I AM THE LIBRARY AND CULTURAL ARTS DIRECTOR FOR THE CITY OF CARLSBAD.

AND I AM JOINED HERE WITH GITA NASSIRI FROM THE CARLSBAD LIBRARY AND ARTS FOUNDATION.

WE'RE HERE TO ACKNOWLEDGE A DONATION THAT THEY ARE GOING TO MAKE OF ALMOST $230,000 FOR US.

IT HELPS TO PROVIDE OUR WONDERFUL LIBRARY AND ARTS EVENTS AND PROGRAMS AND COLLECTIONS AND SERVICES, AND IT SUPPLEMENTS THE PRIMARY FUNDING FROM THE CITY'S GENERAL FUND.

I AM PLEASED TO BE HERE TODAY, AND I'LL TRY TO MAKE THIS AS SHORT AS POSSIBLE.

IT LOOKS LIKE YOU HAVE A FULL AGENDA, BUT I AM PLEASED, VERY PLEASED TO BE HERE TODAY ON BEHALF OF THE CARLSBAD LIBRARY AND ARTS FOUNDATION.

I WOULD ALSO LIKE TO RECOGNIZE SEVERAL SEVERAL OF MY FELLOW BOARD MEMBERS WHO ARE HERE TODAY, JOHN LUCAS, MICHAEL HALL, AND GINA MCBRIDE, WHO IS ALSO SERVING ON THE LIBRARY BOARD OF TRUSTEES AND IS THEIR REPRESENTATIVE ON OUR BOARD. OUR BOARD WE HAVE MINIMAL OVERHEAD.

WE HAVE NO EMPLOYEES. AND THAT'S SOMETHING THAT I LOVE TO TALK ABOUT.

THE FOUNDATION IS A 501 C(3), AS YOU KNOW, NONPROFIT ORGANIZATION ESTABLISHED IN 1998 WITH A SINGLE MISSION, A SINGLE MISSION TO FINANCIALLY SUPPORT AND ENHANCE THE CITY OF CARLSBAD'S LIBRARY AND CULTURAL ARTS PROGRAMS AND FACILITIES.

THANKS TO THE GENEROSITY OF OUR COMMUNITY, THE FOUNDATION HAS CONTRIBUTED MORE THAN $2.5 MILLION TO ARTS, LITERARY, LITERACY AND CULTURAL PROGRAMS THROUGHOUT CARLSBAD AND CURRENTLY MANAGES NEARLY $6 MILLION IN ENDOWMENT FUNDS FOR FISCAL YEAR 2026 2027.

THE FOUNDATION IS PROUD TO PROVIDE $224,877 IN SUPPORT OF THE LIBRARY AND CULTURAL ARTS DEPARTMENT. THE, THE BREAKDOWN OF THAT IS THE MONEY IS COMING FROM THREE ENDOWMENTS.

THE ROBERT H. GARDNER CULTURAL ENDOWMENT FUND.

THE. AND THAT'S FOR PROGRAMING IN THE RUBY G.

SCHULMAN AUDITORIUM, THE BENSON FAMILY ENDOWMENT FUND, AND THE FUNDS FROM THAT ENDOWMENT GO TO THE LIBRARY COLLECTION, MOSTLY THE DIGITAL COLLECTION AND THE LEARNING CENTER.

THE CANNON ENDOWMENT TO SUPPORT PROGRAMS, EXHIBITS AND ACTIVITIES ASSOCIATED WITH THE CANNON ART GALLERY.

IN ADDITION, THE FOUNDATION HAS HELPED BRING BACK LAST YEAR AND CONTINUING THIS YEAR, THE POPULAR POP UP ART EXPERIENCES AND PRE-CONCERT DANCE LESSONS AT THE TGIF CONCERTS IN THE PARK.

LAST YEAR, THE FOUNDATION ALSO FUNDED THE PERCUSSION PLAY INTERACTIVE SCULPTURES AT THE COLE LIBRARY SCULPTURE GARDEN, WHICH ARE NOW BEING ENJOYED BY RESIDENTS OF ALL AGES.

AND I HAVE TO SAY, THE TURNAROUND FOR THAT WAS SO QUICK WITHIN THE YEAR THAT SCULPTURE GARDEN WAS UP.

I AM ALSO PLEASED TO SHARE THAT THE FOUNDATION RECENTLY RECEIVED A REMARKABLE LEGACY GIFT OF $452,805 FROM A TRUST, SO A LITTLE LESS THAN HALF A MILLION.

WE ARE DEEPLY GRATEFUL TO THE FAMILY FOR THEIR GENEROSITY.

THIS GIFT WILL SUPPORT THE CANNON ART GALLERY.

IT WILL BE KNOWN AS THE CANNON ENDOWMENT TO FUND AND WILL HELP ENSURE THIS PERSON'S COMMITMENT TO THE ARTS CONTINUING FOR GENERATIONS TO COME, TO COME. AND JUST TO FINISH OFF, ONE OF THE UNIQUE ASPECTS OF THE FOUNDATION IS THAT THE DONATIONS ARE INVESTED AND THE EARNINGS FROM THE INVESTMENTS ARE USED TO SUPPORT PROGRAMS ALLOWING THE GIFTS THE PRINCIPAL AMOUNTS TO CONTINUE BENEFITING, BENEFITING THE COMMUNITY YEAR AFTER YEAR.

HELLO, VICKY. AND TODAY I'M HERE REPRESENTING CITIZENS FOR FRIENDLY AIRPORT.

WITH A HEAVY HEART I HAVE TO ANNOUNCE THAT C4FA YESTERDAY FILED ITS THIRD LAWSUIT AGAINST THE COUNTY OF SAN DIEGO FOR THEIR NEW AMERICAN AIRLINES CONTRACT.

WE DID THIS AS WE WERE LEFT WITH NO OTHER CHOICE.

THE COUNTY AND AMERICAN HAD THE OPTION TO AMEND THE CURRENT CONTRACT THAT WAS UNDER LITIGATION, BUT COLLECTIVELY, THEY DETERMINED TO END THAT CONTRACT AND START A BRAND NEW ONE WITH VERY SIMILAR, YET DIFFERENT ENOUGH THAT WOULD REQUIRE A NEW LAWSUIT.

THE HEARINGS ARE STILL ON FOR AUGUST 14TH FOR THE CURRENT UNITED ONE.

I'M NOT A LAWYER. I DON'T KNOW WHAT HAPPENS TO THE FIRST LAWSUIT.

AS SOON AS THE COUNTY HAS BEEN SERVED AND WE GET THESE STAMPED COMPLAINT BACK, IT WILL BE SENT OUT VIA EMAIL TO ALL OF OUR SUPPORTERS AND POSTED PUBLICLY ON OUR WEBSITE. I WANT TO MAKE VERY CLEAR THAT C4FA HAD NO CHOICE BUT TO DO THIS.

THE THE COUNTY HAS REFUSED TO FOLLOW A 2021 COURT ORDER.

I'M GOING TO REPEAT THAT. THE COUNTY HAS CHOSEN TO INTENTIONALLY VIOLATE A COURT ORDER, AND THE ONLY REMEDY FOR THAT IS TO HAUL THEM BACK INTO COURT. C4FA REMAINS STEADFAST IN OUR DETERMINATION THAT WE WILL BE PROTECTING LOCAL CONTROL OF THAT AIRPORT FOR CARLSBAD CITIZENS. WE HOPE THE CITY WILL STAND WITH US AND FIGHT AS STRONGLY AS WE WILL.

THIS IS NOT ABOUT THE TYPE. THIS IS NOT ABOUT WHAT'S GOING IN AND OUT OF THE AIRPORT.

THIS IS ABOUT WHO GETS TO MAKE THOSE DECISIONS.

THIS IS ABOUT WHO GETS TO DETERMINE THE FUTURE OF THAT AIRPORT.

THIS IS GOING TO COME DOWN TO A VOTING RIGHTS AND VOTING SUPPRESSION ISSUE, BECAUSE BY A CITIZEN'S INITIATIVE IN 1980, ANY EXPANSION OF THAT AIRPORT MUST BE GIVEN TO A VOTE OF THE PEOPLE.

THE COUNTY IS TRYING TO SUBVERT, SUBVERT THAT VOTE, AND WE ARE NOT GOING TO HAVE THAT.

SO IF WE HAVE TO FILE A LAWSUIT, NUMBER FOUR, NUMBER FIVE, NUMBER SIX, I'M HERE TO SAY TO THE COUNTY AND TO AMERICAN AIRLINES, THAT BILLION DOLLAR COMPANY, WE ARE NOT GOING AWAY.

WE ARE GOING TO PROTECT CARLSBAD'S RIGHT TO VOTE.

WE ARE GOING TO PROTECT CARLSBAD'S LOCAL CONTROL, AND WE ARE GOING TO FORCE THE GOVERNMENT TO FOLLOW COURT ORDERS.

I APPRECIATE THE OPPORTUNITY TO SPEAK TONIGHT. THIS IS AN ELECTION YEAR FOR THREE OF YOU, WHICH PLACES YOU IN A DIFFICULT POSITION OF BALANCING THE INTERESTS OF YOUR CONSTITUENTS, THE FUTURE OF YOUR CITY, PRESERVING YOUR LEGACIES.

AND LASTLY, YOUR MOTTO ON THE WALL. MEANWHILE, THE GREATLY IMPACTED COMMUNITIES BY THE INCREASED COMMERCIAL OPERATIONS OF PALOMAR AIRPORT ARE SAN MARCOS, ESCONDIDO, AND VISTA, WHO ALSO HAVE THREE MAYORAL AND SEVEN COUNCIL SEAT RACES IN NOVEMBER.

MANY OF THOSE RESIDENTS ACROSS THOSE CITIES SHARE DEEP CONCERNS ABOUT THE FUTURE AND SAFETY OF PALOMAR AIRPORT.

THEY NATURALLY LOOK TO CARLSBAD LEADERSHIP FOR ANSWERS, AS MOST PEOPLE ARE UNAWARE OF THE COUNTY'S RESPONSIBILITY.

