTED IN THE VILLAGE AND BARRIO AND NEARBY BEACH AREA NEIGHBORHOODS, CONSISTENT WITH THE PARKING MANAGEMENT PLAN AND THE PARKING ANNUAL PARKING SURVEYS.

AFTER THE SELECTION PROCESS STARTED IN SEPTEMBER 2025, THE REQUEST FOR PROPOSALS WAS ADVERTISED AND FOUR BIDS WERE RECEIVED IN NOVEMBER AND JANUARY OF THIS YEAR. THE REVIEW COMMITTEE CONDUCTED A BEST VALUE EVALUATION AND PURSUANT TO THE CITY'S PURCHASING POLICIES AND PROCEDURES AND EVARI CONSULTING WAS SELECTED FOLLOWING APPROVAL OF THE CONTRACT THERE WILL BE A KICKOFF MEETING WITH THE CITY AND THE CONSULTANT.

THE CONSULTANT WILL ALSO BEGIN COLLECTING INVENTORY DATA AND OTHER RELATED PARKING RESEARCH.

THE SURVEYS WILL BE CONDUCTED OVER THE SPRING AND THROUGH THE SPRING OF NEXT YEAR.

AND THEN NEXT YEAR, THE STUDY WILL BE PREPARED AND STAFF WILL PRESENT TO THE CITY COUNCIL THE FINDINGS AND PROVIDE RECOMMENDATIONS IN AN APPROPRIATE TIME TO DISCUSS NEXT STEPS.

CERTAIN LEGISLATIVE CHANGES DIRECTLY IMPACT THE AVAILABILITY OF PARKING, NAMELY STATE DENSITY BONUS LAW, WHICH OFFERS REDUCED PARKING STANDARDS FOR NEW HOUSING PROJECTS, AND THAT APPLIES ANYWHERE IN THE CITY AND ASSEMBLY BILL 2097, WHICH PREVENTS JURISDICTIONS FROM IMPOSING MINIMUM PARKING REQUIREMENTS FOR ANY DEVELOPMENT LOCATED WITHIN ONE HALF MILE OF TRANSIT, LIKE THE CARLSBAD VILLAGE STATION. AND AS MENTIONED, CITY STAFF ARE NOTICING THAT PARKING IS GETTING BAD.

SO I'M JUST GOING TO MOVE ON. ALL RIGHT, SO THE ASSUMPTION BEHIND THESE STATE LAWS ON DENSITY BONUS ARE THAT JUST BECAUSE PEOPLE ARE LIVING AT A HIGHER DENSITY THAN THE CITY HAS ZONED THAT AREA FOR THAT, THEY ARE MORE LIKELY TO, TO NOT HAVE AN OWNED VEHICLES OR USE VEHICLES.

TO ME THAT'S SILLINESS. THERE'S A PROJECT IN LA COSTA IN MISS ACOSTA DISTRICT WHERE THEY HAVE LESS THAN THE NORMAL AMOUNT OF PARKING, BUT THERE IS NO ALTERNATIVE THERE. THERE ARE NO BUSSES.

IT'S NOT WITHIN WALKABLE, WALKABLE OR BICYCLE DISTANCE OF ANYTHING.

IT'S JUST A WAY FOR THE DEVELOPER TO SAVE MONEY AND BUILD MORE UNITS.

AB 2097 RELIES ON THE FACT THAT WE HAVE A TRAIN STATION, BUT JUST BECAUSE WE HAVE A TRAIN STATION DOESN'T MEAN THAT ALL THE PEOPLE THAT LIVE IN THAT DEVELOPMENT OR THAT GO TO THE BUSINESS THAT'S THERE ARE GOING TO BE USING THE TRAIN TO GET THERE.

SO WE'RE SKEPTICAL THAT THE ASSUMPTION BEHIND THOSE LAWS IS GOING TO PROVE TO BE TRUE.

MANY CITIES, INCLUDING ENCINITAS, HAVE ON STREET PARKING PERMIT PROGRAMS THAT ISSUE A LIMITED NUMBER OF NO OR LOW COST PERMITS TO EXISTING USERS,

AND WHEN FACED WITH THAT DISCLOSURE, MAYBE THE DEVELOPER DOESN'T TRULY BELIEVE THAT THEY CAN MARKET THEIR PROJECT WITH THEIR REDUCED PARKING.