THERE'S ALSO A PERCEPTION THAT KEY DECISIONS ARE BEING SHAPED BY REGIONAL BODIES, WHERE LOCAL REPRESENTATION HAS BEEN LIMITED OR NON-EXISTENT.

THESE INCLUDE THE SAN DIEGO AIRPORT LAND USE COMMISSION, WHICH CARLSBAD HAS NOT HAD REPRESENTATION FOR EIGHT YEARS, AND THE LAFCO, WHOSE NEAREST REPRESENTATIVE IS DEL MAR.

GIVEN THIS CONTEXT, MANY CONSTITUENTS ARE REQUESTING CARLSBAD REVIEW ITS REPRESENTATION ON THESE TWO COMMITTEES AND ENSURE THAT LOCAL VOICES ARE CONSISTENTLY PRESENT WHERE DECISIONS ARE BEING MADE. FINALLY, COMMUNITY MEMBERS ALSO URGE CARLSBAD CONTINUED ENGAGEMENT WITH C4FA IN THE UNITED AIRLINES LAWSUIT, THE AMERICAN AIRLINES SUIT AND TO PROTECT ALL NORTH COUNTY RESIDENTS.

THE SITUATION IS QUICKLY BECOMING AN ACCIDENT WAITING TO HAPPEN, ALL BEING CAUSED BY THE COUNTY'S OWN MAKING.

I LIVE OVER IN MARINER'S POINT, AND I HAVE BEEN WORKING VERY MUCH BEHIND THE SCENES ON THE AIRPORT.

I'VE BEEN RESEARCHING FOR ABOUT TWO YEARS, AND SO BECAUSE IT'S ON THE AGENDA LATER TONIGHT, I WANTED TO, FROM MY PERSPECTIVE OF WHAT I'VE LEARNED IN MY RESEARCH AND IN GETTING TO KNOW THE FOLKS HERE IN THE AUDIENCE TONIGHT, I WANTED TO SET A STAGE FOR WHERE WE'RE GOING IN THE FUTURE REGARDING THE PROCESS, AND I WOULD LIKE TO PUT OUT A VERY KIND AND SUPPORTIVE CHALLENGE FOR ALL OF US. THE CITY HAS BEEN GREAT, COMING ALONGSIDE IN NEW WAYS DIFFERENTLY THAN IN THE PAST REGARDING THE AIRPORT, AND WE APPRECIATE THAT SO MUCH. I APPRECIATE THAT SO MUCH.

BUT I WANT TO CHALLENGE US. THAT'S MY PROFESSION.

THAT'S WHAT I DO. I COACH PEOPLE AND I CHALLENGE PEOPLE IN THE MOST POSITIVE WAY I CAN.

SO I'VE COME UP WITH SOMETHING CALLED TLC. T IS FOR TRANSPARENCY.

I THINK IF WE ALL THINK OUTSIDE THE BOX, IF WE ALL KEEP COMMUNICATING WITH EACH OTHER, WE CAN RAISE THE BAR ON TRANSPARENCY AND I THINK IT WILL BENEFIT EVERYBODY.

THE SECOND L IS FOR LOCAL CONTROL. AND AND I MY PERSONAL ASK FOR YOU IS TO FIND EVERY SINGLE LOCAL CONTROL RESOURCE THE CITY HAS TO HELP THE CITIZENS WITH THE CHALLENGES THAT WE HAVE REGARDING THE AIRPORT.

I'M TALKING EVERYTHING, NOT JUST THE CUP. I MEAN, YOU'VE GOT THE CUP.

SOMETIMES THE CHALLENGE IS WITH THE CUP ARE NOT HAVING IT.

IT'S ENFORCING IT. BUT THERE ARE OTHER THINGS THAT THE CITY HAS EVERYTHING FROM PERMITS TO EASEMENTS TO ALL KINDS OF THINGS THAT YOU CAN PUT A BIG NO IN FRONT OF IT AND SAY, NOPE, WE'RE NOT DOING THAT BECAUSE THE COUNTY HASN'T RESPECTED THE CITY'S LAWS.

THE COUNTY HASN'T RESPECTED THE CITY'S CITIZENS.

THE INSIGHT I HAVE GOES ALL THE WAY BACK TO 1980, AND IT'S GENERATIONAL INSIGHT.

THIS ISN'T A NEW TOPIC FOR THE CITIZENS OF CARLSBAD.

WE ALL KNOW THAT. AND EVERY TIME THERE'S BEEN AN ENCOUNTER BETWEEN THE CITY AND THE COUNTY.

THE COUNTY'S COME OUT AHEAD A LOT OF THE TIME, AND WE DON'T WANT TO SEE THAT HAPPEN ANYMORE.

AND USUALLY IT'S AT THE EXPENSE OF THE CITY AND THE CITIZENS.

AND SO LETTER C IS FOR COMMUNITY COLLABORATION.

AND I ALSO LOVE TO RAISE THE BAR ON THAT. THESE FOLKS, FOR EVERY CONSULTANT THE CITY HIRES, I BET YOU THERE'S FIVE VOLUNTEERING THEIR TIME RIGHT NOW.

HIGH LEVEL, INTELLIGENT, INTELLECTUAL PEOPLE WHO HAVE COMMITTED HOURS AND HOURS AND DOLLARS AND DOLLARS.

AND I WOULD JUST WANT YOU TO KNOW I'M GRATEFUL FOR MY PARTICIPATION WITH THE CITIZENS.

I'M GRATEFUL FOR ALL, OF ALL OF YOU. AND IF THERE'S A CHEERLEADER IN THE GROUP, I'M GOING TO BE THAT PERSON.

I KNOW RECENTLY THE MAYOR WENT TO SEE THE CITY SENIOR CENTER, AND WE COULD USE A SOFA BY THE GYM AND FOR SOME REASON TOO, THERE IS NO GREEN SALAD THAT USED TO BE SERVED EVERY DAY. I KNOW LETTUCE IS EXPENSIVE, BUT I THINK CARLSBAD CAN AFFORD IT, ESPECIALLY DUE TO THE GENEROSITY OF A LOT OF PEOPLE HERE WHO ARE DONATING MONEY. HOPEFULLY ALL OF YOU WILL REACH A CERTAIN AGE WHERE YOU MIGHT WANT TO GO TO THE SENIOR CENTER.

MAYBE YOUR KIDS NO LONGER LIVE HERE. MAYBE YOU NEVER HAD KIDS.

MAYBE YOUR FRIENDS ARE DEAD. MAYBE YOU'RE AFRAID TO SPEAK OR SAY HELLO TO A SENIOR.

I THINK WE CAN DO BETTER. AND IF YOU'RE SATISFIED WITH DOING LESS, THEN WE SHOULD STEP IT UP A BIT. BECAUSE, AS YOU SAY, THERE ARE MANY PEOPLE HERE WHO ARE GENEROUS AND INTELLIGENT AND CAN POSSIBLY SEE THE SENIOR CENTER AS A STEPPING STONE FOR SERVING SENIORS.

ACCORDING TO MR. KIM, CITY TRAFFIC ENGINEER, HIS DEPARTMENT RECEIVED OVER 100 REQUESTS FOR INSTALLING FOUR WAY STOPS.

HIS STAFF DID EXTENSIVE REVIEWS AND ONLY SIX INTERSECTIONS WERE CHOSEN THAT MET THE COMPREHENSIVE WARRANTS.

STAFF RELIES ON FACTS. COMMISSIONERS AT TIMES MAKE DECISIONS BASED ON EMOTIONS.

FOR EXAMPLE, ONE COMMISSIONER FELT THE CITY ALREADY HAD TOO MANY STOP SIGNS AND DRIVERS WOULD PROBABLY RUN IT.

THIS IS AN ENFORCEMENT ISSUE AND SHOULD NOT BE CONSIDERED AS A CRITERION FOR NON-APPROVAL.

I SPENT ABOUT 30 MINUTES AT THE INTERSECTION.

AND REALIZED WHY IT IS IN THE GROUP OF SIX. SOME DRIVERS FAIL TO YIELD TO PEDESTRIANS IN THE FLASHING BEACON CONTROLLED CROSSWALK, DRIVERS GOING SOUTHBOUND ON SUNNY HILL WANTING TO TURN LEFT OR EASTBOUND OR GO STRAIGHT FACE EXTREMELY POOR SIGHT DISTANCES FROM THE RIGHT EASTBOUND TAMARACK AND MUST DEAL WITH WESTBOUND SPEEDING TRAFFIC COMING DOWN THE HILL. PEDESTRIANS WANTING TO CROSS TAMARACK WILL BE SAFER BASED ON THESE FACTORS ALONE. I STRONGLY URGE YOU TO DISREGARD THE COMMISSION NO VOTE AND ACCEPT STAFF'S RECOMMENDATION.

IT'S VERY CONFUSING ADDING THIS IN TO THE MIX JUST MAKES EVERYTHING MORE CONFUSING AND TAKES UP MORE TIME IN EVERYONE'S COMMUTE. I WOULD INSTEAD ENCOURAGE THE CITY TO DO MORE PATROLS IN THE AREA, GIVE OUT TICKETS TO PEOPLE WHO ARE SPEEDING, OR WHO ARE GOING THROUGH THE STOP SIGN JUST BELOW SUNNY HILL OR JUST ABOVE SUNNY HILL AT SKYLINE.

IT'S ONE BLOCK AWAY, SO YOU DON'T NEED THE TWO STOP SIGNS ONE BLOCK AWAY FROM EACH OTHER EITHER.

THESE PROGRAMS WILL BE INCORPORATED INTO SANDAG 2027 REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM, OR RTIP. THE CITY'S FIVE YEAR PROGRAM OF PROJECTS ARE THE SAME TRANSPORTATION PROJECTS INCLUDED IN THE FISCAL YEAR 26-27 BUDGET FOR THE CAPITAL IMPROVEMENT PROGRAM, OR CIP, RECENTLY ADOPTED BY THE CITY COUNCIL. THE CIP TRANSPORTATION PROJECTS LISTED IN THE PROGRAM OF PROJECTS ARE THOSE THAT WILL USE FUNDS FROM TRANSNET, AS WELL AS FUNDING FROM FEDERAL OR STATE GRANTS AND THOSE THAT ARE REGIONALLY SIGNIFICANT AND CAPACITY INCREASING.

SHOULD THE CITY COUNCIL APPROVE THE PROGRAM OF PROJECTS, STAFF WILL SUBMIT THE RESOLUTION TO SANDAG AS REQUIRED.

THE SANDAG BOARD IS SCHEDULED TO ADOPT THE 2027 RTIP IN SEPTEMBER, WITH FEDERAL APPROVAL EXPECTED IN DECEMBER.

AND AS A REMINDER, THIS ITEM INCLUDES A PUBLIC HEARING.

THE PAAC IS ADVISORY TO THE COUNTY BOARD OF SUPERVISORS AND THE COUNTY CHIEF ADMINISTRATIVE OFFICER ON MATTERS RELATING TO PALOMAR AIRPORT. THE DUTIES OF THE PAAC INCLUDE TO REVIEW AND MAKE RECOMMENDATIONS REGARDING ISSUES PERTAINING TO NOISE CONTROL AT PALOMAR AIRPORT, LAND USE WITHIN THE PALOMAR AIRPORT.

AND SO WITH THAT, I'D LIKE TO INVITE MISS ANDERSON AND MR. GREENING TO THE PODIUM TO PROVIDE YOUR UPDATE.

MY NAME IS GARY GREENING. AS YOU HEARD ON, I AM A MEMBER OF THE PAAC COMMITTEE.

I'M ALSO THE CHAIR FOR A NEWLY FORMED SUBCOMMITTEE, AND OUR WHOLE SUBCOMMITTEE'S PURPOSE WAS BASICALLY TO STUDY THE VOLUNTARY NOISE

ABATEMENT PROGRAM AT THE PALOMAR AIRPORT, AND OVER THE PAST NINE MONTHS, OUR SUBCOMMITTEE CONDUCTED THIS COMPREHENSIVE REVIEW OF ALL OF THE NOISE ABATEMENT PROGRAM AND OUR GOAL WAS TO MODERNIZE THE PROGRAM, ALIGN IT WITH BEST STATEWIDE PRACTICES, AND TO STRENGTHEN THE TRUST BETWEEN THE AIRPORT AND THE SURROUNDING COMMUNITY.

WE PRESENTED OUR RECOMMENDATIONS TO THE PALOMAR AIRPORT ADVISORY COMMITTEE ON MARCH 15TH, AND THE PAAC UNANIMOUSLY ACCEPTED AND URGED THE COUNTY TO MOVE FORWARD ON IT. TONIGHT, I WOULD LIKE TO SUMMARIZE OUR FINDINGS, OUR RECOMMENDATIONS AND THE COUNTY CURRENT IMPLEMENTATION SCHEDULE. OUR KEY FINDINGS IN ANALYSIS COVERED 2 OR 3 DIFFERENT AREAS.

ONE OF THEM WAS THE SEVERELY OUTDATED PILOT EDUCATION MATERIALS.

THE EXISTING MATERIALS WERE INCONSISTENT, INCOMPLETE, CONFUSING AND NOT ALIGNED WITH TODAY'S AIRCRAFT MIX OR COMMUNITY NOISE IMPACTS. A NOISE COMPLAINT SYSTEM THAT THE PUBLIC CONSTANTLY COMPLAINS ABOUT IS THAT THE RESIDENTS RECEIVE A NO CONFIRMATION, NO CASE NUMBERS, NO FOLLOW UP, AND THEY MAKE IT VERY IMPOSSIBLE TO TRACK VARIOUS ISSUES OR TRENDS THAT ARE HAPPENING.

ANOTHER FINDING WAS THAT THERE'S NO RECOGNITION BASED INCENTIVE PROGRAM FOR THE PILOTS.

OTHER AIRPORTS, INCLUDING VAN NUYS AIRPORT, HAVE SUCCESSFULLY IMPLEMENTED A NOISE PROGRAM CALLED FLY FRIENDLY, WHERE THEY REWARD AND RECOGNIZE THE OPERATORS.

PALOMAR HAS NO EQUIVALENT. WE, IN OUR ANALYSIS OF PERFORMANCE DATA THAT THE COUNTY PRESENTS.

WE FOUND THAT THERE WAS A 34% INCREASE OF JET TRAFFIC DURING VNAP HOURS OVER LAST YEAR.

SO THE COMMUNITY OBVIOUSLY IS EXPERIENCING A LOT MORE TRAFFIC DURING QUIET HOURS AND THE NOISE IMPACT.

THE LAST ITEM THAT WE FOUND WAS AN OUTDATED FAA PART 150 NOISE COMPATIBILITY STUDY.

THE CURRENT STUDY PREDATES TODAY'S JET ACTIVITY, THE POPULATION GROWTH AND THE FLEET MIX.

IT NO LONGER REALLY REFLECTS THE REAL WORLD CONDITIONS THAT WE HAVE AT OUR LOCAL AIRPORT.

SO SUMMARIZING THE SUBCOMMITTEE'S RECOMMENDATIONS AFTER THIS NINE MONTHS OF ANALYSIS DISCUSSION WE HAD ON OUR COMMITTEE, WE HAD FOUR PILOTS AND FOUR PEOPLE FROM THE COMMUNITY, INCLUDING SOME MEMBERS OF THE AIRPORT STAFF SO WE HAD A GOOD MIX OF INPUTS. LOOKING AT THE DATA THAT WE WERE REVIEWING, WE RECOMMENDED, FIRST OF ALL TO MODERNIZE ALL PILOT EDUCATION MATERIALS, CREATE A CLEAR, CONCISE, CONSISTENT GUIDANCE WITH UPDATED GRAPHICS AND A SINGLE AUTHORITATIVE SOURCE FOR THE PILOTS AND THE FLIGHT SCHOOLS. WE ALSO RECOMMENDED UPGRADING THE NOISE COMPLAINT SYSTEM.

WE WILL URGE THEM TO ADD AUTOMATED CONFIRMATIONS, CASE NUMBERS, MONTHLY PUBLIC REPORTING.

AND WE ALSO WOULD ASK THEM TO DO SOME TO PUT ON BOARD A FULL TIME NOISE ABATEMENT SPECIALIST TO MANAGE THIS, WHICH OUR AIRPORT IS LACKING. ANOTHER ITEM WAS TO IMPLEMENT A FLY FRIENDLY PROGRAM AND MODEL IT AFTER VAN NUYS AIRPORT, WHERE WE USED A SINGLE NOISE EVENT DATA THAT THE COUNTY GATHERS FROM THEIR NOISE MONITORS.

AND BASED UPON SCORING, WE RECOGNIZE THE PILOTS WHO HAVE BEST ACHIEVED IT AND GIVE THEM AWARDS RECOGNITION.

AND ACTUALLY IT'S WORKED EXTREMELY WELL WITH VAN NUYS AND SEVERAL OTHER AIRPORTS WE'VE TALKED TO.

WE ASKED THEM TO PUBLISH MONTHLY SINGLE NOISE EVENT AND NOISE CONTOUR DATA TO IMPROVE TRANSPARENCY AND ALLOW THE CITY AND THE COMMUNITY TO TRACK EVENTS. CURRENTLY, THEY ONLY PUBLISH WHAT'S CALLED [INAUDIBLE], WHICH IS COMMUNITY NOISE, WHICH IS AVERAGED OVER A 30 DAY PERIOD AND REALLY DOES NOT ILLUSTRATE THE THE TREND OF THE NOISE AND THE SEVERITY OF IT.

LAST, WE ASKED THEM IF THEY WOULD UPDATE THE PART 150 FAA STUDY TO ENSURE NOISE CONTOUR MAPS A LONG TERM PLANNING TO REFLECT CURRENT OPERATIONS AND COMMUNITIES ACTUAL CONDITIONS.

SO WORKING WITH THE AIRPORT MANAGER AND MEETING WITH THE COUNTY AFTER OUR PRESENTATION, IT'S BEEN NOW BASICALLY A LITTLE OVER TWO MONTHS.

THE AIRPORT MANAGER HAS REVIEWED OUR RECOMMENDATIONS AND EXPRESSED THAT THEY HAVE STRONG ALIGNMENT WITH THE NEED FOR MODERNIZATION AND WHAT THE CURRENT STATUS FROM THE COUNTY IS.

ON THE PILOT EDUCATION MODERNIZATION WE CAME UP AND DESIGNED A FULL NEW BROCHURE AND FLIER TO DISTRIBUTE TO THE PUBLIC AND TO THE PILOTS, AND THEY CURRENTLY ARE NOW EDITING IT TO CHANGE THE MATERIALS.

SO THEY, IT COORDINATES WITH THE FAA RECOMMENDATIONS, BUT NO TIMELINE HAS BEEN PROVIDED FOR THE ACTUAL PUBLICATION.

THE NOISE COMPLAINT SYSTEM THAT I MENTIONED, THEY SAID IT'S APPROVED AND IT'S IN DEVELOPMENT.

THE COUNTY IS WORKING WITH THEIR IT DEPARTMENT AND TRYING TO UPDATE THE WEB PAGES AND CASE NUMBERS AND STREAMLINE THE PROCESS.

BUT AGAIN, NO COMPLETION DATES HAVE BEEN PROVIDED.

THE MONTHLY SNEL, WHICH IS A SINGLE NOISE EVENT AND NOISE CONTOUR REPORTING.

THEY SAID IT'S STILL PENDING AND THE COUNTY AGREES IN PRINCIPLE, BUT IS TRYING TO DEFINE THE WORKFLOW.

THE FLY FRIENDLY INCENTIVE PROGRAM WHERE WE SET UP THE PILOTS AND ACTUALLY MAKE AWARDS.

THEY THOUGHT THAT WAS A DEFINITELY A GOOD IDEA AND THEY WOULD SUPPORT IT, BUT THEY SAID THEY NEED STAFF AND BUDGET RESOURCES BEFORE THEY CAN PROCEED. AND THEN THE LAST AREA, THE PART 150 UPDATE, THEY ADVISED US IT'S UNDER CONSIDERATION.

AND THE COUNTY ACKNOWLEDGES THAT THAT THEY HAVE A NEED FOR IT.