THEY WOULD BE INCENTIVIZED THEN TO INSTEAD INCLUDE THE CITY'S MINIMUM AMOUNT OF PARKING.

IF THEY TRULY BELIEVE THEIR ON SITE PARKING WILL BE SUFFICIENT, THEN THERE SHOULD BE NO OBJECTION.

AND THERE'S NO REQUIREMENT THAT THE CITY EVER ESTABLISH A PARKING PERMIT PROGRAM IF IT'S NOT NECESSARY.

BUT IF IT DOES BECOME NECESSARY, THEN THIS CONDITION IS CONSISTENT WITH THE STATE'S UNDERLYING GOAL OF REDUCING VEHICLE OWNERSHIP AND GREENHOUSE GAS EMISSION BY THE USERS OF THAT PROJECT. SO IT'S A SIMPLE CONDITION OF APPROVAL THAT CAN JUST BE ADDED.

NOW, IT DOESN'T HAVE TO BE IMPLEMENTED, BUT IT'S AVAILABLE IN THE FUTURE.

SO I WOULD SAY THAT THIS IS ONE AREA WHERE THE STATE IS GIVING YOU THE RIGHT TO DO SOMETHING.

THIS MATTER HAS BEEN PRESENTED TO CITY STAFF AND OTHER DECISION MAKING BODIES LIKE THE PLANNING COMMISSION ON SPECIFIC PROJECTS. THERE ARE SOME LIMITATIONS ON THE IMPOSITION OF CONDITIONS.

ONE THING THAT CAME UP ON THE AS A DISCUSSION ITEM ON THE PREVIOUS ITEM WAS THE MORATORIUM THAT FELL UNDER THE HOUSING ACCOUNTABILITY ACT AND THE HOUSING CRISIS ACT.

GOVERNMENT CODE SECTION 65589.5 LISTS OUT THE LIMITATIONS OF JURISDICTIONS UNDER THE ENACTMENT OF A HOUSING CRISIS AND THE DECLARATION OF OPPORTUNITIES TO STREAMLINE AND REALLY PRODUCE MORE HOUSING.

THE MORATORIUM IS ONE ASPECT OF IT. THE OTHER IS APPLYING OBJECTIVE DESIGN STANDARDS TO PROJECTS AND IMPOSING CONDITIONS THAT ARE BASED ON OBJECTIVE STANDARDS OF THE CITY. SO IF IT WOULD INTERRUPT OR FRUSTRATE THE APPLICANT'S ABILITY TO MOVE FORWARD WITH THE PROJECT, THE CITY COULD BE AT RISK OF VIOLATING THE HOUSING ABILITY HOUSING ACCOUNTABILITY ACT OR HOUSING CRISIS ACT.

IN THIS PARTICULAR CASE, THAT PARTICULAR CONDITION HAD BEEN BROUGHT UP ON AT LEAST TWO OCCASIONS WITH THE PLANNING COMMISSION, AND THE PLANNING COMMISSION DID NOT ELECT TO IMPOSE THAT AS A CONDITION ON THE PROJECT.

I WILL SAY THAT THE PARKING PERMIT PROGRAM IS LISTED AS ONE OF THE TOOLS UNDER THE EXISTING PARKING MANAGEMENT PLAN.

THE PARKING MANAGEMENT PLAN ITSELF IS NOT A REGULATORY DOCUMENT.

IT'S JUST A TOOL OF OPTIONS THAT THE CITY COUNCIL CAN SELECT FROM TO GAUGE OR MONITOR OR ENFORCE DIFFERENT PARKING STRATEGIES.

SO IT IS NOT A FOREIGN CONCEPT, AND IT WILL BE SOMETHING THAT WILL BE CONSIDERED AS PART OF THIS UPDATE PROCESS, AND IT WILL BE A FUTURE DISCUSSION ITEM WITH THE CITY COUNCIL.

BUT AS OF NOW, NONE OF THE PROJECTS HAVE BEEN IMPOSED WITH THIS SPECIFIC CONDITION BECAUSE OF THE DECISION MAKING BODY, IN THIS CASE, THE PLANNING COMMISSION CHOSE NOT TO IMPOSE IT, BUT THERE COULD BE SOME RESERVATIONS, PERHAPS FROM THE CITY ATTORNEY'S OFFICE, ON WHETHER OR NOT THAT MAKES A PROJECT FEASIBLE OR NOT.

OH, PLEASE NOTE THAT TODAY'S ACTION WILL NOT AFFECT THE PROPOSED GRAND AVENUE PROMENADE CAPITAL IMPROVEMENT PROGRAM PROJECT IN ANY WAY SHOULD THE CITY COUNCIL ONE DAY DECIDE TO PROCEED WITH THAT POTENTIAL PROJECT, AS THESE ARE SEPARATE CAPITAL IMPROVEMENT PROGRAM PROJECTS.

THIS IS A VIEW OF EASTBOUND GRAND AVENUE. YOU CAN SEE THE EXISTING DIAGONAL PARKING ON THE SOUTH SIDE OF THE STREET ON THE RIGHT HAND SIDE OF THE PICTURE.

ON THE NORTH SIDE, PARKING IS PARALLEL AND THERE ARE TWO WESTBOUND VEHICLE LANES.

THIS IS A GRAPHIC THAT SHOWS THE EXISTING ROADWAY CONFIGURATION OF GRAND AVENUE.

OUR PROJECT PROPOSES TO CONVERT THE PARALLEL PARKING ON THE NORTH SIDE OF GRAND AVENUE TO DIAGONAL PARKING, THEREBY INCREASING THE NUMBER OF PARKING SPACES.

IN ORDER TO DO THIS, WE HAVE TO REDUCE THE NUMBER OF WESTBOUND TRAFFIC LANES FROM 2 TO 1.

WE WILL ALSO ADD A TWO WAY LEFT TURN LANE IN THE MIDDLE OF THE ROADWAY TO FACILITATE LEFT TURNS AT THE INTERSECTIONS.

THIS CONFIGURATION IS THE RESULT OF COLLABORATION OF INTERNAL STAKEHOLDERS, INCLUDING OUR POLICE AND FIRE DEPARTMENT PARTNERS.

AND THIS IS WHAT THE PROPOSED ROADWAY CONFIGURATION WOULD LOOK LIKE.

THE PROJECT EXTENDS AGAIN BETWEEN TYLER STREET ALLEY AND JEFFERSON STREET.

THE NEW DIAGONAL PARKING SPACES HERE ARE HIGHLIGHTED IN ORANGE.

FOR POLICY 3-P.15 OF THE CITY'S GENERAL PLAN MOBILITY ELEMENT, THE CITY COUNCIL HAS SOLE DISCRETION FOR ANY LANE REDUCTION OR ROAD DIET THAT WOULD REDUCE VEHICLE CAPACITY TO OR BELOW A LEVEL OF SERVICE D.

THEREFORE, STAFF CONDUCTED A LEVEL OF SERVICE EVALUATION AND FOUND THAT THE LEVEL OF SERVICE FOR THIS SEGMENT OF GRAND AVENUE WOULD REMAIN AT A LEVEL OF SERVICE D WITH THE PROPOSED LANE REDUCTION. THE PRIMARY BENEFIT OF THIS PROJECT WOULD BE A NET GAIN OF 11 ADDITIONAL PARKING SPACES.

I DIDN'T MENTION THIS BEFORE, BUT THE ALWAYS STOP AT GRAND AVENUE AND MADISON STREET THAT WAS PREVIOUSLY APPROVED WILL ADD AN ADDITIONAL THREE PARKING SPACES, SO THE TWO ENDEAVORS COMBINED WOULD NET AN ADDITIONAL 14 SPACES.

WITH THE HELP OF OUR COMMUNICATION DEPARTMENT, COMMUNITY OUTREACH FOR THIS EFFORT HAS INCLUDED WEBSITE UPDATES, SOCIAL MEDIA POSTS, UPDATES IN THE CITY MANAGER'S E-NEWSLETTER, AND REACHING OUT TO LOCAL BUSINESSES INCLUDING THE CARLSBAD VILLAGE ASSOCIATION.

THE TRAFFIC SAFETY AND MOBILITY COMMISSION SUPPORTED STAFF'S RECOMMENDATION AT ITS MEETING ON FEBRUARY 2ND, 2026. THE ESTIMATED COST OF DESIGN, PERMITTING AND OUTREACH IS $40,000.