BUT THEY SAID THIS IS A LONG TERM EFFORT AND IT COULD BE DELAYED FOR YEARS WITHOUT THE CITY'S SUPPORT.

SO ONE OF OUR THINGS TONIGHT IS I'M ASKING FOR THE CITY TO SUPPORT SOME OF THESE PROGRAMS SO WE ACTUALLY GET ACTION ON THEM.

THE. VARIOUS AREAS HAVE BEEN DISCUSSED, AND WE END UP WITH A LOT OF MEETINGS WITH THE PUBLIC.

AND WE HAVE COMMENTS FROM ABOUT 26 OR 27 HOA'S THAT COME TO OUR MEETINGS OR FIND US INDIVIDUALLY AND SAY, HELP US, HELP US WITH THIS NOISE ABATEMENT. IT'S GETTING WORSE AND WORSE.

AND WE BRING IT TO THE CITY COUNCIL. SO WHY THIS MATTERS FOR THE CITY COUNCIL? CARLSBAD RESIDENTS EXPERIENCE THE MAJORITY OF THE AIRPORT NOISE IMPACTS BEING SO CLOSE.

MODERNIZING VOLUNTARY NOISE ABATEMENT PROCESS IS DIRECTLY RELEVANT TO THE CITY BECAUSE ONE, IT IMPROVES THE QUALITY OF LIFE FOR RESIDENTS.

IT INCREASES TRANSPARENCY AND ACCOUNTABILITY.

IT ALIGNS WITH PALOMAR AIRPORT STATEWIDE BEST PRACTICES, AND IT ENSURES THE CITY HAS ACCURATE DATA FOR FUTURE PLANNING.

AND LAST, IT STRENGTHENS THE TRUST BETWEEN THE AIRPORT, THE COUNTY, AND THE COMMUNITY.

MANY OTHER AIRPORTS THAT WE DID ON OUR STUDY, WHICH WE HAD, I THINK A TOTAL OF 18 OTHER AIRPORTS WE CONTACTED TO FIND OUT HOW THEIR VNAP OR VOLUNTARY NOISE PROGRAMS WERE WORKING. THEY HAVE TAKEN MUCH MORE AGGRESSIVE AND PROACTIVE APPROACHES AND HAVE SEEN MEASURABLE IMPROVEMENTS.

AND WE PRESENTED A LOT OF THIS DATA TO THE PAAC AND TO THE COUNTY TO SHOW THEM THAT WE ACTUALLY HAVE CHARTS AND FIGURES THAT HAVING A GOOD NOISE ABATEMENT PROGRAM DOES MATTER. AND OVER A PERIOD OF A YEAR OR SO, THEY SAW A DROP IN THE NOISE LEVELS.

SO IN SUMMARY, THE. THE SUBCOMMITTEE HAS COMPLETED A THOROUGH DATA DRIVEN REVIEW.

THE PAC HAS UNANIMOUSLY ENDORSED OUR RECOMMENDATIONS AND URGED THE COUNTY TO MOVE FORWARD.

THE COUNTY HAS ACCEPTED THEM IN PRINCIPLE AND BECOME BEGAN SOME PARTIAL IMPLEMENTATION, THEY ADVISED US.

HOWEVER, NO TIMELINES, COMPLETION TARGETS OR ESTIMATED DATES HAVE BEEN PROVIDED TO US, AND IT SEEMS LIKE THESE ITEMS ARE ALL BEING STALLED. THE CITY'S ENGAGEMENT IS ESSENTIAL TO ENSURE THESE IMPROVEMENTS ARE ACTUALLY DELIVERED.

MODERNIZING VNAP WILL IMPROVE TRANSPARENCY, REDUCE COMMUNITY FRUSTRATION, BRING PALOMAR IN LINE WITH SUCCESSFUL NOISE ABATEMENT PROGRAMS ACROSS CALIFORNIA. THANK YOU FOR YOUR TIME AND SUPPORT.

THE COUNTY IS THE OWNER OPERATOR, AND THE CITY OF CARLSBAD IS WHERE THE AIRPORT IS LOCATED AND PROVIDES SUPPORT SERVICES TO THE AIRPORT.

AND THIS EVENING, I AM GOING TO HIGHLIGHT ONE OF THE RECOMMENDATIONS FROM THE 2025 SUBCOMMITTEE THAT BRINGS THESE THREE SEPARATE SILOS TOGETHER.

THIS IS THE PART 150 NOISE COMPATIBILITY PROGRAM.

WHY IT IS IMPORTANT? THE PROGRAM WAS ESTABLISHED UNDER TITLE 14 CODE OF FEDERAL REGULATIONS, PART 150. THE STUDY IS A VOLUNTEER, FAA FUNDED PROCESS THAT ALLOWS AIRPORT OPERATORS TO ASSESS, TO ASSESS AIRCRAFT NOISE EXPOSURE, MAP NOISE CONTOURS, AND DEVELOP MEASURES TO MITIGATE COMMUNITY IMPACTS.

THE PART 150 IS THE PRIMARY WAY FOR AIRPORTS TO ACCESS FEDERAL NOISE ABATEMENT FUNDING.

MANY MAJOR GENERAL AVIATION AND RELIEVER AIRPORTS UTILIZE THEM.

UTILIZE THIS PROGRAM, AND PALOMAR AIRPORT IS ON THAT LIST.

THERE ARE 275 AIRPORTS ACROSS THE NATION THAT PARTICIPATE IN A VOLUNTEER NOISE COMPATIBILITY PROCESS, AND MANY OF THOSE HAVE HAD THEIR PROGRAMS UPDATED.

THE VNAP IS A PART OF THE IS A PRODUCT OF THE PART 150 COMPATIBILITY PROGRAM.

THE COUNTY CREATED IT, THEN IT WAS APPROVED AND SIGNED OFF BY THE FAA.

PALOMAR AIRPORT APPROVAL FOR THE PROGRAM WAS IN DECEMBER OF 2006, NEARLY 20 YEARS AGO.

WITH THE OPERATIONAL EXPANSION AND MORE COMMERCIAL FLIGHTS AND RESIDENTIAL INFILL, THE PART 150 NEEDS A, NEEDS TO BE UPDATED. CURRENTLY, THE AIRPORT HAS SIX NOISE MONITOR, BUT IT SHOULD HAVE AT LEAST TEN FOR AN AIRPORT OF THIS SIZE.

I WANT TO BREAK DOWN WHAT IS MEANT BY THE NOISE EXPOSURES FROM CNEL TO SNEL.

THE CNEL STANDS FOR THE COMMUNITY EQUIVALENT LEVEL AND IT IS WHAT THE COUNTY USES.

IT IS A METRIC USED TO ASSESS NOISE EXPOSURE IN COMMUNITIES NEAR PALOMAR.

IT HELPS PREVENT IT. IT HELPS IN EVALUATING THE IMPACT OF AIRPORT NOISE ON RESIDENTIAL AREAS.

THE MEASUREMENT CONSIDERS NOISE LEVELS WEIGHTED OVER A 24 HOUR PERIOD.

SNEL STANDS FOR SOUND NOISE EXPOSURE LEVEL. THE COUNTY HAS THE DATA FOR BOTH METRICS FOR MEASURING THE NOISE.

THEY PREFER TO USE THE NOISE LEVEL WEIGHTED OVER 24 HOURS.

WHEN YOU USE THE THE SOUND NOISE EXPOSURE LEVEL, THIS PERTAINS TO A SINGLE EXPOSURE LEVEL OF AN AIRCRAFT OCCURRENCE, WHICH MEANS THE SNEL MEASURES THE DECIBEL LEVEL OF EACH EVENT.

IT IS NOT WEIGHTED. THE PURPOSE OF TRACKING COMPATIBILITY DATA, IT'S IMPORTANT BECAUSE IT HELPS DEVELOP NOISE COMPATIBILITY PLANS AND STRATEGIES. THE GOAL IS TO MINIMIZE THE IMPACT OF AIRPORT NOISE IN THE SURROUNDING COMMUNITIES.

SO WHAT DOES THAT MEAN FOR THE CITY OF CARLSBAD? COMMUNITY NOISE COMPATIBILITY PLANNING FOR BEST LAND USE PRACTICES.

SO CARLSBAD IS BETTER PREPARED TO REACH THEIR RHNA REQUIREMENTS AND NOT DEVELOP RESIDENTIAL COMMUNITIES IN AIRPORT NOISE IMPACTED AREAS.

A NEW PART, A NEW PART 150 NOISE COMPATIBILITY COMPATIBILITY STUDY WOULD CREATE NEW NOISE EXPOSURE MAPS.

THIS WOULD HELP THE CITY OF CARLSBAD TO BETTER UNDERSTAND THE SURROUNDING COMMUNITIES WHEN PUTTING FUTURE DEVELOPMENT BEFORE THE PLANNING COMMISSION.

IT IS A TOOL IN THE TOOLBOX FOR BETTER DEVELOPMENT PLANNING FOR RESIDENTIAL COMMUNITIES EXPOSED TO AVIATION NOISE AND POLLUTION.

IN JANUARY OF 2010, THE CITY OF CARLSBAD ESTABLISHED THE THE MCCLELLAN-PALOMAR AIRPORT LAND USE COMPATIBILITY PLAN.

THIS OCCURRED WHILE PALOMAR AIRPORT WAS DESIGNATED AN FAA CLASSIFICATION B2 GENERAL AVIATION AIRPORT.

THIS IS STILL THE DESIGNATION OF PALOMAR AIRPORT AS TODAY, BUT THE COUNTY IS PUSHING FORWARD WITH THEIR OPERATIONAL EXPANSION PLAN.

PALOMAR IS OPERATING AS A D2 COMMERCIAL AIRPORT, EVEN THOUGH THE DESIGNATION BY THE FAA IS A B-2, THE D-3 ALLOWS HEAVIER AIRCRAFT WITH LONGER WINGSPAN AND INCREASED PASSENGER CAPACITY.

THE COMMUNITY AIRPORT HAS CHANGED. EVEN THE FAA PART 150 STATED THERE WOULD BE, THERE SHOULD BE NO AIRCRAFT OVER 60 POUNDS. THIS IS IN 2006. TODAY THE EMBRAER 175 WEIGHS OVER 90,000 POUNDS.