THERE ARE SUFFICIENT FUNDS IN CIP 6079, WHICH IS PROGRAMED AS AN EVALUATION OF ON STREET PARKING IN THE VILLAGE AND PARKING AREAS OR BARRIO AREAS, BUT WE ARE REQUESTING A TRANSFER FROM THE GENERAL CAPITAL CONSTRUCTION FUND TO THE PARKING IN LIEU FUND TO BETTER ALIGN WITH THE DESIGN NATURE OF THIS EFFORT.

UPON APPROVAL, STAFF WILL BEGIN DESIGN OF THE PARKING MODIFICATIONS ON GRAND AVENUE, WHICH ARE STRIPING ONLY.

WE ESTIMATE THAT THE CONSTRUCTION PACKAGE WILL BE BROUGHT TO CITY COUNCIL FOR APPROVAL IN THE FALL OF 2026.

AND JUST AS A REMINDER, CITY STAFF IS ALSO PROPOSING A CITY POLICY THAT CLARIFIES CITY COUNCIL DIRECTION ASSOCIATED WITH ITS MINUTE MOTION

THE ROAD DIET THAT TOOK PLACE ON LA COSTA AVENUE WAS SOMETHING THAT IRONICALLY, I WAS INVOLVED IN.

IT HAS IMPROVED THE LIFE AND THE SAFETY OF NOT JUST THOSE OF US WHO LIVE ON LA COSTA AVENUE, BUT EVERYBODY WHO DRIVES LA COSTA AVENUE. IT HAS BEEN ABSOLUTELY TRANSFORMATIVE.

AND I SEE SOMETHING LIKE THIS, SOMETHING THAT IS, IS BEING DONE IN THAT SAME SENSE TO MAKE THE ROAD SAFER SLOW IT DOWN A BIT AND THEN WHILE WE GET EXTRA PARKING OUT OF IT AT THE SAME TIME.

I WOULD LIKE TO EXPRESS MY SUPPORT FOR THE ROAD DIET, BUT OPPOSITION TO THE EXTRA PARKING SPACES IN THIS PROJECT, BECAUSE THERE ARE ALTERNATIVE PARKING SOLUTIONS THAT IMPROVE LIVABILITY AND BIKE SAFETY WHILE PRESERVING ALL THE PARKING CURRENTLY ON GRAND PARKING AVAILABILITY. ACCORDING TO THE 2024 CARLSBAD PARKING STUDY, THE TWO BIG PARKING LOTS JUST NORTH OF GRAND IN THIS AREA ARE AT THE PEAK WEEKDAY HOUR, DO NOT EXCEED 70% OF THE SPACES FILLED.

THIS MEANS THAT THERE ARE OVER 50 SPACES THAT RARELY GET USED IN THESE PARKING LOTS, BECAUSE THE BUSINESSES PREVENT ANYONE USING THE WRONG BUSINESSES FROM PARKING THERE. BUT OVER 300 CARS PER HOUR IN EACH DIRECTION TRAVEL ALONG IT, WHICH MEANS ONE EVERY 12 SECONDS.

ADDING PARKING WOULD INCREASE THE AMOUNT OF PEOPLE DRIVING ALONG THEY'RE LOOKING FOR THAT PARKING, WHICH WOULD INCREASE NOISE, EXHAUST FUMES AND PARTICULATES.

SO A LITTLE BIT OF A PATRIOTIC CLOSE. BOTH MISS BURKHOLDER AND I GOT TO GO TO THE AIRPORT AND WELCOME BACK FROM WASHINGTON THE ESCONDIDO 100 YEAR OLD RETIRED MILITARY WHO RECEIVED THE PRESIDENTIAL CONGRESSIONAL MEDAL OF HONOR.

IT WAS EXCITING. WE GOT TO SHAKE HIS HAND. AND I NEVER THOUGHT JUST SHAKING THE HAND OF SOME HUNDRED YEAR OLD MAN WOULD MEAN SO MUCH TO ME, BUT IT DID. SO CONGRATULATIONS TO HIM AND HIS FAMILY FOR THAT RECOGNITION.

IF YOU HEARD WHAT HE DID, YOU'D BE AMAZED. AND I'LL JUST GIVE YOU A TINY BIT OF THE INFORMATION.

MY NUMBERS MIGHT BE A LITTLE BIT OFF. I'M GOING FROM MEMORY, BUT HE WENT UP AGAINST I THINK IT WAS SEVEN RUSSIAN MIG FIGHTER JETS. HE WAS IN HIS OWN WHICH WASN'T AS GOOD AS ANY OF THE RUSSIAN MIGS.