THE COUNTY ABOLISHED THE F-44 POLICY WITHOUT STAKEHOLDER INPUT FROM THE CITY OF CARLSBAD.

THIS CHANGED THE PASSENGER CAPACITY FROM THE MAXIMUM OF 30 SEATS TO NO LIMIT.

WHAT CAN THE CITY COUNCIL DO? REQUEST THAT THE COUNTY DIRECT AIRPORT STAFF TO BEGIN THE PROCESS TO UPDATE THE 20 YEAR OLD PALOMAR AIRPORT PART 150 NOISE COMPATIBILITY PROGRAM. IF YOU STARTED THAT PROCESS TODAY.

IT WOULD TAKE APPROXIMATELY THREE YEARS TO COMPLETE.

WHEN I SERVED ON THE 2019 VOLUNTEER NOISE ABATEMENT COMMITTEE, THIS WAS A REQUEST OF THAT COMMITTEE IN 2019.

THE AIRPORT IS CHANGING AND THE DATA SHOULD REFLECT WHAT THE CHANGES ARE.

YEAH. I'M SPEAKING TODAY AS A RESIDENT WHO IS DEEPLY CONCERNED ABOUT THE BALANCING OF GROWTH AND QUALITY OF LIFE IN CARLSBAD TODAY, FOCUSING ON THE TOPIC OF AIRPORT NOISE AND PUBLIC HEALTH.

AS I'M SURE YOU ARE AWARE, NUMEROUS STUDIES HAVE DOCUMENTED THE IMPACT OF AIRPORT AIRPORT NOISE ON HUMAN HEALTH, NOTABLY, A 2013 US MEDICARE STUDY INVOLVING 6 MILLION RESIDENTS ACROSS 89 AIRPORTS FOUND THAT A MODEST TEN DECIBEL INCREASE IN AIRPORT NOISE EXPOSURE WAS ASSOCIATED WITH A 3.5% INCREASE IN CARDIOVASCULAR HOSPITALIZATION RATES.

DATA COLLECTED FROM OUR RECENTLY INSTALLED JET NOISE MONITORING SITES.

AND THAT WE INSTALLED WE REVIEWED THE DATA FROM MAY 2026 THAT DEMONSTRATED 8331 NOISE EVENTS ABOVE 65DB WITHIN EVANS POINT, NORTH OF THE AIRPORT, WHICH IS DESIGNATED NOISE SENSITIVE AREA.

UNDER THE CURRENT AND PROPOSED VNAP, RESIDENTS EXPERIENCE OVER 1500 EVENTS OVER 65DB.

WHILE ADDITIONAL LOCAL ANALYSIS WOULD BE NEEDED TO QUANTIFY THE PRECISE HEALTH IMPACT, THESE DATA DEMONSTRATE SIGNIFICANT HEALTH RISK FOR RESIDENTS AFFECTED BY THE INCREASED AIRPORT NOISE. TO LIMIT THIS RISK, I STRONGLY ENCOURAGE THE CITY COUNCIL TO APPROVE THE FOLLOWING.

ONE SUPPORT AND ENFORCE THE CURRENT PRACTICE FLIGHT LOOPS NORTHWEST OF THE AIRPORT.

MAY 2026 DATA FROM OUR NEIGHBORHOOD SHOW 2800 EVENTS, WHICH THE PILOTS DID NOT FOLLOW THE CURRENT VNAP GUIDANCE.

FLYING DIRECTLY OVERHEAD OUT OF OUR HOUSES. RIGHT.

I ENCOURAGE YOU ALL TO COME TO MY HOUSE, IN THE BACKYARD AND WITNESS A SATURDAY MORNING.

WITHIN A THREE MILE RADIUS OF THE AIRPORT. THERE ARE 32,000 HOUSES.

THE AVERAGE VALUE OF A HOUSE IN THAT THREE MILE AREA IS A MILLION AND A HALF DOLLARS.

THAT'S $48 BILLION OF REAL ESTATE SITTING WITHIN A THREE MILE RADIUS OF THAT AIRPORT.

THE AIRPORT SITS ON SOME OF THE MOST VALUABLE PROPERTY IN THIS COUNTRY, AND WE'RE BEING BOMBARDED WITH THESE EXCESSIVE NOISE LEVELS.

AN MIT SLOAN STUDY. I PUT IT IN THE NOTES. THEY STUDIED THREE AIRPORTS THAT HAD GROWING AIR TRAFFIC.

ONE WAS CHICAGO O'HARE. THE OTHER ONE WAS BOSTON.

THE OTHER ONE I THINK, WAS SEATTLE. THE STUDY SHOWED THAT FOR EVERY ONE DECIBEL INCREASE IN THE NOISE TO THE AFFECTED COMMUNITIES, IT COULD AFFECT THE PROPERTY VALUES BY 6/10 TO ONE 1%.

THAT DOESN'T SOUND LIKE A LOT, BUT 1% OF ALL THOSE PROPERTIES IS $480 MILLION.

OKAY, SO THIS, THIS, THIS LITTLE AIRPORT HAS A TREMENDOUS IMPACT ON THE SURROUNDING COMMUNITIES.

AND I'M JUST TALKING ABOUT THE MONEY. I'M NOT TALKING ABOUT BEING AWAKENED 3 OR 4 TIMES DURING THE NIGHT BY THESE AIRPLANES.

SO I THINK IT'S REALLY IMPORTANT TO TAKE A NOTE OF THAT.

THE OTHER THING YOU OUGHT TO NOTE, AND I KNOW THIS IS MORE OF THE COUNTY'S DEAL THAN IT IS THE CITY'S, BUT THE AIRPORT LOSES MONEY.

IT COMES AT A TREMENDOUS OPPORTUNITY COST TO THE COUNTY AND THE CITY IN THAT IT LOSES MONEY.

IT HAS TO BE SUBSIDIZED. YOU HAVE TO HAVE YOUR POLICE THERE.

THERE HAVE TO BE FIRE PEOPLE THERE. AND ON TOP OF THAT, IT'S CAUSING IT'S COSTING MONEY TO ALL THE RESIDENTS NEARBY THAT THAT PROPERTY, THEY OUGHT TO DO WHAT THEY DID IN SANTA MONICA AND ANNOUNCE THAT THEY'RE JUST GOING TO CLOSE THE AIRPORT.

THE COUNTY HAS SIX AIRPORTS, AND NONE OF THE OTHER ONES ARE AS VALUABLE OR AS CLOSE TO THE OCEAN OR IN OR ON SUCH PRECIOUS PROPERTY AS THIS ONE. THEY NEED TO JUST CLOSE IT DOWN. IF YOU CLOSE IT DOWN AND THEN DEVELOPED IT INTO THE BEST, HIGHEST, AND BEST USE, THE RIGHT KIND OF REAL ESTATE, THE CITY WOULD GENERATE TREMENDOUS PROPERTY TAX REVENUE FROM IT INSTEAD OF LOSING MONEY ON IT. SO I ASK YOU TO DO WHATEVER YOU CAN WITH THE CONDITIONAL USE PERMIT TO PROHIBIT ANY MORE EXPANSION OF THAT AIRPORT. THE FOCUS FOR NOW IS THE NOISE MONITORING OF PALOMAR AIRPORT.

THAT'S CONSIDERED ANYTHING OVER 65DB IS CONSIDERED NOISE IMPACTED BY THE STATE OF CALIFORNIA, AND 40% OF THE 10,200 ARE 75DB OR LOUDER. DECIBELS ARE MEASURED ON A LOGARITHMIC SCALE, SO A TEN DECIBEL DIFFERENCE ACTUALLY IS TEN TIMES THE SOUND ENERGY.

BUT THE WAY OUR HEARING HUMAN HEARING HAS IT, A TEN DECIBEL DIFFERENCE IS TWICE AS LOUD.

SO OUR COMMUNITIES ALL AROUND THE AIRPORT ARE NOISE IMPACTED.

COMPLAINTS WERE PRINTED OUT. SO AT LAST THURSDAY'S PAAC MEETING DOM VITRO MY, MY PAN CO-FOUNDER BUDDY, HE GAVE IT TO THE AIRPORT MANAGER AND SHE WOULDN'T ACCEPT IT.

SHE SAYS, YOU KNOW, WE'VE BEEN TRYING TO TELL YOU WE ONLY HAVE TWO WAYS OF GETTING INPUT AND EMAIL COMPLAINTS ARE NOT ARE NOT ONE OF THE THINGS THAT WE ACCEPT.

AND THEN THEY WENT BACK AND THEY DREW THESE NOISE CONTOURS. THAT'S THE HOLY GRAIL THAT THE COUNTY HAS BEEN CITING AS THE MAGIC.

IT DOES NOT MATCH WHERE OUR HOMES ARE. IT DOES NOT MATCH THE COUNTY, THE CITY PLAN, THE GENERAL PLAN THAT WAS LAID OUT IN 1986 AS TO WHERE TO BUILD OUR HOUSES AND WHERE NOT TO BUILD, AND ALL OF THAT STUFF, ALL THAT MONEY WE PUT IN AND ALL THE AWARDS WE GOT.

I ATTENDED THE COMMITTEE'S MOST RECENT MEETING LAST WEEK, AND FRANKLY, IT WAS UNLIKE ANY GOVERNMENTAL MEETING I'VE EVER EXPERIENCED.

ONE OF THE CARLSBAD REPRESENTATIVES SPENT THE FIRST 20 MINUTES DISPUTING THE MINUTES OF THE PREVIOUS MEETING, BECAUSE SHE FELT SHE HAD NOT, THAT THE MINUTES DID NOT ADEQUATELY REFLECT HOW SHE HAD BEEN TREATED AT THAT PREVIOUS MEETING IN DECADES OF ATTENDING FEDERAL, STATE AND LOCAL GOVERNMENT MEETINGS. I'VE NEVER EXPERIENCED ANYTHING QUITE LIKE IT.

THE MEETING QUICKLY DEVOLVED INTO ARGUMENTS AND PERSONAL GRIEVANCES RATHER THAN CONSTRUCTIVE DISCUSSION.

UNFORTUNATELY, REPORTS FROM PREVIOUS MEETINGS SUGGEST IT IS NOT AN ISOLATED INCIDENT.

AT THE NOVEMBER 2025 MEETING, THERE WERE OPEN HOSTILITIES, YELLING AND WARNINGS THAT THE ROOM WOULD BE CLEARED IF PARTICIPANTS DID NOT CALM DOWN.

ADVISORY COMMITTEES ARE SUPPOSED TO PROVIDE THOUGHTFUL ADVICE, FACILITATE COOPERATION AND HELP ELECTED OFFICIALS MAKE INFORMED DECISIONS.

IT IS DIFFICULT TO SEE HOW MEANINGFUL GUIDANCE FOR EITHER THE CITY OR COUNTY CAN EMERGE FROM THIS ENVIRONMENT.

I TOOK THE TIME TO RESEARCH THE VNAP PROGRAM.

THE VNAP ORIGINATED AS PART OF A 2022 LAWSUIT FILED BY CITIZENS FOR A FRIENDLY AIRPORT AGAINST BOTH THE CITY AND COUNTY.

THAT LAWSUIT WAS VOLUNTARILY DISMISSED WITH PREJUDICE BY C4FA'S OWN ATTORNEY, CORY BRIGGS, CLEARLY C4FA WAS WILLING TO ACCEPT THE VNAP AS PART OF THAT RESOLUTION.

THE CITY HAS REPORTEDLY SPENT $700,000 ON LEGAL FEES TO AIRPORT MATTERS IN THE LAST FEW YEARS, DESPITE A 2022 COURT RULING THAT THE CITY'S CONDITIONAL USE PERMIT DOES NOT APPLY TO AIRPORT IMPROVEMENTS WITHIN THE EXISTING AIRPORT FOOTPRINT. THE CITY WAS ADVISED OF A SIMILAR LEGAL CONCLUSION BY FORMER CITY ATTORNEY RON BALL IN 1993.

IF THESE LEGAL QUESTIONS HAVE ALREADY BEEN ANSWERED, TAXPAYERS DESERVE AN EXPLANATION FOR WHY WE CONTINUE SPENDING SUBSTANTIAL PUBLIC RESOURCES PURSUING THE SAME ISSUES. THE FIRST WORD IN VNAP IS VOLUNTARY.

NOTHING THAT IS VOLUNTARY IS MANDATORY. IF THE CITY WANTS TO MOVE FORWARD PRODUCTIVELY WITH THE COUNTY AND THE FAA, IT SHOULD ACKNOWLEDGE THE LEGAL AND REGULATORY REALITIES THAT ALREADY EXIST.

I'M HERE BECAUSE LOW AIRCRAFT ARE HAVING A SERIOUS AND MEASURABLE IMPACT ON THE RESIDENTIAL NEIGHBORHOODS.

AND DURING THE MONTH OF MAY ALONE PUBLIC FLIGHT TRACKING DATA IDENTIFIED 201 FLIGHTS OVER MY COMMUNITY ALONE OF RECOMMENDED ALTITUDE OF 1500FT. OF THOSE, 173 WERE BELOW 1000FT AND FOUR WERE BELOW 500FT, ALL CONTRIBUTING TO THESE NOISE EVENTS. THIS IS NOT SIMPLY A MATTER OF OCCASIONAL AIRPORT NOISE.

THIS IS ALSO THESE REPEATED OVERFLIGHTS ARE ALSO ABOUT SAFETY.

THIS DATA ALSO SHOWS THAT THIS PROBLEM IS CONCENTRATED.

APPROXIMATELY 25% OF THESE LOW FLIGHTS ARE COMING FROM JUST TEN REPEAT AIRCRAFT IN THE MONTH OF MAY.

MOST OF WHICH APPEARED TO BE FROM FLIGHT SCHOOLS.

CIRCLE OVER OUR HOMES, CONDUCT TRAINING ACTIVITY ABOVE OUR RESIDENTIAL AREAS, RESIDENTS DESERVE MORE THAN JUST BEING TOLD THIS IS NORMAL AIRPORT ACTIVITY. SO I'M ASKING THE CITY COUNCIL FOR THREE THINGS.

FIRST, FORMALLY REQUEST THAT THE CITY AND THE AIRPORT PROVIDE TRANSPARENT REPORTING ON LOW ALTITUDE FLIGHTS, REPEAT AIRCRAFT FLIGHT, SCHOOL ACTIVITY COMPLAINTS AND FOLLOW UP ACTIONS.

HOWEVER, AS WE KNOW, THIS HAS DRASTICALLY CHANGED WITH COMMERCIAL JETS NOW TAKING OFF THAT HAVE DECIBEL LEVELS NOTED WELL ABOVE WHAT CALIFORNIA ALLOWS. AND THE FLIGHT PATH IS NO LONGER DUE WEST STRAIGHT OUT TO THE OCEAN.

MY NEIGHBORHOOD OF SEABRIGHT IS DIRECTLY, DIRECTLY DIAGONAL TO THE CROSSINGS GOLF COURSE OR DIRECTLY SOUTH OF LEGOLAND.

THE FIRST CHANGE TO THE FLIGHT PATH WE NOTICED WAS THAT THE PLANES STARTED FLYING OVER OUR CANYON, WHICH IS JUST SOUTH WEST OF PALOMAR AIRPORT ROAD.

SLOWLY, THE FLIGHT PATH MOVED FURTHER SOUTH OVER OUR CUL DE SAC OF THE NEIGHBORHOOD NEXT TO THE CANYON, AND HAS CONTINUED TO SLOWLY MOVE FURTHER SOUTH THROUGH THE NEIGHBORHOOD HOUSE BY HOUSE.

THE FLIGHT PATH IS NOW CURRENTLY FIVE HOMES SOUTH OF THAT CUL DE SAC.

I'M SEEING IT NOW OVER MY NEXT DOOR NEIGHBOR'S HOUSE INSTEAD OF AT THE END OF THE CUL DE SAC.

THIS DEVIATION AFFECTS MANY OTHER NEIGHBORHOODS AS WELL, WHO ARE SUDDENLY LIVING UNDER THIS FLIGHT PATH, WHETHER INSIDE OR OUTSIDE OUR HOME, WE CANNOT HEAR ANYTHING BUT THESE PLANES FLYING OVER OUR HOMES, ESPECIALLY THE COMMERCIAL JETS. I NEVER THOUGHT I WOULD SEE AMERICAN AIRLINES OR UNITED AIRLINES FLYING OVER MY STREET.

WE ARE ASKING FOR YOUR HELP. WE NEED TO SUBMIT PAPERWORK TO THE FAA TO CORRECT THESE FLIGHT PATH DEVIATIONS CAUSED BY THE EARTH'S MAGNETIC PULL.

THIS CHANGE ACTUALLY REQUIRES AVIATORS AND AIRPORTS TO UPDATE NAVIGATIONAL DATA CHARTS AND RUNWAY NUMBERS.

WE HAVE ASKED MR. ABBOTT, WHO IS THE DIRECTOR OF THE AIRPORT, MANY TIMES THROUGH THE LAST FEW YEARS, TO SUBMIT THIS PAPERWORK TO THE FAA, AND HE HAS CONTINUED TO STALL.

THE RECOMMENDATIONS ARE TO MODERNIZE ALL PILOT EDUCATION MATERIALS, UPGRADE THE NOISE COMPLAINT SYSTEM AT THE COUNTY, IMPLEMENT A FLY FRIENDLY RECOGNITION PROGRAM, PUBLISH MONTHLY SINGLE NOISE EVENT LEVEL NOISE CONTOUR DATA AND INITIATE AN UPDATE TO THE FAA PART 150 STUDY. CERTAINLY WE CAN ENGAGE ON THE CITY'S BEHALF TO RECOMMEND THAT THE COUNTY IMPLEMENT AND FOLLOW AND FOLLOW UP ON THE RECOMMENDATIONS OF THE SUBCOMMITTEE.

THAT'S ONE OPTION THAT THE CITY COUNCIL HAS. MORE SPECIFICALLY, WE DO HAVE COVER IN OUR LEGISLATIVE PLATFORM THAT IS OBVIOUSLY REVIEWED AND APPROVED BY THE CITY COUNCIL ANNUALLY, WHICH WOULD PROVIDE A BASIS FOR THE RECOMMENDATION TO INITIATE THE UPDATE TO THE PART 150 STUDY.

WE HAVE PROVISIONS IN THE PLATFORM THAT GO TO SUPPORTING EFFORTS TO UPDATE THE, THE PROCEDURE TO MINIMIZE NOISE OVER NEIGHBORHOODS AND ESTABLISH MANDATORY FLIGHT PATHS, AS WELL AS TO STUDY AND MITIGATE THE NOISE AND AIR QUALITY IMPACTS ASSOCIATED WITH AIR TRAFFIC OVERFLIGHTS. THOSE CLEARLY GO TO THAT RECOMMENDATION COMING OUT OF THE SUBCOMMITTEE.

SO I BELIEVE WE HAVE COVER IN THOSE AREAS. WE DON'T HAVE ANYTHING THAT SPEAKS SPECIFICALLY TO THE FLY FRIENDLY RECOGNITION PROGRAM OR THE WAY THAT THE COUNTY HANDLES THEIR NOISE COMPLAINTS PER SE. BUT THOSE AREAS ARE SOME THAT WE COULD WEIGH IN ON, I BELIEVE.

SOME OF OUR ADVOCACY HAS BEEN ALIGNED WITH THE REQUESTS THAT ARE COMING AND RECOMMENDATIONS COMING OUT OF THE VNAP SUBCOMMITTEE, AS WELL AS THE REQUESTS FROM COMMENTERS THAT YOU HEARD TONIGHT, PARTICULARLY ACKNOWLEDGING THE DISCONNECT BETWEEN THE RECOMMENDED FLIGHT PATH THAT IS IDENTIFIED IN THE COUNTY'S VNAP AND THE DIRECTIVES THAT ARE COMING OFF OF FAA DOCUMENTATIONS AS FAR AS HOW FLIGHTS ARE SUPPOSED TO BE DIRECTED. WE HAVE ENGAGED WITH THE FAA ON THE CONCEPT OF CONVERTING THE VNAP, THE VOLUNTARY NOISE ABATEMENT PROGRAM TO A MANDATORY NOISE ABATEMENT PROGRAM. AND A LOT OF THE QUESTIONS THAT THE CITY HAS BEEN ASKING OF THE FAA AND ENGAGING WITH THEM ON WERE ADDRESSED IN THE COMMUNITY MEETING THAT YOU REFERENCED AS WELL.

THAT WAS HELD EARLIER THIS YEAR, HOSTED BY THE COUNTY AND BY THE FAA, AND IT ADDRESSED A VARIETY OF ASPECTS OF OPERATIONS GOING ON AT PALOMAR AND ALL OF THE REGULATORY FRAMEWORKS THAT APPLY IN TERMS OF REGULATING AND GOVERNING AIR TRAFFIC OPERATIONS AND OPERATIONS AT THE AIRPORT.

AND A LOT, A LOT OF WHAT WE HEARD WAS THAT THE FAA HAS PRIMARY CONCERNS ARE EFFICIENCY AND SAFETY OF THE AIRSPACE, AND ALL OTHER ASPECTS ULTIMATELY ARE SECONDARY TO THOSE.

SO A LOT OF OUR ADVOCACY RELATIVE TO THE SPECIFIC FLIGHT PATHS AND HOURS OF OPERATION WERE DEFERRED TO THOSE PRIORITIES, I WOULD SAY. OKAY, GREAT. AND PART OF THE REASON I ASK IS BECAUSE I SAW THAT ONE OF THE RECOMMENDATIONS FROM THE PUBLIC COMMENT THAT WAS IN ONE OF THESE HANDOUTS WAS A LETTER TO

THE FAA INSTRUCTING THE CONTROL TOWER TO DIRECT TAKEOFFS IN THE CERTAIN PATH, WHICH IS THE RECOMMENDED FLIGHT PATH.

HAVE WE MADE THAT REQUEST BEFORE TO FAA AND IF SO, WHAT WAS THEIR RESPONSE? YES, WE HAVE MADE THAT REQUEST PREVIOUSLY. AND ONE OF THE RESPONSES, I THINK, IS THAT THE FAA IS MUCH MORE INCLINED TO FIELD THOSE TYPES OF REQUESTS FROM THE AIRPORT OPERATOR THEMSELVES.

AND SO IN TERMS OF THE CITY'S ADVOCACY THE FAA WOULDN'T NECESSARILY TAKE THAT IN TERMS OF DRIVING ANY ACTION ON THEIR BEHALF.

THEY'RE MUCH MORE INCLINED TO BE RESPONSIVE TO A REQUEST COMING FROM THE COUNTY AS THE AIRPORT OWNER AND OPERATOR.

RIGHT. I COMPLETELY UNDERSTAND THAT. SO TO MOVE ON TO THAT POINT IN OUR ADVOCACY TO THE, THE COUNTY, HAVE WE SENT ANY LETTERS THAT THERE'S A REQUEST HERE ABOUT ACCEPTING THE RESIDENTS NOISE COMPLAINTS.

AND I KNOW THAT THE REPRESENTATIVE MISS ANDERSON, SPOKE ABOUT THAT.

IS THAT CORRECT? THAT AND WHAT IS THE RESPONSIBILITY OF THE CITY OF CARLSBAD TO PROVIDE SERVICES IN CASE OF AN EMERGENCY AT THE AIRPORT? OKAY. SO, MIKE CALDERWOOD, FIRE CHIEF, FOR THE RECORD.

THE RESPONSIBILITY FOR US TO RESPOND. THE AIRPORT IS IN OUR JURISDICTION, EVEN THOUGH THE LAND IS OWNED AND OPERATED THE AIRPORT THROUGH THE COUNTY.

WHAT THE AIRPORT PROVIDES IS WHAT'S CALLED AN RF AND AIRCRAFT RESCUE FIREFIGHTING RESPONSE FORCE, WHICH IS REALLY JUST A LARGE FIRE TRUCK THAT PROVIDES A SPECIAL KIND OF FOAM FOR AIRCRAFT CRASHES.

AND THAT'S WHAT THEY HAVE THERE. THEY HAVE TWO OF THOSE.

THEY'RE A FRONT LINE AND A RESERVE, AND THEY HAVE TWO PRIVATE FIREFIGHTERS OWNED BY, RUN THROUGH A COMPANY CALLED PROTECH, AND THEY WORK ABOUT 19 HOURS A DAY. EVERYTHING ELSE, IF THERE'S A STRUCTURE FIRE, IF THERE'S A MEDICAL AID, IF THERE'S A BRUSH FIRE WHEN THE PLANE CRASHES, THE PEOPLE THAT ARE ON THE PLANE ANY TYPE OF ANYTHING ELSE, HAZARDOUS MATERIALS, EVENTS, THOSE ARE ALL HANDLED BY YOUR LOCAL FIRE DEPARTMENT.

AND ON THE LARGER INCIDENTS, WE'LL USE OUR AUTOMATIC AID FROM NEIGHBORING AGENCIES AROUND US.

SINCE THIS IS COUNTY OWNED PROPERTY, COUNTY OWNED AIRPORT, IS IT OUR FINANCIAL RESPONSIBILITY TO HANDLE THAT, OR DO WE HAVE A CONTRACT WITH THE COUNTY THAT WE PROVIDE THESE SERVICES TO THEIR FACILITY? THERE'S VARIOUS WAYS THAT AIRPORTS DEAL WITH THIS ACROSS THE COUNTRY AND EVEN WITHIN THE STATE OF CALIFORNIA AND OURS,

OUR RELATIONSHIP WITH THE COUNTY AND THE AIRPORT DON'T SEEM DOES NOT SEEM TO HAVE ANY OF THOSE TYPES OF AGREEMENTS IN PLACE.

THAT'S SOMETHING WE ARE LOOKING INTO AND WILL CONTINUE TO EXPLORE FOR MANY YEARS.

THE, OUR FIRE AND POLICE DEPARTMENTS RESPONSIBILITY FOR PROVIDING THE SERVICES TO THE AIRPORT WAS LIMITED TO RELATIVELY SMALL AIRPLANES. NOW THAT WE HAVE COMMERCIAL JETS WITH, I'M GUESSING A DIFFERENT TYPE OF FUEL.

AND OF COURSE, A LOT OF PASSENGERS, IS OUR FIRE DEPARTMENT EQUIPPED TO BE ABLE TO HANDLE IN THE, AND IF THERE'S EVER A CRASH AT THE AIRPORT. OUR FIRE DEPARTMENT BY ITSELF IS NOT EQUIPPED BECAUSE WE DO NOT HAVE THAT SPECIALIZED VEHICLE THAT IS AT THE AIRPORT AND STAFFED BY PROTECH WITH US IN COMBINATION WITH THEM, WE ARE ABLE TO HANDLE THAT THROUGH OUR AUTOMATIC AID AGREEMENTS. HOWEVER, THERE ARE REQUIREMENTS UNDER THE FAA WHERE THERE'S CERTAIN TRAINING THAT NEEDS TO TAKE PLACE.

THERE'S A TRAINING, A LARGE TRAINING EVENT CALLED THEIR TRI ANNUAL DRILL THAT OCCURS EVERY THREE YEARS THAT WE PULL IN WITH THE AIRPORT STAFF, AND WE ABSORB A TON OF ADMINISTRATIVE TIME IN IN PUTTING THAT DRILL TOGETHER.

WHERE WE SIMULATE A LARGE SCALE EVENT LIKE A LARGE PASSENGER, 70 PASSENGER AIRPLANE CRASHING, AND WE HAVE HAD PLANES CRASH AT THE END OF THE RUNWAY AND INTO BUILDINGS.

WE'VE HAD PLANES CRASH ON, ON THE GOLF COURSE AND I'VE UNFORTUNATELY HAD RESPONDED ON SOME OF THOSE AND THEY ARE VERY DIFFICULT EVENTS.

BUT WE CAN HANDLE THEM IN COMBINATION AS LONG AS THE TRAINING CONTINUES.

I DON'T THINK A REQUEST LIKE THAT WOULD HONESTLY BE EFFECTIVE IN LIGHT OF A COUPLE OF THINGS, PRIMARILY ONE OF THE REGULATORY FRAMEWORKS THAT WERE DESCRIBED AT THE RECENT FAA WEBINAR RELATES TO A FEDERAL LAW THAT RELATES TO AIRPORT OPERATIONS, AND THERE ARE A COUPLE PROVISIONS THAT PROVIDE THRESHOLDS THAT ARE UNLIKELY TO BE MET IN TERMS OF TRANSITIONING THE VNAP TO A MANDATORY RESTRICTION.

ONE OF THEM IS THAT THERE HAS TO BE A FINDING THAT ANY RESTRICTIONS PLACED ON AIRPORT OPERATIONS CANNOT IMPEDE INTERSTATE COMMERCE IN ANY WAY, AND ALSO CANNOT IN ANY WAY DIMINISH OR IMPEDE THE NATIONAL OPERATION OF THE NATIONAL AVIATION SYSTEM. AND IT APPEARS THAT THOSE THRESHOLDS ARE INSURMOUNTABLE IN TERMS OF IMPLEMENTING MANDATORY RESTRICTIONS, TO THE POINT THAT SINCE THE LAW WAS PASSED, I BELIEVE IN 1980, NO, NO MANDATORY RESTRICTIONS HAVE BEEN PLACED ON ANY AIRPORT IN THE COUNTRY.

WHO'S, WHO'S RESPONSIBLE FOR EITHER MONITORING OR ENFORCING DIFFERENT TYPES OF HEALTH ISSUES.

WOULD IT BE THE EPA OR COUNTY HEALTH WHO WHO LOOKS AT THAT? YES. AS I UNDERSTAND IT, THE COUNTY IS RESPONSIBLE FOR A LOT OF THOSE PUBLIC HEALTH TYPE PROVISIONS AIR POLLUTION CONTROL CONTROL DISTRICT AND WATER QUALITY CONTROL DISTRICT, PARTICULARLY RELATE TO EMISSIONS OR OTHER ELEMENTS COMING OFF OF THE AIRPORT PROPERTY.

THEY FALL RELATIVELY OUTSIDE OF THE CITY'S PURVIEW AS I UNDERSTAND IT.

OKAY. SINCE WE HAVE A LEGISLATIVE PLATFORM THAT THE COUNCIL HAS ALREADY AGREED ON CAN I ASK THAT YOU PREPARE LETTERS TO, WHETHER IT BE TO COUNTY HEALTH, TO THE COUNTY, TO FAA, WHOEVER.

THAT WOULD FALL UNDER OUR LEGISLATIVE PLATFORM, SO YOU DON'T HAVE TO BRING THEM BACK TO THE COUNCIL AGAIN.

YES. FIRST OF ALL, THANK YOU FOR OUR STAFF FOR PREPARING THIS REPORT.

I BROUGHT THIS UP FOR A COUPLE REASONS. ONE HAVING WORKED AS A CITY STAFF MEMBER IN THE CITY OF CULVER CITY, THERE WAS A GIANT OIL FIELD CALLED THE ENGLEWOOD OIL COMPLEX.

WITH THAT, THERE WAS PHASED OUT OF CLOSING THAT OIL FIELD AS WELL AS NOT ALLOWING FUTURE OIL ONSHORE OIL DRILLING TO TAKE PLACE. WHEN I STARTED LOOKING, WHICH I, I BELIEVE MR. LARDY WILL PRESENT, THERE WAS I TOOK AN OPPORTUNITY TO READ OUR ORDINANCES COVER TO COVER AND THERE WERE THERE WERE ASPECTS OF THE ORDINANCES THAT GAVE ME PAUSE AND CONCERNS.

ONE OF THEM HAPPENED TO BE ABOUT STATEMENTS OF ONSHORE OIL DRILLING AND REGULATIONS FOR IT, WHERE IT WAS KIND OF CONFUSING, WHERE IT ALMOST SEEMED LIKE THAT WE HAD THAT WE WERE ALLOWED TO HAVE IT.

AND I JUST WANTED TO SEE WHAT OUR REGULATIONS WERE CURRENTLY. SO HOPEFULLY MR. LARDY CAN PRESENT THAT TO US NOW. GREAT. THANK YOU.

I'M ERIC LARDY, ASSISTANT DIRECTOR OF COMMUNITY DEVELOPMENT, REPORTING BACK ON THE MINUTE MOTION FROM FEBRUARY 10TH, 2026 RELATED TO CURRENT REGULATIONS FOR ON AND OFFSHORE OIL DRILLING, MANUFACTURING AND REFINING.

THIS PRESENTATION WILL BE SEPARATED INTO DISCUSSIONS ON ONSHORE DRILLING AND OFFSHORE DRILLING, AS WELL AS OPPORTUNITIES IN EACH AREA. FIRST, WE'LL START WITH OFFSHORE DRILLING.

THE UNITED STATES DEPARTMENT OF THE INTERIOR BUREAU OF OCEAN ENERGY MANAGEMENT REGULATES OFFSHORE OIL DRILLING FROM THREE TO AT LEAST 200 NAUTICAL MILES OFF SHORE. IN APRIL 2025, THEY INITIATED A PROCESS TO DEVELOP A FIVE YEAR OIL AND GAS LEASING PROGRAM.

IF APPROVED, THAT PROGRAM WOULD BEGIN IN 2027 AND INCLUDES SIX LEASE SITES OFF CALIFORNIA COAST.

THE STATE'S JURISDICTION IS FROM THE MEAN HIGH TIDE LINE, SO THE TOP OF THE BEACH TO THREE MILES OFFSHORE.

AFTER THE 1969 SANTA BARBARA OIL SPILL, THE CALIFORNIA STATE LANDS COMMISSION PLACED A MORATORIUM ON NEW OFFSHORE OIL AND GAS LEASES IN STATE WATERS.

MORE RECENTLY, THERE'S BEEN ADDITIONAL ACTIONS STARTING IN 1994 AND AGAIN IN 2018, WHERE THE STATE STRENGTHENED THE LAWS TO PROHIBIT NEW OIL AND GAS INFRASTRUCTURE.

AND IN 2023, THEY AMENDED THE COASTAL ACT TO PROHIBIT NEW OR EXPANDED FACILITIES.

THIS GRAPHIC SHOWS THE BREAKDOWN OF JURISDICTION WITH THE FEDERAL JURISDICTION ON THE MOST OUTWARD PART OF THE OFFSHORE, THE STATE JURISDICTION THREE MILES INLAND, AND THEN THE CITY'S JURISDICTION, WHICH STARTS AT THE TOP OF THE BEACH AT THE MEAN HIGH TIDE LINE, GOING UPLAND INTO THE CITY. WHILE THE CITY HAS NO ABILITY TO RESTRICT OFFSHORE OIL DRILLING, THERE'S A LONG HISTORY OF OPPOSING OFFSHORE DRILLING GOING BACK TO THE 1980S AT LEAST.

IN 2018, THE CITY FORMALLY ADDED BY RESOLUTION TO THE CITY'S LEGISLATIVE PLATFORM OPPOSITION TO OFFSHORE OIL DRILLING THAT WAS SUBSEQUENTLY ADOPTED IN ALL LEGISLATIVE PLATFORMS SINCE THAT TIME.

EVEN RECENTLY, JUST A FEW MONTHS AGO, THE CITY SENT A LETTER SUPPORTING SENATE JOINT RESOLUTION 12 OPPOSING OFFSHORE OIL DRILLING, WHICH IS INCLUDED IN EXHIBIT THREE TO THE STAFF REPORT.

AS FAR AS OPPORTUNITIES, THE LEGISLATIVE PLATFORM CURRENTLY HAS PROHIBITIONS TO OPPOSE NEW OFFSHORE OIL DRILLING TO SUPPORT DECOMMISSIONING OF EXISTING OFFSHORE OIL DRILLING INFRASTRUCTURE, AND TO SUPPORT LEGISLATION THAT REQUIRES DOUBLE HOLES FOR ALL OIL TANKERS.

SINCE OUR AUTHORITY IS LIMITED TO BRING OPPORTUNITIES.

OUR OPPORTUNITIES ARE THROUGH ADVOCACY OR DIRECTING STAFF TO ADOPT A RESOLUTION OPPOSING THE LEASES THAT THE FEDERAL GOVERNMENT IS PROPOSING.

A SAMPLE RESOLUTION IS INCLUDED THAT THE CITY OF CORONADO PASSED AND IS ATTACHED AS EXHIBIT SIX TO THE STAFF REPORT.

NEXT, WE WILL TALK ABOUT ONSHORE OIL DRILLING AND REFINING FACILITIES.

FEDERALLY, THE REGULATIONS ARE LIMITED BECAUSE THERE'S NO FEDERAL LANDS AND THERE'S NO MINERAL OIL RIGHTS HELD BY THE FEDERAL GOVERNMENT.

STATE LAWS HAVE CONTINUED TO PASS RELATED TO ONSHORE OIL DRILLING AND FACILITIES AS WELL.

SENATE BILL 1137 FROM 2022 PROHIBITS FACILITIES WITHIN 3200FT OF SENSITIVE USES.

SENSITIVE USES INCLUDES HOUSING, SCHOOLS, PARKS, DAYCARE CENTERS, COMMUNITY RESOURCE CENTERS, HEALTH CARE FACILITIES AND BUILDINGS WITH BUSINESSES OPEN TO THE PUBLIC.

BASED ON OUR ANALYSIS, IN THIS LARGE BUFFER, THE CITY IS ENTIRELY RESTRICTED TO THESE SENSITIVE USES.

ADDITIONAL BILLS PASSED AT THE STATE LEVEL IN 2024 ALSO GIVE THE CITY BETTER AUTHORITY TO LIMIT AND PROHIBIT OIL AND GAS OPERATIONS.

THE CITY DOES HAVE REGULATIONS THAT WERE ENACTED IN 1989 THAT WOULD PROVIDE FOR LIMITED ONSHORE FACILITIES, ALLOWING THEM IN OUR HEAVY COMMERCIAL AND INDUSTRIAL ZONES.

AT THE TIME THE REGULATIONS WERE ESTABLISHED, THE CITY ATTORNEY ADVISED AGAINST PROHIBITING AGAINST FACILITIES DUE TO LITIGATION RISK.

THERE ARE NO FACILITIES IN THE CITY AND IMPLEMENTATION OF STATE LAW, AND THESE REGULATIONS WOULD PRECLUDE OIL AND GAS FACILITIES.

THE ABILITY FOR ONSHORE DRILLING AND FACILITIES WITHIN THE CITY ARE ALREADY RESTRICTED SIGNIFICANTLY BY THE STATE RESTRICTIONS AND MUNICIPAL CODE.

THERE ARE NO FACILITIES THAT PROPOSED AND IF THEY WERE PROPOSED, THEY WOULD BE TOLD THE STATE LAW AND OUR LOCAL RESTRICTIONS PROHIBIT THEM.

BUT AS AUTHORIZED BY THAT 2022 BILL, ASSEMBLY BILL 3233, THE COUNCIL COULD DIRECT STAFF TO REMOVE ANY REFERENCE TO OIL AND GAS FACILITIES FROM THE CARLSBAD MUNICIPAL CODE AND THE LOCAL COASTAL PROGRAM TO REMOVE THE LANGUAGE THAT WAS ADOPTED IN THE 1980S.

ON THE SLIDE NOW IS ONE OF THOSE SECTIONS FROM THE CARLSBAD MUNICIPAL CODE SHOWING THAT OIL AND GAS FACILITIES WOULD BE ALLOWED IN THE CM, WHICH IS OUR HEAVY COMMERCIAL ZONE AND WHICH IS OUR MANUFACTURING ZONE, AND PM, WHICH IS OUR INDUSTRIAL ZONE FOR OIL AND GAS FACILITIES AND PROHIBITED IN ALL OTHER ZONES. SO THIS IS THE EXISTING ORDINANCE IN OUR MUNICIPAL CODE ON THE BOOKS.
